3 Objectives of the Consultancy 1. Undertake a detailed review of current and under development ESIA requirements in Myanmar, including for HPP, roads, quarries, transmission lines and other infrastructure and activities associated with HPPs, as well as related laws and regulations on natural resource protection and management, HPP, and international treaties that the GoM is a party to; 2. Identify and review GIIP for the preparation of HPP ESIAs; 3. Review of the main environmental and social issues; including legacy and historical impacts of operational HPPs in Myanmar, to provide a real world focus for the ESIA Guideline; 4. Review of HPP currently being reviewed by the GoM and the evolving direction of the HP industry in Myanmar, to understand the potentially new/emerging environmental and social issues likely to occur in the existing project approval pipeline that has not traditionally been an issue and that may also require focus or particular attention or emphasis for the ESIA Guideline.
4 Objectives of the Consultancy 5. Develop the ESIA Guideline considering local conditions, including: a) identifying significant and secondary environmental and social issues associated with project design, construction and operation; b) identifying of relevant stakeholders, and describing requirements for the integration of stakeholder engagement (public participation) during the ESIA process, with special consideration of local conditions and transboundary issues. Provide guidance on Stakeholder Mapping including the development of an outline for Stakeholder Engagement Management Plan and Grievance Redress Mechanism; c) identifying the range of project siting, design and operational alternatives that need to be considered; d) identifying the generic environmental and social impacts and risks typically encountered in hydropower projects; e) define the environmental and social baseline needed to better assess the magnitude, significance and temporality of the potential impacts and risks; f) identifying relevant key performance indicators and metrics, prevention, mitigation, management and monitoring measures and arrangements that need to be considered; g) providing an indicative outline of the contents of: a comprehensive hydropower ESIA, including the content of each section with a focus on major impacts; an Environmental and Social Management and Monitoring Plan; Key supporting studies and plans (e.g. Resettlement and Livelihood Restoration Action Plan h) providing quality review criteria for the ESIA in the form of a checklist, specifically for the use of regulators who will be required to review the ESIA report; and i) providing an example Terms of Reference for the ESIA consultant team to be hired for carrying out the ESIA for hydropower projects.
5 Objectives of the Consultancy 6. Organize two multi-stakeholder consultations to obtain inputs from a wide range of stakeholders on the draft guideline. The consultant will be expected to prepare consultation materials (draft agenda, presentations and workshop report) and present the materials; and 7. The Consultant will review of up to five ESIAs that are pending for the hydropower sector and provide on-the-job learning for the review process and how the guideline will be used for future projects.

7 Status of Hydropower Projects in Myanmar Over 100 existing or planned HPPs Range in size from <1 MW to 7,000 MW HPP seen as a reliable source of power going forward for Myanmar
8 Environmental and Social Concerns Concerns have been raised over numerous HPPs in Myanmar - many of the dams are in areas with high ethnicity The most prominent is the Myitsone Dam project that was stopped by the then President Thein Sein on 30 September 2011 On 12 August 2016, President Htin Kyaw formed a commission to evaluate all proposed HPPs on the Irrawaddy River prior to their going ahead The Commission submitted its report on 11 November 2016
9 What is a Environmental and Social Impact Assessment An environmental and social impact assessment (ESIA) is an instrument to identify and assess the potential environmental and social impacts of a proposed project, evaluate alternatives, and design appropriate mitigation, management, and monitoring measures. Myanmar law uses the terms Initial Environmental Examination (IEE) and Environmental Impact Assessment (EIS - based on ADB Safeguards Policy). For HPPs, two levels of assessment within the EIA Procedures IEE EIS
