SUMMARY OF REQUEST The applicant is requesting a special exception for a nonexempt excavation on approximately 576 acres zoned a mixture of Prime Agriculture (A-1), Rural Agriculture (A- 2), Forestry Resource (FR) and Resource Corridor (RC). However, the excavation area is limited to an area zoned A-2 and FR, and will impact approximately 50 acres of the overall property. Per the applicant, this use is intended to provide fill dirt for the I-4 widening project currently underway. The schedule for completion of the project, from start of excavation to completion of the site reclamation plan is five years. Staff Recommendation: Forward to county council for final action with a recommendation of approval with conditions.

Location: This property is located on the west side of State Road 415, approximately 1.5 miles south of the intersection of State Road 415 and State Road Parcel Number(s): and Property Size: The project area is acres of a 576-acre parcel 4. NRMA Overlay: Yes 9. Adjacent Zoning and Land Use: Due to the size of the parcel, the zoning and land use described below are adjacent to the project site rather than the parcel. The parcel itself provides significant buffer to the project area on the north, west and south sides. 3 Page 3 of 42 III. BACKGROUND The proposed excavation is situated north of the community of Osteen and south of Samsula, on the west side of State Road 415. The project area is approximately acres of a 576- acre parcel, as shown on the aerial to the right. The property is currently used for agriculture as cropland and timberland per the Property Appraiser s office. There are two houses and various agriculture related structures on site. One of the houses was built in 1960 and the other in The archived permit file indicates there might have been two parcels at the time the latter house was permitted, but the legibility of the survey data is unclear. If the applicant intends to maintain the houses during and after the excavation operation, the nonconforming situation will need to be addressed. The parcel can be split into two lots, or one of the houses may be removed. The other structures that are located within the excavation area will be removed. The surrounding area consists of pasturelands, ranchettes, a nursery, and two nonconforming landfill operations. IV. REVIEW CRITERIA AND ANALYSIS Nonexempt Excavation Use and Code Requirements: Section (15)b of the zoning code contains a list of technical requirements and conditions that an applicant must meet to find this special exception in compliance with the ordinance. This code section has been attached to this report as Attachment C for reference. These requirements address such items as setbacks, landscape buffers, slopes, hours of operation, fencing, as well as technical requirements of the excavation. The excavation pit is proposed to be done in three cells, or stages, with reclamation to follow after all three cells have been dug. The pit slopes shall be 6:1 to a depth of 2-feet below the dry season normal water elevation. The proposed bottom elevation of the pit will be 30-feet from the present grade per the side slope detail on the special exception excavation plan. Approximately 1,270,990 cubic yards of material will be dug from the site. There will be no stockpiling of material onsite. All material will be loaded into trucks within the confines of the working cell and will be hauled immediately off-site. The proposed hours of operation will be from 8:00 a.m. to 5:00 p.m., Monday through Friday.

4 Page 4 of 42 The ingress/egress to the site will be the current access point as can be seen on the aerial. Per the applicant, the average number of trucks that will be leaving and returning to the site is 30. The haul route will be north or south on State Road 415. An FDOT use permit will be required prior to site permit issuance for any driveway connection improvement to State Road 415. More extensive traffic analysis may be required at the time of site plan review. The excavation site is setback 300 feet from the State Road 415 right-of-way, and 150 feet from any on-site wetlands. A six-foot high chain link fence will be installed around the perimeter of the excavation area. As required, a 50-foot wide landscape buffer shall be established and planted adjacent to the roadway, running the length of the excavation site. The remainder of the parcel will buffer the excavation site from other abutting properties. Per the applicant, the purpose for the nonexempt excavation is to sell fill dirt to supply the I- 4 widening project currently underway in Volusia County. The excavation is to take five years from the start of excavation to completion of site reclamation. The planned reclamation of the pit will result in a lake with a curvilinear shoreline. The reclamation plan must be approved by Environmental Management and St. John s River Water Management prior to side slope planting. Reclamation includes, at a minimum, stabilization of all surfaces, shaping and planting of the littoral zone of the waterbody, and seeding and mulching of any disturbed areas within the project site. If the special exception is approved, a detailed review of the project shall take place during the final site plan review process, prior to any excavation activity occurring on site. If it is determined during the site plan review process that there are any variations to the referenced section, a variance application shall be required to be heard by the PLDRC prior to permit issuance. Special Exception Criteria: Under subsection (8) Reasons for denial, the commission may recommend denial of any application for a special exception, and the county council may deny the application for one or more of the following reasons: (a) It is inconsistent with the purpose or intent of this article. A nonexempt excavation is allowed in the A-2 and FR zoning classifications, subject to meeting the express requirements of section (15)b. A conceptual plan has been submitted and the project proposes to meet all these conditions. It is to be located on an already cleared area of a 576-acre parcel. The parcel provides ample separation from abutting properties to the north, south and west. The excavation site will be setback from the right-of-way twice the minimum required at 300 feet. It will be setback the minimum 150 feet from on-site wetlands. All code requirements are proposed to be met. If it is found during site plan review that there are variations to these requirements, a variance application shall be required to be heard by PLDRC prior to site plan approval. This application is consistent with the purpose and intent of this article.

5 Page 5 of 42 (b) It is inconsistent with any element of the comprehensive plan. The future land use designation of the property affected by the excavation operation is Rural. Rural areas should be developed in a manner consistent with the retention of agriculture and the protection of environmentally sensitive areas. This is a temporary use of the land, that when reclaimed, will become a lake. The excavation site is so located to avoid impacts to on-site wetlands and environmentally sensitive areas. The surrounding property will remain agriculture. The comprehensive plan contains the following policies relating to the requested special exception: Land reclamation measures and sound conservation practices shall be required on lands used for the excavation of natural resources and used as disposal sites. A reclamation plan shall be submitted as part of the required application for an excavation or disposal permit. The plan shall also indicate how the site will be used after completion of the excavation/disposal, including a time line for such reuse Extraction of natural resources and disposal activities shall be permitted only where compatible with existing and proposed land uses, as determined in the Land Development Regulations Prior to 1999, the County shall identify those areas with the highest suitability for mineral extraction, based on the quality of mineral deposits, and the patterns of land use and natural systems, and shall prevent the premature encroachment of incompatible land uses into these areas Mineral extraction activities proposed outside of the areas identified in Policy shall be adequately buffered from residential areas to avoid adverse fluctuations of groundwater levels to nearby individual well systems, and to minimize noise pollution Proposed mineral extraction activities shall continue to minimize impacts to environmentally sensitive lands and critical habitats. In cases where adverse alteration of such lands are unavoidable, appropriate mitigation shall be required The County shall continue to implement standards for reclamation of excavation sites so as to resemble a natural system to the greatest extent feasible, including, at minimum: a. creation of sinuous shorelines; b. bank gradients properly sloped to establish planted littoral shelves with appropriate submerged and emergent vegetation; c. fish stocking, if warranted;

6 Page 6 of 42 d. ambient water quality testing; e. completion of the reclamation plans; f. compliance with standards established for artificial lakes by the SJRWMD and other appropriate agencies. Comprehensive Plan, Figure 1-5 Mineral Resources and Extraction Sites, identifies the soil types suitable for mineral extraction activities. The proposed site is located within the area identified as having sand resources. This application is consistent with the comprehensive plan. (c) It will adversely affect the public interest. The proposed special exception has potential for both positive and negative impacts. The chief positive impacts are to provide a product and service necessary in improving the transportation infrastructure of the community. Negative impacts of the proposed special exception include increased traffic generation, noise, dirt/dust dispersion and effects on the rural character of the area. As it is a temporary use, these impacts will not be permanent; however for the duration of the project these impacts must be ameliorated. The applicant proposes to limit hours of operation to 8:00 am to 5:00 pm, Monday through Friday, which will limit roadway and noise impacts to standard business hours. Roadway impacts will consist of an average of 30 additional trips per day. The trucks will be standard dump trucks with dust blankets to reduce sediment discharge. A silt fence will be erected around the entire site and there will be no stockpiling on site which will help reduce windborne sediment. The proposed 300-foot setback to State Road 415 and the landscape buffer will reduce the visual impact of the use to the road and protect the rural character of the area. The site is not visible on any other side of the property. The imposition of these conditions help address the potential for negative impacts from this use. (d) It does not meet the expressed requirements of the applicable special exception. Section (15)b governs the requirements for a special exception for a nonexempt excavation. This section is attached for reference. These special exception requirements are unique in that they focus on issues normally addressed during the engineering review of the site plan for permitting purposes. For purposes of this special exception, the Concept Plan prepared by Mark Dowst and Associates, dated November 25, 2014 and date stamped received on December 23, 2014, along with written commitments submitted by the applicant, meet these requirements. This application meets the requirements of the applicable special exception. (e) The applicant will not be able to meet all requirements imposed by federal, state or local governments, or by the county council. The applicant must meet the requirements of the special exception as well as permitting requirements by any applicable federal, state, and local agencies.

7 Page 7 of 42 (f) Notwithstanding the provisions of division 14 of the Land Development Code [article III], it will generate undue traffic congestion. There are no critical or near-critical roadways within a five-mile radius of the site. The project will access State Road 415, a two-lane state highway operating at LOS C. The applicant has stated that an average of 30 trips per day will be generated by this use. With the addition of 30 trips, the LOS will remain at C. Although the applicant provided general answers to Traffic Engineering s request for a traffic study, they did not submit an actual traffic impact analysis, signed and sealed by a traffic engineer. If the special exception is approved, a detailed traffic impact analysis will be required as part of site plan review process. In addition, FDOT use permits will be required prior to permit issuance. (g) It will create a hazard or a public nuisance, or be dangerous to individuals or to the public. Potential hazards or public nuisances that may be generated by this excavation operation include dust, noise and traffic impacts. Dust - The site will be contained within a silt fence and there will be no stockpiling of dirt on-site so this nuisance should be minimized. To further prevent any potential public health issue, the site may need to be watered down during dry periods so as to prevent sediment and debris from leaving the site. Haul trucks are to be covered with a dust blanket to reduce sediment discharge on the roadway. Noise - The noise generated from this site will be from heavy equipment used in the digging operation and trucks being loaded with fill dirt. These activities will be limited to standard business hours, Monday through Friday. Traffic Impacts State Road 415 currently operates at LOS C. The applicant has stated that there will be an average of 30 additional trips per day. With the addition of 30 trips, the LOS will remain at C. Signage stating Trucks Entering Highway will be provided in both directions. Additional requirements may be imposed subject to a detailed traffic impact analysis to be required at the time of site plan review, and subject to FDOT s use permit. (h) It will materially alter the character of surrounding neighborhoods or adversely affect the value of surrounding land, structures or buildings. The excavation project is a temporary use of the land that will last a maximum of five years. During operations the project area is not visible from any abutting properties to the north, south or west as it is surrounded by a heavily wooded, 576-acre parcel. Where the site is visible from State Road 415, there will be a landscape buffer adjacent to the roadway, and the extraction activity setback 300 feet from the roadway. Once the project is complete, the pit will become a lake and the 576 acre parcel will continue as agriculture/timberland use. This use will not materially alter the character of the surrounding area or adversely affect the value of surrounding land, structures or buildings once the project is complete.

8 Page 8 of 42 (i) It will adversely affect the natural environment, natural resources or scenic beauty, or cause excessive pollution. The excavation site has been situated so as not to be within any environmentally sensitive area. The requirements for nonexempt excavations specifically require that there are sufficient setbacks to wetlands, rights-of-ways, and abutting properties to minimize any adverse effects it may cause during operations. The operation will be screened from the abutting roadway for the duration of the project and then will be restored to its previous condition. V. STAFF RECOMMENDATION Staff recommends that the PLDRC forward this special exception for a nonexempt excavation on Rural Agriculture (A-2) and Forestry Resource (FR) zoned property, to the county council for final action with a recommendation of approval, subject to the following staff recommended conditions: 1. Special exception approval is limited to the site improvements as permitted by this special exception and as shown on the site plan submitted with this application and prepared by Mark Dowst and Associates with a revision date of December 22, 2014, and stamped received on December 23, Any proposed expansion of the acre area to be excavated must obtain an additional special exception. 2. The applicant shall not begin the excavation until after final site plan review and approval by the County Development Review Committee (DRC) and issuance of a Development Order/Excavation Permit issued by the Growth and Resource Management Department. Development and use of the subject site shall be in substantial compliance with the submitted conceptual plan and written documents as may be modified by the DRC. The applicant shall comply with the requirements of Section (15) of the Zoning Ordinance. 3. The special exception shall be granted for a five (5)-year time period, including reclamation activities, subject to compliance with the approved DRC Development Order/Excavation Permit. The excavation shall operate from 8:00 am to 5:00 pm, Monday through Friday. It will not operate on weekends or any Federal holidays. 4. All appropriate permits from local, state and federal regulatory agencies shall be obtained by the applicant as required prior to issuance of a Development Order/Excavation Permit by the Growth and Resource Management Department. Copies of required State and Federal Permits or statements from appropriate agencies to indicate that permits are not required shall be provided during the DRC review process. The applicant shall comply with any applicable local, state or federal rules and regulations of other concerned governmental agencies.

9 Page 9 of The applicant shall post an irrevocable letter of credit for reclamation payable to the County of Volusia in an amount approved by Volusia County Environmental Management Services, in a format approved by the County Legal Department prior to permit issuance. The irrevocable letter of credit shall run with the life of the excavation and reclamation activities. If the applicant has not completed the excavation on the five years granted by the special exception, the county may redeem the letter of credit and utilize the funds to perform any remedial work necessary to complete the terms and conditions of the reclamation, as required by the county in the special exception, and to be required by the county in the final site plan approval process. 6. The applicant shall submit an engineer s certification and progress report to the Planning and Development Services Division on an annual basis outlining that the excavation is proceeding in accordance with the terms of the excavation permit and/or DRC requirements and/or conditions. 7. The pumps used for dewatering shall be designed for quiet operation and shall be surrounded by earthen berms for noise abatement. 8. The developer shall record a covenant stating that the excavation pit shall only be filled with water. 9. A traffic study, signed and sealed by a registered traffic engineer, shall be required to be submitted prior to site plan approval. The methodology shall be coordinated with Volusia County Traffic Engineering. 10. The existing nonconformity regarding the two single family homes existing on the single parcel shall be corrected prior to site plan approval. The property may be subdivided into two lots, each containing one house to match the original 1987 building permit; or one of the houses shall be removed prior to permit issuance. VI. 10 Page 10 of 42 VII. AUTHORITY AND PROCEDURE Pursuant to Section , the county council shall hold a public hearing after due public notice on all recommendations from the commission. It may accept, reject, modify, return, or seek additional information on those recommendations. No approval of a special exception application shall be made unless, upon motion, four members of the county council concur. The county council will thereafter forward its decision to the applicant. Any new information to be presented at the planning and land development regulation commission for any application will be grounds to continue an application to the next planning and land development regulation commission. Applicants shall inform and provide staff with the new information prior to the planning and land development regulation commission. Any new information to be presented at the county council meeting that was not previously presented to the planning and land development regulation commission for any application will be grounds to return an application to the planning and land development regulation commission for further review. Applicants shall inform and provide staff with the new information prior to the council meeting.

14 Page 14 of 42 Section (15) Excavations. b. The following requirements and conditions must be met for any nonexempt excavation. A nonexempt excavation requires a special exception to this article and issuance of a permit in accordance with the final site plan procedures of division 3 of the Land Development Code [article III]. 1. Each application for a special exception shall be accompanied by plans, drawings, and information prepared by a Florida registered engineer depicting, at a minimum: i. Existing and proposed topography at one-foot contour interval. Such topography shall extend a minimum of 150 feet beyond the top of the bank of excavation. ii. Proposed side slopes and depths which meet these minimums: All sides of the excavated area shall, at a minimum, comply with the following: A. One foot vertical for each six feet horizontal to a depth of ten feet below the dry season water table elevation, unless waived by the county council. B. For depths greater than ten feet below the dry season water table elevation, the slope may be one foot vertical for each one foot horizontal. Notwithstanding section of this article, any excavation in excess of the aforementioned slope shall be enclosed by a sixfoot-high chain link fence approved by the development engineering division which shall include a gate that shall be closed and locked at all times during which the excavation pit is not in use. Said fencing shall be completely installed prior to initiation of the excavating activity and shall remain in place, unless determined otherwise by the development engineering division, until the excavation is satisfactorily reclaimed. iii. Wet and dry season water elevations and the existing surface drainage pattern. iv. Notwithstanding any other minimum yard sizes required by this article, the top of the bank of an excavation shall be set back the following minimum distance: A. One hundred fifty feet from the right-of-way of any public street, road or highway. B. One hundred fifty feet from abutting residential or mobile home classified property. C. One hundred fifty feet from any other abutting property. D. One hundred fifty feet from any natural or manmade surface water body, watercourse or wetland. v. Perimeter landscape buffers shall be established prior to initiation of the excavating activity and shall meet the requirements of subsection (2)a., "Landscape Buffer Table".

15 Page 15 of 42 vi. The area and amount of material to be excavated in cubic yards. A discussion of the proposed method of excavation shall be provided. vii. The proposed method of dewatering. viii. The time, duration, phasing and proposed work schedule of the total project. ix. A detailed reclamation plan, drawn to an acceptable scale, and program to be performed upon completion of the project. As a minimum, the plan of reclamation shall include: A. Time, duration, phasing and proposed work schedule of the reclamation. B. Depiction of finished, stabilized, side slopes, including methods and plant materials proposed for use. For a wet excavation, a littoral zone is required to be established around the resultant water body. The specifications of said zone shall be determined in conjunction with the county's environmental management department. The establishment, to the fullest extent practical, of sinuous shorelines is required. C. Landscape plan for the portion of the property disturbed by excavation and associated activities, including an inventory of plant/tree species to be used. The reclamation plan must be approved by the development review committee. D. The resultant artificial water body shall comply with the standards established by the St. Johns River Water Management District and other appropriate agencies. Said water bodies may be required to be stocked with fish. Ambient water quality testing may also be required. x. A hydrogeologic report, prepared by a qualified engineer of hydrologist, of the proposed excavation site. Such a report shall, at a minimum, provide: A. A detailed description of subsurface conditions. B. A groundwater contour map. C. A map depicting the thickness and depths of material to be excavated. D. A discussion of the environmental impacts of the proposed excavation, including but not limited to the impact of the proposed excavation upon existing area wells. E. A recommendation of the necessity to install monitoring wells. xi. The proposed location of access points to the site and proposed haul routes for disposal of excavated material. Vehicular access to and from excavations shall be designated by the council at the time of approval of the special exception. xii. Proposed plans for fencing and signs. xiii. A statement from the applicant identifying all other federal, state and local permits required, if any. 2. The bottom of any reclaimed excavation should be graded to allow all water to drain to a sump area not less than 15 feet by 15 feet (225 square feet). The bottom of the excavation shall be graded in a fashion

16 Page 16 of 42 which will not cause water to accumulate in stagnant pools. The bottom of excavations shall be uniformly graded to prevent anoxic sinks. 3. Whenever the Volusia County Public Works Department determines that the use of any county right-of-way designated by the applicant for ingress and egress to and from the excavation site will be subject to excessive deterioration resulting in the breakdown of the subsurface and base of such right-of-way, the applicant may be required to agree to provide the county with funds in the amount necessary to mitigate the adverse impact upon the right-of-way which is caused by the excavation operation and to ensure that said roadway is maintained in a satisfactory condition. In furtherance of this agreement, the excavator may be required by the county council to post an acceptable performance bond, irrevocable letter of credit, or funds in escrow in the amount up to 100 percent of the estimated reconditioning costs, as estimated by the Public Works Department. 4. All excavations, as applicable, shall be reclaimed in accordance with the rules of the Florida Department of Environmental Protection, Division of Resource Management, found in the Florida Administrative Code. The requirements of this article shall not relieve a person from complying with the above said state rules, as applicable. Should the requirements of this article conflict with said state rules, the stricter reclamation and restoration requirements shall govern. 5. All reclamation activities shall be initiated at the earliest possible date. Reclamation of the site concurrent with excavation activities is encouraged provided that the reclamation activities will not interfere with the excavating activity or if the excavating activity will damage the reclaimed areas. 6. All temporary structures shall be removed from the premises upon completion of the excavation activity unless said structures are of sound construction [and] are compatible with the reclamation goals. Said structures shall be accurately depicted upon the approved reclamation plan. 7. Whenever it is determined that reclamation of the excavation pit is required at the termination of the project in order to prevent soil erosion, adverse effects on county-maintained rights-of-way or natural drainage pattern, to protect the natural environment surrounding the excavation pit or to protect the character and value of surrounding property, the county council may require an acceptable performance bond, funds in escrow, or irrevocable letter of credit in the amount of 100 percent of the estimated cost of reclamation. Said cost shall be derived using the proposed plan of reclamation. Said bond or letter of credit shall be conditioned that the excavation and reclamation shall be in accordance with the approved plan. 8. No person may engage in the business of being an excavator until such person has secured an occupational license in accordance with the county occupational license requirements. 9. No excavator may excavate a parcel of land until he obtains an excavation permit issued by the growth management department in

17 Page 17 of 42 accordance with the terms of this article prior to any excavation being made on the property to be excavated. 10. The excavation shall not be used for the disposal of material generated off-site without prior approval from the county environmental management department and the Florida Department of Environmental Protection and without obtaining all appropriate federal, state and local permits. 11. The excavation shall comply with the tree protection requirements specified by division 10 of the Land Development Code [article III], and with the requirements of the county noise ordinance [Code section et seq.]. 12. If upon the conclusion of public hearings the special exception is approved, final site plan approval, as specified by division 3 of the Land Development Code [article III], is required. 13. Off-site discharge is prohibited. c. Any excavator shall be responsible for notifying Volusia County and the Florida Department of State, Bureau of Historical Resources when human remains and/or artifactual materials are discovered. The county reserves the right to monitor the excavation activity and to prohibit such activity if artifactual materials and/or human remains are encountered. d. All excavations shall use the most current best management practices (BMP) so as to control erosion and limit the amount of sediment reaching surface waters. The county reserves the right to monitor the excavation activity and prohibit said activity if it is determined that said activity is responsible for offpremises erosion.
