1 ADDENDUM NO. 3 RFP # 995 University-Wide Chemical Waste Disposal November 30, 2011 Date of Original RFP Document: October 28, 2011 Addendum No. 1: November 9, 2011 Addendum No. 2 November 16, 2011 INTENT: This Addendum forms a part of the Contract Documents and modifies the Original Bidding Documents and Prior Addenda, if any, as identified above. Acknowledge receipt of this Addendum in the space provided on the Bid Form. Failure to do so may subject Bidder to disqualification. I. Points of Information: The bid proposal submission due date and time has been extended to 11:00 AM on Thursday, December 8, QUESTION: What was an average amount of material picked up for each removal last year? RESPONSE: A total of 2.01 tons was picked up based on the 2009 Biennial Hazardous Waste Report. 2. QUESTION: Is a straight truck sufficient for the volume or is a tractor-trailer required? RESPONSE: A straight truck will be sufficient. It will be difficult to maneuver a tractor trailer on campus 3. QUESTION: The RFP mentions typical 90 day removals. Has this varied much over the last several years? Is there any anticipated change? RESPONSE: Pickups have averaged once every 90 days, or once per semester. This has not varied over the years. We do not anticipate any change. 4. QUESTION: The General Description of Work on page 10 identifies a large list of service for which there are no line items in the price schedule. How will these be ordered and billed? For example, there is a requirement for onsite stabilization laboratory moves, decommissioning and decontamination, field services, removal of temperature sensitive chemicals. Will this be priced off contract? RESPONSE: All services and pricing listed in the University s stated scope and price schedule will be permitted under the awarded contract. No case-by-case pricing will be permitted under the awarded contract(s). This request is for all inclusive pricing. University-Wide Chemical and Radioactive Waste Disposal Services Page 1 of 18

2 5. QUESTION: How often have these types of services occurred in the past? RESPONSE: There have been three full laboratory cleanouts in the past ten years 6. QUESTION: Will all waste be collected from the 90 day storage area? It is mentioned that the contractor may be required to collect waste from Satellite Accumulation areas, how often is this done and how many SAA have historically been serviced? Does this happen during a normal removal service? RESPONSE: There are three Satellite Accumulation Areas located on-campus at Richardson Hall, Mallory Hall and Science Hall. The SAAs will be serviced during normal removal service. 7. QUESTION: There are waste streams mentioned in the General Description of Work not listed in the price schedule such as mixed waste, DEA, pharmaceuticals and biological. Are these rarely encountered and priced case by case? Is the term mixed waste for mixed RCRA and Radioactive waste or mixed infectious and RCRA waste or is it used for some other waste combination? RESPONSE: Mixed waste, DEA, pharmaceuticals, and biological waste include materials from University Police, University Health Center and Athletics. No infectious or pathogenic waste is included in the hazardous waste stream. 8. QUESTION: Does the bulk waste pricing include the container cost or will the University provide the container? RESPONSE: The vendor will provide the container. As stated on the attached revised Attachment #5 Price Schedule, pricing must be inclusive except where noted therein. 9. QUESTION: Will disposal in Canada be allowed for any waste streams? RESPONSE: All disposals must comply with Federal and State regulations. 10. QUESTION: Is the pricing to be given per drum except for the section specially requesting pricing per pound? RESPONSE: All pricing must be provided as requested on the attached revised Attachment #5 Price Schedule. 11. QUESTION: Are Poison Inhalation Hazardous wastes encountered at the University and if so what category are they placed under? RESPONSE: Poison Inhalation Hazardous waste would be placed under 49 CFR University-Wide Chemical and Radioactive Waste Disposal Services Page 2 of 18

3 12. QUESTION: Can alternate treatment technologies be identified for some waste streams listed in the price schedule? Some of the Toxic wastes may be more suitable for treatment than incineration if inorganic in nature. Can we use the most suitable treatment available for a waste stream? RESPONSE: No, any alternative pricing submitted on the price schedule will not be considered and may result in your bid being considered unresponsive. 13. QUESTION: Is the PCB oil in the price schedule TSCA regulated? Is this Transformer oil and if not what type of oil is it? Do you have a range for the PCB concentration? RESPONSE: This would not be used Transformer oil. It would be oil used in research labs. 14. QUESTION: Page 12 item 3.6 identified emergency response services. There is no section in the price schedule that covers any type of emergency response services how will these be billed? RESPONSE: Please see revised Attachment #5 Price Schedule for emergency response services pricing requirements. 15. QUESTION: How many Emergency Responses have there been in the last two years and for what type of events? RESPONSE: There have been no emergency response incidents in the past two years. 16. QUESTION: Please provide pricing for the current contract and any bid tabulation from the most recent award for these services? RESPONSE: This RFP is the first time the University is soliciting contract pricing for these services. 17. QUESTION: If we desire a site visit can we arrange one, and if allowed whom would it be with? RESPONSE: No site visit has been scheduled under this RFP. The campus map is available on-line at QUESTION: Can the university please state who the current contractor/incumbent is? RESPONSE: There is no current contract. Please see response to question no QUESTION: Can the university please clarify if the services provided under this RFP are covered by the New Jersey Prevailing Wage Act? If the answer is yes, what labor classification is currently used? University-Wide Chemical and Radioactive Waste Disposal Services Page 3 of 18

4 RESPONSE: The University cannot provide guidance on this matter. As stated in the University Standard Terms and Conditions, the New Jersey Prevailing Wage Act is hereby made part of every contract entered into by the University, except those contracts which are not within the scope of the Act. 20. QUESTION: Page 4, Section Radioactive Waste disposal is mentioned in the bid three different times. However, there is no pricing requirement for radioactive waste disposal in Attachment #5. Can the university provide this requirement, or will radioactive/mixed waste be quoted on a case-by-case basis? RESPONSE: Please see the attached Revised Attachment #5 Price Schedule for radioactive waste service pricing requirements. 21. QUESTION: Page 10, Section Can the university please clarify if pricing for analytical can be on a case-by-case basis? RESPONSE: All the services and pricing contained in the University s stated scope and price schedule will be permitted under the awarded contract. No case-by-case pricing will be permitted under the awarded contract(s). 22. QUESTION: Page 10, Section There are a number of tasks noted in this requirement that are labor intensive and may not result in disposal of hazardous waste. There is no pricing requirement for labor, transportation, or supplies listed on pricing sheets (Attachment #5). Can the university please explain how work for these types of project will be billed? RESPONSE: The awarded bidder(s) will include all associated costs for their services based on the attached Revised Attachment #5 Price Schedule. 23. QUESTION: Page 10, Section Can the university please clarify Collect waste from Satellite Accumulation Areas (SAA) requirement? Is waste from SAAs to be collected during waste disposal days? Or will this be performed on separate days dedicated to moving waste from SAA to MAA locations? If so, how many days/hours are spent doing this currently? RESPONSE: Waste in Satellite Accumulation Areas will be picked up during normal disposal days. 24. QUESTION: Page 11, Section There are two campuses that this RFP is covering. Can the university clarify if they are both Quantity Generators? Additionally, there is a Federal deadline of March 1 for biennial reporting. Can the university please clarify why the deadline in the RFP is January 15? RESPONSE: The Montclair campus is a large quantity generator. The New Jersey School of Conservation is a small quantity generator. University-Wide Chemical and Radioactive Waste Disposal Services Page 4 of 18

5 25. QUESTION: Page 12, Section 3.6, - There appears to be no pricing category for Emergency Spill Response (Attachment #5). Can the university please provide this? RESPONSE: Please refer to University s response under question #14 herein. 26. QUESTION: Page 12, Section 3.7 Can the university please list the total volumes for each campus separately? RESPONSE: Please refer to response to question #1 herein. 27. QUESTION: Page 18, Section 5.1 Can the awarded contract have language added that specifically applies to the services the contractor is providing? RESPONSE: No. 28. QUESTION: Page 20, Section 6.1 Can the university provide more details regarding decision making criteria as it selects a partner for the chemical and radioactive waste disposal services? How are the criteria for this selection process weighed? RESPONSE: No, the University cannot provide any more detail on the decision-making criteria process. 29. QUESTION: Page 23, Section Can the required insurance limited be met with a combination of the underlying policy and an Excess/Umbrella Liability policy? RESPONSE: Yes. 30. QUESTION: Page 10, Section 3.1, bullet point 5 There are references, including the RFP title, to radioactive waste, including a mention of mixed wastes in Section 3.1. However, there is no description of the radioactive or mixed wastes listed, or field(s) for entry of pricing information. Does the University plan to provide these details for pricing by the bidders? RESPONSE: Please see revised Attachment #5 Price Schedule. 31. QUESTION: Page 11, Section 3.3, bullet point 4 The University has noted a requirement for the vendor to provide Certificate of Destructions (CODs). CODs are only required by law for TSCA regulated PCB wastes. Due to permitted storage times at various TSDFs, actual treatment or destruction can sometimes occur months after a waste pickup, causing delays in providing CODs. Will the University consider alternative documentation to provide similar cradle to grave tracking closure? RESPONSE: Yes, generally the Certificate of Tracking will be sufficient, unless the University specifically requests certain documentation in advance or requires certain documentation based upon the type of hazardous waste pickup. In the case of COD, it is necessary when disposing of expired pharmaceuticals. University-Wide Chemical and Radioactive Waste Disposal Services Page 5 of 18

6 32. QUESTION: Page 40, Attachment 5: Can Attachment 5 be provided in word or excel format to facility entry of responses? RESPONSE: No. 33. QUESTION: Page 40, Attachment 5: There are no fields for entry of packaging material or labor in the pricing section. Will the attachment be modified to include these items? Or can the University identify those items that will be pre-packaged, not requiring materials? RESPONSE: Please see revised Attachment #5 Price Schedule. 34. QUESTION: Page 40, Attachment 5, Emergency Response (ER) is noted in Section 3.5 as a requirement in the RFP. However, there is no location in the RFP for provision of pricing associated with labor or equipment for performing these services. Will the University be adding a section for ER services? RESPONSE: Please see revised Attachment #5 Price Schedule. II.
