In response, City staff provided a report at the City Council meeting on September 27, 2016 stating that staff was advised that no dirt was received in Palos Verdes Estates. At the meeting, it was then clarified that school sites in Palos Verdes Estates may have received dirt from the Palos Verdes Peninsula Unified School District (PVPUSD) maintenance yard in Rolling Hills. It was alleged that the dirt was contaminated. Furthermore, the City s easement with the PVPUSD was referenced as providing the City with control over the dirt potentially received in Palos Verdes Estates. This memorandum is to report on the City s inquiry into this matter, and it is for your receipt and file. Transportation of dirt to Palos Verdes Estates schools or sites On September 29 th, City staff contacted PVPUSD Superintendent Donald Austin regarding whether dirt from PVPUSD s Rolling Hills maintenance yard was delivered to schools or sites within the boundaries of Palos Verdes Estates. In correspondence with Superintendent Austin, PVPUSD confirmed that dirt was used to fill gopher holes on the campuses of Palos Verdes High School and Montemalaga Elementary School. Page 1 of 2 001

2 Allegation of tainted dirt According to the PVPUSD, the dirt at the maintenance yard in Rolling Hills was independently tested and cleaned prior to any use on facilities prior to its delivery to schools in Palos Verdes Estates. The results of the soil sample analysis from from the PVPUSD Rolling Hills maintenance yard, as posted on the PVPUSD website, show that soil samples tested to be safe and clean. Moreover, PVPUSD has stated that the dirt delivered to Palos Verdes High School and Montemalaga Elementary School was tested separately from dirt at the Ladera Linda fields. PVPUSD/City Easement Agreement The City entered into an Open Space Preservation Agreement with PVPUSD on May 19, 1998, which granted an Easement to PVPUSD for specifically and only the field at Malaga Cove School. Additionally, in Section 8, Subsection B of the easement, PVPUSD indemnifies the City from any claims that may arise as a result of the accumulation, transportation, and migration of hazardous materials. The indemnification includes any cleanup, remediation, removal or restoration work required by federal, state, or local governmental agencies and any and all associated costs. Moreover, Section 2, Subsection D assigns all responsibility for maintenance of the field to the PVPUSD. Moving Forward The City of Palos Verdes Estates has no jurisdiction over the construction, permitting, and inspection of school properties. The PVPUSD is an independent governmental agency. As such, concerns about school sites are appropriately addressed directly to the School District or oversight agencies such as DTSC, AQMD and State Superintendent. However, the City maintains a strong focus and commitment to the safety of its residents and the public. If it is determined through the DTSC and AQMD investigation that the School District distributed soil in the City, the City will want to know that for the safety of the public, measures and protections are in place to prevent future such occurrences. In turn, City staff will monitor the outcome of the investigations. Due to the broad exemptions from local land use and zoning regulations that are afforded to school districts under State law, the options that the City has for exerting meaningful, direct pressure on this issue are limited, short of initiating litigation. This matter is under investigation by the Department of Toxic Substances Control, the South Coast Air Quality Management District and other local, State and Federal agencies. 4 November 18, 2015 Lydia Cano Deputy Superintendant Palos Verdes Peninsula Unified School District 375 Via Almer Palos Verdes Estates, California Re: Results of Soil Sample Analysis from Soil Stockpile at Palos Verdes Peninsula Unified School District (PVUSD) Maintenance Yard, 38 Crest Road West, Rolling Hills, California Project No. PVPU Dear Ms. Cano: (Alta) was requested by the Palos Verdes Peninsula Angeles Unified School District (PVPUSD) to conduct environmental soil sampling from a soil stockpile located at the PVPUSD maintenance yard at 38 Crest Road West, Rolling Hills, California. The following is a summary of the sampling and analysis of the soil stockplile sample. Soil Sampling and Analysis On November 2, 2015, Alta collected one (1) soil sample (sample no ) from the soil stockpile located at PVPUSD maintenance yard. 5 Soil Sample Results A summary of the analytical results for the soil sample is provided in Attachment A (Table 1). A photograph of the soil stockpile is located in Attachment B. The laboratory analytical report and chain-of-custody are provided in Attachment C. Discussion As indicated in the analytical results table (Table 1, Attachment A), the soil sample collected from the soil stockpile exhibited detectable concentrations of the Title 22 metals barium, chromium, cobalt, copper, lead, nickel, vanadium, and zinc. The detected metal results (Attachment A, Table 1) are below California and RCRA (federal) hazardous waste criteria threshold values and State of California Office of Environmental Health Hazard Assessment (OEHHA) soil screening levels ( In addition, 4,4 -DDT was detected above the laboratory reporting limits, but below California and RCRA hazardous waste criteria and the OEHHA soil screening levels. No other chemical compounds were detected in the soil sample.
