5 EXECUTIVE SUMMARY CMW Gescience (NZ) Ltd has cmmissined Gehazard Envirnmental Ltd t prepare a Preliminary Site Investigatin (PSI) Reprt t investigate the site at 10941L State Highway 2, Tauranga, fr the presence f cntaminants. The primary purpse f this is t investigate whether cntaminants are present at high levels that wuld warrant further actin prir t use fr cmmercial develpment. This reprt summarises Gehazard Envirnmental Ltd. s investigatin, and has been prepared fllwing the Ministry fr the Envirnment s Guidelines fr investigatins invlving ptentially cntaminated land (referred t herein as the MfE Guidelines). The PSI cnsisted f a desktp study t gather infrmatin abut the site and its histry, and a site inspectin; this infrmatin was used t develp an initial cnceptual site mdel, which identifies ptential surces f cntaminatin, pathways fr release, and ptential effects. The findings reprted herein indicate that there are n triggers t indicate that the site is cntaminated. Accrdingly, Gehazard Envirnmental Ltd assesses that by the standards f best practice there is n basis fr recmmending a detailed site investigatin and recmmends n further investigatin fr cntaminants be undertaken at the site. This assessment is subject t limitatins, as described herein, and it is imprtant that CMW Gescience (NZ) Ltd (The Client) ensures that these are understd and that additinal advice is sught, if apprpriate, t manage any undiscvered risks. The presence f any cntaminants at site, even at levels that exceed the relevant sil guideline values, des nt necessarily mean that an unacceptable human health risk r envirnmental risk exists. Specific cnclusins and recmmendatins based n findings herein are summarised as fllws: The site has been used fr farming purpses since at least There is n evidence f any structures built n the prpsed develpment area. Grundwater at the site is anticipated t be shallw (less than 5m belw grund level). It is expected that grundwater will flw eastwards, twards the cast. Areas within the wider land parcel that the subject site sits has been used fr activities, including a transprt dept and milking shed, which may cause grund cntaminatin. The distance frm the develpment site t these features make it unlikely any cntaminants frm activities such as wrkshps r refuelling areas wuld affect the site. Undergrund fuel tanks have been lcated n the wider land parcel, apprximately 400m frm the site. Tanks and sil surrunding the tanks were remved in Sil sampling at the time f the tank remval shwed elevated levels f hydrcarbns remaining in sme sils. It is likely the tanks are hydraulically dwn-gradient f the site, and unlikely t have significant effect n the prpsed develpment. Grundwater is nt expected t transprt cntaminants t the site. The Client may chse t undertake baseline grundwater mnitring at the site fr their wn purpses, if it is prpsed t install any undergrund fuel tanks as part f their develpment. There is n evidence that the site f the prpsed develpment has been subject t Hazardus Activities and Industries List (HAIL) activities. The site is nt cnsidered t be a piece f land under NES legislatin. Fr the avidance f dubt, it is highly unlikely sils at the site will have an adverse effect n human health fr the prpsed develpment (cmmercial). 6 1.0 INTRODUCTION 1.1 Backgrund and Objectives Histrically, the site at Bruce Rd has been used fr grazing. It is planned t develp the site fr cmmercial use. CMW Gesciences (NZ) Ltd requested that Gehazard Envirnmental Ltd investigate the site t determine whether envirnmental cntaminatin might be present. The primary deliverable f the wrk is this Preliminary Site Investigatin (PSI) Reprt, which includes cnclusins as t the site s dispsitin with respect t knwn r ptential envirnmental cntaminatin, and, as apprpriate, recmmended steps needed t ensure that cntaminant risk is mitigated fr end-users f the site. 1.2 Scpe f Wrk Cnsistent with the MfE Guidelines fr PSI f ptentially cntaminated land, the fllwing scpe f wrk was undertaken: (i) Review f all relevant infrmatin, including searching fr any previus reprts pertaining t the site. Surces were as fllws: Tauranga City Cuncil prperty file recrds. Bay f Plenty Reginal Cuncil prperty file recrds. Histric Certificates f Title. Histric aerial images. (ii) (iii) Inspectin f the site t assess its present state and any indicatins f ptentially cntaminating activities that have taken place histrically r are currently ccurring at the site. Preparatin f this PSI reprt, which includes all relevant infrmatin (cllected frm abve), and cmplies with relevant reprting guidelines (MfE, 2003). Herein, this reprt will assess the fllwing: Whether previus and/r current n-site activities had r have the ptential t cause n-site cntaminatin. The likely nature f any cntaminatin. The risks t future site users frm any cntaminatin. The requirement fr further n-site investigatins t define the extent f any cntaminatin. 7 1.3 Limitatins Gehazard Envirnmental Ltd has perfrmed services fr this prject in accrdance with current prfessinal standards fr envirnmental site assessments. N guarantees are either expressed r implied. This reprt des nt attempt t fulfil the requirements f legal due diligence. There is n investigatin that is thrugh enugh t preclude the presence f materials at the site that presently, r in the future, may be cnsidered hazardus. As regulatry criteria are subject t change, cntaminant cncentratins present and cnsidered t be acceptable may, in the future, becme subject t different regulatry standards that cause them t becme unacceptable fr existing r prpsed land use activities. Any recmmendatins, pinins r findings stated in this reprt are based n circumstances, facts and regulatry criteria as they existed at the time that Gehazard Envirnmental Ltd perfrmed the wrk and n data btained frm the investigatins and site bservatins as detailed in this reprt. Opinins and judgements expressed in this reprt, which are based n an understanding and interpretatin f current regulatry standards, shuld nt be cnstrued as legal pinins. 8 2.0 SITE OVERVIEW 2.1 Site Identificatin The site is lcated at the suth-east crner f Bruce Rd and State Highway 2, Tauranga. The site is listed n Tauranga City Cuncil files as 10941L State Highway 2 Suth. Figure 1 illustrates the general lcale f the site. The site is legally described as Part Lt 1 DP The land parcel site is m 2 in size. In this reprt, reference t the site cnstitutes an area at the nrth-west crner f the land parcel where it is prpsed t develp the land fr cmmercial purpses. This includes review f past wnership, cuncil file review, histric pht review, and where pssible discussins with ccupiers. Hazardus Activities and Industries List (HAIL) cdes are given where apprpriate Histric Certificates f Title Histric Certificates f Title (CT) are used t give an indicatin f the ccupatin f land wners. Whilst nt definitive that an activity did ccur, in many cases it can be reasnably assumed that the wner s ccupatin crrelated with site use. This reprt uses the terminlgy (?) t indicate if text is unclear r illegible. The earliest reviewed CT, 202/36 has an illegible date. The CT cvers a large area f land including the subject site. The first wner is recrded as a settler. A transfer t a farmer is nted in Fllwing subdivisin, CT 920/265 was created in 1949, with the wner listed as a farmer. 10 2.2.2 Tauranga City Cuncil Files Tauranga City Cuncil (TCC) prperty files were prvided n USB stick, created n 22 December Infrmatin n the file is limited. There are n building cnsents r plans shwn in the files. A series f Building Warrant f Fitness certificates and related crrespndence are n file, dating frm The nted use f the buildings are ffice and Wrkshp. It is assumed these relate t the truck dept n the wider land parcel Bay f Plenty Reginal Cuncil Files The Bay f Plenty Reginal Cuncil nted in a letter dated 21 December 2015 that it hlds infrmatin n the Selected Land Use Register relating t Hazardus Activities and Industry List (HAIL) activity. The file number is TGA_139. Supprting infrmatin in the letter states: Recrds shw this site was used as a Transprt Depts r Yards Including Areas Used fr Refuelling r the Bulk Strage f Hazardus Substances site frm 1990 fr an unknwn perid. This land use may have ccurred n site utside the perid indicated. The fllwing infrmatin was held by the Bay f Plenty Reginal Cuncil, and is disseminated belw. Bld text is added by Gehazard Envirnmental Ltd fr emphasis. Gehazard Envirnmental Ltd has nt reviewed the reprts and letters that are referred t belw. Nvember 2010: Sil Validatin Mike Lambert Diesel Stp, Bruce Rad, Papama Beach, Tauranga, May 2010, ERM. On April 2010 a sil investigatin was undertaken fllwing the remval f tw 40,000 litre diesel undergrund strage tanks (USTs), and ne 5,000 litre petrl UST at the site. Thirty-five sil samples were cllected within the area f the tank pull and a further fur sil samples were cllected frm the backfill remved frm site. All sil samples were analysed fr Ttal Petrleum Hydrcarbns (TPH), eleven samples were further analysed fr Benzene, Tluene, Ethylbenzene and Xylene (BTEX), ne sample was further analysed fr Plycyclic Armatic Hydrcarbns (PAHs). Grundwater was encuntered at apprximately 3 metres belw grund surface during the tank remval. Apprximately 138 tnnes f sil was remved frm site due t lfactry evidence f hydrcarbn impact and taken t Hamptn Dwns licensed landfill. One in-situ sil sample cllected frm Tank 1 n the suth wall (west end) returned TPH cncentratins exceeding the Tier 1 All Pathways sil acceptance criteria fr cmmercial/industrial land use fr PAH surrgate. This sample was further analysed fr PAHs and the respective PAH cncentratins were less than the Tier 1 All Pathways sil acceptance criteria fr cmmercial/industrial land use, which verrides the TPH result that exceeded the criteria. All ther in-situ sil samples returned TPH and BTEX cncentratins belw the applicable sil acceptance criteria. Hwever, the reginal cuncil reviewed the Sil Validatin Reprt and stated in a letter t ERM (Chevrn's cnsultant): 1) Sil sample PAP-4 cllected at 1.8m bgl had a TPH C10-C14 cncentratin f 3500 mg/kg, this value exceeded the threshld likely t crrespnd t the frmatin f residual separate phase hydrcarbns. The reginal cuncil nted that n deeper sil samples were cllected in this lcatin r t the suth therefre the extent f cntaminatin in this area had CMW Gesciences (NZ) Ltd Preliminary Site Investigatin Reprt, 10941L State Highway 2, Tauranga Page 6

11 nt been delineated. The cuncil required further sil sampling in this area t determine the extent f cntaminatin/ r justify why further sil sampling was nt required. If the tank pull area is redevelped in the future and sil lcated in the area f PAP- 3 and PAP-4 is remved frm site, this sil will nt be able t g a cleanfill due t residual hydrcarbn cntaminatin. 7/04/2010 Tank Pull Ntificatin, Remval f fuel strage tanks frm site will cmmence n 12 April N tanks will be replaced. 24 June 2009: Service Statin Strmwater Audit undertaken in cnjunctin with Tauranga City Cuncil. The fuel tanks n the site are wned and maintained by Caltex (Chevrn Oil). There is a large 5 bay truck wrkshp n the site as well as a large truck washing area (hardstand seal) N drainage plan and n spill respnse kit were available. Recmmendatins included investigatin f regularity f interceptr maintenance and cleaning; lk at interceptr capacity - it appeared smaller than the ptential fr any spill n the site. A spill respnse kit shuld be available near the refuelling area, and the truck wash area with its stckpile f ptentially cntaminated sil frm the sump culd d with an upgrade. Infrmatin taken frm Tauranga City Cuncil File A letter n file (08 Octber, 1992) frm Tauranga District Cuncil indicates applicatin was made fr the installatin f a new 5000 litre class 3(a) (slvents including petrl) and a 40,000 litre class 3(c) (diesel) tank as well as the pulling f an existing tank. The same letter requests a reprt n the cause f a leak in an existing 10,000 litre 3(a) tank. A cpy f prf f installatin f new tanks r a leak reprt is nt available n the file held. Dangerus Gds Licences up until expiry n 31 March, 2004 are held fr tanks 3(a) capacity 11,000 litres, 3(b) capacity 600 litres and 3(c) capacity 80,000 litres The Bay f Plenty Reginal Cuncil GIS system shws 3 HAIL sites within 500m f the site. One is the truck dept n the land parcel (TGA_139). Tw ther HAIL sites are frm persistent pesticide applicatin r use (TGA_664 and TGA_741), lcated suth f State Highway 2. It is unlikely any f these HAIL sites will affect the prpsed develpment, given the distance frm the activities t the prpsed site Histric Aerial Images Aerial images are reviewed t present a snapsht in time, and give an indicatin f what activities may have been undertaken at the site. In the images belw the entire land parcel is shwn apprximately within the red bundary. The site is lcated at the nrth-west crner f the Land Parcel. The earliest reviewed image is dated It shws the site in pasture, with n structures visible. A prbable milking shed is lcated n the centre-west bundary f the site. 12 characterised by a tanker turning bay, and cncrete rund pad. The surrunding area is rural in nature. Develpment f the truck dept at the nrth-east crner f the land parcel is visible. Multiple vehicles are visible parked arund the building. A likely truck wash pad is visible t the east f the building, and a refuelling area t the nrth. The surrunding area remains rural in nature. Investigatins have been undertaken at the dept when fuel tanks were remved, and they are summarised abve in Sectin Current and Future Use The site is currently used fr the pastral grazing f cattle. It is prpsed t develp the site fr cmmercial purpses. 2.5 Gelgy and Hydrlgy The site is flat, with n appreciable slpe. The nearest surface water feature cmprise drainage ditches that crss the wider land parcel. It is likely these ditches drain t the cast. The gelgy is mapped as OIS1 (Hlcene) swamp depsits, described as sft, dark brwn t black, rganic mud, muddy peat and wdy peat with minr verbank sand, silt and mud. There are n grundwater bres cnsented n the site r wider land parcel. The nearest cnsented bre, #4144, is lcated apprximately 400m suth f the site. The bre is recrded as being 10m deep. Grundwater is anticipated t be fairly shallw, within 5m f the grund surface. Grundwater is expected t flw generally eastwards twards the cast. Wrkshps, a truck wash and fuel tanks have been lcated n the dept area. Undergrund fuel tanks have been lcated n the wider land parcel (at the dept), apprximately 300m frm the site. Tanks have been present since at least A leak frm a 10,000l class 3a (assumed petrl) tank is nted in a 1992 letter, but n further details were prvided regarding this. Tw 40,000l diesel and a 5,000l petrl tank and sil surrunding the tanks were remved in Sil sampling at the time f the tank remval shwed elevated levels f hydrcarbns remaining in sme sils. It is likely the tanks are dwn-gradient f the site, and unlikely t have significant effect n the prpsed develpment. Table 2, belw utlines typical cntaminants fund n land uses similar t the site. 17 3.0 SITE CONDITION AND SURROUNDING ENVIRONMENT 3.1 Site Inspectin A site inspectin f the prpsed develpment area was undertaken n 21 December The inspectin was cnducted by Gehazard Envirnmental Ltd staff t examine the site and bserve any evidence f cntaminatin. Specific pints nted are cnditins at the site bundaries and visible signs f cntaminatin r durs that might suggest cntaminatin. A cursry inspectin f factrs that relate t site gelgy and hydrlgy is als perfrmed t ensure cnsistency with what is knwn f the surrunding area. An verall picture f the site gelgy and hydrlgy is useful in assessing the transprt ptential f cntaminants t r frm the site. 3.2 Cnditins at Site Bundaries Cnditins at the site bundaries are as described belw: Nrth East Suth West Pastral land. Residential develpment beynd. Pastral land. Residential develpment beynd. Pastral land. SH 2. Residential Land beynd. The drainage ditches at the nrth and western bundaries f the develpment area are likely t frm a barrier frm any ffsite cntaminants migrating t the site. 3.3 Visible Inspectin, Signs f Cntaminatin and Odurs The grund surface at the area f the site investigated is in pasture, in gd cnditin. There were n nticeable bare patches. N remnants f any structures were bserved during the site walkver. Phtgraphs 1 and 2 shw the general nature f the site. N specific features were bserved requiring phtgraphs. Frm the visible indicatins, there is n evident sign f cntaminatin at the site. The absence f dur is cnsistent with there being n bvius indicatins f grss cntaminatin frm site inspectin. 19 4.0 DISPOSITION OF SITE CONTAMINATION The dispsitin f any cntaminatin at site must be cnfirmed with results frm field sampling and analysis, and, fr cntaminated land, these results must be evaluated against sil guideline values (SGV), als knwn as sil cntaminant standards (SCS). This sectin summarises apprpriate SCS fr the site, fllwed by Gehazard Envirnmental Ltd review f readily available infrmatin cncerning the dispsitin f site cntaminatin. The site investigated here is classed as rural by the Tauranga City Cuncil, but als cnsidering the site s prpsed use, the industrial use scenari, described in Table 3 belw, is mst relevant t this investigatin. As a result, based n the MfE Guidelines, any results shuld be assessed against SCS given fr this scenari. There are bth mre cnservative and mre liberal standards that culd be applied; hwever, the ne presented is apprpriate bth t the use classificatin f the site based n the infrmatin available. 20 5.0 SITE CHARACTERISATION 5.1 Type f Envirnmental Cntaminatin The term cntaminant refers t a substance that is nt nrmally present in the envirnment. Fr this reprt hwever, the fllwing peratinal definitin is used: a cntaminant is a substance that is present at levels that might cause harmful effects t humans r the envirnment. Therefre, this reprt des nt cnsider whether r nt the levels present are frm natural surces r nt, but nly whether r nt cntaminatin is likely t, r des, exist abve safe levels, i.e. SCS. Since the scpe f wrk fr this investigatin did nt include sampling and analysis and Gehazard Envirnmental Ltd did nt discver results frm previus investigatins during the desktp study, there are n results t cmpare t SCS t assess whether cntaminatin is present at the site. N evidence f previus activities at the site with ptential t cause grund cntaminatin was fund. The site walkver inspectin did nt identify any evidence f grund cntaminatin at the site. 5.2 Expsure Rutes and Risks t Expsed Ppulatins Fr human health, expsure is the primary cncern, and fr expsure t ccur there must be 1) cntaminants present at site, and 2) expsure rutes via which site users wuld be expsed t same. In the absence f verified r suspected cntaminatin, n expsure risk can be assessed. 5.3 NES Cnsents The Natinal Envirnmental Standards fr Assessing and Managing Cntaminants in Sil t Prtect Human Health (NES) utlines varius Permitted Activities (nt requiring cnsent) and Cntrlled, Restricted Discretinary and Discretinary Activities (requiring resurce cnsent). The advice f a planner shuld be sught t ensure all cnsent requirements are met. Based n infrmatin gathered in this PSI, there is n evidence t suggest that HAIL activities have ccurred at the site. It is mre likely than nt that HAIL activities did nt ccur at the prpsed develpment site. Natinal Envirnmental Standard rules relating t the subdivisin, land use change r sil disturbance at the site d nt apply as the site is nt cnsidered t be a piece f land Land Use Change Sectin 8(4) f the NES states that subdivisin r land use change is a Permitted Activity, prvided a PSI exists, and the PSI states that it is highly unlikely that there will be a risk t human health. As utlined abve, the site is nt cnsidered t be a piece f land. Hwever, fr the avidance f dubt it is highly unlikely the prpsed activity wuld present a risk t human health, and it is expected the develpment wuld be a Permitted Activity under NES legislatin. 21 5.4 Other Cnsent Requirements The Bay f Plenty Reginal Water and Land Plan Rule 35 requires cnsent fr remediatin r disturbance f a cntaminated site. The BOPRC defines a cntaminated site as a lcatin at which hazardus substances in sil, grundwater r surface water ccur at cncentratins abve backgrund levels.and where assessment indicates thse substances pse.a hazard t human health r the envirnment. There is n indicatin that the site meets the definitin f a cntaminated site. The advice f a planner shuld be sught t ensure all cnsent requirements are met. 22 6.0 CONCLUSIONS AND RECOMMENDATIONS 6.1 Summary and Cnclusins The fllwing summarises results frm Gehazard Envirnmental Ltd. s preliminary investigatin f the site: The site has been used fr farming purpses since at least There is n evidence f any structures built n the prpsed develpment area. Grundwater at the site is anticipated t be shallw (less than 5m belw grund level). It is expected that grundwater will flw eastwards, twards the cast. Areas within the wider land parcel that the subject site sits has been used fr activities, including a transprt dept and milking shed, which may cause grund cntaminatin. The distance frm the develpment site t these features make it unlikely any cntaminants frm activities such as wrkshps r refuelling areas wuld affect the site. Undergrund fuel tanks have been lcated n the wider land parcel, apprximately 400m frm the site. Tanks and sil surrunding the tanks were remved in Sil sampling at the time f the tank remval shwed elevated levels f hydrcarbns remaining in sme sils. It is likely the tanks are hydraulically dwn-gradient f the site, and unlikely t have significant effect n the prpsed develpment. Grundwater is nt expected t transprt cntaminants t the site. The Client may chse t undertake baseline grundwater mnitring at the site fr their wn purpses, if it is prpsed t install any undergrund fuel tanks as part f their develpment. There is n evidence that the site f the prpsed develpment has been subject t Hazardus Activities and Industries List (HAIL) activities. The site is nt cnsidered t be a piece f land under NES legislatin. Fr the avidance f dubt, it is highly unlikely sils at the site will have an adverse effect n human health fr the prpsed develpment (cmmercial). 6.2 Recmmendatins The advice f a planner shuld be sught, r cntact made with the District and Reginal Cuncils, prir t undertaking any earthwrks at the site, t ensure all rules are cmplied with. Based n the results f this PSI, Gehazard Envirnmental Ltd recmmend t CMW Gesciences (NZ) Ltd that further assessment f the site fr ptential cntaminants is nt required. Hwever, shuld site earthwrks indicate fill material n site cntains anthrpgenic material, a suitably qualified envirnmental specialist shuld be engaged t determine if there is any undue risk.
