Draft SGMA Groundwater Sustainability Plan (GSP) Regulation Concepts A Primer on Initial GSP Regulation concepts and actions January 13, 2016 SCGA Board Hearing 1

Presentation Objectives Introduction to Draft GSP Regulations Highlight GSA Coordination Concepts Discuss Alternative Plan Language 2

Purpose of GSP Regulations By June 1, 2016, State Department of Water Resources (DWR) shall adopt regulations for: Evaluating GSPs Implementation of GSPs Coordination Agreements 3

Approximate Schedule December Informal Outreach Efforts January Follow-up Meetings Drafting (Legal) of GSP Regulations Public Draft Review Period\Intensive Outreach Collect and Respond to Public Comments California Water Commission Hearings Adoption and Digest (Plain Language) 4 Dec Jan Feb Mar Apr May Jun

GSP Regulation Content The regulations shall identify: Required Plan Components ( ) 1. Basin Setting, Water Budgets, Conceptual Models 2. Measurable Objectives Addressing Undesirable Results Additional Plan Elements ( ) Coordination Control Monitoring of Saline Plan Water of Multiple GSPs in Basin ( Wellhead Land Use Protection Agency Coordination ) Migration of contaminated GW 4. Well Abandonment, Well Destruction 5. Other Replenishment information of GW Extractions that will assist local agencies in developing and implementing 7. Well Construction Policies GSPs and coordination agreements 6. Activities Implementing or Removing Impediments for CU or Aquifer Storage Projects 8. GW Cleanup, recharge, diversions to Storage, conservation, water recycling, and extrac 9. Efficient water management practices for delivery of water and water conservation 5 me 1. Projects 3. Plan Review and Revisions 10.Develop relationships with state and federal agencies 2. Reporting 4. Alternative Plans 11.Assess land use activities which create risks to GW quality or quantity by review and c 12.Impacts on GW Dependent Ecosystems

Be Prepared Developing a GSP is going to require significant time and a high level of commitment from: Agency staff and their consultants In-basin groundwater users (or chosen representatives) Interested in-basin parties State DWR staff (support and review) 6

Agency Coordination Concepts Draft GSP Regulations - Presentation Concepts 7

Governance GSA Formation Local public agency is defined as an agency (including a JPA) that has water supply, water management, or land use responsibilities within a groundwater basin GSA 1 Local Agency GSA 3 Basin 1 GSA 2 Entire basin must be covered by a GSA(s) by June 30,

Two Types of Basin Coordination Intra-Basin Inter-Basin 9

Intra Basin Coordination A Single Intra-Basin Coordination Agreement is required if there are multiple GSA s in basin GSA 1 Basin 1 Single Intra-Basin Coordination Agreement GSA 3 GSA 2 Not required for Single GSA basin Single GSA 10

Number of Intra-Basin GSP(s) Multiple GSPs or Single GSP Multiple GSPs within a single basin require a whole basin summary document to report single: Sustainability Goal Sustainable Yield Annual Reporting Etc. GSA 1 Local GSP 1 Basin 1 Agency GSA 3 GSA-1 GSA-2 GSA-3 GSA-1 GSA-2 GSA-3 Single GSP GSP 3 GSP GSA 2 GSP 2 GSP-1 GSP-2 GSP-3 Whole Basin Document 11

Intra-Basin Data Sharing Multiple GSPs within a Single Basin Shall Coordinate and Use the Same Data and Methodologies ( ) including: Agreement on hydrologic and hydrogeologic data and assumptions Identification of data gaps Reconciliation of numerical differences Sharing 12

Inter Basin Coordination DWR shall evaluate if one GSP adversely affects an adjacent basin s GSP ( (c)) Inter-Basin Coordination Agreement(s) describe: Interaction between basins How to reconcile boundary data (and modeling) differences How conflicts will be identified and resolved GSA 1 Basin 1 GSP Basin 1 GSA 3 Basin 2 GSP GSA 2 13

Alternative Plan Concepts Draft GSP Regulations - Presentation Concepts 14

SCGA GMP may Qualify for Alternative Plan Submittal GSP Covers Entire Basin Submitted by GSA(s) Annual Reporting 5 Year Evaluation Submitted to DWR by 1/31/2020 (Critical Overdrafted) 1/31/2022 (all other High/Medium Priority) Alternative Plan Covers Entire Basin Submitted by Local Agency or GSA Eligibility: 1. Existing GMP, or 2. Basin Operated within Sustainable Yield for 10 years CASGEM Compliant Annual & 5 Year Reporting Submitted to DWR by 1/1/

Alternative Plan Submittal Pros and Cons Pros: Recognition of past efforts, costs, and higher standards of achieving consensus in an interest-based public process in both: Water Forum Central Groundwater Forum Establishes the Water Forum s and SCGA s successful groundwater management efforts over the past 10+ years Governance structure and existing stakeholder representation does not change More efficient use of staff and resources 16

Alternative Plan Submittal Pros and Cons Cons: Preparation of scientific and legal support of past management and sustainability of groundwater basin May require SCGA to file as a competing GSA to pause intra-basin GSA formations Defining entire Basin GSAs 17

sin South American Subbasin SCGA s Existing Portion within S. American Subbasin Cosumnes Subbasin North Delta Water Agency 18 For Illustrative Purposes Only

DWR Consultation Consult with DWR regarding the feasibility of an Alternative Plan approach to SGMA compliance If Alternative Plan moves forward, Pause intra-basin GSA formations which put an Alternative Plan at risk Pursue a Boundary Modification with Support from Delta interests 19
