3 INTRODUCTION 1. This document comprises a Non Technical Summary (NTS) of the Environmental Statement and has been prepared by SLR Consulting Limited (SLR) on behalf of SITA UK Limited (the applicant). The NTS is part of a package of documents being submitted to Lancashire County Council in support of a planning application in respect of land at Clifton Marsh Landfill Site, Lytham Road, Clifton, Lancashire PR4 0XE. 2. The applicant is submitting a planning application pursuant to section 73 of the Town and Country Planning Act 1990 to vary the conditions attached to planning permission ref.05/09/0376 & 06/09/0576 dated 18 July The planning application does not seek to amend the footprint of the landfill site, nor increase the void, but does seek to amend the date when landfill operations are to cease. This is set out further in paragraph 18 below, and Chapter 3 of the ES. Application Submission Package 3. This ES comprises part of a multi volume submission to accompany the planning application. The ES itself comprises three volumes: Volume 1: Main Text and Drawings Volume 2: Technical Appendices Volume 3: Non Technical Summary ( NTS ) 4. The planning application itself, in addition to the formal planning application forms, drawings and certificates, comprises: Planning Supporting Statement (SITA UK); and (Volumes 1 to 3) 5. The NTS has been produced as a separate document to accompany the planning submission, being a mandatory part of the ( ES ). This provides, in non-technical language, a brief summary of the likely significant effects that the proposed development would have on the environment. 6. 4 7. The application documents will also be available to download from the Lancashire County Council web site. Copies of key documents can also be downloaded from SITA UK s website: PLANNING AND EIA 8. The European legislation (the Environmental Impact Assessment Directive or EIA Directive for short) requires that, before granting development consent for projects authorities should carry out a procedure known as environmental impact assessment (or EIA ) of any project which is likely to have significant effects on the environment. In the UK, development consent includes the grant of planning permission. An ES is a report of an EIA that is required to be submitted with a planning application. 9. In connection with the development proposals for Clifton Marsh, Lancashire County Council (as Local Planning Authority, LPA) has provided a formal Screening Opinion confirming their view that the proposed development should be subject to EIA. In providing this opinion, the LPA indicated that the development is considered to be EIA development by virtue of the potential ground and surface water contamination associated with the disposal of the proposed waste types. 10. The applicant has carried out a formal scoping exercise culminating in the LPA issuing their formal Scoping Opinion on 1 October This scoping opinion sets out the environmental topics and extent of assessment that should be undertaken. It also indicated that the following topics do not need to be considered: Transport; Noise; Agriculture and soils; and Archaeology PLANNING AND ENVIRONMENTAL PERMITTING 11. The Phase 4 landfilling operations are subject to regulation by the Environment Agency under two Environmental Permits ( EP ); one regulating the non-hazardous waste inputs (ref.bk2348iu) and one regulating the Lower Activity Low Level Waste (LA-LLW) inputs (ref.cd0235). 12. The non-hazardous waste inputs accepted into Clifton Marsh landfill under permit BK2348IU include domestic, commercial and industrial wastes, together with stabilised non-reactive hazardous waste (currently only asbestos) which can be disposed of in specifically segregated and engineered areas known as mono-cells. Only the lower radiological activity spectrum of LLW (termed LA-LLW ) is accepted for landfill disposal at Clifton Marsh, as regulated by permit CD In applying for the Environmental Permits, a number of risk assessments were submitted to the Environment Agency. These assessments have been thoroughly reviewed by the EA prior to issuing the EP and continue to be reviewed and 2 Refer to Appendix 1/3 of the ES SITA UK Clifton Marsh Landfill Page 2 SLR Consulting Limited
5 updated over time; had the EA felt that there was a likelihood of harm to the environment or health of local communities, they would not have issued the permits. THE SITE 14. The land to which the planning application relates (referred to as the application site within this ES) covers all of the land associated with planning permission ref.05/09/0376 & 06/09/0576 dated 18 July 2011 at Clifton Marsh Landfill site. The landfill site is located approximately six kilometres west of Preston town centre, just over 1km south of Clifton, 1.5km southwest of Lea and 3.3km to the east of Freckleton. 15. Clifton Marsh Landfill is classified as a predominantly non-hazardous waste landfill site which can also accept asbestos wastes and some Lower Activity Low Level (radioactive) Waste ( LA-LLW ). 16. The landfill site lies within an area bounded by the A584 (Preston New Road)/A583 Blackpool Road to the north, the River Ribble to the south, the Savick Brook to the east and a road leading to a waste water treatment works to the west. The application site covers some 113 hectares (ha) of land located on the northern side of the River Ribble, south of the A584 and west of Savick Brook. It includes areas of the landfill site that have been infilled and restored; areas that have been capped pending restoration; the current disposal areas; and areas that have yet to be infilled. The extent of the application site is shown edged in red on the drawings within the ES, and particularly Drawing L12/00/77A in Chapter 2 of the ES. 17. The application site and its environs are described in detail in Chapter 2 of the ES. THE PROPOSED DEVELOPMENT 18. As noted above, a planning application is being submitted to vary the conditions attached to planning permission ref.05/09/0376 & 06/09/0576 dated 18 July 2011 for landfilling at Clifton Marsh landfill site. The proposals seek to: allow a continuation of landfilling until 31 December 2035; relinquish landfill permission within Cell 6 of Phase 4 in favour of continuing the existing permitted recycling operations; include a review mechanism to ensure certainty of new end date for landfilling; and make minor changes to improve the final landform (without increasing the overall void for waste within cells 1 to 5). 19. This proposal would require a variation to the dates referenced in condition 1 and the plans listed under condition 2 of planning permission 05/09/0376 & 06/09/0395, as well as the addition of a new condition requiring periodic review of tipping progress. The relinquishment of void within Cell 6 and the minor changes to the final landform entail amendments to the submissions made under planning conditions 4 and 41 and therefore a variation to the approved documents listed under condition 2 of planning permission 05/09/0376 & 06/09/0395. The review of progress towards the final landform every 5 years would avoid unnecessarily losing the landfill void asset at this stage, whilst providing certainty of an end date for landfilling operations at Clifton Marsh in line with Lancashire County Council waste planning policy. 21. The minor changes proposed to the final landform for Phase 4 (Cells 1 to 5) do not increase the void for waste; indeed they very slightly reduce it. The amendments have been made to recognise the need to review settlement rates over the remaining site, given the changing waste types (less municipal and more commercial and industrial wastes) and reduced input rates. 22. Further details of the proposed development are set out in Chapter 3 of the ES. PLANNING POLICY 23. The government is committed to a plan led system, with the Development Plan forming the basis of all planning decisions. Legislation confers a presumption in favour of development proposals which accord with the Development Plan, unless material considerations indicate otherwise. 24. The planning application will be determined in accordance with prevailing policies at national and local level. National planning policies are contained in the National Planning Policy Framework and National Planning Policy for Waste. National policy on LLW is set out in Defra s March 2007 Policy for the Long Term Management of Solid Low Level Radioactive Waste in the UK (the 2007 LLW policy ) and (by virtue of paragraph 31 of Annex 1 of the 2007 Defra policy) in the various published strategy documents. This national policy on LLW is a material consideration worthy of equivalent weight to national planning policy where it is directly relevant to the proposals. 25. Local policies translate national strategic issues into site specific proposals through the Development Plan, comprising: the Lancashire Minerals and Waste Local Plan comprising; o Core Strategy (February 2009); o Site Allocations and Development Control Policies Local Plan (September 2013); o Policies Map; o Supplemental planning guidance; Fylde Local Plan as altered (adopted October2005). 26. Land use constraints have been identified and the application site is free from any international or national land use constraints; operational areas of the application site are also free from local designations of ecological, heritage and landscape. Three European and nationally important ecological designations lie within 2km of the boundary of the application site, as do six local ecological designations: one of the local designations (Pippy Lane Banks) falls partially within the boundary of the application site (but not an operational area). These designations have been taken into account within the EIA. SITA UK Clifton Marsh Landfill Page 4 SLR Consulting Limited
7 27. The Development Plan seeks to reconcile the development needs of society against safeguarding the environment and amenity of local communities. In so doing, the Development Plan sets out a series of policies which seek to guide developments in terms of acceptable limits and design, whilst ensuring interests of archaeological, cultural heritage, ecological and landscape interest and importance are protected, and that the local amenity and environment of communities are not derogated through pollution to air, land or water. 28. Through the EIA process, it has been possible to demonstrate that the development proposals would not conflict with the stated aims and policies of the Development Plan. WATER ENVIRONMENT 29. A review of the baseline geological, hydrogeological and hydrological conditions has been undertaken and is reported in Chapter 6 of the ES. It is based on previous s, hydrogeological risk assessments and other technical reports prepared for the site. These have been updated as far as possible using web based sources, monitoring data obtained from the site, a data request from the Environment Agency (for up to date flood level data and confirmation of current licensed water abstractions, discharges and water quality data). This has provided up to date information on water abstractions, flood risk zones, aquifer designations and Water Framework Directive classifications of water bodies. The geology, groundwater and surface water regimes at the application site have been up-dated with reference to information held by the BGS, the Environment Agency, Local Authority and others, and by the consideration of site specific investigations and reports for the application site. 30. The potential additional impact of the proposals upon the hydrogeological and hydrological environments have been identified and assessed. The assessment has demonstrated that the likely increase to environmental impacts as a result of these changes would be negligible and that further mitigation, in addition to that already in place, is not required. 31. Overall, the EIA has concluded that, with respect to groundwater and surface water, there would be no significant residual effects resulting from the development proposals. LANDSCAPE AND VISUAL IMPACT 32. A landscape and visual assessment has been completed in accordance with accepted guidance and methodology. A study of the landscape and visual components of the application site and the local area was undertaken through desktop study and fieldwork. This study identified the main landscape and visual receptors and resulted in a baseline appraisal, against which the existing and proposed landscape and visual impacts could be assessed. 8 visual implications of the development and their potential impacts were identified, along with the effect of any mitigating factors which reduce these impacts. 33. This assessment has identified that the proposed development would potentially give rise to some moderate (but mostly negligible) effects on the landscape, with some beneficial effects being identified in relation to the completed profile. 34. No valued components of the landscape would be lost due to the proposed development, given the current operational nature of the application site. The principal landscape effects relate to the delay in the delivery of the final restoration works and difference in resultant landform profile. 35. As illustrated via the viewpoint analyses potential visual effects would, in most cases, be negligible with some moderate and minor/moderate being recorded at three viewpoints. Current landfilling operations are generally well screened from the surrounding area, and while activity may become more visible from some locations as the profile builds up, the resultant visual effects would be limited. Peripheral mature vegetation on the northern, eastern and western sides of the landfill provides a high level screen, with the earlier (and restored) phases of the landfill (Phases 1, 2 and 3) limiting views into the operational part of the site (Phase 4). 36. The baseline against which these effects have been judged is a landfill restored by the end of 2016, which in terms of landform would be broadly similar to the current site profile. It would thus have a steep batter on its western flank and a flattish plateau to the north. Continuation of landfill would create a landform that is more akin to that previously approved i.e. a more typical domed profile. This, in most instances, would deliver beneficial effects with the more consistent profile better reflecting the natural transition between coastal marsh and coastal plain. ECOLOGY 37. Chapter 8 in the ES examines those issues relating to nature conservation and ecology arising from the proposed continued operation of Clifton Marsh Landfill Site, and comprises an Ecological Impact Assessment. 38. An Ecological Impact Assessment can be considered as having three purposes: to provide an objective and transparent assessment of the ecological effects of a proposed development or activity; to permit objective and transparent determination of the consequences of the proposals in terms of national, regional and local policies relevant to nature conservation; and to demonstrate that a proposed development or activity will meet the legal requirements relating to species and habitats. 39. The assessment has considered the impact of the proposed continuation of landfill operations on the ecological environment both within and in the vicinity of the application site. Consideration has been given to data records held by third parties SITA UK Clifton Marsh Landfill Page 6 SLR Consulting Limited
9 and an extended Phase 1 ecological survey of the application site. Allied to this, consideration has been given to previous assessments, particularly those that underpin the issuing of an Environment Permit for the deposit of LA-LLW. 40. The application site does not support any statutory wildlife site designations. However, three European and/or nationally important ecologically designated sites lie within 2km of the boundary of the application site. There are also six local wildlife sites within 2km of the application site. 41. The ecological assessment has found that none of the predicted effects of the continued development of the landfill site, i.e. its continued operation for 20 years before final restoration in accordance with the agreed scheme, would have a significant residual adverse effect upon the ecological receptors identified. 42. The applicant would continue with the current environmental protection measures operating at the site. With these measures in place, potential adverse effects in the long term would be minimised and have not been found to be significant in the future. AIR QUALITY 43. Chapter 9 of the ES considers the potential for the proposed continuation of landfill operations to impact upon air quality in the vicinity of the application site. The chapter describes the scope, relevant legislation, assessment methodology and the baseline conditions currently existing at the application site and its surroundings. It then considers any potential significant environmental effects the proposed continuation of landfilling would have on this baseline environment; the mitigation measures required to prevent, reduce or offset any significant adverse effects; and the likely residual effects after these measures have been employed. 44. The assessment has considered impacts arising from the following sources: vehicle emissions, dust (from the various waste types, along with landfill operations); and odour. 45. Emissions of dust and odour from the landfill operations, including landfill gas, have previously been assessed within the permit applications and are controlled through the Environmental Permits for the site, which cover the operations proposed within this planning application. Moreover, an Environmental Safety Case and Radiological Risk Assessment were prepared for the application for the Environmental Permit for the disposal of LA-LLW. This current assessment on air quality has had regard to these reports. 46. Mitigation measures for dust and odour are already in place at the site. The continued, effective application of these mitigation measures will continue to be monitored by the Environment Agency as part of their Regulatory role. The proposed continuation of the landfilling activities at Clifton Marsh landfill would not increase the levels of environmental risk of vehicular emissions, dust or odour above that currently posed by the existing operations on site. Therefore, impacts are considered to be insignificant. CUMULATIVE IMPACTS 48. It is possible for a number of the environmental topics to impact upon nearby receptors; whilst individually, the impacts may be within accepted limits, collectively the impacts may be more significant. These are referred to as interrelationships between impacts. At the same time, potential impacts associated with the proposed development may be acceptable in isolation, but when considered in the context of other developments in the immediate vicinity, may become more significant. These are referred to as Cumulative Impacts. 49. Consideration has been given to the potential for cumulative impacts to arise through the continued landfilling at Clifton Marsh. Consideration has been given to the likelihood of cumulative impacts with other waste management developments at the Clifton Marsh site (such as the recycling operations); historic operations; and any other similar operations in the immediate vicinity of the landfill site. 50. In all cases, no significant cumulative impacts have been identified. This is mainly due to the location of the site away from receptors and that there aren t any other similar land uses in the immediate vicinity of the application site.
