3 Section 7 Table Legislation Climate, Natural Hazards and Climate Change Landscape and Visual Amenity Adani and its contractors will comply with all relevant Commonwealth, State and local government legislation, and will be licensed appropriately Adapting to the potential adverse impacts of climate change upon the port operation and the Abbot Point area Undertaking regular energy audits during operation. If these audits identify that the Project exceeds the values specified in NGER Act, Adani will adhere to the obligations of the NGER Act Adani will undertake an Australian Green Infrastructure Council assessment process to guide design, procurement, and operational policy Adani will contribute to monitoring, research, habitat protection, or if required, habitat restoration activities mutually agreed to and supported by all proponents at the Port of Abbot Point The colours for on-site infrastructure will allow infrastructure to naturally blend with the surrounding landscape, including adjacent infrastructure if appropriate A site specific ASS assessment will be developed for construction works Soils, Geology and Topography An Erosion and Sediment Control Plan (ESCP) will be prepared to define construction contractor requirements Areas of identified dispersive soils shall be monitored to assess the efficacy of erosion control measures A drainage design addressing runoff volumes and erosion minimisation will be implemented Barriers to prevent public access to construction areas will be provided Use of water sprays, odour suppressants and/or odour causing material covered by plastic or mulch to mitigate odour emissions Contaminated Land and Land Disturbance Implementation of material haulage controls, including covering loads or wetting material to reduce airborne dust emissions Documentation of all contaminated material during transport operations and monitoring movement and disposal Carriers of dangerous goods will maintain a communication system and will carry firefighting and spill response equipment A program of regular equipment inspection and testing will be implemented to ensure reliable performance 7-1

4 Operators will be trained in the safe operation of the system and emergency response procedures in the event of fuel oil leakage Spill containment equipment will be available for use in the event of spillage A sump will be provided to collect any spillage and allow recovery of fuels and chemicals Ignition sources will be strictly controlled and limited to avoid a fire Tank level indicators will be installed on fuel oil tanks for monitoring of fuel oil levels Fuel, oil and chemical storage areas will be designed in accordance with Australian Standards and best practice Procedures for handling and use of fuels, oils and other chemicals will be developed Workers will be trained in proper procedures for handling and use of fuels, oils and other chemicals Treated water from the sediment ponds will be tested as outlined in the Surface Water MP and records of treated water will be kept Surface Water Quality and Hydrology All hazardous chemicals will be stored in compliance with the WHandS Act and NOHSC Approved Criteria for the Storage and Handling of Flammable and Combustible Liquids Prior to construction activities commencing, Adani will develop and implement an ESCP to mitigate the potential for sediment rich overland flow Hydrogeological monitoring will be undertaken where activities are likely to cause localised lowering of groundwater levels Site investigation and monitoring to determine contaminants of concern, contaminant concentrations, contaminant sources and hydraulic properties of key aquifers Groundwater Environmental management practices and procedures will be followed during construction of the Project, including for dewatering activities that are likely to be required during excavations for deep infrastructure such as for dump station vaults Regular auditing will be undertaken for erosion and sediment control measures, surface water diversion methods and groundwater quality analyses to determine effectiveness of the adopted mitigation measures Monitoring of groundwater quality conditions will be undertaken before, during and after construction and ensure any impacts to groundwater quality are identified and addressed effectively Coastal Processes If abutment is required for the Project jetty, the general design of the existing jetty abutment revetment will be maintained to ensure no adverse additional impacts on longshore transport are created Terminal 0 Environmental Impact Statement 7-2

5 An investigation of the beneficial impacts of sand bypass from south of the MOF to north of the MOF channel will be undertaken A shoreline erosion management plan will be developed Where practicable all buildings, workshops and storage areas will be located outside the erosion prone area Adani will follow the recommendations of the Abbot Point CIA (ELA and OpenLines 2012) and McCauley (2012) concerning underwater noise Turtle monitoring program will be undertaken to manage lighting related impacts on nesting turtles pre and post construction, and to validate the lighting model prepared for the Abbot Point CIA (ELA and OpenLines 2012) as it pertinent to Abbot Beach Marine Ecology A Port wide pest management response will be engaged in accordance with the overarching requirements of NQBP Adani will develop or link to an existing water quality survey program including assessing any potential impacts of coal dust on the marine environment through the validation of the BMT WBM (2012) model included in the Abbot Point CIA (ELA and OpenLines 2012) Ongoing engagement with commercial and recreational fishing stakeholders via a port-wide engagement process led by NQBP Aquatic Ecology Stormwater, ESC and Weed and Pest Management Plans will be developed and implemented prior to construction commencing Plant and equipment will be switched off when not required. Machines such as cranes that might have intermittent use should be shut down between work periods or should be throttles down to a minimum. Plant and equipment noise attenuation will be adopted and maintained An internal roads maintenance program will be developed and implemented Transfer chutes will be designed to minimise product impact and associated noise Noise and Vibration The drop heights of materials will be minimised Low noise idlers usage on the conveyors Sequential starting up of plant and vehicles rather than all together Excessively loud reversing warning systems on mobile plant and vehicles will be avoided Sources of significant noise will be enclosed when practicable Plant to be used in accordance with manufacturers instructions Terminal 0 Environmental Impact Statement 7-3

6 Plant noise will be directed away from noise-sensitive areas as far as practicable Acoustic covers will be used on engines where available Real-time monitoring program designed to collect ambient noise data throughout the construction and operational phases will be implemented Operations will be notified when monitoring system alerts that a noise criterion has been exceeded. An investigation into the cause will be undertaken and mitigation measures adapted accordingly. Development of an underwater piling noise management program for the key marine fauna species: Establish suitable exclusion zones and observation areas based on the zones of impact identified in McCauley et al. (2012) for relevant species, impact types and scenarios; Outline the requirements for monitoring marine fauna species including the monitoring method and timing in relation to operations (especially night time considerations); Define appropriate conditions to undertake work, triggers for reactive management and the necessary mitigation or management measures to monitoring results; and Be developed and implemented under the Marine Environment Management Plan No pile driving activities will commence, resume or continue if key marine species are observed within the zones of estimated physiological impacts (defined in McCauley et al. 2012) Adani will commit to installation of underwater noise loggers for the initial 30 day piling period for the purpose of model validation and confirmation of the exclusion zone distance to reflect 183 db re 1μPa 2.s Soft start procedures will be used for piling activities with pile driving plants spaced as far apart as practicable during construction and hammers started at the lowest power setting and brought up to required operational power over three minutes. Simultaneous pile driving and the operation of multiple pile driving plants on the outer wharf will be minimised. Adaptive management techniques will be employed and zones modified accordingly in consultation with regulators Acoustic monitoring will be undertaken in order to verify the sound transmission modelling and form the basis for estimating zones of impacts. Key marine fauna species must be monitored within the exclusion zones and observation areas Air Quality Managing short term dust emissions during the construction phase through a comprehensive dust management plan Implementing dust control measures, such as water spraying at stockpiles, using partially enclosed conveyor systems and covered coal unloading system Terminal 0 Environmental Impact Statement 7-4

7 Implementing a dust monitoring program across the site that includes dust monitoring points and a meteorological station to provide an accurate measure of local weather condition Preparing specific dust control and mitigation measures as part of the decommissioning strategy Lighting Adani will undertake a turtle nesting monitoring program. The program will be designed to ensure that any potential lighting impacts associated with the Project can be monitored and if required further mitigation measures can be developed Adani will develop a rehabilitation and decommissioning plan during the operation of the Project to address issues relating to shipping activities during decommissioning Adani will develop and implement management plans for waste materials that reflect Port Authority requirements and in accordance with legislation Shipping Adani will have ongoing engagement with Maritime Safety Queensland for relevant aspects of terminal development, construction and operation Adani will prepare a Shipping Management Plan which will take into account measures appropriate to maintaining the Particularly Sensitive Sea Area (PSSA) status of the Great Barrier Reef Adani is committed to implementing the national guidelines and requirements relating to ballast water and biofouling and supports the port wide introduced marine pest monitoring requirements (environment and infrastructure) Adani will actively encourage the use of the proposed bus service for employees and sub-contractors during the construction and operational phases, as a means of reducing the amount of vehicles entering the site The road pavement condition will be monitored along Abbot Point Road and at the intersection with the Bruce Highway. Adani will provide NQBP and DTMR with a road condition report at the beginning, middle and end of construction activities. The findings from this report will be used to establish any potential pavement impacts and necessary mitigation requirements Road Traffic and Transport The quantity of materials that will be provided in each vehicle load entering the site will be maximised High occupancy transportation vehicles will be provided to service the construction accommodation camp Assessment and application for appropriate permits to be undertaken for over dimension transport to the site. This shall include a review of the DTMR Conditions of Operation Database, which provides an updated source of restrictions for OD vehicles, including around temporary roadwork Truck drivers to conduct themselves with appropriate care towards local residents. This will include limiting the use of air brakes in townships and near residences, restricting the movements of heavy vehicles to within standard business hours where possible, and driving in a safe and responsible manner All heavy vehicles leaving the site will be subject to inspection and treatment of tyres to limit loose material transportation Terminal 0 Environmental Impact Statement 7-5

8 Delivering materials, plant and equipment by sea where practicable A Road Use Management Plan will be developed Non-Indigenous Cultural Heritage Adani commits to the implementation of procedures during site activities that aim to identify, assess and record undetected non-indigenous cultural heritage sites, including the appropriate induction of relevant Project personnel Consultation with traditional owners of the land will continue to be undertaken in regards to identifying and protecting any Indigenous cultural heritage that may be discovered within the Project area in the future Indigenous Cultural Heritage Avoid, minimise, and manage adverse impacts from Project activities on known and unknown Indigenous cultural heritage objects, sites, and places will be avoided, minimised and managed Establishing a physical barrier between the T0 Project and the eastern dune area by maintaining a 50 m buffer and establishing a bund wall, fencing, vehicle rail guards and signage along the boundary of this area A local employment program will be developed and implemented for local latent workforce population Contribute to a work experience and training program to identify employment opportunities for providers which can access the available pool of skilled labour in the region Teaching and administration of training programs will be supported Non-resident workforce will only be used when a demand for skills exceeds supply within the local government area A Transport Management Plan will be developed and implemented Economic Matters Local businesses will be utilised for supplies and industrial processes A workers accommodation camp will be developed near the site so that demands will not be placed on local commercial accommodation as well as preventing a shortage of residential housing properties A workers code of conduct for non-resident workers employed during the construction phase will be developed and implemented A housing market monitoring program will be developed and implemented for the Bowen SLA and WRC Skills development and training programs will be reviewed on a regular basis Ongoing review of the uptake of supply contracts by local businesses will be undertaken and online feedback opportunities will be provided for suppliers Terminal 0 Environmental Impact Statement 7-6

9 Social Matters A Stakeholder Engagement Strategy will be developed and implemented A workforce management plan will be developed and implemented Develop and implement management plans that influence the management of social impacts and opportunities including: Project Environmental Management Plan (construction and operation), Cultural Heritage Management Plan, Traffic Management Plan and Emergency Response Plan Adani is committed to recycling as much waste material as possible and will continually revise their waste management and recycling strategy Throughout the life of the Project, Adani will liaise with Whitsunday Regional Council and other relevant groups to determine existing capacities and accepted waste types of their landfills and where required assist with the planning of expansion and upgrade of landfills to ensure wastes generated from the Project can be accommodated When sourcing waste contractors preference will be given to local businesses employing sustainable waste management practices Waste Management Work with local businesses so that they can take advantage of opportunities for reuse and recycling Describe the management and control of construction and operational activities to ensure that all parties involved are aware of their environmental obligations in relation to waste management Ensure that all waste-related environmental aspects and impacts for each phase of the Project are addressed Ensure that best management practice and mitigation measures are incorporated into all Project activities and consider sustainable management principles and opportunities where appropriate Developing and implementing a Project specific WHS Management System which is compliant with the requirements of all relevant legislation Ensure all staff and relevant sub contractors undertake a compulsory induction training course for WHS Provide adequate and appropriate PPE for all personnel to ensure their safety Health, Safety and Risk Management Undertake ongoing monitoring and auditing of the WHS Management Plan to ensure its adequacy Ensure handling and storage procedures for potentially hazardous chemicals are in compliance with relevant legislation and Australian Standards Ensure all site equipment undergo maintenance and servicing by a qualified and licensed contractor at scheduled intervals Undertake ongoing inspections and implement maintenance programs to ensure structural integrity of infrastructure and equipment Consider potential impacts of climate change on human health risk Terminal 0 Environmental Impact Statement 7-7

10 Construct infrastructure under a formal IRMP in accordance with the requirements of all relevant legislation Undertake the operations of the coal Terminal under a formal IRMP in accordance with the requirements of all relevant legislation Monitor and amend the IRMP on a frequent basis to ensure its applicability and currency is maintained through the life of the Project Frequently liaise with internal and external WHS personnel in regard to the maintenance and improvement of the IRMP Ensure that all emergency response procedures part of the ERP are compliant with the requirements of all relevant legislation Develop and implement an ERP to address all potential site-based emergencies Provide flow-charts for various emergency scenarios for safe response Ensure all site personnel are trained and inducted in the various ERP procedures Cumulative Impacts Adani will commit to collaborating with other terminal proponents and the Port Authority so as to manage cumulative residual impacts Terminal 0 Environmental Impact Statement 7-8
