1 SUNY Canton Hazard Communication Program PURPOSE In an effort to ensure SUNY Canton s continued commitment to providing the safest workplace possible and comply with federal, state, and local regulations SUNY Canton has prepared this Hazard Communication Program. This shall be accomplished by complying with the State of New York Right to Know Law, and OSHA Hazard Communication Standard which is incorporated into this Hazard Communication Program. SCOPE This policy applies to all employees, contractors, or other individuals whose job duties require them to use chemicals in the workplace. POLICY It shall be the policy of SUNY Canton to provide employees with appropriate training and information on the safe handling and work practices associated with hazardous chemicals, materials, and conditions to which employees may be exposed in the work place. Any amendments to this Standard will be considered to be incorporated into this policy on the date they become effective. Implementation of this policy shall be accomplished through this written SUNY Canton Hazard Communication Program. A. Hazardous chemical - any chemical which is a physical hazard or a health hazard. B. Physical hazard - a chemical for which there is scientifically valid evidence that it is a combustible liquid, a compressed gas, explosive material, flammable material, an organic peroxide, an oxidizer, pyrophoric material, unstable (reactive), or water reactive. C. Health hazard - chemicals, which are carcinogens, toxic or highly toxic agents, reproductive toxins, irritants, corrosives, sensitizers, hepatotoxins, nephrotoxins, neurotoxins, agents which act on the hematopoietic systems, and agents which damage the lungs, skin, eyes or mucous membranes.
2 EXCLUSIONS A. Any hazardous waste as such term is defined by the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act of 1976, as amended (42 U.S.C et seq.), when subject to regulation issued under that Act by the Environmental Protection Agency. B. Any hazardous substance as such term is defined by the Comprehensive Environmental Response, compensation and Liability Act (CERCLA) (42 U.S.C et seq.) when the hazardous substance is the focus of remedial or removal action being conducted under CERCLA in accordance with Environmental Protection Agency regulations. C. Tobacco or tobacco products. D. Wood or wood products, including lumber which will not be processed, where the chemical manufacturer or importer can establish that the only hazard they pose to employees is the potential for flammability or combustibility (wood or wood products which have been treated with a hazardous chemical covered by this standard, and wood which may be subsequently sawed or cut, generating dust, are not exempted). E. Articles, defined as manufactured items other than a fluid or particle which are formed to a specific shape or design during manufacture, which have end use function(s) dependent in whole or in part upon its shape or design during end use, and which under normal conditions of use do not release more than very small quantities, e.g., minute or trace amounts of a hazardous chemical and do not pose a physical hazard or health risk to employees. F. Food or alcoholic beverages which are sold, used, or prepared in a retail establishment (such as a grocery store, restaurant, or drinking place), and foods intended for personal consumption by employees while in the workplace. G. Any drug, as defined in the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 301et seq.), when it is in solid, final form for direct administration to the patient (e.g., tablets or pills); drugs which are packaged by the chemical manufacturer for sale to consumers in a retail establishment (e.g., over-the-counter drugs); and drugs intended for personal consumption by employees while in the workplace (e.g., first aid supplies). H. Cosmetics which are packaged for sale to consumers in a retail establishment, and cosmetics intended for personal consumption by employees while in the workplace; I. Any consumer product or hazardous substance, as those terms are defined in the Consumer Product Safety Act (15 U.S.C. 2051et seq.) and Federal Hazardous Substances Act (15 U.S.C et seq.) respectively, where the employer can show that it is used in the workplace for the purpose intended Hazard Communication Program Page 2
3 by the chemical manufacturer or importer of the product, and the use results in a duration and frequency. J. Nuisance particulates where the chemical manufacturer or importer can establish that they do not pose any physical or health hazard covered under this section. K. Ionizing and non-ionizing radiation, except that ionizing radiation should be included in the pleading requirements of this standard. L. Biological hazards. LABORATORIES A. All SUNY Canton laboratories must comply with this Hazard Communication Policy and Right-To-Know (RTK) Program; however, in instances where hazardous substances, i.e. chemical intermediates, being developed and used exclusively in SUNY Canton laboratories, safety data sheets (SDS) are not required. B. Laboratory personnel must adhere to applicable occupational and environmental health regulations including, but not limited to, the OSHA Occupational Exposure to Hazardous Chemicals in Laboratories Standard (29 CFR ) C. Laboratories that ship hazardous chemicals developed by that laboratory to another employer are considered to be either a chemical manufacturer or a distributor under the Federal Hazard Communication rule, and thus must ensure that: 1. A hazard determination following the procedures in 29 CFR (d)(1)-(3) has been performed. 2. An SDS is provided which complies with the requirements of 29 CFR (g)(1)-(6). 3. any containers of hazardous chemicals leaving the laboratory are labeled with: a. Identity of the hazardous chemical(s) b. Appropriated hazard warnings. c. Name and address of SUNY Canton as the manufacturer. CHEMICAL INVENTORY All Immediate Supervisors (or their designated coordinators) should ensure that an inventory is prepared for each workplace in their assigned departments or work areas in which hazardous materials are used or stored. The inventory should be continuously updated if possible or updated annually at a minimum. RECORD OF EXPOSURE A. If an employee receives a potentially hazardous exposure or develops signs or symptoms of overexposure to a hazardous substance, the employee should notify his/her supervisor immediately. Once aware an employee has received a potentially hazardous exposure, the supervisor or designated coordinator and should immediately notify the employee and take such steps as may be necessary to send them for medical evaluation, monitoring, treatment, and document such exposure. C. When an employee has an accident or an injury on the job the employee is responsible to taking the following steps: 1. Notify your supervisor immediately. 2. Complete the accident report. (Form CS-13), (available from HR Dept.), and submit the form to the HR Department. 3. Employees should call the Accident Reporting System at under one of the following circumstances: a. You go to the doctor. b. You go to the hospital. c. You lose time from work. If you call the Accident Reporting System to report an accident, they will give you an incident number that you must give to the Benefits Office. D. Forms and records are maintained and stored for at least 40 years in the Human Resources Department. SAFETY DATA SHEETS (SDS) The Safety Data Sheet (SDS) provides relevant safety information and warnings applicable to hazardous chemicals. Electronic access and other alternatives to maintaining paper copies of the SDS are permitted as long as no barriers to immediate access in each workplace are created by such options. In lieu of maintaining hard copies of SDS s, electronic versions are available through MSDSonline, SUNY Canton s Chemical Inventory and Safety Data Sheet service provider. Each department head or designee at SUNY Canton is responsible for maintaining a manufacturer-specific SDS for each hazardous or toxic substance used or stored in his/her work area(s), and for ensuring that they are readily accessible during each work shift to employees when they are in their work area(s). A link to the general MSDSonline SDS database can be found on the SUNY Canton EH&S web site. Please note, MSDSonline may ONLY be used as the SOLE SDS resource if ALL employees with the potential for chemical exposure in any given area have full access (i.e. computer access, a general understanding of how to navigate the system, etc.) to the service; otherwise, hard copies must be made readily available as well. Each department head or designee at SUNY Canton must also send copies of all SDSs for new chemicals as they arrive, to the Environmental Health and Safety Department. This can be done one of two ways: Hazard Communication Program Page 4
5 A. Access the MSDSonline site and enter the product name you're seeking to submit an SDS for in the search engine (you can narrow down your search by also including such information as the CAT. Number, the CAS Number, the Manufacturer, etc.) If your initial search is not successful, try adding or removing information you've included in the search field and resubmit: 1. Once you've found the correct SDS, check the box associated with that product (left of product name) which prompts you to select "Assign to Company List"; click on that prompt, which opens up a second screen. 2. Fill out all required information on this "Approval Details" page and hit 'submit'. Your submission will be sent to a queue for the System Administrator/EH&S Coordinator's approval. Please note: if your specific location is not listed in the drop down menu on the "Approval Details" page, call or the System Administrator/EH&S Coordinator so that the location can be added. B. SDSs should be ed to the System Administrator/EH&S Coordinator at conversed@canton.edu and, be certain to add within the the specific location where the chemical(s) are to be used/stored - identify the Building, Department, Room Number and the Specific Location (i.e. cabinet A, stockroom, under fume hood #1, etc.). Once received, the proper SDS will be paired with the associated chemical(s) within MSDSonline. SECONDARY CONTAINER LABELING A. All containers of hazardous chemicals used in the workplace must be labeled in accordance with the federal Hazard Communication Standard (29 CFR ) at the time of receipt: 1. The labels should be in English but warnings in foreign languages may be included to assist non-english speaking staff. 2. Labels must include the identity of the hazardous chemical as well as the signal word, hazard statement, pictogram(s) and precautionary statement(s) related to the product. 3. The Hazard Communication Program Pictogram Explanation Sheet is located within (Appendix A). This provides information relevant to the pictograms required to be on container labels. 4. Secondary containers into which hazardous chemicals are transferred from labeled containers and which are intended for the immediate use of the employee who performs the transfer are exempt from the labeling requirements. Once the container is left unattended, it must be properly labeled. EMPLOYEE INFORMATION 1. All personnel must be supplied with information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new chemical hazard is introduced into Hazard Communication Program Page 5
6 their work area. Training will be supplied to employees and reviewed annually under the WeComply HazCom Right to Know program. 2. The following information must be provided to employees: 1. The requirements of the Hazard Communication program. 2. Any operations in their work area where hazardous chemicals are present. 3. The location and availability of the written Hazard Communication program including the required list of hazardous chemicals and the safety data sheets for their work area. 3. Employee training must include the following: 1. Methods and observations that may be used to detect the presence of a hazardous chemical in the work area. 2. The physical, health, simple asphyxiation, combustible dust and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in their work area. 3. The measures that employees can take to protect themselves from these hazards. 4. The details of the hazard communication program including an explanation of the labels received on shipped containers and the workplace labeling system, the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information.
