4 7.II Mdel Water Quality Management Plan (WQMP) 7.II 1.0 Intrductin The City f Laguna Beach Mdel Water Quality Management Plan (Mdel WQMP) has been develped t aid the Cunty f Orange, the Orange Cunty Fld Cntrl District, and the cities in Suth Orange Cunty (Permittees) and prject prpnents with addressing pst-cnstructin urban runff and strmwater pllutin frm new develpment and significant redevelpment prjects that qualify as Pririty Develpment Prjects. New develpment Pririty Develpment Prjects create new impervius surface n a previusly undevelped site. The amunt f new impervius surface that qualifies a prject as a Pririty Develpment Prject depends upn the prject type. Significant redevelpment prjects add r replace 5,000 r mre square feet f impervius surface n an already-develped site. These terms are further defined fr specific prject types in Sectin 7.II-1.2. This Mdel WQMP has been develped specifically fr Suth Orange Cunty, which is defined in Figure 7.II-1 and Table 7.II-1. LID BMP a BMP that prvides retentin r bifiltratin as part f an LID strategy these may include hydrlgic surce cntrls (HSCs), retentin, and bifiltratin BMPs The purpse f this Mdel WQMP is t describe the prcess that Permittees will emply fr develping a Prject WQMP fr pririty new develpment and redevelpment prjects, which, when implemented, will minimize the effects f urbanizatin n site hydrlgy, runff flw rates, and pllutant lads. Fllwing apprval f the final Prject WQMP and cnstructin f the prject, the Prject WQMP will serve t maintain the terms, cnditins, and requirements with the prject prpnent and their successrs and assigns. The effects f urbanizatin will be minimized thrugh implementatin f practicable and enfrceable prject-based cntrls r strmwater Best Management Practices (BMPs), r thrugh a cmbinatin f prject-based and reginal BMPs. Fr mst prjects, the prcess will first invlve preparing a Cnceptual r Preliminary WQMP t incrprate Lw Impact Develpment (LID) and hydrmdificatin cntrl BMPs where necessary at the earliest cnceptual planning stages f a prject fr early review. All Pririty Develpment Prjects will require a final Prject WQMP be prepared, regardless f whether a Cnceptual r Preliminary WQMP was prepared first. The prcess fr preparing Cnceptual r Preliminary WQMPs and/r final Prject WQMPs is described in Sectin 7.II-5.0, with supplemental infrmatin prvided in the Technical Guidance Dcument (TGD). By initiating runff management planning early in the develpment prcess, the Preliminary/Cnceptual WQMP can be used as the principal mechanism fr describing hw impacts f a prject will be reduced t less than significant when develping dcumentatin fr the prject t cmply with the Califrnia Envirnmental Quality Act (CEQA). 5 The City f Laguna Beach Mdel WQMP identifies cntrls, referred t as lw impact develpment (LID) BMPs and hydrmdificatin BMPs as well as ther BMPs and alternative cmpliance prgrams, fr new develpment and redevelpment prjects that are subject t WQMP requirements pursuant t the DAMP Sectin 7. The Permittees require that certain new develpment and redevelpment prjects develp and implement a Cnceptual r Preliminary WQMP, and/r final Prject WQMP that includes LID BMPs and/r ther BMPs. Depending upn the prject size and characteristics, BMPs may include: Site design measures Implementing LID BMPs n-site Implementing hydrmdificatin cntrl BMPs n-site Utilizing alternative prgrams r treatment cntrl BMPs Emplying applicable surce cntrl BMPs Explanatin, definitins, and examples f the abve site design measures and BMP types as well as alternative prgrams are prvided later within this dcument. 7.II 1.1 Regulatry Basis The develpment f this Mdel WQMP is required by the Natinal Pllutant Discharge Eliminatin System (NPDES) Municipal Separate Strm Sewer System (MS4) permit held jintly by the Permittees in Suth Orange Cunty (Order N. R ). As authrized by the Federal Clean Water Act (CWA), the NPDES permit prgram cntrls water pllutin by regulating surces that discharge pllutants int waters f the United States. Suth Orange Cunty is defined as the area under the jurisdictin f the San Dieg Reginal Water Quality Cntrl Bard (SDRWQCB). Figure 7.II-1 shws the divisin f the Cunty between Nrth and Suth Cunty areas. Table shws which cities are situated within each permit area. The Cunty unincrprated area and three cities verlay bth permit areas. 7 A draft versin f this Mdel WQMP fr Suth Orange Cunty was submitted t the SDRWQCB n December 16, The SDRWQCB reviewed the Draft Mdel WQMP fr cmpliance with the Furth Term MS4 Permit fr Suth Orange Cunty (Suth Cunty Permit, Order R ) and issued a cnditinal finding f adequacy (Memrandum dated June 20, 2013: Cnditinal Finding f Adequacy fr the December 16, 2011 Mdel Water Quality Management Plan (Mdel WQMP) fr Suth Orange Cunty MS4 Permit Order N. R , NPDES N. CAS108740). By December 20, 2013, Suth Orange Cunty (SOC) Area Permittees are required t adpt their wn lcal Jurisdictinal Runff Management Prgram (JRMP) and Lcal Standard Strmwater Mitigatin Plan (Lcal SSMP, als knwn as Lcal Implementatin Plan, LIP) incrprating all requirements f this Mdel WQMP (see DAMP, Appendix A-7). Using the Lcal SSMP (r LIP) as a guide, each SOC Area Permittee will review and apprve Prject WQMPs as part f the develpment plan and entitlement apprval prcess r the ministerial permit apprval prcess fr pririty new develpment and redevelpment prjects as defined in DAMP Sectin 7.6 and Table 7.II-2. Sectin F.1.d(9) f the Suth Orange Cunty MS4 Permit (Order N. R ) requires that each Lcal SSMP (r LIP) adpted by SOC Permittees describe a prcess that will be implemented t verify cmpliance with Mdel WQMP requirements. The prcess must identify at what pint in the planning prcess pririty new develpment and redevelpment prjects will be required t meet Mdel WQMP requirements and, at a minimum, that these pririty develpment prjects implement the required pstcnstructin BMPs prir t ccupancy and/r the intended use f any prtin f the prject. The prcess must als include identificatin f the rles and respnsibilities f varius municipal departments in implementing the Mdel WQMP requirements, as well as any ther measures necessary fr the implementatin f Mdel WQMP requirements. 7.II 1.2 Pririty Develpment Prject Categries This Mdel WQMP describes the prcess fr preparing Cnceptual r Preliminary WQMPs and final Prject WQMPs fr certain new develpment and redevelpment prjects called "Pririty Develpment Prjects." A prject is cnsidered a Pririty Develpment Prject if it meets any ne f the criteria listed in Table 7.II-2. City f Laguna Beach Mdel WQMP 7.II 1-4 December 20, 2013

8 Table 7.II-2: Pririty Develpment Prjects Categries fr Suth Cunty Permit Area 1. New develpment prjects that create r add 10,000 square feet r mre f impervius surface. This categry includes cmmercial, industrial, residential husing subdivisins, mixed-use, and public prjects n private r public prperty that falls under the planning and building authrity f the Permittees. 2. Autmtive repair shps. This applies t facilities that are categrized in any ne f the fllwing Standard Industrial Classificatin (SIC) cdes 5013, 5014, 5541, , and Restaurants where the land area f develpment is 5,000 square feet r mre including parking area. This categry is defined as facilities that sell prepared fds and drinks fr cnsumptin, including statinary lunch cunters and refreshment stands selling prepared fds and drinks fr immediate cnsumptin (SIC cde 5812), where the land area fr develpment is greater than 5,000 square feet. Restaurants where land develpment is less than 5,000 square feet shall meet all WQMP requirements except fr LID BMP, treatment cntrl BMP, and hydrmdificatin/hcoc requirements. 4. Hillside develpment greater than 5,000 square feet. Hillside develpment is defined as any develpment which is lcated in an area with knwn ersive sil cnditins r where the natural slpe is 25 percent r greater. 5. All develpment lcated within r directly adjacent t r discharging directly t an ESA (where discharges frm the develpment r redevelpment will enter receiving waters within the ESA), which either creates 2,500 square feet f impervius surface n a prpsed prject site r increases the area f imperviusness f a prpsed prject site t 10 percent r mre f its naturally ccurring cnditin. Directly adjacent means situated within 200 feet f the ESA. Discharging directly t means utflw frm a drainage cnveyance system that is cmpsed entirely f flws frm the subject develpment r redevelpment site, and nt cmmingled with flws frm adjacent lands. 6. Parking lts 5,000 square feet r mre, r parking lts with 15 parking spaces r mre, including assciated drive aisle, and ptentially expsed t urban strmwater runff. A parking lt is defined as a land area r facility fr the temprary parking r strage f mtr vehicles used persnally, fr business, r fr cmmerce. 7. Streets, rads, highways, and freeways. This categry includes any public r private paved surface that is 5,000 square feet r greater used fr the transprtatin f autmbiles, trucks, mtrcycles, and ther vehicles. Thse redevelpment prjects that create, add, r replace at least 5,000 square feet f impervius surface n an already develped site and the existing develpment r redevelpment prject falls under anther Pririty Develpment Prject Categry. Where redevelpment results in the additin r replacement f less than 50 percent f the impervius surfaces f a previusly existing develpment site, and the existing develpment was nt subject t WQMP requirements, the numeric sizing criteria discuss belw nly applies t the additin r replacement, and nt the entire develpment. Where redevelpment results in an additin r replacement f mre than 50 percent f the impervius surfaces, the Prject WQMP requirements apply t the entire develpment. 9. Retail Gasline Outlets (RGOs). This categry includes RGOs that meet the fllwing criteria: (a) 5,000 square feet r mre, r (b) a prjected Average Daily Traffic (ADT) f 100 r mre vehicles per day. 10. Effective December 16, 2012, all pllutant generating develpment r redevelpment prjects that result in the disturbance f ne acre r mre f land are cnsidered a Pririty Develpment Prject. This categry f Pririty Develpment Prjects is in additin t thse categries described abve in this table. 7.II 1.3 Nn-Pririty Develpment Prjects The prvisins f this Mdel WQMP d nt apply t prjects if they d nt meet the criteria t be cnsidered a Pririty Develpment Prject. 7.II 1.4 Use f the Mdel WQMP, TGD, and WQMP Templates Three dcuments have been develped t supprt the Pririty Develpment Prject requirements: a Mdel WQMP, a TGD, and a WQMP Template. This Mdel WQMP describes the requirements fr preparing a Prject WQMP. The TGD cntains supprting technical guidance n hw t perfrm the technical analyses necessary t prepare a Prject WQMP. The WQMP Template shuld be used t prepare a Prject WQMP. Additinally, Appendix C t this Mdel WQMP describes the criteria currently in place fr hydrmdificatin cntrl (subject t change) and directs the user t the apprpriate reference(s) t find guidance fr implementing hydrmdificatin cntrl requirements. The TGD has been prepared as a cmpanin t this Mdel WQMP (DAMP Sectin 7.III). The TGD cntains mre detailed infrmatin and explains hw t cmplete the requirements and the technical analyses necessary fr preparing a Cnceptual r Preliminary WQMP r Prject WQMP. Thrughut this dcument, references t the TGD will be made, including the sectin f the TGD where the crrespnding infrmatin is lcated. The WQMP Template is t be used by prject prpnents as a tl fr the preparatin and submittal f Prject WQMPs. The WQMP Template cntains the verall structure fr develping a Cnceptual r Preliminary WQMP r final Prject WQMP, including fields fr entering general infrmatin and space fr sizing calculatins and ther analyses necessary fr WQMP cmpletin. It is expected that prject prpnents will adapt the WQMP template as needed, t prvide the required infrmatin in a manner that demnstrates cnfrmance t applicable criteria. 11 7.II 1.5 Public Agency Prjects New develpment/redevelpment requirements apply t public agency prjects that meet the definitins in the Pririty Develpment Prject categries described abve. In general, the same Prject WQMP verall develpment steps described herein apply t public agency prjects as well as private develpment prjects. Hwever, there are unique issues assciated with certain public agency prjects that are either specifically recgnized in the MS4 Permit, r fr which particular appraches can be cnsidered. Public agency street, rad, highway, and freeway Pririty Develpment Prjects are subject t the standard hierarchy f LID and hydrmdificatin requirements applicable t ther categries f Pririty Develpment Prjects as described in Sectin 7.II and 7.II f this Mdel WQMP. Pririty Develpment Prjects may emply a green street design apprach that incrprates United States Envirnmental Prtectin Agency (USEPA) guidance, Managing Wet Weather with Green Infrastructure: Green Streets in a manner cnsistent with the maximum extent practicable (MEP) standard. A cpy f the guidance is included in Appendix B. Hwever, these prjects must demnstrate that they meet the LID and hydrmdificatin standards applicable t ther categries f Pririty Develpment Prjects as described in Sectin 7.II and 7.II f this Mdel WQMP. Abve grund linear lined drainage prjects typically cnsist f lined vertical r trapezidal channels. These prjects may result in the creatin f mre than 10,000 square feet f impervius surface r the additin f mre than 5,000 sq-ft t an existing develped site, which wuld result in a categrizatin as a Pririty Develpment Prject. These types f prjects are permitted t use the Green Infrastructure guidance as described in Appendix B and Sectin 2.7 f the TGD. Individual Permittees may elect t develp a separate Master Prject WQMP fr anticipated future prjects with similar characteristics based upn the requirements utlined in this dcument. A Master Prject WQMP dcument wuld need t list the public agency prjects that are anticipated t ccur within the Permittee s jurisdictin ver a given time perid and the prpsed methds f cmpliance with this Mdel WQMP. Belw grund linear drainage and utility cnstructin prjects, such as strm drains, sewers and water lines, may result in the replacement f mre than 5,000 square feet f impervius surface within a develped public street, rad r highway. Hwever, such prjects wuld nt qualify as a Pririty Develpment Prject if they maintain riginal line and grade, hydraulic capacity, riginal purpse f the facility, r ccur in respnse t an emergency t prtect public health and safety. Cnsequently, these prjects wuld nt require the preparatin f a Prject WQMP. 7.II 1.6 WQMP Develpment Prcess Several steps are invlved in cmpleting an apprvable Cnceptual r Preliminary WQMP, r final Prject WQMP fr new develpment r significant redevelpment prjects. Figure7.II-2 displays an verview WQMP flwchart and the majr implementatin and decisin steps that must be fllwed t successfully cmplete a Prject WQMP fr the SOC Permit Area. 12 are described in later sectins f the Mdel WQMP. The relevant sectins which detail each step are referenced in the verall WQMP flw chart. Figure 7.II-3 prvides a mre detailed verview f the steps in the prcess. Each f these steps is described in mre detail in Sectin 7.II-2.0. 14 7.II 2.0 Prject WQMP Requirements The purpse f the Prject WQMP is t define prject features and BMPs that will mitigate the prject s impacts n receiving water quality and hydrmdificatin. In rder t cmplete a Prject WQMP, the fllwing steps will need t be perfrmed: 1. Determine discretinary permits and water quality cnditins that may apply Sectin 7.II Describe the prject Sectin 7.II Assess the site Sectin 7.II Develp and select BMPs, including LID BMPs, site design BMPs, hydrmdificatin cntrl BMPs, and surce cntrl BMPs Sectin 7.II Determine any applicable alternative cmpliance appraches Sectin 7.II Identify parties respnsible fr BMP maintenance and funding surces Sectin 7.II-4.0 The first fur steps are discussed in the fllwing subsectins. Additinal infrmatin with technical guidance and supprting infrmatin can be fund in the TGD. 7.II 2.1 Discretinary Permit(s) and Water Quality Cnditins This Mdel WQMP prvides a framewrk fr addressing General Plan, discretinary permit cnditins, water quality cnditins, and cmplying with CEQA. Cmpliance with the requirements set frth in this dcument can prvide the basis fr evaluating the surface water impacts and any mitigatin measures and can be sufficiently specific t satisfy the requirements f CEQA with regards t prjects. See TGD Sectin 2.1 fr additinal details regarding discretinary permits and water quality cnditins. 7.II 2.2 Prject Descriptin The Prject WQMP shall cntain an verall descriptin f the prject including permit applicability, whether the prject is in NOC and/r SOC Permit Areas, if it is in an envirnmentally sensitive area (ESA), whether it may be eligible fr water credits (as discussed in Sectin 7.II-3.2), and whether the prject cntains specific features, such as abve grund linear facilities that wuld require specific BMP appraches (as discussed in Sectin 7.II-2.4.2). See TGD Sectin 2.2 fr additinal details regarding prject descriptins. 7.II 2.3 Site Assessment 7.II Intrductin Site assessment invlves the fllwing steps: 1. Gather site infrmatin. 2. Hydrmdificatin is the alteratin f natural flw characteristics and sediment supply in streams and channels due t urbanizatin, which can result frm new develpment and significant redevelpment prjects withut apprpriate preventative cntrls. Hydrmdificatin cntrls are implemented in rder t prevent hydrmdificatin frm happening. Urbanizatin cmmnly results in increased runff vlume and velcity; reduced infiltratin; increased flw frequency, duratin, and peaks; and faster time t reach peak flw. Under certain circumstances, urbanizatin culd als result in the reductin in the amunt f sediment supplied t the channel fr transprt. If the sediment supplied t the channel is reduced such that in-stream flws are transprting sediment faster than it can be replenished, then ersin f the channel s bed and bank may ccur. These changes have the ptential t permanently impact dwnstream channels and habitat integrity. A change t a Pririty Prject site s hydrlgic characteristics wuld be cnsidered a cnditin f cncern if the change wuld have a significant impact n dwnstream natural channels and habitat integrity. Pririty Develpment Prject prpnents shall use the appraches identified in Appendix C (r by reference frm Appendix C) t determine if the Prject has an HCOC. In Suth Orange Cunty, all prjects are cnsidered t have a ptential HCOC unless they are tributary t an exempt receiving water as defined in Appendix C (r by reference frm Appendix C). 7.II Determine Pllutants f Cncern Strmwater runff frm new develpment and significant redevelpment prject sites has the ptential t cntribute pllutants, including suspended slids/sediment, nutrients, metals, micrbial pathgens, il and grease, txic rganic cmpunds, and trash and debris frm the municipal strm drain system t tributary receiving waters. Knwing the POCs is necessary t select the mst effective BMPs, since sme BMPs are mre effective fr sme pllutants than thers. 18 pllutants that are anticipated t be generated by a prject based n the type f develpment prject that is prpsed. Primary POCs are any pllutants anticipated t be generated by the prject that als have apprved TMDLs r which are causing an impairment fr which a TMDL has nt yet been apprved. Other POCs are thse pllutants anticipated t be generated by the prject that have nt been identified as causing impairment nr have an adpted TMDL fr the prject s receiving waters. TGD Sectin prvides technical details regarding identifying POCs. Further infrmatin n POCs may als be available frm the envirnmental impact assessment fr the prject (e.g., prject-specific pllutant evaluatins in CEQA Envirnmental Impact Reprts). This site-specific infrmatin shuld be used t supplement, r in sme cases supersede, the POCs identified thrugh the methds described in this sectin. Any site-specific infrmatin used t identify additinal POCs r remve a pllutant frm being a presumed POC must be based n substantial evidence and justified in either the prject s CEQA dcument and/r the prject WQMP. Watershed planning dcuments previusly develped by Orange Cunty shuld als be reviewed fr identificatin f specific implementatin requirements that address POCs, where applicable. 7.II 2.4 Select Lw Impact Develpment Best Management Practices 7.II Intrductin BMPs are prgrams and plicies, including structural cntrls that are implemented t cntrl the discharge f pllutants. This Mdel WQMP describes LID BMPs, site design BMPs, hydrmdificatin cntrl BMPs, surce cntrl BMPs and treatment cntrl BMPs. Using the infrmatin cmpiled abve, the fllwing steps must be taken t determine what perfrmance criteria apply t the prject: 1) LID, 2) treatment cntrl, and 3) hydrmdificatin cntrl. These perfrmance criteria are evaluated individually althugh they can be interrelated. It is pssible t meet ne and nt meet the thers. This is synnymus with perfrmance standard as used by ther guidance dcuments, but nly perfrmance criteria is used in this dcument. Several steps must be fllwed in rder t determine what perfrmance criteria will apply t a prject. These steps include: 1. Determining if the prject is an abve grund linear lined drainage facility. Once the perfrmance criteria have been established, the next step is t develp and select site design practices and n-site LID BMPs and hydrmdificatin cntrl BMPs based n these prject-specific criteria. 7.II Determine Perfrmance Criteria 7.II Determine if the Prject is an Abve Grund Linear Lined Drainage Facility If the prpsed prject is a public agency prject that is an abve grund linear lined drainage facility, the prject shall incrprate USEPA guidance, Managing Wet Weather with Green Infrastructure: Green Streets (see Appendix B) in a manner cnsistent with the MEP standard. Separate cmpliance requirements fr these prjects are discussed in TGD Sectin 2.7. Public agency street prjects that meet criteria t be cnsidered a Pririty Develpment Prject may emply a green street design apprach, hwever, these prjects must demnstrate that they meet the full LID and hydrmdificatin standards applicable t the remaining categries f Pririty Develpment Prjects as described in Sectin and f this Mdel WQMP. 7.II Determine Hydrmdificatin Perfrmance Criteria Hydrmdificatin criteria are applicable t all Pririty Develpment Prjects, except thse that discharge t an exempt receiving water. Appendix C identifies the hydrmdificatin cntrl criteria that are currently applicable in Suth Orange Cunty, and includes technical guidance fr addressing these criteria (within Appendix C and/r by reference frm Appendix C). 7.II Determine LID and Treatment Cntrl BMP Perfrmance Criteria The fllwing perfrmance criteria fr LID implementatin are stated in the Suth Orange Cunty MS4 Permit: Pririty Develpment Prjects must infiltrate, harvest and use, evaptranspire, r bifilter, the 85th percentile, 24-hur strm event (Design Capture Vlume). A prperly designed bifiltratin system may nly be cnsidered if infiltratin, harvest and use, and evaptranspiratin (ET) cannt be feasibly implemented fr the full design capture vlume. In this case, infiltratin, harvest and use, and ET practices must be implemented t the greatest extent feasible and bifiltratin may be prvided fr the remaining design capture vlume. A diversity f cntrls must be prvided, where feasible, t achieve the greatest feasible retentin f the Design Capture Vlume, then if necessary, bifiltratin f the remaining design capture vlume. The Design Capture Strm Depth is the 85th percentile, 24-hr strm depth that, when applied t the prject site, results in runff equal t the Design Capture Vlume (DCV). The design capture strm depth varies acrss the Cunty and is shwn in TGD Exhibit XVI-1. 20 strm depth t apply t a prject t calculate design capture vlume as well as guidance fr recmmended hydrlgic methds. Equivalent LID perfrmance criteria have been synthesized frm the permit requirements with cnsideratin f the MEP standard and analysis f lcal precipitatin and ET patterns. The fllwing perfrmance criteria result in capture and retentin and/r bifiltratin f 80 percent f average annual strmwater runff vlume. The perfrmance criteria fr LID are stated as fllws: LID BMPs must be designed t retain (infiltrate, harvest and use, r evaptranspire), n-site, strmwater runff up t 80 percent average annual capture efficiency. LID BMPs must be designed t: Retain (infiltrate, harvest and use, r evaptranspire), n-site, strmwater runff as feasible up t the Design Capture Vlume; and Recver (i.e., draw dwn) the strage vlume as sn as pssible after a strm event (see criteria fr maximizing drawdwn rate in the TGD Appendix XI); and, if necessary, Bifilter, n-site, additinal runff, as feasible, up t 80 percent average annual capture efficiency (cumulative, retentin plus bifiltratin); and, if necessary Fulfill alternative cmpliance bligatins fr runff vlume nt retained r bifiltered up t 80 percent average annual capture efficiency using treatment cntrls r ther alternative appraches as described in Sectin 7.II-3. Where a prject can retain the DCV and drain this vlume in less than r equal t 48 hurs fllwing the end rainfall, the system is cnsidered t achieve 80 percent capture, as described in the TGD, Appendix III. When bifiltratin is used, the vlume prvided in the pre-filter detentin vlume (surface strage) and pres f bifiltratin BMPs may nt be less than 75 percent f the remaining DCV, regardless f the average annual capture efficiency achieved. The prefilter vlume criterin is nt applicable t infiltratin systems. Further discussin n determining the pre-filter detentin vlume and calculating BMP sizing t meet these criteria are prvided in the TGD and the TGD Appendix II and III. 7.II Selecting LID BMPs The Suth Cunty Permit stresses the imprtance f prject planning and design utilizing the principles f LID. The use f LID BMPs is intended t reduce the discharge f pllutants and the effects f changes t runff patterns caused by land use mdificatins. Permit requirements fr Pririty Develpment Prjects must be met thrugh the use f structural and nn-structural BMPs, with fremst cnsideratin given t LID BMPs. The primary gal f using LID BMPs is t preserve a site s predevelpment hydrlgy in rder t preserve the integrity f receiving water bdies. 21 land use mdificatins can be reduced thrugh the use f structural and nn-structural techniques that stre, infiltrate, evaprate, and detain runff. Predevelpment is defined as the naturally ccurring (pre-human disturbance) cnditins. The Suth Cunty Permit cntains requirements t implement LID practices in rder t address the impacts f hydrmdificatin and pllutin f strmwater runff frm a Pririty Develpment Prject n the physical, chemical, and bilgical integrity f receiving waters. A list f LID BMPs is shwn in Table 7.II 3. Specific details and fact sheets fr each BMP are prvided in TGD Sectins 4 and TGD Appendix XIV. Additinally, the fllwing treatment cntrl and pre-treatment BMPs may be used, as applicable, hwever these BMPs d nt meet LID requirements: Cnstructed wetlands, Vegetated swales, Vegetated filter strips, Dry extended detentin basins, Wet extended detentin basins, Prprietary bitreatment (except when designed t meet pre-filter detentin vlume criteria defined in Ftnte 1), Media filters (sand filters), and Hydrdynamic separatrs and catch basin inserts. While requirements fr LID BMPs, treatment cntrl BMPs, and hydrmdificatin cntrl are stated independently in the Permit, and Pririty Develpment Prjects must demnstrate cmpliance with each requirement individually, the requirements verlap significantly and sme management practices may fulfill r partially fulfill ne r mre requirements. The LID and treatment cntrl requirements are especially interrelated because full cmpliance with LID requirements nsite inherently results in cmpliance with treatment cntrl requirements. LID and hydrmdificatin cntrl requirements are als interrelated as bth are based n reductin f runff vlume as their first pririty. Hwever, meeting the perfrmance criteria fr either LID BMPs r hydrmdificatin cntrl BMPs des nt imply that the perfrmance criteria fr the ther has categry been met. As a result, a prject that has HCOCs will need t dcument that it has met the perfrmance criteria fr bth categries f BMPs. The steps invlved in selecting LID practices are described in mre detail in the fllwing subsectins. A flw chart f the key steps and decisins required fr selecting LID BMPs is shwn in Figure 7.II-7 fr prjects where there is n ptential fr HCOCs and Figure 7.II-8 fr Prjects which must cnsider HCOCs. The TGD expands n these steps and prvides specific instructins fr selecting, designing, and dcumenting the use f LID practices. 23 scale: (1) reginal (several develpments within the same watershed); r (2) sub-reginal (multiple adjacent develpments within the same watershed) fr certain develpment cnditins. There culd be multiple benefits and/r cnstraining factrs, including, but nt limited t, smart grwth gals, water cnservatin and grundwater recharge benefits sil cnditins, grundwater levels, sil and/r grundwater cntaminants, space restrictins r redevelpment pprtunities and ecnmic cnsideratins. Where a develpment prject greater than 100 acres in ttal prject size, r smaller than 100 acres in size yet part f a larger cmmn plan f develpment that is ver 100 acres, has been prepared using watershed and/r sub-watershed based water quality, hydrlgic, and fluvial gemrphlgic planning principles that implement reginal LID BMPs in accrdance with the sizing and lcatin criteria f the Suth Cunty Permit and acceptable t the Reginal Bard, such standards shall gvern review f prjects and shall be deemed t satisfy the Suth Cunty Permit s requirements fr LID site design, buffer zne, infiltratin and grundwater prtectin standards, surce cntrl, treatment cntrl, and hydrmdificatin cntrl standards. Reginal BMPs must clearly exhibit that they will nt result in a net impact frm pllutant ladings ver and abve the impact caused by capture and retentin f the design strm with n-site LID BMPs. 26 7.II Site Design BMPs LID site design practices include a wide range f ptential practices that can be implemented t reduce the vlume f strmwater runff generated n a prject site as well as imprve the quality f runff that leaves the site and help avid dwnstream hydrmdificatin impacts. LID site design is predminantly preventative in nature as it cnsists f practices that reduce the amunt f runff and ther impacts befre, r immediately after, they ccur. Examples f preventative aspects f LID site design include reductin f impervius area, preservatin f drainage curses, and restratin f impacted sils. Descriptins f the mst cmmn site design practices are prvided in TGD Sectin There are n numeric perfrmance criteria fr site design practices, hwever, LID site design shuld be cnsidered as the first pririty in the hierarchy f LID implementatin, beginning with the earliest phases f a prject. The use f effective site design practices can result in a reductin in the vlume f strmwater runff that must be retained, a reductin f the design capture vlume, and the related reductin in the size f structural treatment BMPs than if site design practices are nt used. Allcating space fr BMPs in the site design at the earliest phases f the prject planning prcess can allw prjects t mre easily satisfy numeric perfrmance criteria. On-site LID practices that shuld be cnsidered include, but are nt limited t, the fllwing: Maximize Natural Infiltratin Capacity and Grundwater Recharge (where apprpriate), Preserve Existing Drainage Patterns and Time f Cncentratin, Prtect Existing Vegetatin and Sensitive Areas, Minimize Impervius Area, Discnnect Impervius Areas, Minimize Cnstructin Ftprint, and Re-vegetate Disturbed Areas. Each f these techniques is described further in the TGD Sectin 3. Certain site design practices are referred t as HSCs, and can be cunted tward LID perfrmance criteria. These HSC are described in TGD Sectin 4 and TGD Appendix XIV. In additin, where hydrmdificatin criteria apply, site design activities shuld include identificatin and preservatin f areas f carse sediment supply. Mre technical guidance n managing carse sediment supply can be fund in Appendix C (r by reference frm Appendix C). 7.II Hydrmdificatin Cntrl BMPs All prjects must address hydrmdificatin unless they are identified as exempt under the applicable criteria that apply t the prject. Surce Cntrl BMPs are defined as any administrative actin, design f a structural facility, usage f alternative materials, and peratin, maintenance, inspectin, and cmpliance f an area that aims t eliminate r reduce strmwater pllutin. This Mdel WQMP categrizes Surce Cntrl BMPs as either Structural r Nn-Structural Surce Cntrl BMPs. Surce Cntrl BMPs are required within all Pririty Develpment Prjects unless they d nt apply due t the prject characteristics. This sectin describes alternative cmpliance appraches fr LID criteria fr prpsed prjects that are nt able t fully capture and infiltrate, harvest and use, r bifilter the design capture vlume in ne f the fllwing ways: Using a cmbinatin f site design and n-site LID BMPs. Develpment prjects greater than 100 acres in ttal prject size r smaller than 100 acres in size yet part f a larger cmmn plan f develpment that is ver 100 acres, that have been prepared using watershed and/r sub-watershed based water quality, hydrlgic, and fluvial gemrphlgic planning principles that implement reginal LID BMPs cnsistent with an apprved watershed scale apprach (See Sectin 7.II ). 31 7.II 3.1 Waivers Fr prject prpnents in the SOC Permit Area, a Waiver Request is required if it is technically infeasible t cmpletely satisfy LID requirements thrugh the implementatin f n-site LID BMPs. Permittees in Suth Orange Cunty must develp, cllectively r individually, a LID Waiver Prgram fr incrpratin int lcal SSMPs meeting the requirements f Sectin d(7) f the permit. A waiver applicatin fr an alternative cmpliance plan in accrdance with the adpted prgram must be submitted fr Permittee apprval fr each prject, which will be reprted t the San Dieg Reginal Water Quality Cntrl Bard within the Permittee s annual strmwater prgram reprt. Prject prpnents that have been granted a waiver must cmply with requirements fr the alternative cmpliance plan prpsed by the Prject Prpnent and apprved by the Permittee fr the prpsed prject t mitigate ptential negative impacts n the watershed due t the infeasibility f fully implementing LID BMPs. 7.II 3.2 Water Quality Credits 7.II Type f Prject Ptentially Qualifying fr Water Quality Credits Fr certain types f develpment prjects, LID BMPs may be mre difficult t incrprate due t the nature f the develpment, but the develpment practices may prvide ther envirnmental benefits t cmmunities. Fr example, infiltratin BMPs may nt desirable fr a Brwnfield redevelpment site where infiltrated strmwater culd cause an adverse impact t grundwater supply, but redevelpment f the site wuld be expected t have ther envirnmental benefits such as accelerated site cleanup. Develpment in city centers, histric districts, r histric preservatin areas ften fllws land-use patterns that existed befre the intrductin f the autmbile and subsequent urban sprawl. New develpment r redevelpment in these areas is expected t fllw thse same patterns in rder t be cmpatible with the surrunding area and thereby mimic many LID principles, while ptentially reducing the number f vehicle miles traveled and assciated water pllutin. In additin, redevelpment prjects culd be implemented in a way that reduces the verall impervius ftprint f the prject site rather than increasing it. Lcal jurisdictins may develp a water quality credit prgram that applies t certain types f develpment prjects after they first evaluate the feasibility f meeting LID requirements n-site. In rder t determine if a prject falls int any f the fllwing categries, lcal jurisdictins will use the descriptins prvided belw as well as City f Laguna Beach Mdel WQMP 7.II 3-3 December 20, 2013

32 descriptins r definitins in lcal planning dcuments. If any f these descriptins r definitins is inadequate t determine a prject s eligibility fr credits, lcal jurisdictins will use published and generally accepted descriptins r definitins. If it is nt feasible t meet the requirements fr n-site LID, prject prpnents fr specific prject types can apply credits that wuld reduce prject bligatins fr selecting and sizing ther treatment BMPs r participating in ther alternative prgrams. Credits can be applied nly as part f the LID Waiver Prgram. Prjects ptentially eligible fr cnsideratin fr credits include: Redevelpment prjects that reduce the verall impervius ftprint f the prject site; Brwnfield redevelpment, meaning redevelpment, expansin, r reuse f real prperty which may be cmplicated by the presence r ptential presence f hazardus substances, pllutants r cntaminants, and which have the ptential t cntribute t adverse grund r surface water quality if nt redevelped; Higher density develpment prjects which include tw distinct categries (credits can nly be taken fr ne categry): Thse with mre than seven units per acre f develpment (lwer credit allwance); Vertical density develpments, fr example, thse with a Flr t Area Rati (FAR) f 2, r thse having mre than 18 units per acre (greater credit allwance); Mixed use develpment, such as a cmbinatin f residential, cmmercial, industrial, ffice, institutinal, r ther land uses which incrprate design principles that can demnstrate envirnmental benefits that wuld nt be realized thrugh single use prjects (e.g., reduced vehicle trip traffic with the ptential t reduce surces f water r air pllutin); Transit-riented develpments, such as a mixed use residential r cmmercial area designed t maximize access t public transprtatin; similar t abve criterin, but where the develpment center is within ne half mile f a mass transit center (e.g., bus, rail, light rail r cmmuter train statin). These categries address ther types f alternative pprtunities r cmpliance appraches that are described in ther sectins f this MWQMP. This prvisin des nt exempt the prject prpnent frm first cnducting the investigatins t determine if is feasible t fulfill the full LID, treatment cntrl, and hydrmdificatin requirements thrugh a cmbinatin f site design practices and LID BMPs cnsistent with the permit hierarchy. These credits are nt applicable t hydrmdificatin requirements. 7.II Applying Water Quality Credits t LID Perfrmance Criteria T determine the amunt f credit a prject wuld qualify fr, the first step is t calculate the vlume that wuld need t be satisfied in the absence f any credits as described in Sectin 7.II-3.2. Any credits wuld then be taken as a reductin t this remaining vlume. The credits wuld be calculated in ne f tw ways: Fr redevelpment prjects that reduce the verall impervius ftprint f the prject site cmpared t current use, the credits wuld be calculated as fllws: Calculate an equivalent existing Design Capture Vlume fr the site (DCV E ) using the LID BMP Perfrmance Criteria defined in Sectin 7.II and current site cnditins Calculate the full Design Capture Vlume fr the site under the prpsed develpment plan (DCV p ) Subtract t btain a credit vlume: (DCV E ) - (DCV p ) = Credit Vlume Fr all ther categries f prjects nted abve, the remaining vlume t be treated r mitigated wuld be reduced in accrdance with the fllwing prtins f the riginal design capture vlume : Histric district, histric preservatin area, r similar areas 10 percent Brwnfield redevelpment 25 percent Higher density develpment 7 units/acre 5 percent Vertical density 20 percent Mixed use develpment, transit riented develpment r live-wrk develpment 20 percent Infill develpment 10 percent If mre than ne categry applies t a particular prject, the credit percentages wuld be additive up t a 50 percent reductin (50 percent reductin maximum). This credit (expressed as a vlume) is subtracted frm the prpsed prject s remaining alternative cmpliance bligatins. If the credit vlume exceeds the remaining vlume that culd nt be prvided in n-site LID, there are n further alternative cmpliance bligatins. 7.II 3.3 Treatment Cntrl BMPs This sectin cntains perfrmance criteria fr treatment cntrl BMPs. Nte that satisfactin f LID perfrmance criteria als fully satisfies treatment cntrl perfrmance criteria, therefre this sectin is nly applicable when the prject cannt fully retain r bifilter the design capture vlume, and must enter an alternative cmpliance prgram. 7.II Determine Treatment Cntrl BMP Water Quality Perfrmance Criteria This sectin cntains perfrmance criteria fr treatment cntrl BMPs when used as part f an alternative cmpliance plan. If LID perfrmance criteria have nt been met thrugh retentin and bifiltratin n-site r in a reginal LID BMP (per criteria in Sectin 7.II-3.5), the Prject shall participate in the LID Waiver Prgram (see Sectin 7.II- 3.1) and treatment cntrl BMPs shall be prvided prir t discharge t Waters f the US. Sizing f treatment cntrl BMP(s) shall be based n either: The unmet vlume as calculated in TGD Appendix VI. Hwever, treatment cntrl BMPs can als be lcated at a sub-reginal r reginal scale, prvided that they meet the applicable criteria described in Sectin 7.II II Cmpute the Remaining Obligatin after Applying Treatment Cntrl BMPs The alternative cmpliance bligatins that must be prvided thrugh the LID Waiver Prgram (see Sectin 7.II- 3.1) shall be based n the difference between the pllutant lad reductin achieved by the prvided LID BMPs cmpared t the pllutant lad reductin that wuld result frm full implementatin f LID BMPs fr the design capture vlume. After applying treatment cntrl BMPs, tw ptins may be used t determine the amunt f LID bligatin that remains: 1) a vlume-based like-fr-like, equivalency determinatin, and (2) a quantitative pllutant-lad-based equivalency calculatin. In the vlume-based like-fr-like, equivalency apprach, the benefits f treatment cntrl BMPs are nt quantified. It is assumed that all remaining LID bligatins will be met with an ff-site mitigatin prgram r urban runff fund. The prject prpnent participates in an ff-site mitigatin prgram r urban runff fund fr the remaining vlume nt addressed by LID BMPs. Participatin in these prgrams is based n treating an equivalent vlume f runff frm like land uses with like pllutant lads. In the quantitative, pllutant lad-based equivalency apprach, the pllutant lad reductin achieved in treatment cntrl BMPs that are prvided per the criteria abve may cnstitute all r part f this alternative cmpliance bligatin. The pllutant lad reductin that is nt met thrugh a cmbinatin f LID and treatment cntrl must be prvided via an ff-site mitigatin prgram r urban runff fund such that the resulting discharge f pllutant lads is nt greater than wuld have been achieved via full implementatin f LID fr the design capture vlume. Equivalent lading calculatins shall be based n the pririty pllutant(s) f cncern, if present. If n pririty POCs exists, equivalent lading calculatins shall be based n all POCs and the mst stringent POC shall be used. Scientifically defensible infrmatin abut BMP perfrmance shall be used t calculate pllutant lad reductin achieved in treatment cntrl BMPs cmpared t full implementatin f LID BMPs and assumptins and ratinales shall be prvided in the Prject WQMP. Remaining bligatins t be met via ff-site mitigatin prjects r urban runff funds shall be expressed in terms f pllutant lads that must be reduced. 7.II 3.4 Urban Runff Funds / Mitigatin Prgrams and Off-Site Mitigatin Prjects 7.II Urban Runff Funds / Mitigatin Prgrams Fr prjects granted a LID BMP Waiver, participatin in an urban runff fund r mitigatin prgram is an ptin fr meeting remaining bligatins, in cmbinatin with treatment cntrl BMPs, as discussed in Sectin 7.II-3.3. Payment int an urban runff fund r mitigatin prgram can be used t address the runff vlume r pllutant lad that is nt addressed thrugh LID BMPs r ther alternative cmpliance ptins including treatment cntrl BMPs described abve. When an apprved urban runff fund r mitigatin prgram is available, participatin in the prgram is allwable as lng as the net effectiveness f the alternative prgram is the same r better than that City f Laguna Beach Mdel WQMP 7.II 3-7 December 20, 2013

36 which wuld have been achieved with n-site cmpliance. The fllwing sectin describes a general basis and criteria fr develping such prgrams. Hwever, a specific prgram with established quantitative criteria and cst basis has nt been established. It is expected that the Permittees will develp a specific prgram and submit this t the Executive Officer fr future review and apprval t allw specific prjects t use this apprach. Payment int a runff fund r mitigatin prgram is an alternative t ff-site mitigatin, but must include implementing n-site treatment cntrls. The amunt f the cntributin will be based n the unmet difference between the pllutant lad reductin that wuld be achieved thrugh full cmpliance with n-site LID BMPs and the actual pllutant lad reductin that can be achieved thrugh the cmbinatin f LID practices and treatment cntrl BMPs that can be incrprated in the prject. The basis fr determining the value f the cntributin will be determined by additinal future studies by the Permittees. The urban runff fund r mitigatin fund must be expended fr water quality imprvement r ther related prjects. Examples f prjects eligible fr funding thrugh an urban runff/mitigatin fund include, but are nt limited t: Green street prjects Prjects which retrfit f existing develpment areas with LID and ther BMPs t reduce existing pllutant lads Retrfit incentive prgrams Reginal BMPs/Sub-Reginal BMPs Stream restratin Prjects which prmte grundwater recharge t increase water supplies Other mitigatin prjects prpsed by Permittees 7.II Off-Site Mitigatin Prjects Fr prjects granted a LID BMP Waiver, an ff-site mitigatin prject r alternative pllutant-reducing prject may be cnsidered t meet remaining bligatins after claiming applicable water quality credits and prviding treatment cntrl BMPs. The prject is nt required t be upstream frm the ff-site mitigatin, but the ff-site mitigatin must be implemented within the same hydrlgic subarea as the prpsed prject. Off-site mitigatin prjects utside f the hydrlgic subarea but within the same hydrlgic unit may be develped fr Permittee apprval prvided that the prject prpnent demnstrates that mitigatin prjects within the same hydrlgic subarea are infeasible and that the mitigatin prject will address similar beneficial use impacts as expected frm the prpsed prject s pllutant lad types and amunt. Offsite prject BMPs shuld be lcated as clse as pssible t the prject site and shuld generally address a similar mix f land uses t that prpsed by the prject. The ff-site prject shall nt be lcated within waters f the US and it shall be demnstrated that equivalent pllutant remval is accmplished prir t discharge t waters f the US. Off-site mitigatin prjects may demnstrate equivalent pllutant lad reductin using a City f Laguna Beach Mdel WQMP 7.II 3-8 December 20, 2013

37 vlume-based apprach when treating a like land use, r via a quantitative pllutant lad-based equivalency apprach when addressing a different land use type, as discussed in Sectin 7.II Off-site mitigatin prjects may include, but are nt limited t: Green streets prjects Existing develpment retrfit prjects Retrfit incentive prgrams Reginal BMPs Grundwater recharge prgrams Stream restratin Other ff-site mitigatin techniques may be prpsed t the Permittee fr review and apprval. 7.II 3.5 Use f Sub-Reginal r Reginal BMPs as Part f Alternative Cmpliance Where it is nt feasible t prvide LID BMPs fr the entire design capture vlume nsite and the prject has submitted a waiver request, sub-reginal r reginal LID BMPs can be prpsed as an alternative cmpliance apprach fr the remaining design capture vlume. These types f BMPs are based n the LID principles f strmwater retentin r bifiltratin, but are lcated beynd the bundaries f the specific develpment prject, and may address several develpments within the same watershed r multiple adjacent develpments within the same watershed. A sub-reginal LID BMP, selected per the LID selectin hierarchy described in Sectin 7.II and with capacity allcated fr the remaining design capture vlume frm a prject, fully meets alternative cmpliance bligatins fr the prject. The ptential availability f reginal r sub-reginal LID BMP pprtunities culd be identified as part f a planning prcess undertaken by the apprpriate jurisdictins and prject prpnents. Fr this apprach t be cnsidered, the Prject WQMP r an assciated planning dcument must demnstrate that reginal LID BMP will meet the fllwing criteria: The sub-reginal/reginal BMP is lcated such that the prject wuld drain t the BMP prir t discharge t a Waters f the US, the net pllutant remval lad within the watershed is equivalent t what wuld be accmplished n-site, r wuld nt impair the beneficial uses f Waters f the US. The sub-reginal/reginal BMP is sufficiently sized t treat strmwater runff frm its tributary area, t the extent needed t address vlume that is nt met nsite. The sub-reginal/reginal BMP is sited and designed such that it will prvide equal r greater verall pllutant lad reductin than wuld be achieved by LID BMPs n-site as described in TGD Sectin City f Laguna Beach Mdel WQMP 7.II 3-9 December 20, 2013

38 The sub-reginal/reginal BMP will be adequately maintained fr the life f the prject and the sub-reginal/reginal BMP will be cnstructed and peratinal t serve the prject prir t certificatin f ccupancy fr the prject. A sub-reginal r reginal BMP pprtunity that meets all f the abve criteria, but is a treatment cntrl BMP rather than an LID BMP, may be cnstructed t address the treatment cntrl criteria described in Sectin 7.II-3.3, but may nt fully address the remaining LID bligatins, unless demnstrated t be equivalent t the treatment prvided in LID BMPs via pllutant lad calculatins. 39 7.II 4.0 BMP Maintenance Requirements A BMP Operatin and Maintenance (O&M) Plan must be prepared as part f the Prject WQMP (see DAMP Sectin 7.6.6) and a mechanism must be in place that will ensure nging lng-term maintenance f all structural BMPs. This mechanism may be prvided either thrugh the lcal jurisdictin under a maintenance agreement r ther mechanism, r by the prject prpnent as further described herein. As part f prject review, if a prject prpnent is required t include interim r permanent structural BMPs in prject plans, and if the lcal jurisdictin des nt prvide a mechanism fr BMP maintenance, the lcal jurisdictin shall require that the applicant describe an apprach t implement and maintain all BMPs included in apprved Prject WQMP thrugh such means as may be apprpriate, at the discretin f the lcal jurisdictin, including, but nt limited t cvenants, legal agreements, maintenance agreements, cnditinal use permits and/r funding arrangements. 7.II 4.1 Maintenance Mechanisms The fllwing are alternative mechanisms that may be used t prvide n-ging maintenance fr the BMPs included in the apprved Prject WQMP. Public entity maintenance: The lcal jurisdictin with the respnsibility fr WQMP apprval may apprve a WQMP that identifies a public r acceptable quasi-public entity (e.g., the City, the Cunty, r Cunty Fld Cntrl District, an existing assessment district, an existing utility district, r a cnservatin cnservancy) as assuming respnsibility fr peratin, maintenance, repair and replacement f the BMP. Unless therwise acceptable t individual lcal agencies, public entity maintenance agreements shall ensure estimated csts are frnt-funded r reliably guaranteed, (e.g., thrugh a trust fund, assessment district fees, bnd, letter f credit r similar means). In additin, the lcal jurisdictins may seek prtectin frm liability by apprpriate releases and indemnities. The Prject Prpnent must demnstrate that it will transfer the BMP maintenance t anther public entity subject t the fllwing prvisins. Lease prvisins: In thse cases where the lcal jurisdictin hlds title t the land in questin, and the land is being leased t anther party fr private r public use, the lcal jurisdictin may assure strmwater BMP maintenance, repair and replacement thrugh cnditins in the lease. Cnditinal use permits: Fr discretinary prjects nly, the lcal jurisdictin may assure maintenance f strmwater BMPs thrugh the inclusin f maintenance cnditins in the cnditinal use permit. Security may be required. Sme jurisdictins include requirements t implement apprved WQMPs in their municipal cde. Alternative mechanisms: The lcal jurisdictin may accept alternative maintenance mechanisms if such mechanisms are as prtective as thse listed abve. 7.II 4.2 Maintenance Requirements 7.II O&M Plan An Operatin and Maintenance Plan fr the BMPs will be prepared and included as Sectin 5 f the final Prject WQMP. The lcal jurisdictin shall ensure that the O&M plan, prepared by the prject prpnent satisfactry t the agency, is received prir t permit clseut and the issuance f certificates f use and ccupancy. The O&M Plan describes the designated respnsible party t manage the strmwater BMP(s), emplyee's training prgram and duties, perating schedule, maintenance frequency, rutine service schedule, specific maintenance activities, cpies f resurce agency permits, and any ther necessary activities. The final Prject WQMP shall require the prject prpnent r apprved maintenance entity t cmplete and maintain O&M frms t dcument all maintenance requirements. Parties respnsible fr the O&M plan shall retain recrds fr at least 5 years. These dcuments shall be made available t the lcal jurisdictin fr inspectin upn request at any time. 7.II O&M Cmmitments At a minimum, the final Prject WQMP shall require the inspectin and servicing f all structural BMPs n an annual basis. As part f the maintenance mechanism selected abve, the lcal jurisdictin shall require the inclusin f a cpy f an executed access easement within the final Prject WQMP that shall be binding n the land thrughut the life f the prject, until such time that the strmwater BMP requiring access is replaced, satisfactry t the lcal agency. 41 7.II 4.3 Permit Clseut Requirements Fr discretinary prjects, the methd apprved by lcal jurisdictin fr strmwater BMP maintenance shall be incrprated int the prject's permit, and shall be cnsistent with permits issued by resurce agencies, if any. Just as with all ther aspects f a prject s apprved plans and designs, the lcal authrity will make a determinatin that all requirements f the Prject WQMP have been satisfactrily cmpleted prir t clseut f permits and issuance f certificates f use and ccupancy (see DAMP Sectin 7.6.6). Fr prjects requiring nly ministerial permits, the methd apprved by lcal jurisdictin fr strmwater BMP maintenance shall be shwn n the prject plans befre the issuance f any ministerial permits. Verificatin will ccur similar t discretinary prjects. In all instances, the prject prpnent shall prvide prf f executin f a methd apprved by lcal jurisdictin fr maintenance, repair, and replacement (O&M Plan See DAMP Sectin 5.3) befre the issuance f cnstructin apprvals, permit clseut and issuance f certificates f use and ccupancy. 42 7.II 5.0 WQMP Preparatin and Apprval The preceding sectins describe the requirements and prcess fr develping site design; selecting the apprpriate LID BMPs, ther BMPs, and/r identifying ther cmpliance appraches; and identifying the BMP maintenance requirements fr Pririty Develpment Prjects. This sectin describes the prcess fr dcumenting this infrmatin in a Cnceptual r Preliminary WQMP and/r Prject WQMP and fr submitting and btaining apprval f the Prject WQMP. Prject prpnents are strngly encuraged t incrprate LID and hydrmdificatin cntrl BMPs at the earliest cnceptual planning stages f a prject fr early review, t ptentially avid necessary prject changes and delays during the subsequent review and apprval prcess. Fr all prjects requiring discretinary r land use entitlement actins, a Cnceptual r Preliminary WQMP shuld be submitted as part f the applicatin fr prject apprval during the envirnmental review phase (CEQA) and must be submitted prir t relevant prject-level apprval f entitlements and Planning Cmmissin apprval f a prject r ther public hearing. The lcal jurisdictin will assure that a final Prject WQMP is submitted fr review and apprval prir t issuance f grading r building permits. The final Prject WQMP must be prepared by r under the directin f a Califrnia Registered Civil Engineer and affixed with their stamp unless specifically exempted frm this requirement by the Permittee. 7.II 5.1 Cnceptual r Preliminary WQMP Preparatin T facilitate early water quality planning and ensure that water quality prtectin and LID principles are cnsidered in the earliest phases f a prject, a the lcal jurisdictin will suggest that the prject prpnent prepare a Cnceptual r Preliminary WQMP prir t a cmplete r final Prject WQMP fr full review and apprval. A Cnceptual r Preliminary WQMP may be used by the lcal jurisdictin during the land use entitlement prcess r as part f a prject applicatin fr discretinary prject apprval. A Cnceptual r Preliminary WQMP supprts the CEQA prcess and prvides dcumentatin t supprt a checklist fr an Initial Study and Negative Declaratin r Mitigated Negative Declaratin, r serves as the basis fr the water quality sectin f an EIR. It shuld als serving as the basis fr the Lead Agency and Respnsible Agency t cnclude that the MEP standard is being met, by serving as the basis that selected BMPs will nt have the ptential t cause significant effects and/r that the effects have been mitigated, and are nt significant with mitigatin. The Cnceptual r Preliminary WQMP shuld t be circulated with the CEQA dcument r summarized within the circulated CEQA dcument. If the prject is participating in an alternative prgram such as a cntributin t a Runff Mitigatin Fund r Participatin in a Mitigatin Prgram, the Prject WQMP must describe and dcument the Prject s participatin. The Final Prject WQMP, when prepared fr submittal fr apprval, must be certified by the wner, and must include elements agreed upn at Cnceptual r Preliminary WQMP acceptance and any revisins prpsed. A WQMP Template has been prduced t assist prject prpnents with develping a Prject WQMP (available at The Final Prject WQMP must be cnsistent with the Cnceptual r Preliminary WQMP. If there are any substantial differences, the lcal jurisdictin must make a determinatin that the differences d nt diminish the effectiveness f the BMPs t mitigate r address the prject's ptential impacts t water quality.
