6 II. Certification of the Storm Water Pollution Prevention Program (SWPPP) A. Have you developed a Storm Water Pollution Prevention Program for your MS4? Municipalities must demonstrate how their Storm Water Pollution Prevention Program will be implemented and enforced over the term of the five-year Permit. SWPPPs must incorporate appropriate educational components, all required BMPs and the measurable goals associated with each. Storm Water Pollution Prevention Programs must address the specific requirements contained in Part V. G. of the Permit. SWPPPs must outline how the six minimum control measures will be addressed, the contact person, department in charge, timeline and measures that will be implemented to meet the schedules required by the Permit. Attach a to this application for each BMP in your SWPPP. B. Does your SWPPP address all of the six Minimum Control Measures as outlined in the Permit? The General Permit requires that you incorporate all six of the defined Minimum Control Measures in your Stormwater Pollution Prevention Program. You are required to implement mandatory BMPs which are directly associated to each of the Six Minimum Control Measures. C. 10 From: MPCA Special and Impaired Waters Search Map Red: Impaired Stream: St. Louis River Blue: Trout Streams Of the above identified trout streams indicated on the MPCA Special Waters search, only Otter Creek is within the City s jurisdiction. The other trout stream (Fond du Lac Creek) indicated on the map is within the Fond du Lac Reservation and not necessarily included in the City s MS4 program. However, there may be some cases in which the City could have jurisdiction over the non-indian owned properties within the reservation. Since there are cases in which the City could have jurisdiction, the water bodies within the reservation have been listed under receiving waters. The City s MS4 program would be extended to cover non-indian owned properties within the reservation if it is determined that the City has jurisdiction.

12 City of Cloquet, Minnesota Section II: SUMMARY OF SWPPP Background The City of Cloquet, with a population of 11,200 persons, is located in north central Minnesota in Carlton County. Cloquet shares no borders with another NPDES MS4. The City covers approximately 35.5 square miles of land consisting of a mix of residential, commercial, lightindustrial, heavy industrial, right-of-way, lakes/water, open space and park lands. Following is a summary the City completed to prepare this Notice of Intent (NOI) for coverage under the NPDES MS4 Phase II Permit. Self-Assessment Process, Receiving waters designation, City s local water resources management plan, Significant non-storm water discharges to the City s system, and Listing of the Best Management Practices (BMPs) for each Minimum Control Measure (MCM) incorporated into the SWPPP. BMP summary sheets for each of the six MCMs are provided in Appendix A. Self-Assessment Process Throughout the process of selection and development of Best Management Practices (BMPs) that establish the basis for the Storm Water Pollution Prevention Program (SWPPP), the City has considered the significant sources of pollution, the potentially polluting activities being conducted in the watershed and the sensitivity of the receiving waters. The City has also considered the physical and organizational characteristics of the minor watersheds within the City. The ultimate goal of the City s SWPPP is to control or reduce the discharge of storm water generated pollutants to receiving waters. The City is actively participating in the Regional Storm Water Protection Team (RSPT- Duluth area communities). Participation in the RSPT and the associated activities fulfill a number of the requirements of the MS4 permit. City of Cloquet, MN Page 1

13 Receiving Waters Receiving waters are recipients of outfall discharges from the City s municipal separate storm sewer system (NPDES MS4 Phase II Permit, page 19 of 23). In designating receiving waters within the SWPPP, the MS4 owner (Cloquet) must consider the sensitivity of the receiving waters (ibid., page 7 of 23) and future SWPPP modifications to address storm water discharges impacting water quality of the receiving waters (ibid., page 12 of 23). The City realizes the importance of these guiding documents, and will be working on creating and implementing these in the near future. Process for Evaluating, Recordkeeping and Reporting The City will comply with the requirements of Part VI of the NPDES MS4 permit and has identified the items to be tracked and recorded in the s included with this submittal. Records are maintained by the individuals responsible for each BMP and are compiled during the annual reporting process. The City will continue to: A. Evaluate program compliance and progress towards achieving its goals on an ongoing basis and summarize these findings in the annual report. B. Keep record for at least three years beyond the term of the permit. C. Make program-related records available to the public during regular business hours and upon adequate advance notice of the desire to review the program records. D. Submit our annual report by June 30 of each year. Regional Stormwater Protection Team (RSPT) The City of Cloquet is a member of the Regional Stormwater Protection Team. The RSPT maintains a website ( and the following are a few excerpts from the website. In a long-term effort to promote positive community and individual activities to protect the waters of the region, 16 governments and groups combined in 2003 to form the Regional Stormwater Protection Team (RSPT). Their mission: to protect and enhance the region's shared City of Cloquet, MN Page 2

14 water resources through stormwater pollution prevention by providing coordinated educational programs and technical assistance. The RSPT educational campaign is supported by a grant from the Minnesota Department of Natural Resources-Waters and Minnesota's Lake Superior Coastal Program through the Coastal Zone Management Act, which is administered through the National Oceanic and Atmospheric Administration's Office of Ocean and Coastal Resource Management. 15 The special nature of Otter Creek will be taken into consideration when the City completes the required Storm Water and Erosion Control Ordinances. The City will consult with the DNR and others to gather input on appropriate set back requirements from Trout Streams, either as part of its Storm Water/ESC ordinance or a separate set back ordinance. The goal of this program would be to identify and better address a range of potentially polluting activities that can occur throughout the City (e.g., construction projects, hazardous materials handling, used oil and pesticide disposal, etc.). Once identified, illicit discharges must be dealt with. (See BMP 3b-1) Inspecting storm sewer outfalls in the City will be one approach to identify and track illicit discharges or other potential water quality hazards that may impact the MS4 system.
