Department of Health and Environmental Control by Mr. Bryan Stone /o James Seay Lokhart Power Company P.O. Box 1, 42 River Street Lokhart, South Carolina for a permit to perform routine stabilization maintenane on the anal embankment in the Lokhart Hydro Canal loated east of the town of Lokhart between Lokhart Reservoir and the Broad River in Union County, South Carolina (Latitude: N, Longitude: W), Lokhart Quadrangle. n order to give all interested parties an opportunity to express their views N O T C E is hereby given that written statements regarding the proposed work will be reeived by the Corps until 15 Days from the Date of this Notie, and SCDHEC will reeive written statements regarding the proposed work until 3 Days from the Date of this Notie from those interested in the ativity and whose interests may be affeted by the proposed work. The proposed work onsists of maintenane and replaement of existing riprap along the banks of the Lokhart Hydro Canal. The appliant is requesting a 1 year permit for these ativities. n detail the appliant is proposing to stabilize the banks of the Lokhart Hydro Canal by plaing up to 25, ubi yards of riprap below the ordinary high water mark during times of drawdown as needed over the next ten years. The total area overs 13,24 linear feet of the

The appliant has requested the maximum amount of riprap needed to stabilize the entire anal, though they intend to utilize the permit only as neessary to stabilize where needed during the next 1 years. The appliant has typially added less than 1% of the total ubi yards requested during eah stabilization effort. The appliant has not proposed any ompensatory mitigation for impats assoiated with this projet. The projet purpose is to stabilize the Lokhart Hydro Canal during times of drawdown over the next 1 years, as needed. NOTE: This publi notie and assoiated plans are available on the Corps website at: The Distrit Engineer has onluded that the disharges assoiated with this projet, both diret and indiret, should be reviewed by the South Carolina Department of Health and Environmental Control in aordane with provisions of Setion 41 of the Clean Water At. As suh, this notie onstitutes a request, on behalf of the appliant, for ertifiation that this projet will omply with appliable effluent limitations and water quality standards. The work shown on this appliation must also be ertified as onsistent with appliable provisions of the Coastal Zone Management Program (15 CFR 93). This ativity may also require evaluation for ompliane with the S. C. Constrution in Navigable Waters Permit Program. State review, permitting and ertifiation is onduted by the S. C. Department of Health and Environmental Control. The Distrit Engineer will not proess this appliation to a onlusion until suh ertifiations are reeived. The appliant is hereby advised that supplemental information may be required by the State to failitate the review. This notie initiates the Essential Fish Habitat (EFH) onsultation requirements of the MagnusonStevens Fishery Conservation and Management At. mplementation of the proposed projet would impat 13,24 linear feet of freshwater habitat well inland of estuarine substrates and emergent wetlands utilized by various life stages of speies omprising the shrimp, and snappergrouper management omplexes. The Distrit Engineer s initial determination is that the proposed ation would not have a substantial individual or umulative adverse impat on EFH or fisheries managed by the South Atlanti Fishery Management Counil and the National Marine Fisheries Servie (NMFS). The Distrit Engineer s final determination relative to projet impats and the need for mitigation measures is subjet to review by and oordination with the NMFS. Pursuant to the Setion 7 of the Endangered Speies At of 1973 (as amended), the Corps has reviewed the projet area, examined all information provided by the appliant, and the Distrit Engineer has determined, based on the most reently available information that the projet will have no effet on any Federally endangered, threatened, or proposed speies and will not result in the destrution or adverse modifiation of designated or proposed ritial habitat. This publi notie serves as a request to the U.S. Fish and Wildlife Servie and the National Marine Fisheries Servie for any additional information they may have on whether any listed or proposed endangered or threatened speies or designated or proposed ritial habitat may be present in the area whih would be affeted by the ativity. Pursuant to Setion 16 of the National Histori Preservation At (NHPA), this publi notie also onstitutes a request to ndian Tribes to notify the Distrit Engineer of any histori properties of religious and ultural signifiane to them that may be affeted by the proposed undertaking. n aordane with Setion 16 of the NHPA, the Distrit Engineer has onsulted South Carolina ArhSite (GS), for the presene or absene of histori properties (as defined in 36 2

3 REGULATORY DVSON January 29, 217 SAC C.F.R. 8.16)(l)(1)), and has initially determined that there are histori properties present, but they will not be affeted; therefore, there will be no effet on histori properties. To ensure that other histori properties that the Distrit Engineer is not aware of are not overlooked, this publi notie also serves as a request to the State Histori Preservation Offie and other interested parties to provide any information they may have with regard to histori properties. This publi notie serves as a request for onurrene within 3 days from the SHPO (and/or Tribal Histori Preservation Offier). The Distrit Engineer s final eligibility and effet determination will be based upon oordination with the SHPO and/or THPO, as appropriate and required and with full onsideration given to the proposed undertaking s potential diret and indiret effets on histori properties within the Corpsidentified permit area. Any person may request, in writing, within the omment period speified in this notie, that a publi hearing be held to onsider this appliation. Requests for a publi hearing shall state, with partiularity, the reasons for holding a publi hearing. The deision whether to issue a permit will be based on an evaluation of the probable impat inluding umulative impats of the ativity on the publi interest and will inlude appliation of the guidelines promulgated by the Administrator, Environmental Protetion Ageny (EPA), under authority of Setion 44(b) of the Clean Water At and, as appropriate, the riteria established under authority of Setion 12 of the Marine Protetion, Researh and Santuaries At of 1972, as amended. That deision will reflet the national one for both protetion and utilization of important resoures. The benefit whih reasonably may be expeted to arue from the projet must be balaned against its reasonably foreseeable detriments. All fators whih may be relevant to the projet will be onsidered inluding the umulative effets thereof; among those are onservation, eonomis, aesthetis, general environmental ones, wetlands, histori properties, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline erosion and aretion, rereation, water supply and onservation, water quality, energy needs, safety, food and fiber prodution and, in general, the needs and welfare of the people. A permit will be granted unless the Distrit Engineer determines that it would be ontrary to the publi interest. n ases of onfliting property rights, the Corps annot undertake to adjudiate rival laims. The Corps is soliiting omments from the publi; Federal, state, and loal agenies and offiials; ndian Tribes; and other interested parties in order to onsider and evaluate the impats of this ativity. Any omments reeived will be onsidered by the Corps to determine whether to issue, modify, ondition or deny a permit for this projet. To make this deision, omments are used to assess impats on endangered speies, histori properties, water quality, general environmental effets, and the other publi interest fators listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental mpat Statement pursuant to the National Environmental Poliy At. Comments are also used to determine the need for a publi hearing and to determine the overall publi interest of the ativity.
