Box 8913 Little Rock, AR Dear Tony: This letter is in response to your letter dated October 23,2006. At this time we have taken corrective action to comply with your request. Some minor grading was required in order to get proper drainage to the detention pond. Also, the area where the sediment plume was indicated has been fixed in order to prevent future problems. The inspections will know be completed by an employee of ours, Darrin Pharis, and he will keep one copy of the inspections on site. The seeding has not been completed and we are requesting that you allow us to do this in the spring for proper germination of the seed which should offer the needed ground cover. Home, AR Re: Construction Site in Baxter County, Arkansas Dear Mr. King: On July 26, 2006, I performed a permit compliance inspection of the construction site on Hwy 5 North in accordance with the provisions of the Federal Clean Water Act, the Arkansas Water and Air Pollution Control Act and the regulations promulgated thereunder. This inspection revealed the following violations: 1. You are the owner/developer of a construction site which has discharged sediment laden storm water without a NPDES Storm Water Permit in violation of the provisions of the Arkansas Water and Air Pollution Control Act and the federal Clean Water Act. You must immediately obtain an NPDES Storm Water Discharge Permit for this site. 2. Sediment contaminated runoff water from your construction site has causing pollution to water of the state in violation of the Arkansas Water and Air Pollution Control Act and the federal Clean Water Act. In addition to the above violations, site deficiencies noted during the investigation included the following: The site was not accurately posted as required by the construction storm water general permit; a site Storm Water Pollution Prevention Plan (SW3P) was not available for review; storm water Best Management Practices (BMP s) were not installed or maintained; a record of rainfall and periodic inspection of the integrity and adequacy of site BMP s was not being maintained. You must submit a written response to these findings to the attention of the NPDES Enforcement Section of this Department. This response should contain documentation describing the course of action taken to correct each item noted.
