1 Staff Presentation to WRTAC 8/22/ Local TMDLs in Loudoun County Update Prepared for Water Resources Technical Advisory Committee August 22, 2016 David Ward, Dept. of Building & Development Impaired Waters & TMDLs Section 303(d) of the Clean Water Act requires states to develop lists of waters. These are waters that are too polluted or otherwise degraded water quality standards set by states. The law requires the states to establish priority rankings for waters on the lists and develop TMDLs for these waters Clean Water Act (CWA) 1997 Water Quality ing Information and Restoration Act (WQMIRA) 4 Content Water Quality Circle 1. TMDL Fundamentals 2. TMDLs in Loudoun County 3. TMDL Priorities 4. TMDL Implementation Implement to meet waste load 2 5 What is a TMDL? A Total Maximum Daily Load is a calculation of the maximum amount of a pollutant that a waterbody can receive and still safely meet water quality standards. TMDL = Sum WLA + Sum LA + MOS Where: WLA = Waste Load Allocation (point source pollutant, e.g., discharge from a waste water treatment plant) LA = Load Allocation (non point source pollutant, e.g., runoff from pasture or road) MOS = margin of safety Water Quality in s & Reservoirs Benthic (Aquatic Life ) Bacteria (Recreational ) Water Chemistry Fish Tissue (PCB and Mercury affecting consumption of fish) Toxics (Drinking water) Data window is limited to past 6 years, therefore the 2014 assessment is based on data 3 6
2 Implement Staff Presentation to WRTAC 8/22/ Assess Waters for Support of Demonstrated By Aquatic Life Swimming/Recreation Biological evaluation (Benthic macroinvertebrates) Conventional Pollutants (Dissolved Oxygen, ph, Temp.) Nutrients and toxic Conventional Pollutant (Fecal Coliform Bacteria, E. coli) Fish Consumption Public Water Supply Wildlife Shellfish Consumption Advisories, limiting or restricting consumption (VDH); Exceeding state screening values for toxic pollutants found in fish tissue Closures or advisories by VDH; comparison of data to applicable public water supply standards Aquatic life toxics criteria in water column Restricted harvesting and marketing of shellfish by VDH States define s that are used to develop Water Quality Standards 7 10 Assess Waters for Category 1: Water fully supports all designated uses. Category 2: Water fully supports all designated uses data are available for, but there is insufficient or no information regarding the remaining designated uses. Category 3: There is insufficient information to determine if any designated uses are being met. Category 4: Waters are or threatened, but do not need a TMDL. Categories 4 & 5 are ed Category 5: Waters are and do need a TMDL Draft 9 12
3 Staff Presentation to WRTAC 8/22/ Impaired Waters Waste Load VA DEQ submits s 303(d) in the Integrated Report to EPA for approval every two years Webmap Typically calibrate watershed model using daily flow and monitoring data Additional impairments and Delisting GIS Download Simulate transport of fecal coliforms or sediment through the Over 2,500 pages, fact sheets, watershed under existing loads interactive map and GIS Estimate target reduced loads Informally referred to as dirty water necessary to achieve water quality standards by rerunning model Bacteria & Benthic Impaired Waters BENTHIC (2010) BACTERIA (2010) Virginia TMDLs VA DEQ reports on surface water monitoring every 2 years (Water Quality Assessment) and submits listed water to EPA EPA provides a 8 13 year time frame for the TMDL Report to be prepared State (DEQ) prepares TMDL Reports with EPA Approval followed by VA State Water Control Board Approval State (DCR) voluntarily prepares TMDL Implementation Plans and engages in implementation Nationwide there are over 43,000 TMDL s. In Virginia there are 281 approved TMDL s and ~60 TMDL Implementation Plans Current agreed upon pace is to prepare 50 TMDL s per year In Loudoun County there are 9 TMDL s and one has a TMDL Implementation Plan EPA approval can take a year or more and is required prior to release of GIS Bacteria & Benthic Impaired Waters BENTHIC (2014) BACTERIA (2014) EPA approval can take a year or more and is required prior to release of GIS 15 18

Coli Final report Fairfax, and Loudoun counties 9/26/2013 4/4/2014 Draft Recent Changes to Scheduled Implement Jeffries Branch (Benthic) was in the original priority list (July 2015). However, in April 2016, DEQ decided to remove it from the priority list. Broad Run is not a formal priority the list DEQ supplies to EPA includes both formal priorities (for which DEQ is required to develop TMDLs) and nonformal priorities. For non formal priorities such as Broad Run, DEQ would like to move forward with TMDL development during , but DEQ is not required to do the work. The first step for Broad Run would be a stressor analysis. Starts with an Implementation Plan (IP) Public participation through workgroups (agricultural, government and residential) Funding Originally through Department of Conservation and Recreation (DCR), VA Department of Health (VDH) Now through Dept Environmental Quality (DEQ). Loudoun has one IP completed and one in preparation for bacteria. Loudoun has not benthic Ips
