8 EC study I on HW in EU MS ( ) Study on hazardous waste management in 2015 revealed a series of! Challenges: - Classification - Record keeping - Statistical gap - 28 basic screening information on hazardous waste management have been elaborated for the EU MS 10 in-depth Factsheets on hazardous waste management elaborated for MS with highest and smallest statistical gap: BG, DE, EE, IE, IT, LV, LU, NL, UK covering challenges, good practices and assessment of statistics Good Practices: - Guidance framework - Shared responsibility scheme - Enforcement of legislation - 15/09/2017 8

23 Suggestions for policy options to tackle challenges of HW management Measure (4) Waste Management Officers (DE) KrWG: The Waste Management Officer shall advise the operator and the company s personnel on matters that could be of significance with regard to waste prevention and waste management Tasks include: supervision of life cycle of waste and compliance with the KrWG and the statutory ordinances inform and consult company personnel, encourage development & introduction of environmentally compatible, low-waste processes and products, encourage improvements of installation, submit annual written report to the operator details: Waste Management Officer Ordinance (AbfBeauftrV) + amendments and LAGA guideline Recognition of Courses Limitation: affordability SMEs 15/09/

24 Suggestions for policy options to tackle challenges of HW management Measure (5): Holistic support framework, addressing regional differences (UK) Competent Authorities in UK provide a holistic support framework Hotlines to report environmental incidents or to seek advice from waste specialists available Support for different waste streams and for all aspects of waste management available online Guidance framework consists of general information, step-by-step explanations, FAQs, etc. Information is tailored to all actors in waste management and refers to regional differences in UK Source: 15/09/

25 Suggestions for policy options to tackle challenges of HW management Measure (6): Federal Working Group LAGA (DE) Bund/Länder-Arbeitsgemeinschaft Abfall (LAGA), established in 1963 A federal working group of reps. from regional federal and national level Environmental authorities of 16 Federal States Federal Ministry for the Environment (BMUB) Three committees: Product Responsibility, Waste Law, and Waste Engineering Aim is to secure homogenous enforcement of waste legislation: Exchanges and discusses information and experience regularly Develops positions and suggestions to further develop laws and to represent Germany at the European and international level Elaborates instruction/ information sheets and guidelines on aspects of waste management Background: WM administered and enforced at regional level, waste legislation at national level, close cooperation with other associations / institutions Source: 15/09/

27 Suggestions for policy options to tackle challenges of HW management Selected challenge: Inspections Insufficient inspection capacity to address all waste sectors (UK) Lack of uniform inspections for all waste streams (BG) Potential measures: Measure (1): Working groups (UK) Installation of working groups reviewing waste data for particular waste streams in order to identify sectors with suspiciously low HW amounts (e.g. waste wood) 15/09/

28 Suggestions for policy options to tackle challenges of HW management Measure (2): Uniform inspections for all waste streams (BG) Since 2016: 16 Regional Inspectorates (RIEWs) perform inspections on waste operators (facilities) every three months new approach: additional accent on several waste streams including HW streams to guarantee uniform procedures and structured inspections across the different systems, guidance plans + checklist developed by the MoEW. first conducted reports: positive results regarding compliance and implementation in the facilities Past complaints about differing inspection procedures in certain facilities can be avoided + all aspects covered (checklist) -> Altogether, no higher workload for the inspectorate! 21/06/

30 Suggestions for policy options to tackle challenges of HW management Challenge: Responsibility alongside WM chain Article 15 of the WFD: responsibility for waste management Shared responsibility regime : waste producer shares responsibility for the ultimate fate of the waste even though the waste might be managed by intermediate actors Main objective: foster self-regulation of the industry Good practice France: Shared responsibility Specification in environmental legal code Compliance of the chosen treatment with the waste hierarchy Control: consignment note + penalties Additional duties: justification for the chosen treatment option to the competent authorities 21/06/
