6 1 Introduction 1.1 Proposal identification Roads and Maritime Services (Roads and Maritime) is undertaking works to adjust, relocate and / or protect existing utility services and install new utilities infrastructure to facilitate the construction of the WestConnex M4 East project. These activities were addressed in the Utilities and Services Enabling Works Review of Environmental Factors (the original REF, RMS January 2016). The proposed adjustment, which is the subject of this addendum, is the application for extension of the use of the laydown area off Queen Lane, North Strathfield. The submission for the use of this laydown area was addressed in the REF Addendum Utility Works (addendum 1 REF, RMS 2016), determined 1 April This addendum 2 REF should be read in conjunction with the original REF, as well as the addendum 1 REF. The location of the laydown area is generally bounded by Queen Street, Sydney Street and Queen Lane in North Strathfield, and is shown in Figure 1. The laydown area is within the Canada Bay Local Government Area (LGA). 1.2 Purpose of the report The laydown area has been used to enable access to material and equipment for the utility works assessed and approved under the original REF. The purpose of this addendum 2 REF is to extend the timeframe for the use of the laydown area for five months (to early 2017), and document any likely impacts of the proposed change, and to detail any additional protective measures to be implemented. This addendum 2 REF has been prepared by CPB Samsung John Holland Joint Venture (CSJ) on behalf of Roads and Maritime. For the purposes of these works, Roads and Maritime is the proponent and the determining authority under Part 5 of the Environmental Planning and Assessment Act 1979 (EP&A Act). The description of the proposed change and associated environmental impacts have been undertaken in the context of clause 228 of the Environmental Planning and Assessment Regulation 2000, the Threatened Species Conservation Act 1995 (TSC Act), the Fisheries Management Act 1994 (FM Act), and the Australian Government s Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). In doing so, the addendum 2 REF helps to fulfil the requirements of section 111 of the EP&A Act, which provides that Roads and Maritime Services is to examine and take into account to the fullest extent possible, all matters affecting or likely to affect the environment by reason of the activity. The findings of the addendum 2 REF would be considered when assessing: Whether the proposed change is likely to result in a significant impact on the environment and therefore the necessity for an environmental impact statement to be prepared and approval to be sought from the Minister for Planning under Part 5.1 of the EP&A Act. The significance of any impact on threatened species as defined by the TSC Act and/or FM Act, in section 5A of the EP&A Act and therefore the requirement for a Species Impact Statement. 7 The significance of any impact on nationally listed biodiversity matters under the EPBC Act, including whether there is a real possibility that the activity may threaten long-term survival of these matters, and whether offsets are required and able to be secured. The potential for the proposed change to significantly impact any other matters of national environmental significance or Commonwealth land and therefore the need to make a referral to the Australian Government Department of the Environment for a decision by the Commonwealth Minister for the Environment on whether assessment and approval is required under the EPBC Act. 1.3 Background The addendum 1 REF was determined on 1 April 2016 to enable the utilisation of the laydown area. As described in the original REF, Roads and Maritime proposed to conduct adjustments to, relocation of and protection of existing utility services and installation of new utilities infrastructure to facilitate the WestConnex M4 East project. The service and utility works are essential preparatory works to enable the construction and operation of the M4 East project. Utility and Services Enabling Works 2

8 2 Description of the proposed change CPB Samsung John Holland JV, on behalf of Roads and Maritime, is conducting adjustments to, relocating, and protecting existing utility services and installation of new utilities infrastructure to enable the M4 East project. This section describes the proposed change - an extension for the use of the established laydown area between Queen Street and Sydney Street, North Strathfield. 2.1 The proposed change To facilitate the utility and services enabling works, a laydown area has been established off Queen Lane, North Strathfield. The laydown area enables access to material and equipment required for the utilities works assessed and approved under the original REF. Utility ID No AGTP2, AGTP3, WW060 and WW070 (see Table 1) are not complete. As the laydown area is central to these utility works, and there is limited space within the construction boundary, keeping the laydown area for approximately a further five months (to early 2017) would be beneficial to ensuring the utility works can be completed without encroaching on the already restricted space within the construction footprint for equipment to enable the completion of utility works. As the utility works are generally undertaken within the road reserve, which are generally narrow in this area, the use of the laydown area will minimise potential traffic and access impacts associated with the utility works. The land on which the laydown area is located is owned by Roads and Maritime and is an irregular shaped property, approximately 25 m in length and 20 m in width at the longest and widest spots, respectively. The area is generally bounded by Queen Street, Sydney Street and Queen Lane in North Strathfield, and a row of large mature trees adjacent to the residential house at 13A Queen Lane. Access to the site is via an established gate off of Queen Lane. The laydown area would be utilised for the materials to enable utility and services works, such as plastic conduits and frames, associated sundries for use in the conduit laying, a small container (approximately 6 m in length) to store hand tools and small power tools associated with running the conduits. A portable toilet is also included within the area. Temporary fencing is installed around the laydown area. All necessary signage advising the general public of access restrictions has been provided. Use of the laydown area is primarily limited to standard daytime construction hours as follows: Monday to Friday: 7am to 6pm Saturday: 8am to 1pm Sunday and public holidays: No work. However, it is noted that some works may require night works, and therefore access to the site may be required. Access to the laydown area would primarily be at the beginning (approximately 8-9pm) and the end (approximately 6am) of the night shift. A noise assessment prepared for night-time access indicated that impacts would exceed the noise management level (NML) at the nearest receiver. Access to the site would be limited to three consecutive evenings or nights in a calendar week and not Utility and Services Enabling Works 3

9 more than four evenings or nights in a calendar week. Validation monitoring would be undertaken during representative works to confirm the predicted impacts. Upon completion of works, the laydown area would be demobilised, all rubbish and materials would be removed from site and the area would be rehabilitated to a state consistent with its current land use. No tree removal would be required as part of the proposed change. Utility and Services Enabling Works 4

12 3 Statutory and planning framework 3.1 Environmental Planning and Assessment Act 1979 Environmental assessment of the proposal is undertaken under Part 5 of the Environmental Planning and Assessment Act 1979 (EP&A Act). All matters affecting or likely to affect the environment as a result of the proposal are considered in this REF. 3.2 State Environmental Planning Policies State Environmental Planning Policy (Infrastructure) 2007 State Environmental Planning Policy (Infrastructure) 2007 (ISEPP) aims to facilitate the effective delivery of infrastructure across the State. Clause 94 of ISEPP permits development on any land for the purpose of a road or road infrastructure facilities to be carried out by or on behalf of a public authority without consent. As the proposed change is for a road or road infrastructure facility and is to be carried out on behalf of Roads and Maritime Services, it can be assessed under Part 5 of the Environmental Planning and Assessment Act Development consent from council is not required. The proposed change is not located on land reserved under the National Parks and Wildlife Act 1974 and does not affect land or development regulated by State Environmental Planning Policy No Coastal Wetlands, State Environmental Planning Policy No Littoral Rainforests, or State Environmental Planning Policy (Major Development) Part 2 of the ISEPP contains provisions for public authorities to consult with local councils and other public authorities prior to the commencement of certain types of development. No additional consultation would be required as a result of the proposed change State Environmental Planning Policy (State and Regional Development) 2011 State Environmental Planning Policy (State and Regional Development) 2011 (SRD SEPP) aims to identify development that is State significant infrastructure and critical State significant infrastructure. The WestConnex M4 East project has been declared critical State significant infrastructure (critical SSI) by Schedule 5, Clause 4(3) of the SRD SEPP. Clause 4(7) of the same Schedule excludes specific activities from the definition of development. In this clause: development does not include the following: (a) (b) surveys, test drilling, test excavations, geotechnical investigations or other tests, surveys, sampling or investigation for the purposes of the design or assessment of a project, in the case of the M4 East project, - any of the following undertaken prior to the commencement of the construction of the new multi-lane road: Utility and Services Enabling Works 7

13 (i) (ii) adjustments to, or relocation of, existing utilities infrastructure and installation of new utilities infrastructure, the establishment of construction compounds including the erection of temporary buildings and the provision of associated facilities including access roads and car parks. Consequently, works associated with the original REF were able to be commenced prior to the approval of the M4 East project, as it is specifically excluded from the description of the development in the SRD SEPP. The proposed change supports the works commenced under the original REF. 3.3 Local Environmental Plans The proposed works are located within Canada Bay LGA. Development on the proposed area would be subject to the Canada Bay Local Environmental Plan However, as identified in Section 3.2.1, consent from council is not required in accordance with ISEPP. 14 4 Environmental assessment This section of the addendum 2 REF provides a description of the potential environmental impacts associated with the proposed change. The existing environment is generally consistent with the existing environment described in the original REF. The proposed laydown area is located between Queen Street and Sydney Street, North Strathfield. Aspects of the environment potentially impacted upon by the proposed change are considered. This includes consideration of the factors specified in the guidelines Roads and Related Facilities (DUAP) and Is an EIS required? (DUAP 1999) as required under clause 228(1) of the Environmental Planning and Assessment Regulation The factors specified in clause 228(2) of the Environmental Planning and Assessment Regulation 2000 are also considered in Appendix A. Any additional site-specific mitigation and management measures are identified to minimise potential impacts. These management measures would be undertaken in combination with those identified in the original REF (Table 29). 4.1 Applicable environmental factors Table 2 Identification of relevant environmental factors Environmental factors Traffic and parking Noise and vibration Comments Access to the proposed laydown area is from Queen Street, a one way street running south to meet up with Sydney Street. Use of the laydown area would result in the short term increase in construction vehicle traffic to/from the proposed laydown area. Light vehicles are expected to enter the site, load up with materials and exit the site. Use of the site would primarily be at the commencement and completion of each shift. Transport noise is generally the primary contributor to background noise levels, largely due to the presence of the M4 Motorway and the Main North Line. A Construction Noise and Vibration Impact Statement has been prepared for the original REF, which identifies recommended management measures for the approved utilities works. Use of the proposed laydown area would generate some additional noise impacts that may affect nearby sensitive receivers. Noise would be associated with the arrival / departure of vehicles and loading / unloading of materials and tools. The useable area of the proposed site is at least 15 m from the edge of the nearest residential receiver, which is separated by some mature tree screening. Access to the laydown area would generally be during standard daytime construction hours. If access to the laydown area is required during night works, would be limited to the beginning and the end of the shift where practicable. Additional management measures Management measures identified in the original REF are considered sufficient to manage potential traffic and parking impacts. Space permitting, the site would be arranged to use the shipping container as shielding or to locate material as far from residential receivers as possible. Access to the site would be limited to three consecutive evenings or nights in a calendar week and a total of four evenings or nights in a calendar week. Validation monitoring would be undertaken to confirm impacts predicted in the noise assessment for the works. Utility and Services Enabling Works 9

15 Environmental factors Flora and fauna Soils, water and contamination Non-Aboriginal heritage Aboriginal heritage Air quality Waste Comments Vegetation in the area is not mapped within the OEH (2013) vegetation mapping, nor within the mapping prepared for the M4 East project (refer Annexure B). No threatened ecological communities (TECs) or endangered ecological communities (EECs) listed under the TSC Act are mapped within the proposed laydown area. The M4 East environmental impact statement (EIS) identified that no threatened flora species native to the area were recorded or considered likely to occur within the M4 East project footprint or its surrounds. No vegetation removal is expected for use of the proposed laydown area. Minor branch trimming / pruning may be required to enable vehicle access. Laydown of materials / storage container would be on top of planted grasses. No excavation works would be required for use of the proposed laydown area. Further, the area is located within an area with a low risk of contamination. The works are unlikely to impact on surface water, soils or contamination. The proposed laydown is located across from the Powells Estate Heritage Conservation Area (HCA). Use of the proposed laydown area may result in the short term impact on visual amenity from the edge of the HCA, particularly 39 Sydney Street, which faces the proposed laydown area. Some vegetation screening is located within the property s boundary and within the proposed laydown area. A Stage 2 PACHCI Aboriginal heritage assessment was undertaken for the potential M4 East project, which found that the project would not impact on any known Aboriginal objects or places. Due to the disturbed nature of the site and the distance to known and potential Aboriginal heritage objects or places identified in the M4 East assessment (included in the M4 East EIS (AECOM GHD 2015), no impact on Aboriginal heritage is expected to occur as a result of the works. The use of the proposed laydown area is not expected to improve or worsen the potential impacts to air quality identified in the original REF. Use of the proposed laydown area would not result in any additional generation of wastes above and beyond what was identified in the original REF. Additional management measures Management measures identified in the original REF are considered sufficient to manage potential flora and fauna impacts. Management measures identified in the original REF are considered sufficient to manage potential soils, water and contamination impacts. Management measures identified in the original REF are considered sufficient to manage potential non-aboriginal heritage impacts. There would be no impact on long-term flooding and drainage patterns as the laydown site would be reinstated to a pre-construction condition at the completion of the works. The use of the laydown area is not expected to improve or worsen the socio-economic impacts identified in the original REF. No property acquisition is required for the laydown area. The area is owned by Roads and Maritime and is fenced off as road reserve. Use of the laydown area would be short-term with no permanent changes to land use. Visual impacts associated with HCA are described above. The area is currently open space, fenced road reserve. Use of the laydown area would result in short-term impacts on visual amenity for nearby residents and passing traffic. Impacts on visual amenity are considered to be relatively minor and of short term duration. The use of the laydown area is unlikely to improve or worsen the greenhouse gas emissions described in the original REF. The potential impacts of climate change on the proposed laydown area are expected to be negligible. The use of the laydown area is unlikely to improve or worsen the hazards and risks associated with the works assessed in the original REF. The use of the laydown area is unlikely to improve or worsen the potential for minor cumulative impacts associated with nearby construction and development projects that were addressed in the original REF. Additional management measures Management measures identified in the original REF are considered sufficient to manage potential flooding and drainage impacts. Management measures identified in the original REF are considered sufficient to manage potential socio-economic impacts. N/A The proposed area would be surrounded with temporary fencing. Management measures identified in the original REF are considered sufficient to manage potential cumulative amenity impacts. 4.2 Summary of beneficial and adverse effects The key beneficial outcome to the extension of the use of the laydown area is: Reduced long vehicle trips to collect necessary materials and tools for utility and services enabling works. 17 As there is restricted space in road reserves, allowing a laydown area for the utilities works will reduce over-crowding of construction equipment within the road reserves (usually of narrow local streets). The laydown area is central to the utilities to be completed. The land is RMS owned. The key potential adverse impact of the proposal is: Amenity impacts on nearby residents, particularly noise, visual and traffic impacts. With the implementation of the safeguards provided in this document and the original REF, these impacts are expected to be relatively minor. Furthermore, the above impacts are temporary in nature. 18 5 Environmental management Two additional environmental safeguards have been identified in this assessment undertaken in Section 4. These environmental safeguards would be implemented in addition to those environmental safeguards identified in the original REF (Table 29). Combined, the safeguards would be sufficient to minimise any potential adverse impacts arising from the approved works and proposed change. 19 6 Justification and conclusion The Utility and Services Enabling Works Review of Environmental Factors was determined on 25 January 2016 under Part 5 of the EP&A Act. During detailed design, it was identified that a designated laydown area for utility works would be beneficial for materials and tools to be used specifically for the utility works. An REF Addendum Utility Works for the setup and use of the laydown was determined on 1 April An extension for the use of this laydown area is required to enable completion of utility works and is the subject of this addendum 2 REF. The proposed change facilitates the activities approved in the original REF and would result in short term impacts to the amenity of nearby residents including minimal noise, visual and traffic impacts. The proposed changes are generally consistent with the objects of the EP&A Act as described in the original REF. This addendum 2 to the REF has examined and taken into account to the fullest extent possible all matters affecting or likely to affect the environment as a result of the proposed change. This has included consideration of impacts on threatened species, populations and ecological communities and their habitats and other protected fauna and native plants. The safeguards and management measures as detailed in this addendum 2 REF and the original REF would ameliorate or minimise these expected impacts. The environmental impacts of the proposed change are not likely to be significant and therefore it is not necessary for an environmental impact statement to be prepared and approval to be sought for the proposal from the Minister for Planning under Part 5.1 of the EP&A Act. The proposed change is unlikely to affect threatened species, populations or ecological communities or their habitats, within the meaning of the Threatened Species Conservation Act 1995 or Fisheries Management Act 1994 and therefore a Species Impact Statement is not required. The proposed change is also unlikely to affect Commonwealth land or have an impact on any matters of national environmental significance. Utility and Services Enabling Works 14

20 7 Certification This review of environmental factors provides a true and fair review of the proposal in relation to its potential effects on the environment. It addresses to the fullest extent possible all matters affecting or likely to affect the environment as a result of the proposal. 24 Clause 228(2) Checklist In addition to the requirements of the Is an EIS required? guideline as detailed in the REF, the following factors, listed in clause 228(2) of the Environmental Planning and Assessment Regulation 2000, have also been considered to assess the likely impacts of the proposal on the natural and built environment.
