1 DAY ONE Ohio EPA Compliance Assistance Conference November 7-8, 2011 Conference Agenda 7:30 a.m. - 8:30 a.m. Foyer/Registration Area 8:30 a.m. - 8:45 a.m. Grand Ballroom Registration, Coffee and Pastries Welcome and Opening Remarks Plenary Session Grand Ballroom - 8:45-9:30 a.m. Keynote Speaker - Ohio EPA Director Scott Nally Break/Midmorning Coffee - 9:30 a.m. to 9:45 a.m. (Foyer/Exhibit Area) Breakouts: Session One - 9:45 a.m. to 11:00 a.m. EPCRA (Right-to-Know), TRI (Toxic Release Inventory) and RMP (Risk Management Plan) Reporting (Part 1) If you are handling chemicals or hazardous waste at your business, you probably need to report under one or more of these programs. Even small businesses may be required to report. Come learn more about who is required to file reports and the reporting procedures for each program. This is a two-part session. Hazardous Waste Requirements The Basics (Part 1) If you need to know the basics about Ohio s hazardous waste regulations, then this session is for you. We ll cover how to evaluate your waste streams to see if they are hazardous. In addition, this session will include an overview of record keeping, reporting and container management requirements. We ll also cover simple steps you can take to recycle and/or reduce wastes at your business - steps that can reduce your regulatory burden and save you money! This is a twopart session which continues after the morning break. Introduction to Air Permitting and Reporting (Part 1) Environmental regulations are complex and determining if your business needs an air permit can be confusing. If you are wondering whether you need an air permit, this first session is for you. We'll cover the basic steps in evaluating all your emission sources, documenting exemptions, and getting a permit for those that need one. We'll cover the types of permits available, including general permits, permit-by-rule options, and permits-to-install-and-operate (PTIO). Authorized pre-permit construction activities will be discussed. Finally, we ll provide an overview of how to complete permit application data, calculate emissions of criteria and air toxic pollutants and work with your district office. Do you Know Where Your Floor Drains Go? Pretreatment and the Underground Injection Control (UIC) Requirements If you are discharging wastewater to a municipal wastewater treatment plant, it s important for you to understand the wastewater pretreatment requirements. You may be subject to local discharge limits, permitting and wastewater pretreatment requirements. If you want to discharge industrial wastewater to an on-site septic system, it s very important that you understand the UIC requirements that apply to your activity to avoid problems. In this session, we ll review the basic requirements for discharging your wastewater.

2 Breakouts: Session Two - 11:00 a.m. to 12:00 noon EPCRA (Right-to-Know), TRI (Toxic Release Inventory) and RMP (Risk Management Plan) Reporting (Part 2) This session continues as we review the EPCRA, TRI and RMP reporting requirements. Hazardous Waste Requirements The Basics (Part 2) This session continues as we cover the basics about Ohio s hazardous waste regulations. Introduction to Air Permitting and Reporting (Part 2) This session continues with an overview of record keeping and reporting requirements contained in a typical air permit. You'll get practical advice on how to keep on top of your reporting responsibilities and stay in compliance, including the reporting of equipment malfunctions and completing fee emission reports. Also included is an overview of how to handle your reporting requirements online using Air Services. Do I need an NPDES Discharge Permit and, if so, How Do I Get One? Federal and State law prohibit the discharge of pollutants to a stream or river without having a discharge permit. The discharge permit s fancy name is National Pollution Discharge Elimination System or NPDES for short. This session will cover basics of when someone needs to be covered under the NPDES program and how to get this coverage. 12:00-1:30 Lunch (Provided) Grand Ballroom Plenary Panel Discussion Air, Waste and Water Divisions: Priorities for the Ohio EPA Breakouts: Session Three - 1:30 p.m. to 3:00 p.m. SPCC Plans for Oil and Oil products If you handle oil or oil products, you could be subject to the Spill Prevention Control and Countermeasure (SPCC) regulations. The SPCC requirements apply to even small businesses. These regulations require that secondary containment be provided for oil storage areas and that you prepare an SPCC plan to address emergency situations. If you handle oil or oil products, you ll want to sit in on this session to learn more about how the SPCC requirements. Doing Business Electronically with Ohio EPA An Introduction to the Agency s E-Tools and Resources This session includes an overview of the latest and greatest in electronic reporting to Ohio EPA. There are now several divisions that have implemented electronic reporting systems and this session is designed to provide you with an overview and starting point in identifying what might be helpful to your operations.

3 Special Topics in Hazardous Waste (Part 1) This is part one of a two-part session which continues at 3:15 p.m. Having trouble determining if your waste is hazardous or when a waste is a listed hazardous waste? We will provide a more in depth discussion about using your knowledge of the waste and proper sampling and analysis. Do you generated hazardous spent lamps or batteries? You may be able to manage them under less burdensome standards than regular hazardous waste. We will provide information about Universal Waste in this session. Are you unsure about how to manage the other hazardous waste you send for recycling? We ll tell you the ins and outs of determining the proper regulations for recycled hazardous waste. Do You Need a Storm Water Permit? The goal of Ohio EPA s storm water program is to prevent the pollutants from entering into our waterways through contaminated storm water runoff. If you are involved in a construction project that will be disturbing one or more acres of land, you are required to get a general storm water construction permit from Ohio EPA, before you begin site activities. Plan to attend this session if you want to know more about how to get a permit, best management practices in the field and how to avoid problems. Over the past year Ohio EPA has been updating the General Industrial Storm Water Permit to include more detailed guidance for specific sectors of industry. This informative session will cover the structural changes to the permit and update interested parties on permit renewal concerns. Afternoon Break - 3:00 p.m. to 3:15 p.m. - Sodas & Cookies in Foyer/Exhibit Area Breakouts: Session Four - 3:15 p.m. to 4:30 p.m. How to Report When Things Go Wrong Have you ever had a spill or release of materials and weren t sure exactly what to do? In this session, we ll cover the basic Ohio EPA reporting requirements for emergency situations like this. Ohio s Water Quality Standards and the TMDL Process Over the last 35 years, Ohio has made great progress implementing the goals of the Clean Water Act. The foundations of these successes are based on Ohio s development and implementation of water quality standards. This session will review Ohio s water quality standards and show how Ohio s TMDL process is used to make our waters fishable and swimmable. We will review key components of the water quality standards, how they apply to small business, and how we work to resolve stream impairments using the TMDL process. Special Topics in Hazardous Waste (Part 2) Many businesses generate used oil and are subject to Ohio EPA's used oil regulations. This session will help you understand the requirements for used oil generators, including record keeping, spill response and options for recycling and disposal. We ll also discuss regulations related to burning used oil. Ohio EPA s Division of Materials and Waste Management Updates and Opportunities Ohio EPA's Division of Materials and Waste Management (DMWM) regulations cover a variety of solid waste, infectious waste, and construction & demolition debris management activities. First, don't panic. Come learn more about the inspection process and get practical tips on how you can prepare your business when an inspector does show up. Part one of this session will also include a panel discussion from field staff who will share with you the common problems they've seen during inspections. Or, perhaps your business has already been inspected in the past and you want some guidance on how to improve communication with the Agency. If you want to know more about what happens before, during and after an inspection and be better prepared when the time does come, stop by this session.

5 OCAPP - Resources to Help You Achieve Compliance, Reduce Waste and Save Money We'll cover the free services of Ohio EPA's Office of Compliance Assistance and Pollution Prevention, including P2 site visits, compliance visits, assistance with air permit applications and more. Did you also know that some simple changes in the way you do business can result in not only reducing pollution, but also save you money? Reducing your waste generation may also mean that you have fewer regulations to comply with. Imagine that! Come learn more about simple, pollution prevention (P2) strategies that you can adopt at your business. We'll show you case studies from businesses that have reduced waste and how they did it. In addition, we'll review the many resources available to you to not only help you identify P2 opportunities, but also to help you achieve compliance. Does Your Business Operate a Public Water System? In this session, we will talk about compliance requirements for a small to medium business operating its own public water system, including: How someone is determined to be a public water system and the different types of systems The responsibilities of a PWS, including monitoring requirements, certified operators, maintenance, plan approval requirements and agency oversight. The session will also cover electronic reporting through Ohio EPA s edwr system. 6 Ohio EPA s New Expedited Enforcement Process and Policy Working Through the Agency s Legal Process In this session, we cover Ohio EPA s legal process and what to do if you are in an enforcement action. We discuss common misconceptions about the enforcement process and the best ways for working with Ohio EPA if enforcement does occur. This session identifies why enforcement is necessary and how Ohio EPA takes your business concerns into account during enforcement. A summary of the Agency s new expedited enforcement process is provided to give you a better understanding of how the process is used to protect the environment. Ask the Experts Open Q&A Session for Participants This session will be open to participants to ask Ohio EPA technical experts questions related to their air, waste and water compliance requirements. Call Before You Build... An Introduction to Section 401 and Isolated Wetlands Permitting in Ohio Are you considering a green space for your new business, or contemplating an on-site expansion project? If so, will your project involve dredging, filling or other activities that may have an impact to waters of the state, such as wetlands, ponds, streams, rivers? If so, you need to be aware of Ohio EPA s 401 water quality certification and isolated wetlands permitting requirements under Ohio s laws and regulations.
