2 Statistics on import and export of waste (covering also transboundary movements of waste within the EU) Background Regulation (EC) No 2150/2002 on waste statistics 1 contains a provision on statistics on Import and export of waste (Article 5(1)) for which no data are collected under the Regulation (EC) No 1013/2006 on shipments of waste 2. In accordance with Article 5 of Regulation (EC) No 2150/2002, the Commission has drawn up a pilot study programme on import and export of waste. The results of these studies carried out in Member States generally confirmed the necessity for these statistics for the purposes of monitoring Community waste policy [see Report to the European Parliament and to the Council of , COM(2008)501 3 ]. As the current provisions of Regulation (EC) No 2150/2002 do not describe the requirements for statistics on shipment of waste in sufficient detail, the Commission has proposed specifications for these statistics by way of a formal amendment of the Annex I of the above Regulation. To limit the reporting burden for Member States it was proposed to use as far as possible foreign trade statistics as common data source. Current situation On 12 February 2009 the Statistical Programme Committee (SPC) was invited to take note of a draft for a Commission Regulation amending Regulation (EC) No 2150/2002 [see in Annex doc. CPS 2009/69/3]. Despite extensive discussion of the proposal at the Working Group level, some countries expressed severe objections against new reporting burdens and questioned the need for this type of statistics. Furthermore, one Member State expressed its view that the quality of foreign trade statistics was insufficient to improve data on waste statistics. Since waste had a low economic value, most of the waste trade would not be covered and in the end would have to be estimated. Furthermore, the extent of data collection was not clarified. The delegate instead suggested including the reporting obligations on the shipment of 'green-listed' waste under the Regulation on shipments of waste. Justification for statistics on import and export of waste Regular Community statistics on waste are necessary to monitor the implementation of waste policy, in particular, compliance with the principles of maximisation of recovery and safe disposal. This implies that at Community level knowledge on the link between the amounts of waste generated and the amounts of waste recovered and disposed of has to be enhanced

3 For several reasons the current structure of Regulation (EC) No 2150/2002 on waste statistics does not allow following waste streams from the generating process to the recovery and disposal operation, inter-alia because of international trade of waste. Member States that do not have recycling capacity for a certain type of waste will not be able to monitor achievements on recycling of this waste generated in their country unless it is known how much of this waste is exported for recycling. Member States that import large quantities of certain types of waste would no longer be able to monitor progress of management of the waste generated in their own country, unless they know how much waste is imported. In addition, the Environment Council of 2 March 2009 has called upon the Commission to closely monitor developments on the recycling markets. In order to do so information on transboundary movements of waste for recycling is necessary for such monitoring. Furthermore, the management of natural resources as set out in the 'Thematic Strategy on the sustainable use of natural resources' [COM(2005) 670 final] 4 requires sufficient knowledge about material flows. It is important to know in this context how much valuable secondary materials such as metals, paper, plastics, glass etc. are exported. In its 'Recommendation of the Council on resource productivity' [C(2008)40] 5 the OECD has requested its Member Countries to [ ] 'Upgrade the extent and quality of [ ] data on physical trade flows, including flows of recyclable materials and waste' Following this OECD recommendation 19 EU Member States will have to report on waste and recyclable materials anyway. The way forward Eurostat suggests submitting the proposal to the ESS-Committee for its meeting in autumn 2009 without specific reference to Foreign Trade Statistics (and in this way to fully respect Article 3 of Regulation (EC) No 2150/2002 on waste statistics on the freedom of method for collection of data). The DIMESA is asked to give its opinion on the proposal for regular statistics on import and export of waste (including transboundary movements of waste within the EU) considering the following questions: 1) Shall the current proposal be submitted to the ESS without reference to Foreign Trade Statistics? 2) What changes could be made to limit the reporting burden? 3) Can reasonable cost estimates be provided for the anticipated additional administrative burden in order to assess whether costs will be disproportionately high for Member States? 4) Other proposals?

5 EXECUTIVE SUMMARY 1. Recommendation for action by the SPC The SPC is invited to take note of the attached draft for a Commission Regulation amending Regulation (EC) No 2150/2002 of the European Parliament and of the Council of 25 November 2002 on waste statistics. This draft will be submitted to the SPC for vote (comitology procedure) by written procedure after the entry into force of the Regulation of the European Parliament and of the Council amending Regulation (EC) No 2150/2002 on waste statistics, as regards the implementing powers conferred on the Commission. 2. Background and brief history of the proposal Regulation (EC) No 2150/2002 contains a provision on statistics on Import and export of waste (Article 5(1)) for which no data are collected under the Regulation (EC) No 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste. In accordance with Article 5 of Regulation (EC) No 2150/2002, the Commission has drawn up a pilot study programme on import and export of waste 6. The results of these studies carried out in Member States confirm the need for these statistics for the purposes of monitoring Community waste policy. The current provisions of Regulation (EC) No 2150/2002 do not describe the requirements for statistics on import and export of waste in sufficient detail, the Commission therefore proposes specifications for these statistics by way of a formal amendment of the Annex I of the above Regulation. The proposal was discussed extensively within the Working Group on waste statistics. Comments made by Member States following a written consultation in October 2007 on the draft Regulation were included in this draft proposal. The Interservice Consultation was completed on 20 November 2008 and the comments were taken into account as far as possible. 3. Policy context Regular Community statistics on waste are necessary to monitor the implementation of waste policy, in particular, compliance with the principles of maximisation of recovery and safe disposal. This implies that at Community level knowledge on the link between the amounts of waste generated and the amounts of waste recovered and disposed of has to be enhanced. For several reasons the current structure of Regulation (EC) No 2150/2002 does not allow following waste streams from the generating process to the recovery and disposal operation, inter alia because of physical and chemical changes through waste treatment processes and international trade of waste. Member States that do not have recycling capacity for a certain type of waste will not be able to monitor achievements on recycling of this waste generated in their country unless it is known how much of this waste is exported for recycling. Member States that import large quantities of certain types of waste would no longer be able to monitor progress of management of the waste generated in their own country, unless they know how much waste is imported. 6 COM(2008) 501 of

6 The need for statistics on imports and exports of waste not covered by other reporting obligations was underlined by the results of a pilot study programme. The studies therefore focused on how to compile these statistics and proposed, despite certain restrictions and limitations, foreign trade statistics as the most suitable data source to start the compilation of statistics on import and export of waste. 4. Consequences of the proposal for Member States, including financial implications In order to reduce the reporting burden of Member States the Commission will, as far as possible, provide Member States with data based on foreign trade statistics compiled in accordance with Regulation (EC) No 638/ of the European Parliament and of the Council and with Council Regulation (EC) No 1172/95 8. Member States will have to approve or to revise the data. First data on imports and export of waste based on foreign trade statistics have been sent out to Member States for comments on a voluntary basis, with positive results. 5. Outstanding problems The draft Commission Regulation proposes, without prejudice to Article 3 (1) of Regulation (EC) No 2150/2002, to use foreign trade statistics as basis for statistics on imports and exports of waste. The general advantage of using available statistics based on common parameters and a harmonised nomenclature used by all Member States is compromised, however, by the fact that different thresholds, expressed in monetary value, are applied by Member States to reduce the administrative burden on businesses. This means that data are not fully comparable and may lead to the amounts of waste traded being underestimated. In addition, the respective nomenclatures for foreign trade statistics (Combined Nomenclature CN) and waste (European Waste Classification for Statistics EWC- Stat) are not comparable for all waste streams. As a commodity-orientated classification, the Combined Nomenclature does not provide a uniform definition of waste materials. Some Combined Nomenclature codes clearly distinguish waste from products; others combine waste and scrap with other products. Therefore, the use of foreign trade statistics has to be improved by action taken both at Community and at Member States level: - at Community level: a limited number of new codes need to be introduced into the Combined Nomenclature to make a clearer distinction between waste and products and to expand the applicability of foreign trade statistics to waste statistics; - at Member States level: the impact of confidentiality and national reporting thresholds for foreign trade statistics on imports and exports of waste has to be estimated. 6. Risk assessment The draft Commission Regulation needs to be approved soon in order to allow Eurostat and the Member States to prepare for the data delivery in Failure to adopt this draft Commission Regulation would mean that it will be hardly possible for 7 OJ L 102, , p OJ L 118, , p. 10 6

7 the Community to establish waste statistics including the effects of imports and exports of waste. This would seriously hamper the monitoring of Community waste policy. 7. Next challenges/steps This draft will be submitted to the SPC for vote (comitology procedure) by written procedure after the entry into force of the Regulation of the European Parliament and of the Council amending Regulation (EC) No 2150/2002 on waste statistics, as regards the implementing powers conferred on the Commission. In the light of the opinion of the SPC, Eurostat will forward the text to the Commission for formal adoption. 7

8 Draft COMMISSION REGULATION (EC) No /.. of [ ] amending Regulation (EC) No 2150/2002 of the European Parliament and of the Council on waste statistics (Text with EEA relevance) THE COMMISSION OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Community, Having regard to Regulation (EC) No 2150/2002 of the European Parliament and of the Council of 25 November 2002 on waste statistics 9, and in particular Article 5(4) thereof, Whereas: (1) As required by Article 5 of Regulation (EC) No 2150/2002 the Commission has drawn up a programme for pilot study on import and export of waste for which no data is collected under Council Regulation (EC) No 1013/2006 of 14 June 2006 on shipments of waste 10. (2) The Commission has informed the European Parliament and the Council of the results and recommendations of the pilot studies and outlined the possibilities of compiling statistics on import and export of waste. (3) The results of the pilot studies have confirmed the need for the new data on the import and export of waste for the purposes of monitoring Community waste policy. (4) The first reference year for new data on the import and export of waste should be established. (5) Without prejudice to Article 3 (1), with the aim of increasing the comparability of statistics on imports and exports of waste, the Commission will, as far as possible, provide Member States with data based on foreign trade statistics compiled in accordance with Council Regulation (EC) No 1172/95 11 and Regulation (EC) No 638/2004 of the European Parliament and of the Council 12 in order to allow Member States to confirm or revise these data. 9 (7) The measures provided for in this Regulation are in accordance with the opinion of the Statistical Programme Committee established by Council Decision 89/382/EEC, Euratom 13, HAS ADOPTED THIS REGULATION: Article 1 The Annex I to Regulation (EC) 2150/2002 is replaced by the text set out in the Annex to this Regulation. Article 2 This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union. 10 ANNEX "ANNEX I GENERATION OF WASTE. IMPORT AND EXPORT OF WASTE SECTION 1 Coverage 1. The statistics shall be compiled for all activities classified within the coverage of Sections A to U of NACE Rev. 2. These Sections cover all economic activities. This Annex also covers: (a) waste generated by households; (b) waste arising from recovery and/or disposal operations; (c) waste imported and waste exported for which no data is collected under Council Regulation (EC) No 1013/2006. Characteristics for the waste categories: 1.1 For each waste category listed in Section 2(1), the quantity of waste generated shall be compiled. 1.2 For each waste category listed in Section 2(1), the quantity of waste imported and the quantity of waste exported shall be compiled, taking into account Section 1(1) (c) on the coverage. 2. Regional characteristics: Population or dwellings served by a collection scheme for mixed household and similar waste (NUTS 2 level). 11

12 SECTION 4 Reporting unit 1. The reporting unit to be used for all waste categories is tonnes of (normal) wet waste. For the waste categories sludge an additional figure for dry matter should be provided. 2. The reporting unit for regional characteristics should be the percentage of the population or dwellings. SECTION 5 First reference year and periodicity 1. The first reference year is the second calendar year following the entry into force of this Regulation. 2. The first reference year for statistics on import and export of waste is Member States shall furnish data for every second year after the first reference year. SECTION 6 Transmission of results to Eurostat The results shall be transmitted within 18 months of the end of the reference year. SECTION 7 Report on the coverage and quality of statistics 1. For each item listed in Section 8 (activities and households), Member States will indicate the percentage to which the compiled statistics represent the universe of waste of the respective item. The minimum requirement for the coverage will be defined by the Commission. These measures, designed to amend non-essential elements of this Regulation, by supplementing it, will be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 7(3). 2. Member States will submit a quality report, indicating the degree of precision for the collected data. A description will be given on the estimations, aggregations or exclusions, and the way these procedures affect the distribution of waste categories, listed in Section 2(1) by economic activities and households, as referred to in Section The Commission will include the coverage and quality reports in the report provided for in Article 8 of this Regulation. For economic activities, statistical units are local units or kind-of-activity units, as defined in Council Regulation (EEC) No 696/93 14, according to each Member State's statistical system. In the quality report, to be produced under Section 7, a description of how the chosen statistical unit affects the groupings of NACE Rev. 2 data distribution should be included. 3.
