4 SECTION B Section B: Status of Compliance with Permit Conditions A: PUBLIC EDUCATION AND OUTREACH The status of BMPs and measurable goals performed in Year 2 are described below. The Village of Lake Zurich committed to continue conducting Public Education and Outreach as part of its permit. Public Education and Outreach requires implementation of a program to distribute educational material to the community or conduct equivalent outreach activities about the impacts of storm water discharges on water bodies and the steps that the public can take to reduce pollutants to stormwater runoff. The Village of Lake Zurich committed to implementation of BMPs related to A.1 and A.4. Also, the Village is trying to continue engaging the public through Boy/Girl Scouts and Homeowner Associations related to A.2 and A.6. A.1 Distributed Paper Material Measurable Goals: Continue the distribution of informational materials from take away rack located at the Village Hall, Main Lobby and 2 nd Floor Building and Zoning counter. The Village of Lake Zurich provided informational material related to stormwater runoff and a variety of other stormwater related materials on a take away rack. Additionally, all take away material is available on our village web site and through special events such as Arbor Day and High School events. A.4 Community Event Measurable Goals: A soil erosion and sedimentation control discussion will take place on every project with the developer and his contractors. Also, Conduct soil erosion and sediment control workshop (bi-annual workshop scheduled to be conducted in 2004) and Illicit Discharge Workshop. The Village of Lake Zurich will continue providing educational information for every project in town to the developer and his contractors. A one-hour discussion on erosion and sediment control practices will take place. * Measurable goal: The Village of Lake Zurich will continue enforce the Village WDO 4

5 SECTION B B: PUBLIC PARTICIPATION/INVOLVEMENT The Village of Lake Zurich will continue to performing activities and services related to Public Participation/Involvement minimum control measure under BMP number B.3, B.4 and B.7. B.3 Stakeholder Meeting Measurable Goals: The Village will continue involvement with a number of watershed planning committees along with the Lake County Stormwater Management Commission on new watershed planning effort. The Village of Lake Zurich provides educational information and updates on our village web site that includes a feedback form. The Village of Lake Zurich has provided a link to the Lake County Stormwater Management Commission s website. B.4 Public Hearing Measurable Goals: The Village of Lake Zurich is conducting a monthly public hearing for new development, which will give the public an opportunity to raise any issues related to the stormwater management and natural resource protection areas. Also, the Village of Lake Zurich participated in the Illicit Discharge Workshop that was sponsored by the APWA and SMC at the College of Lake County. The Village of Lake Zurich Engineering staff will continue recommending to the Board of Trustees to adopt a Stormwater Regulations, which will be announced at a televised meeting. B.7 Other Public Involvement Measurable Goals: The Village of Lake Zurich will continue conducting a storm inlets stenciling and creek clean up program with the Boys/Girls Scout and the Homeowner Associations throughout the Village. * 5

6 SECTION B C: ILLICIT DISCHARGE DETECTION AND ELIMINATION The Village of Lake Zurich committed to perform some activities related to the Illicit Discharge Detection and Elimination minimum control under BMP numbers C.1, C.2, C.4, C.5, and C.7. The status or progress for each of the measurable goals related to these BMPs is presented below: C.1 Storm Sewer Map Preparation Measurable Goals: The Village of Lake Zurich will add any new utility to the storm sewer atlas throughout the Village All the storm sewer outfalls were located on the map. The Village will continue to update the storm sewer map on a regular basis. Also, the Village may purchase GPS equipment to establish accurate bench marks throughout the Village Limit based on USGS Datum and to locate all the storm sewer conveyance system on a vertical and horizontal elevations C.2 Regular Control Program Measurable Goals: The Village of Lake Zurich will implement the Illicit Discharge Ordinance, which regulate illegal dumping in the storm sewer system. The Village of Lake Zurich will continue to enforce the Illicit Discharge Ordinance, which is posted on the Village web site C.3 Detection/Elimination Prioritization Plan Measurable Goals: The Village of Lake Zurich will continue working on develop a map of all the septic locations to conduct an inspection. The Village will enforce the 90 day sewer connection to all the residents that are served by septic to connect to the sanitary sewer line if available. The Village of Lake Zurich will continue to inspect and enforce the Illicit Discharge Ordinance C.4 Illicit Discharge Tracing Procedures Measurable Goals: The Village of Lake Zurich will continue developing a Stormwater Outfall Screening Program and Quality Assurance Guidelines. This Program will be used for identification and removal of inappropriate discharge to storm sewer system and surface water bodies The Village of Lake Zurich will continue to finalize and implement the Program. 6

7 SECTION B D: CONSTRUCTION SITE RUNOFF CONTROL The Village of Lake Zurich has adopted a Watershed Development Ordinance (WDO) that establishes the minimum stormwater management requirements for development in Lake County. The WDO, which is enforced by Lake Zurich as well as by SMC, establishes standards for construction site runoff control. The enforcement of the WDO, in conjunction with other Lake Zurich activities and functions, implements BMPs under BMP numbers D.1, D.2, D.3, D.4, D.5 and D.6. The status or progress for each of the measurable goals related to these BMPs is presented below. D.1 Regulatory Control Program Measurable Goal: Continue to enforce the Village of Lake Zurich WDO, participate in WDO revision, and adopt WDO amendment. The Village of Lake Zurich continues to enforce the countywide WDO,. D.2 Erosion and Sediment Control BMPs Measurable Goal: Continue to enforce the Village of Lake Zurich WDO,, participate in WDO revision, and adopt WDO amendment. Continue working with SMC to complete TRM updates on Wetlands Areas. Continue working with SMC to prepare TRM updates for other chapters. The Village of Lake Zurich continues to enforce the WDO. D.3 Other Waste Control Program Measurable Goal: Working with SMC to initiate the drafting of the WDO amendments. Discuss the control of waste and debris at construction sites at a minimum of one TAC meeting as the Village of Lake Zurich continue to be an active member of the TAC Committee. The WDO amendment has been drafted and is currently under review by the public prior to the final approval by the Board TAC. D.4 Site Plan Review Procedures Measurable Goals: Begin preparation of Ordinance Administration and chapter of TRM. The Village of Lake Zurich will continue to be an active member of the Lake County Stormwater Management Commission and TAC. D.5 Public Information Handling Procedures Measurable Goal: Track number of complaints received and processed related to soil erosion and sediment control. The Village of Lake Zurich is requiring a pre-construction meeting with all the builders that require a Watershed Development Permit. 7

8 SECTION B D.6 Site Inspection/Enforcement Procedures Measurable Goals: The Village will develop a Track number system for site inspections conducted by VOLZ. 8

9 TABLE OF CONTENTS E: POST CONSTRUCTION RUNOFF CONTROL As described above, the Lake County Watershed Development Ordinance (WDO) establishes the minimum stormwater management requirements for development in the Village of Lake Zurich. The WDO establishes standards for post-construction site runoff control. These standards apply to any new development or redevelopment resulting in over 0.5 acres of new impervious area. The enforcement of the WDO, in conjunction with other VOLZ activities and functions, implements BMPs under BMP numbers E.2, E.3, E.4, E.5, E.6 and E.7. The status or progress for each of the measurable goals related to these BMPs is presented below. E.2 Regulatory Control Program Measurable Goal: Continue to enforce the WDO, participate in WDO revision process, and adopt amendment. The Village of Lake Zurich continues to enforce the Watershed Development Ordinance E.3 Long Term O&M Procedures Measurable Goal: Continue to enforce the WDO, participate in WDO revision process, and adopt amendment. The Village of Lake Zurich continues to enforce the WDO which requires an Operations and Maintenance plan for all permitted stormwater/water quality treatment facilities. E.4 Pre-Construction Review of BMP Designs Measurable Goal: Continue to enforce the WDO, participate in WDO revision process, and adopt amendment. The Village of Lake Zurich continues to enforce the WDO. E.5 Site Inspections During Construction Measurable Goal: Continue to enforce the WDO. The Village of Lake Zurich continues to enforce the WDO which requires inspections at prescribed points during development. E.6 Post-Construction Inspections Measurable Goal: Continue to enforce the WDO, participate in WDO revision process, and adopt amendment. The Village of Lake Zurich continues to enforce the WDO. 9

10 SECTION B E.7 Other Post-Construction Runoff Controls Measurable Goals: Attend annual WMB meeting.and track number of BMP projects to which the Village of Lake Zurich has contributed funding. The Village has three BMP construction projects to which the Village of Lake Zurich has contributed funding. Part E5 contains a complete list of the projects. 10

11 TABLE OF CONTENTS F: POLLUTION PREVENTION/GOOD HOUSEKEEPING This minimum control measure involves the development and implementation of an operation and maintenance program to reduce the discharge of pollutants from municipal operations. This program must include a training program for municipal employees. VOLZ committed to implement the BMP number F.1 F.1 Employee Training Program Measurable Goal: The Village of Lake Zurich has conducted a Workshop for the Village employees and Ela Township Employees. Also, the Village will attend a Workshop sponsored by the Lake County Stormwater Management Commission in March and will continue to conduct workshop for the Village employees. The Village of Lake Zurich will develop training program for employees in relevant positions F.2 Inspection and Maintenance Program Measurable Goals: The Village of Lake Zurich is developing an inspection and maintenance program. The Village of Lake Zurich will continue to develop a long term inspection and maintenance program. Also, the Village of Lake Zurich will implement the inspection and maintenance program by training the appropriate employees on catch basin cleaning and regular street sweeping. F.3 Municipal Operations Storm Water Control Measurable Goals: The Village of Lake Zurich is using the Caliber M1000, this materials is been mixed with the salt (Material Specs is attached).the Caliber de-icer appeared to have significantly improves the eutectic point and phase change properties of MgCl2 and reduce the use of the salt. The Village of Lake Zurich will continue using the Caliber de-icer. F.6 Other Municipal Operations Controls Measurable Goals: The Village has published articles in the News Line addressing of improper waste disposal, Chemical Waste Disposal, Leaf Disposal, and Brush Disposal. The Village of Lake Zurich will continue to be a Partner with SWALCO to address the Chemical Waste Disposal. 11

12 SECTION C Section C: Information and Data Collection Results Year 2 activities consisted primarily of permit program planning efforts. Therefore, no information or monitoring data was collected during this period. 12

15 SECTION D B.4 Public Hearing Measurable Goals: The Village of Lake Zurich will continue conducting a monthly public hearing for new development which will give the public an opportunity to raise any issue related to the stormwater management and natural resource protection areas. Also, present Municipal NPDES Phase II presentation to municipal governing board. B.6 Other Public Involvement Measurable Goals: The Village of Lake Zurich will continue conducting a storm inlets stenciling and creek clean up program with the Boys/Girls Scout and the Homeowner Associations throughout the Village. C: ILLICIT DISCHARGE DETECTION AND ELIMINATION The Village of Lake Zurich will perform activities related to the Illicit Discharge Detection and Elimination (IDDE) minimum control. The majority of these activities will be related to IDDE program design. The requirements of an IDDE program include the following: Develop a storm sewer system map that shows the locations of all outfalls and the names and locations of all water of the US that receive discharges from those outfalls. Prohibit non-storm water discharges into the storm sewer system and implement appropriate enforcement procedures and actions. Develop and implement a plan to detect and address illicit discharges into the storm sewer system. Educate public employees, businesses and general public of hazards associated with illegal discharges and improper disposal of waste. Identify the appropriate best management practices and measurable goals. BMPs will be implemented under BMP numbers C.1, C.2, C 3, C.4, C.5, C.7 as described below. C.1 Storm Sewer Map Preparation The Village of Lake Zurich will prepare outfall map to allow for tracking of dry weather flow inspections and outfall maintenance. Measurable Goals: Create a map with all storm sewer outfalls discharging to receiving waters. Verify outfalls in the field and give each outfall a unique identifier to be used to Document inspections. Update map regularly as improvements or new developments occur. Submit map to SMC. 15

16 SECTION D C2 Regulatory Control Program The Village of Lake Zurich will review, consider and adopt ordinance language to prohibit nonstormwater discharges to the storm sewer or drainage system and to provide an enforcement mechanism for the illicit discharge detection and elimination program. Measurable Goals: The Village of Lake Zurich will continue to enforce the Illicit Discharge Ordinance, which is posted on the Village web site. DC3 Detection/Elimination Prioritization Plan The Village of Lake Zurich will develop a plan to detect and address illicit discharges. The plan developed by the MS4 will be dependent on several factors, including available resources, size of staff, and degree and character of its illicit discharges. SMC has assembled various sources of information, including case studies, on illicit discharge detection and elimination programs throughout the U.S. SMC will also co-sponsor an illicit discharge detection and elimination workshop. Measurable Goals: Begin development of IDDE program. Identify methods, activities, enforcement and schedule to identify and remove illicit discharges. (Suggested schedule: Design program and develop ordinance in Year 3, adopt ordinance by end of Year 4, program pilot in Year 4 and implement permanent program in Year 5.) Review information provided by SMC on how to develop IDDE program. Review case studies of IDDE programs. C.4 Illicit Discharge Tracing Procedures Measurable Goals: The Village of Lake Zurich will continue to finalize and implement the Program. C.5 Illicit Source Removal Procedures The Village of Lake Zurich will provide a convenient location where the general public can dispose of common household pollutants. Solid Waste Agency of Lake County (SWALCO) holds household waste collection events in various communities throughout Lake County. These events can be used to collect waste before it enters the MS4 s storm system through illicit dumping and also to publicize the Village of Lake Zurich s illicit discharge detection and elimination plan. Measurable Goals: Create and distribute materials educating public about elements of IDDE program. Contact SWALCO for relevant waste collection events in your community. Coordinate with SWALCO to market waste collection events to the public. Conduct event and document participation. Establish an illicit discharge/illegal dumping hotline for citizens to report illegal dumping and suspicious discharges. Advertise hotline in local newsletter. 16

17 SECTION D C.7 Visual Dry Weather Screening The Village of Lake Zurich will begin to pilot dry weather screening activities in support of IDDE program development on needed bases. Measurable Goals: Establish an illicit discharge/illegal dumping hotline for citizens to report illegal dumping and suspicious discharges. Advertise hotline in local newsletter. Pilot activities used to identify illicit connections such as dry weather field screening and targeted video inspection. E: POST-CONSTRUCTION RUNOFF CONTROL As described above, the Lake County Watershed Development Ordinance (WDO) establishes the minimum stormwater management requirements for development in VOLZ. The WDO establishes standards for post-construction site runoff control. These standards apply to any new development or redevelopment resulting in over 0.5 acres of new impervious area. The enforcement of the WDO, in conjunction with other VOLZ activities and functions, implements BMPs under BMP numbers E.2, E.3, E.4, E.5, E.6 and E.7. The status or progress for each of the measurable goals related to these BMPs is presented below. E.2 Regulatory Control Program Measurable Goal: The Village of Lake Zurich will continue to enforce the WDO. E.3 Long Term O&M Procedures Measurable Goal: The Village of Lake Zurich will continue to enforce the WDO, participate in WDO revision process, and amendments. Allow, when appropriate, that grassed swales or filter strips be installed along roadsides in lieu of curbs and gutters to reduce directly connected impervious surfaces in new developments and redevelopment projects. Inventory new and existing detention facilities E.4 Pre-Construction Review of BMP Designs Measurable Goal: The Village of Lake Zurich will continue to enforce the WDO, participate in WDO revision process, and adopt amendments. Begin process of conducting inventory of structural runoff controls. 18

19 SECTION D E.5 Site Inspections During Construction Measurable Goal: The Village of Lake Zurich will continue to enforce the VOLZ WDO, participate in WDO revision process, and adopt amendments. 23 SECTION E E2 E2. STATUS OF COMPLIANCE WITH PERMIT CONDITIONS The Lake County Stormwater Management Commission (SMC) will serve as a Qualifying Local Program for MS4s in Lake County. As part of ongoing services, SMC will perform functions related to each of the six minimum control measures. The status of BMPs and measurable goals performed in Year 2 are described below. All BMPs were deemed appropriate, through evaluation of the status of the BMP, unless specifically detailed in Part E1. A: PUBLIC EDUCATION AND OUTREACH The SMC committed to conduct Public Education and Outreach as part of its ongoing countywide services. Public Education and Outreach requires implementation of a program to distribute educational material to the community or conduct equivalent outreach activities about the impacts of storm water discharges on water bodies and the steps that the public can take to reduce pollutants to stormwater runoff. The SMC committed to implementation of BMPs related to A.1, A.3, A.4, and A.6. The status or progress for each of the measurable goals related to these BMPs is presented below. A.1 Distributed Paper Material Measurable Goals: Distribute informational materials from take away rack at SMC. Distribute materials to MS4s for local distribution. Develop or coordinate manuals or manual updates related to stormwater management. Various NPDES II related information is available on SMC s take away rack and on its website. This information is distributed to MS4s through mail-outs and in PDF format for use on MS4 websites. SMC completed updates to its Homeowners Guide to Stormwater Best Management Practices and made it available in hard copy and in PDF format. SMC also includes nonpoint source pollution reduction messages on over 2000 envelopes. A.3 Public Service Announcement Measurable Goal: Include public service announcement highlighting community accomplishments related to the NPDES Phase II process in Mainstream once annually. Post watershed identification signage with LCDOT. A NPDES Phase II article was published in Mainstream. Watershed identification road signs are being made for two watersheds. A.4 Community Event Measurable Goals: Lead homeowner/landowner watershed tours. SMC and the Upper Des Plaines River Ecosystem Partnership sponsored a watershed tour of the Upper Des Plaines River watershed. Fifty-five attendees toured water quality projects along with flood reduction and natural resource restoration efforts. 23

Provide references to stenciling kit information. Website updates are continual. Additional NPDES II related information is regularly forwarded to MS4s along with reference materials and links. SMC is on the planning team for a storm drain stenciling effort in Lake Michigan and North Branch watersheds, and provided text comments on door hangers to be distributed to homeowners along the stenciling routes. B: PUBLIC PARTICIPATION/INVOLVEMENT The SMC committed to performing activities and services related to the Public Participation/Involvement minimum control measure under BMP numbers B.1, B.3, and B.6. The status or progress for each of the measurable goals related to these BMPs is presented below. B.1 Public Panel Measurable Goals: Provide notice of public meetings on SMC website. Track number of meetings conducted. Notice of all public meetings was provided by SMC on their website s calendar of events. SMC tracked the number of Stormwater Management Committee Board meetings, Technical Advisory Committee (TAC) meetings, and Watershed Management Board (WMB) meetings held during the 2004 fiscal year. According to records, there were 11 SMC meetings, 12 TAC meetings and 1 WMB meeting conducted during this period. B.3 Stakeholder Meeting Measurable Goals: Provide notice of stakeholder meetings on SMC website. Track number of watershed planning committee meetings conducted. Establish watershed planning committees for each new watershed planning effort. Notice of all stakeholder meetings was provided by SMC on their website s calendar of events. C: ILLICIT DISCHARGE DETECTION AND ELIMINATION The SMC committed to provide some supporting functions to MS4s for meeting the Illicit Discharge Detection and Elimination minimum control under BMP numbers C.2 and C.10. The status or progress for each of the measurable goals related to these BMPs is presented below. C.1 Storm Sewer Map Preparation Measurable Goal: Develop countywide mapping protocols and distribute information to MS4s for use. An ad hoc MAC committee was convened to develop the protocol, which was then widely distributed for comment and approval. The protocol is available on SMC s website. C.2 Regulatory Control Program Measurable Goal: Provide MS4s with model ordinance examples for their consideration. Model ordinances and on-line resources were provided. C.10 Other Illicit Discharge Controls Measurable Goal: Adopt WDO amendments to prohibit illegal dumping. Watershed Development Ordinance amendments were discussed and approved by the Technical Advisory Committee. The amendment package will be forwarded to the Commission for deliberation. 25

26 SECTION E E2 D: CONSTRUCTION SITE RUNOFF CONTROL Lake County has adopted a Watershed Development Ordinance (WDO) that establishes the minimum stormwater management requirements for development in Lake County. The WDO, which is enforced by SMC as well as by certified communities in the county, establishes standards for construction site runoff control. The enforcement of the WDO, in conjunction with other SMC activities and functions, implements BMPs under BMP numbers D.1, D.2, D.3, D.4, D.5 and D.6. The status or progress for each of the measurable goals related to these BMPs is presented below. D.1 Regulatory Control Program Measurable Goal: Continue to enforce the countywide WDO. Initiate feasibility planning for the Inspection Certification Program. SMC continues to enforce the countywide WDO. WDO amendments on the inspection certification program were drafted. D.2 Erosion and Sediment Control BMPs Measurable Goal: Continue to enforce the countywide WDO. Complete TRM updates on Wetlands Areas. Continue to prepare TRM updates for other chapters. SMC continues to enforce the countywide WDO. TAC has reviewed and approved TRM updates on the wetland preservation program. SMC continues to prepare TRM updates for other chapters. D.3 Other Waste Control Program Measurable Goal: Adopt WDO amendments for the control of waste and debris at construction sites. The Watershed Development Ordinance proposed amendments include language for this issue. They have been approved by the Technical Advisory Committee and are being forwarded to the Commission. D.4 Site Plan Review Procedures Measurable Goals: Track the number of enforcement officers who attend training sessions on WDO and TRM revisions. Track number of communities that undergo a performance review. Six community assistance visits (performance reviews) initiated by IDNR-OWR were attended by SMC. An April 2004 soil erosion/sediment control workshop drew over 145 participants. The workshop focused on WDO se/sc standards, new technologies and case studies. D.5 Public Information Handling Procedures Measurable Goal: Track number of complaints received and processed related to soil erosion and sediment control. 26

The WDO establishes standards for post-construction site runoff control. These standards apply to any new development or redevelopment resulting in over 0.5 acres of new impervious area. The enforcement of the WDO, in conjunction with other SMC activities and functions, implements BMPs under BMP numbers E.2, E.3, E.4, E.5, E.6 and E.7. The status or progress for each of the measurable goals related to these BMPs is presented below. E.2 Regulatory Control Program Measurable Goal: Continue to enforce the countywide WDO. SMC continues to enforce the countywide WDO. Approximately 60 violation notifications were resolved successfully between March 2004 and March E.3 Long Term O&M Procedures Measurable Goal: Continue to enforce the countywide WDO. SMC continues to enforce the countywide WDO which requires an operations and maintenance plan for all permitted stormwater/water quality treatment facilities. Staff members have enhanced maintenance information that is distributed throughout the County. There are also WDO amendments designed to enhance post-development maintenance procedures. E.4 Pre-Construction Review of BMP Designs Measurable Goal: Continue to enforce the countywide WDO. SMC continues to enforce the countywide WDO. SMC continues to add to its technical reference library, additional BMP technology as it becomes available.
