We have made a preliminary determination that the aquatic resources that would be impacted by the proposed project are subject to Corps of Engineers jurisdiction under Section(s) 9 & 10 of the Rivers and Harbors Act of 1899 and/or Section 404 of the Clean Water Act. f an approved jurisdictional determination is completed as part of the review process for this application, a copy will be posted on the St. Paul District web page at the following link: Project: Cloquet ndependent School District 94 is proposing to construct a new middle school on a vacant lot south of the existing high school on 18 th Street, Cloquet, MN. This work is needed to replace the outdated and undersized middle school. PROJECT DESCRPTON AND PURPOSE: A Facilities Planning Task Force, along with a third-party random sample, reached the conclusion that the school district needs to replace the aging, outdated, and undersized middle school. The school district proposes to construct the new middle school on a vacant parcel south of the existing Cloquet High School because of its current ownership by the school district, its proximity to the high school, existing municipal services, and its central location for community use and transportation convenience. The new Cloquet Middle School would be approximately 142,123 square feet with multiple levels, an 8 lane indoor pool, a 1700 seat gymnasium, 166 stalls of parking, storm water treatment areas, and an access road with 8 walking path from Washington Avenue. The school 1

2 would create educational opportunities for 800 students, grades 5-8, as well as a facility for community use and physical education. A 650 long by 24 wide access road, with a turn lane and an 8 walking path is proposed off of Washington Avenue conveying traffic to two parking lots. The east parking lot consists of 43 stalls, and the west parking lot consists of 122 stalls. Two infiltration basins and 1 storm water pond are proposed for true infiltration of storm water. The school would have a 1700 seat gymnasium with three basketball courts and an 8 lane indoor pool; both would serve as recreational facilities for the community as well as for middle school and high school events. Erosion control measures would be in place such as silt fence, erosion control blanket, sediment control logs, and sediment control devices at storm sewer inlets. The disturbed areas would be reseeded and/or planted to limit erosion and further impact to wetlands. NAME, AREA AND TYPES OF WATERS (NCLUDNG WETLANDS) SUBJECT TO LOSS: The project would result in permanent impact to 23,942 square feet (0.55 acres) of wet meadow and forested wetlands adjacent to an unnamed tributary to the St. Louis River. The work for this project would include the construction of an access road with a turn lane and 8 walking path through a small wetland, accounting for 1,250 square feet of wetland impacts. The work for this project would also include the construction of two parking lots and a 142,123 square-foot middle school, accounting for 22,750 square feet of wetland impacts. Erosion control measures would be in place to ensure additional wetland impacts do not occur. All affected areas would be restored, seeded, and/or planted as necessary to restore vegetation and prevent erosion. ALTERNATVES CONSDERED: The no build alternative consisted of preserving the site, and leaving the students to use the existing facility. This alternative was abandoned due to the need for an updated and reliable middle school with physical education qualities utilized for extracurricular activities and by the community. Alternative 1 This is the original concept consisting of a 142,123 square-foot school, 650 long by 24 wide access road, and 664 parking stalls. This alternative required 92,000 square feet (2.11 acres) of wetland impact and was dismissed. Alternative 2 This is the revised concept to alternative 1. The gymnasium seating was reduced from 2500 seats to 1700 seats. According to the 1 stall per 5 gymnasium ratio, this allowed for a reduction in parking stalls from 664 to 355. This alternative still required 50,000 square feet (1.15 acres) of wetland impact. Due to the high amount of wetland impact, this alternative was also dismissed. Preferred Alternative This has the same building configuration and driveway entrance as alternatives 1 & 2. However, the school district took the high school parking stalls into account for the gymnasium to parking ratio. This allowed for the number of parking stalls to be reduced to 166. This alternative has reduced wetland impacts by 52%, and for this reason it is the preferred alternative. COMPENSATORY MTGATON: The applicant proposes to compensate for the loss of function associated with this project by purchasing 0.55 acres of wet meadow wetland credits to be debited from the University of Minnesota Wetland Mitigation Bank in Bank Service Area 1.
