35 National Priorities List (NPL) This database returned no results for your area. The Superfund Program, administered under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) is an EPA Program to locate, investigate, and clean up the worst hazardous waste sites throughout the United States. The NPL (National Priorities List) is the list of national priorities among the known releases or threatened releases of hazardous substances, pollutants, or contaminants throughout the United States and its territories. The NPL is intended primarily to guide the EPA in determining which sites warrant further investigation. The boundaries of an NPL site are not tied to the boundaries of the property on which a facility is located. The release may be contained with a single property's boundaries or may extend across property boundaries onto other properties. The boundaries can, and often do change as further information on the extent and degree of contamination is obtained.

36 CERCLIS List This database returned no results for your area. The United States Environmental Protection Agency (EPA) investigates known or suspected uncontrolled or abandoned hazardous substance facilities under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). EPA maintains a comprehensive list of these facilities in a database known as the Comprehensive Environmental Response, Compensation and Liability Information System (CERCLIS). These sites have either been investigated or are currently under investigation by the EPA for release or threatened release of hazardous substances. Once a site is placed in CERCLIS, it may be subjected to several levels of review and evaluation and ultimately placed on the National Priority List (NPL). CERCLIS sites designated as "No Further Remedial Action Planned" (NFRAP) have been removed from CERCLIS. NFRAP sites may be sites where, following an intitial investigation, no contamination was found, contamination was removed quickly without the need for the site to be placed on the NPL, or the contamination was not serious enough to require Federal Superfund Action or NPL consideration.

NFRAP sites may be sites where, following an initial investigation, no contamination was found, contamination was removed quickly without the site being placed on the NPL, or the contamination was not serious enough to require Federal Superfund action or NPL consideration. EPA has removed these NFRAP sites from CERCLIS to lift unintended barriers to the redevelopment of these properties. 63 Underground Storage Tanks (UST) containing hazardous or petroleum substances are regulated under Subtitle I of the Resource Conservation and Recovery Act (RCRA). The Virginia Department of Environmental Quality (DEQ) maintains a list of registered storage tanks. DEQ implements the UST program under Article 9 of State Water Control Law. Article 9, first enacted in 1987, enables DEQ to receive UST notifications, receive federal grant funds, develop regulations, conduct cleanups, and provide overall supervision of UST activities in the state. The State Water Control Board adopted a new regulation, 9 VAC et seq. which consolidated the three repealed regulations, e.g., (i) Oil Discharge Contingency Plans and Administrative Fees for Approval, 9 VAC et seq. 90 8-STEP PROCESS FOR PROJECTS LOCATED WITHIN A FLOODPLAIN Step 1: Determine whether the action is located in a 100-year floodplain (or a 500-year floodplain for critical actions). This project is located within a 100-year floodplain (Zone AE) and proximal to the Meherrin River floodway, as indicated on Flood Insurance Rate Map Panel 51081C0158C, revised July 7, 2009 (see attachment). The project is funded through a combination of Community Development Block Grant (awarded September 2, 2016), Hazard Mitigation Grant Program (application pending), and Transportation Alternatives Program (application pending) funds. Project activities that will occur within the 100- year floodplain or the Meherrin River floodway are as follows: Rehabilitation of eleven (11) residential properties located within the 100-year floodplain (CDBG); Acquisition and demolition of ten (10) residential properties within the 100-year floodplain (HMGP); Acquisition and demolition of one (1) residential property within the Meherrin River floodway (HMGP); Repair/replacement of aging and undersized storm drainage infrastructure and associated curb and gutter improvements; and Addition of sidewalks along the length of Center Street, providing access to the Meherrin River. Due to the varied nature of the proposed project activities within the floodplain, this analysis will consider impacts to the floodplain and floodway with concerns to loss of life and property. Step 2: Notify the public for early review of the proposal and involve the affected and interested public in the decision-making process. A public notice describing the project was published in the Independent-Messenger, the local and regional newspaper, on October 17, The advertisement targeted local residents, including those in the floodplain. A copy of the published notification was kept in the project s Environmental Review Record and attached to this document. The required 15 calendar days were allowed for public comment. As required by regulation, the notice also included the name, proposed location and description of the activity, total number of floodplain acres involved, and the HUD official or responsible entity contact for information as well as the location and hours of the office at which the full description of the proposed action can be viewed. A copy of the advertisement is included as an attachment. No comments were received as confirmed by the on

91 Step 3: Identify and evaluate practicable alternatives The East Atlantic Street Neighborhood has long suffered from dilapidated housing conditions and aging and undersized storm drainage infrastructure that contributes to problematic ponding at the intersections of East Atlantic Street and Reese Street and Center Street and Cleveland Avenue (see attached map). These issues are exacerbated when the Meherrin River is high, particularly for those homes located within the 100-year floodplain and proximal to the floodway. The neighborhood was prioritized to receive rehabilitation assistance following the completion of a citywide Housing Needs Assessment in These revitalization efforts are in keeping with the s Comprehensive Plan, prepared in 2015, which specifically references the s need to address housing and infrastructure deficiencies in older neighborhoods, particularly those adjacent to downtowns and along the railroads (p.14). The following alternatives were considered: 1. No Action Alternative or Alternative Actions that Serve the Same Purpose The No Action Alternative or Alternative Actions that Serve the Same Purpose assumes that no revitalization activities will occur in the East Atlantic Street Neighborhood. This option was determined to be infeasible for the following reasons: The issues resulting from aging and undersized storm drainage infrastructure that runs the length of the Project Area to the Meherrin River have grown to the point that it is essential that they be addressed in a timely manner. The areas of ponding following heavy rains in December, 2015 depicted in the attached images provide evidence of the severity of these issues. The has prioritized addressing flooding associated with the Meherrin River in the Comprehensive Plan (Priority Item D: Housing and Neighborhoods).

92 2. Concentrate Revitalization Efforts to Properties and Infrastructure Outside of the Floodplain The second alternative explored would be to concentrate revitalization efforts to those residential properties and infrastructure outside of the floodplain. This option was determined to be infeasible for the following reasons: Approximately 60% of the East Atlantic Street Neighborhood Revitalization Project Area is included within the 100-year floodplain. Furthermore, an initial Housing Conditions Assessment revealed that, of the twenty-three (23) residential units included in Phase I of the East Atlantic Street Neighborhood Revitalization Project located within the floodplain, 52% exhibit moderate or major deficiencies. Such deficiencies must be addressed as urgently as possible to prevent increased blight and blighting influences in the neighborhood. Ignoring the needs of such a high proportion of the neighborhood would jeopardize the health, safety, and welfare of a significant portion of the neighborhood s population. The Crater Planning District Commission has identified flooding as a significant threat to the in the Richmond-Crater Multi-Regional Hazard Mitigation Plan (2011). A major flooding event occurring in May, 2003 resulted in significant property damage to seven (7) homes along Cleveland Avenue. Strategy PP specifically states the following: Elevate built upon areas within the flood zone for possible relocation and/or acquisition. Specific areas under consideration include the homes on the river side of Center Street. Strategy PP additionally states: Identify existing flood-prone structures that may benefit from mitigation measures such as elevation. Deficient storm drainage infrastructure runs the length of the Project Area. As stated in the Preliminary Engineering Report prepared during the CDBG-funded Planning Grant phase of this project, the greatest concern for flooding is at the intersection of Center Street and Cleveland Avenue (p.2). The degree of flooding in this area after heavy rains when the Meherrin River is high is evidence of the degree to which the section of drainage infrastructure within the floodplain and proximal to the river contributes to the overall functionality of the neighborhood drainage system.

93 3. Other Sites Considered The of conducted a wide Housing Assessment in April 2015, which consisted of a tiered assessment that included a visual survey of housing conditions within all residential neighborhoods throughout the. Of the twelve sub areas identified through this assessment, three neighborhoods were targeted by the project management team as warranting a house-by-house assessment: The East Atlantic Street Neighborhood, The Halifax Street Neighborhood, and the West End Boulevard Neighborhood. The then conducted a house-by-house assessment of the target areas as well as hosted public meetings to gauge community interest in a revitalization project. It was determined that, of the three target areas, the East Atlantic Street Neighborhood exhibited the necessary combination of resident support and blighted housing concentration to qualify as the highest community development need. The neighborhood is the largest of the three target areas, with nearly double the number of residential units. In addition to blighted housing, the East Atlantic Street Neighborhood suffers from periodic flooding as a result of aging and deficient storm drainage infrastructure. This issue is exacerbated significantly when the Meherrin River is high. Although other priority neighborhoods were studied extensively during the assessment process, it is clear that the East Atlantic Street Neighborhood exhibits the highest degree of need. The intends to aggressively address housing and infrastructure issues during the first phase of the project through an extensive combination of funds provided through the Virginia Department of Transportation, the Virginia Department of Emergency Management, and the Virginia Department of Transportation. Step 4: Identify Potential Direct and Indirect Impacts of Associated Floodplain Development The of is a member of the National Flood Insurance Program. It is not anticipated that proposed project activities will have any permanent adverse impact on the existing floodplain. Additionally, activities within the floodplain will additionally directly benefit neighborhood residents in the following ways: 1. The voluntary acquisition/demolition of properties located within the 100-year floodplain and proximal to the Meherrin River floodway will allow existing residents to move to safe, sanitary, and affordable housing that is not subject to flooding. The resulting vacant land will be placed into permanent conservation per HMGP guidelines, therefore preventing future development in the floodway. 2. Improvements to aging and deficient storm drainage infrastructure will mitigate areas of ponding throughout the neighborhood, vastly reducing incidents of water damage to residential properties during periods of heavy rainfall. 3. Rehabilitation of eligible properties will vastly improve the living conditions of existing residents.

94 4. The addition of neighborhood sidewalks will facilitate non-vehicular access to throughout the neighborhood itself and to surrounding services and amenities. Step 5: Minimize the potential adverse impacts from work within floodplains and wetlands (identified under Step 4), restore and preserve the natural beneficial values served by wetlands. All project activities will comply with appropriate regulations for construction with a floodplain and debris and runoff associated with project activities will be mitigated to the highest extent feasible. As a result, it is not anticipated that demolition, rehabilitation, or construction activities will adversely impact the floodplain. All vacant land acquired through acquisition/demolition of existing residential units within the floodplain will be placed into permanent conservation per HMGP guidelines, thereby preserving the natural beneficial value of the floodplain and significantly reducing conflicting development. Step 6: Re-evaluate the Proposed Action to determine: 1) if it is still practicable in light of its exposure to flood hazards; 2) the extent which it will aggravate the hazards to others; 3) its potential to disrupt floodplain and wetland values. The Proposed Action remains practicable based on the minimal (if any) potential impacts to the surrounding floodplain. Land placed into permanent conservation will serve to enhance rather than detract from floodplain values. Step 7: If the agency decides to take an action in a floodplain or wetland, prepare and provide the public with a finding and explanation of any final decision that the floodplain or wetland is the only practicable alternative. The explanation should include any relevant factors considered in the decision-making process. An Environmental Review Record was completed for all proposed project activities, and the FONSI/RROF was published on December 8, 2016 with the public/state comment period ending on January 8, Step 8: Review the implementation and post-implementation phases of the Proposed Action to ensure that the requirements of the EOs are fully implemented. Oversight responsibility shall be integrated into existing processes. This step is integrated into the project management and oversight functions per funding agency requirements.
