8 For Member States Art. 103f of Reg. 1234/2007 NEFs Legal Requirements (I) 1. MSs (with recognised POs) must establish a NEF (to be integrated in the National Strategy for sustainable operational programmes) 2. MSs must submit their proposed NEF to the Commission Art. 58(1) of Reg. 1580/ MSs must also notify the Commission of any amendments to the NEF The Commission may require modifications within three months if it finds that the proposal does not enable the attainment of the objectives set out in Art. 174 of the Treaty and in the 6th EAP. 9 NEFs Legal requirements (II) Regarding the content of the NEF Art. 103f of Reg. 1234/ The NEF must provide that: environmental actions meet the appropriate requirements of Reg. 1698/2007 Art. 58 of Reg. 1580/ The NEF must set out: a non-exhaustive list of environmental actions and the conditions therefore applicable in the MS 3. For each environmental actions, the NEF must indicate: a) The specific commitment or commitments entailed b) The justification of the action based on its expected environmental impact in relation to environmental needs and priorities. 10 NEFs Legal requirements (III) Regarding the definition of environmental needs and priorities Art. 103f(2) of Reg. 1234/ The National Strategy for sustainable operational programmes must provide (inter alia) for: an analysis of the situation (in terms of strenghts and weaknesses and potentials for development) justification of the priorities chosen Art. 57(3) of Reg. 1580/ The analysis of the initial situation must identify and assess: the needs to be met, the ranking of the needs in terms of priorities, the goals to be achieved through the operational programmes to meet those priority needs. The type of actions defined must serve one or more well-defined priority needs identified in the National Strategy. The justification of the action must be clearly indicated 2. The commitments entailed by the actions must go beyond the baseline The commitments must be clearly described Effective implementation of the commitments must be verifiable 3. 23 NEFs State of play (May 2009) Main types of actions: a summary The environmental actions included in the National Frameworks belong to three general categories: Investments Agri-environment commitments Commitments in support to environmental actions Special provisions apply to certain types of actions: Investment aimed at water saving, energy saving and/or reduction of emissions into air, water or soil Commitments that are similar to agri-environmental measures included under the Rural Development Programme Training/Advice/Technical assistance in support to environmental actions Fruit and vegetable sector - National Frameworks for environmental actions State of play (May 2009) 23

24 NEFs State of play (May 2009) Investments aimed at water saving, energy saving and/or reduction of emissions into soil, water and air Special provisions: For eligibility for support the investment must allow a reduction of at least 25% in water consumption, energy consumption or emissions of pollutants compared to the system to be converted or updated, as attested by a person or body accredited for that purpose (i.e. ex-ante control of the eligibility condition, based on the technical specifications of the project). Investments that are expected to result in a lower (but at least 10%) reduction can be supported, when the investment is attested to provide additional environmental benefits (e.g. reduction in the application of fertilisers, in energy consumption, use of renewable sources of energy, reduction in emissions of air pollutants). 25 NEFs State of play (May 2009) Agri-environmental commitments similar to agri-environmental measures included under the Rural Development Programme Special provisions where the duration is critical for the attainment of the expected environmental benefits, the duration of the environmental action will be the same as it applies to the similar agri-environmental measure concerned. Where the duration of the operational programme is shorter (2 or 3 years) than the duration referred to above, the PO must continue the environmental action concerned in its subsequent operational programme, if this is necessary for attaining the duration applying for similar agri-environmental measures under the Rural Development Programmes, except for duly justified reasons, and in particular based on the results of the mid-term evaluation of the operational programme (as provided for in Article 127(3) of Commission Regulation (EC) No 1580/2007). 26 NEFs State of play (May 2009) Training, advice and technical assistance in support to environmental actions Special provisions For eligibility for support: 1. The training/advisory/assistance is intended to complement at least one of the environmental actions included in the National Framework, which must therefore be included in the operational programme of the PO. The actions concerned must be specified in the operational programme of the PO. 2. The (training/advisory/assistance) activity must be entrusted to additional (internal or external) qualified personnel. 3. The operational program must clearly indicate the specific tasks that the additional qualified personnel is required to perform. 4. The PO must maintain records concerning their members and/or employees who participated in the training/advisory/assistance action.
