4 SRK Consulting: : Audit Report 05 Page 1 1 Introduction The ethekwini Municipality Huan Settleents Unit (ethekwini) is in the process of undertaking the Kloof Extension 15 and 21 Housing Upgrade developent project. An Environental Authorisation (EA) was granted for this project on 11 August The Authorisation requites that environental copliance onitoring be undertaken during the construction phase. An independent qualified Environental Control Officer (ECO) is required to undertake environental copliance onitoring for the duration of the construction phase. 2 Details of the EAP Table 2-1 provides inforation on the copilers of this docuent and their related experience. Counity Developent 4 years The EAP declaration is attached at Appendix 1 while the CV s of the tea are included at Appendix 2. 3 Purpose and Scope The purpose of the audit was to deterine copliance with the EA, EMPr and Section 19(1) (B) Directive fro the Departent of Water and Sanitation (DWS). This report provides a suary of the findings for the Environental Copliance site audits, undertaken on 12 July 2017 and 28 July 2017, and any issues identified. As noted in the previous audit report (July 2017), the scope of the site visit included the setup of the construction cap and site clearance for Phase 1 of the Kloof Extension 15 and 21 Housing Upgrade Developent Project. The environental site inspections were undertaken by Mrs. P. Bureister and Mr. T. Nebula of SRK, Mr. S. Masango of ethekwini Municipality and Ms. K. Naidoo and Mr. Suyesh Naidoo of Shula Construction. 4 Methodology 4.1 Approach The SRK approach included the following tasks: Conducting site visits on 12 July 2017 and 28 July Auditing the site based on the checklist copiled that is based on the requireents of the EA, EMPr and Section 19(1) (B) Directive fro DWS. Preparing a report docuenting the findings of the audit, observations ade while on site, and recoendations ade to address on-going issues. 4.2 Consultation A coplaints register is aintained on site. Coents fro Interested and Affected Party s (I&AP s) are recorded therein. All relevant Health and Safety legislation will be strictly adhered to including the Occupational Health & Safety Act, 1993 (Act No. 85 of 1993). A full Occupational Health and Safety Prograe will be developed and ipleented. Construction caps ust be situated away fro any adjacent properties and at a iniu distance of 50 away fro any watercourses, wetlands or drainage lines. As noted in the previous audit, the following still reains: The construction cap has been established and fenced with a controlled access point (refer to Plate 1). The fencing includes shade cloth that will act as a protection against wind for the waste storage areas used during construction. The cap is located on the only piece of Municipal owned land that was clear, easily accessible to all four phases of the project and not affected by the construction. Health and safety protocol and signage has been observed during the audit site inspection. No non-conforances were noted. As noted in the previous audit, the construction cap is secured thereby reducing the opportunity for criinal activity. A spill kit is available in the site office, a copy of the SCP is in the environental file kept in the site office and a list of hazardous aterials on site is kept on the wall in the site office A diesel tank trailer has been placed in a bunded area in the construction cap site office. It is noted that the diesel tank is obile and gets taken off site to refuel. Because it is obile it is not possible to copletely enclose the bunded area. Therefore, it has been recoended that the bunded area be constructed such that the floor slopes towards the back of the bunded area and includes a speed bup. This is to ensure that in the event of a spill the bunded area will be able to contain the spill. As noted fro the previous audit, the Contractor has anaged to use their water tanker fro another site for soil wetting to this site to iniise dust (refer to Plate 6). As noted in the previous audit, the whole of Phase 1 has been cleared and as such there is a large area of exposed soil. Sourcing raw water for construction and dust suppression is noted as a constraint as an abstraction point has yet to be identified by ethekwini in agreeent with DWS. The Contractor is currently aking use of an established abstraction point. It is however far fro the site resulting in increased costs and tie delays. Regular dust suppression spraying was however observed despite the issues (refer to Plate 6). No non-conforances were noted. Soil copaction in the establishent of the platfors and roads has liited soil erosion and significant erosion has not been observed during site visits (refer to Plate 7). The Construction and Operation Stor Water Manageent Plan (SWMP) has been updated and sent to the departent of EDTEA and DWS, as a result to avoid a household that has been constructed along the pipeline to the discharge point. As noted in the previous audit report, the reason for the extensive clearing is twofold. Firstly, there are social issues with the counity that required the developable area to be cleared to avoid people returning to portions of the site during the construction phase. Secondly, it is not financially viable to keep a TLB on site for the duration of the construction phase. No non-conforance was noted. As noted in the previous audit report, the bers and grading of the site will not create sufficient stor water control and additional echaniss of stor water anageent were discussed with the Contractor. No nonconforance was noted. The Contractor, in consultation with the ethekwini Municipality and wetland specialist, ust ipleent ore foral stor water anageent easures to itigate the potential for soil erosion. This is particularly iportant as the site slopes north to the wetland and should a stor event occur the wetland could potentially be affected. (Conditions 5.1.1, and of the EMPr; Conditions 3.3.4, of the EA; and Condition 2 of the DWS Section 19(1)(B) Directive). As noted in the previous audit reports, that the counity was using the site as a vehicular access route and the counity has created a vehicle access point along the northern boundary of the site gaining access to the wetland. The concern noted in the previous audit regarding the relocated houses fro phase 1, into the wetland boundary, has been verified by the surveyor findings. There are fifteen (15) houses within the wetland buffer and only forty seven (47) houses outside the wetland buffer, (refer to appendix 5). There are however approxiately 120 beneficiary households in Phase 1. The dwellings established outside the wetland buffer will be used to ove people into, for the other phases. To prevent access to the wetland, the contractor has installed danger tape along the boundary of the access road and along the edge of the wetland buffer area (refer to the yellow arrows in Plate 8). Furtherore, concrete bollards have been placed at the ain entrance to the site thereby preventing access to the site and ergo access to the wetland (refer to Plate 9). These itigation easure appear to have liited vehicle access to the site and then through the wetland. Relocation of hoes into the wetland buffer is considered a ajor non-conforance ethekwini is to consult with Departent of Environental Planning & Cliate Protection Departent. (EPCPD) regarding an acceptable way forward with regards to the fifteen (15) houses within the wetland buffer. Relocation Plan (Condition of the EA) Construction has coenced, in the for of site clearance and establishent of services and platfors. An updated EMPr was subitted to the EDTEA on the 26 th of June 2017 for approval. The Method stateents have been reviewed by the ECO and saved on the Environental file. Approval of the EMPr subitted to the EDTEA on the 26 th of June 2017 is awaited. As per the concern noted in the previous audit, with regards to the verification of the relocated houses fro phase 1 into the wetland boundary. The findings have been verified by the surveyor. There are fifteen (15) houses within the wetland buffer and only forty seven (47) houses outside the wetland buffer. It should also be noted that there are approxiately 120 beneficiary households for Phase 1. The Relocation Plan subitted during the Basic Assessent Process required aending during the ipleentation thereof (refer to Appendix 3 for a copy of the revised plan). The counity fro Phase 1 were not teporarily relocated to a transit cap (refer to updated RAP for explanations) and as such were provided with aterials to construct teporary dwellings within Phases 3 and 4 of the project. As noted in the previous audit, a onitoring prograe is yet to be finalised and ipleented. Once approved, as noted above, the EMPr in the Environental file on site will need to be replaced.
