2 The Energy Savings Certificate (ESC) System: principles and operation : The 13st July 2005 law : lays out the principles for the ESC, designed to generate consumers energy savings. In order to reach these diffuse potential sources, legislation requires energy suppliers to achieve or encourage residential savings amongst their customers. Obliged parties have obligation targets. It deal with electricity, gas, domestic oil, heating and cooling systems suppliers.

5 An official catalogue lists 170 standardized operations" with predetermined saving targets. 6 Examples of predetermined saving targets : - the distribution of a low-energy light bulb earns an equivalent of 230 kwh, cumulated and discounted, called cumac ; - loft insulation is equivalent to 300 to kwh cumac per sq.m of installed insulation, depending on the region, type of housing, and energy used for heating ; - condensing boiler for a single-family household generates to kwh cumac based on the climatic zone and housing size ; - standardized value does not represent the savings generated by each operation alone, but the average baseline savings.

7 Creation of a trade market for ESC The system also provides opportunities for eligible parties to undertake actions and to sell them to the obliged parties. The eligible parties include large companies and local authorities, which may implement programmes in their own building or toward the third parties belonging to their territory. This procedure creates a free trade market between ESC buyers and sellers.

8 The First Period July 2006 July 2009 The objective is 54 TWh cumac ; divided in different types of energy. 10 obliged energy supplies account for 85 % of the overall obligation. The penalty is 2c per kwh missing at the end of the first period. It represents a global financial risk estimated at 1,08 billion.

10 Initial results On 1st January 2009, 36 TWh 66% of the objective have been delivered to 147 beneficiaries. 147 beneficiaries of ESC : 110 obliged parties, 37 eligible parties. It is estimated that targets will be reached because : ESC allocation have quickly accelerated since July 2008 ; the system has entered into its productive phase ; ESC are granted after completion of programmes.

15 CONCLUSION (1) A successful measure with a necessary delay more than 1,5 year needed to be fully operational. Targets will be reached and the impact of the measure will represent 0,5 % of the building overall consumption (0,2 % of national consumption). Most of the actions are focused on households because of the obliged strategy ; in addition, most of the delivered measures are also eligible for tax credits. The ESC trade market remains marginal as supplier have decided to undertake initiative on their own.

16 CONCLUSION (2) * Major changes on the way (still under discussion) : - The scheme will be renewed after the 30th June 2009 for a second period with expanded objectives and an overall streamlining of operation ; - for instance : - reduction of the number of suppliers(in the heating oil segment) thanks to the reduction of sales thresolds ; - extansion to transport sector ; - obligation level could be multiplicated by 3 to 12 ; - different eligibilty rules should be implemented. * Discussions and exchanges with the UK and Italy continue to be undertaken, to look at each-others specific rules, operations and results.
