The amount of the security shall be based upon the cost of the work required to ensure compliance with the permit s terms and conditions. The security, with interest at the rate currently earned by the city, less any deductions, shall be released upon the city s determination that the Permittee has successfully completed all work required by the permit. If the Permittee does not successfully complete all required work or violates any requirement of the permit, the city may take corrective measures and charge the cost of such to the Permittee. Such costs shall include the actual cost of any work deemed necessary by the city plus administrative and inspection costs and penalties pursuant to the city s Stormwater Quality Enforcement Policy. In determining the cost of work, a 15% contingency shall be added. If the total of such costs exceeds the security, the Permittee shall be responsible for payment of the remaining balance within thirty calendar days of receipt of an accounting of such from the city. It is the Permittee s responsibility to request a release of the Performance Security. Please note that eligibility for a full release is determined by adequate permanent stormwater quality control features, including established vegetation. In most cases, a minimum of one year from the date of seeding is necessary to determine vegetation establishment. Why is a Small Site Stormwater Quality Permit required from the City of Loveland? The City of Loveland s stormwater program is mandated under the National Pollutant Discharge Elimination System (NPDES), a component of the Clean Water Act. The requirement is intended to reduce the amount of pollutants entering waterways such as streams, rivers, lakes, and wetlands as a result of runoff from residential, commercial and industrial areas. Large construction sites have been under a requirement from the State (the Colorado Department of Public Health & Environment (CDPHE) to obtain permit coverage since 1992 (Phase I of the program). Small construction sites have been under a requirement to obtain permit coverage from CDPHE since July 1, When is a Small Site Stormwater Quality Permit required from the City of Loveland? A Small Site Stormwater Quality Permit, to be referred to as (Permit) is required from the City of Loveland for all land disturbance activities less than one-half (½) acre that are part of a larger common plan of development or sale that would disturb one-half (½) acre or more. 3. What is necessary to obtain a Small Site Stormwater Quality Permit from the City of Loveland? Fill-out all 6 sections of the Permit application form. o Section 1 Project Information You will need to provide a project name, address/location, legal description along with existing and proposed use for the site. o Section 2 - Contact Information You will need to provide the name, address, phone number(s), and of the Owner and Contractor. o Section 3 - SWMP (Stormwater Management Plan) Administrator You will need to designate a SWMP Administrator on the permit. Note: The SWMP Administrator must be the person who will be the responsible party for the project regarding the installation & maintenance of temporary sediment/erosion control measures and who has the authority to make modifications to the SWMP. o Section 4 Site Personnel who have the authority to make modifications to the SWMP You will need to provide the name(s) and contact information for any personnel other than the SWMP Administrator that are authorized to make modifications to the SWMP. Note: Authorized site personnel are typically any site personnel in addition to the Permittee who can ensure quick response to BMP repairs and/or failures. o Section 5 Project Information You will need to provide the size of the project in acres and a brief description of the project. o Section 6 Project Schedule You will need to provide both the expected work start and completion dates. Note: Failure to fill-out all 6 sections of the Permit application form could delay the start of the project. Stormwater Management Plan (SWMP). As part of the review process, the City of Loveland requires a copy of the SWMP that was prepared for the development site. 4 Performance Security. Stormwater Inspector The City of Loveland Stormwater Inspector will perform site inspections on subdivisions at least twice a month, after a significant storm event, and as needed during the development of the site. Public Works Inspector The City of Loveland Public Works Inspector will perform commercial and industrial lot construction site inspections at least once a month, after a significant storm event, and as needed during the development of the site. 5. What will happen if I fail to install and/or maintain the Control Measures for the site? The failure to install and/or maintain the Control Measures on your site could result in the following: Verbal Notification of Violation; Written Notification of Violation; Stop Work Order; Work Performed by Permittee or Permittee s Contractor and Responsible Party Charged/Bond Withheld (include the number of enforcement actions, not a dollar amount), or; A Monetary Penalty/Fine. 5 Small Site Stormwater Management Plan (SWMP) Guidance FIRE & ADMINISTRATION BUILDING PUBLIC WORKS/STORMWATER 410 E. FIFTH STREET, LOVELAND, CO (FAX) CITYOFLOVELAND.ORG/STORMWATER A Stormwater Management Plan (SWMP) is required for all City of Loveland Stormwater Quality Permits. This guidance document is designed to help you develop a SWMP for your construction project. It lists each of the SWMP requirements and outlines some items for you to consider when developing the SWMP 1. Although the SWMP shall be prepared in accordance with good engineering, hydrologic and pollution control practices it does not need to be prepared by a registered professional engineer. The main objective of the SWMP is to identify potential sources of pollution, including sediment, which may reasonably be expected to affect the quality of stormwater discharges associated with construction and development from leaving the site. The SWMP should contain the following three components: 1. A Descriptive Narrative The written narrative should describe the implementation of appropriate control measures or Best Management Practices (BMPs) which will be used to reduce the pollutants in stormwater discharges associated with both the Construction Activity and Post-development Runoff for the site. The narrative related to Construction Activity should describe what, when, where and why each of the temporary structural and nonstructural sediment/erosion control BMPs will be installed and maintained during each of the four development phases of construction to prevent sediment and construction materials from discharging both onto the paved surfaces and from discharging off-site. The narrative related to Post-development Runoff for the site should describe what Permanent Stormwater Quality BMPs (PBMPs) will be incorporated into the development site; why they were chosen, and; how each of the PBMPs incorporated into the development site will improve the water quality of the stormwater runoff. 2. Drawing(s) The SWMP will need to contain one or more drawings of the development site. The drawing(s) should clearly show the location of each of the BMPs incorporated into the development site. Note: A separate drawing should be incorporated into the SWMP that identifies where each of the PBMPs is located. 3. Details The SWMP document should also contain details for each of the BMPs and PBMPs incorporated into the development site. Note: The BMPs and PBMPs should be installed per the manufacturer s recommendation and/or as shown in the details. Note: During construction each of the three SWMP components should be revised as needed to accurately reflex the condition of the development site at all times. The following should be used as a guide when preparing the SWMP: 1. Site Description a) A description of the construction activity; b) A proposed construction schedule; c) Total area of the site, and total disturbed area, including offsite staging/storage areas; 1 Please note that the list of SWMP requirements prepared by the City of Loveland may not be as inclusive as those required by the Colorado Department of Health & Environment (CDPHE) and the Environmental Protection Agency (EPA). 6 d) An estimate of the runoff coefficient before and after construction activities are completed, and existing data describing the soil and soil erosion potential; e) A description of the existing vegetation at the site, including coverage; f) The location of other potential pollution sources, such as vehicle fueling, storage of chemicals, etc.; g) A description of other potential pollution sources, such as concrete washout, port-o-lets, dumpsters, etc., and; h) The name of the receiving water(s) and the size, type and location of any outfall or, if the discharge is to a Municipal Separate Storm Sewer (MS4), the name of the system, the location of the storm sewer discharge, and the ultimate receiving water(s). 2. Location and description of appropriate control measures (BMPs) The plan should indicate the locations of and descriptions for the BMPs that will be used for each of the four major development phases of the development site: Phase 1 - Grading Phase BMPs for initial installation of perimeter controls. Phase 2 - Infrastructure Phase BMPs for utility; paving; curb & gutter installation. Phase 3 - Vertical Construction Phase BMPs for individual lot construction. Phase 4 - Permanent BMPs & Final Stabilization. In addition, the SWMP should also identify how materials will be handled and what spill prevention measures will be implemented for the site. 3. Inspection and Maintenance Procedures The SWMP should also include inspection and maintenance procedures to ensure BMPs are in good and effective operating condition. The following are recommended procedures: a) Inspections 1) Perform every 14 days, or following a significant stormwater event. 2) Complete an inspection report for each inspection performed. Note: You may use your own form or the Erosion Sediment Control Inspection List (ESCIL) the City of Loveland has developed. 3) Keep inspection reports on site. b) Maintenance 1) Perform maintenance and repairs as soon as possible on items or areas identified in the inspection report. 2) Perform maintenance as indicated in the City of Loveland Storm Drainage Standards, per manufacturer s specifications, or other sources determined to be acceptable. Note: An efficient record-keeping system is a helpful tool in managing inspection and maintenance reports. It is recommended that a logbook be maintained for inspection reports, maintenance records, spill response, weather conditions, training, correspondence, etc. 4. Identification of non-stormwater discharges The location and description of any anticipated non-stormwater discharges, such as: a) Return flows from landscape irrigation. b) Ground water. c) Flows from riparian habitats and wetlands. d) Water line flushing. e) Discharges from potable water sources.
