3 Mohawks of the Bay of Quinte Bereavement Policy 1.0 POLICY The Mohawks of the Bay of Quinte (MBQ) Administration provides permanent employees, who have completed three (3) consecutive months of employment, with paid bereavement leave when there is a death in the employee s immediate or extended family. The MBQ Bereavement Policy complies with the standards for bereavement as set out in the Canada Labour Code, R.S.C Extended Family: Immediate Family: Employees: DEFINITIONS refers to the employee s and/or the employee s current spouse s, first generation only, of the following family members: aunts, uncles, nieces, nephews and cousins. refers to a current relationship that includes the following family members: father, stepfather, mother, step-mother, spouse, domestic partner, child, step-child, ward of the employee, sibling, grandchild, step-grandchild, grandparents, great grandparents, fatherin-law, mother-in-law, son-in-law, daughter-in-law, grandparent-in-law or any family member who permanently resides with the employee. please refer to the MBQ Personnel Policy Definition section for definitions of permanent full-time, permanent part-time, seasonal, term, short term and casual employee. 3.0 BEREAVEMENT LEAVE WITH PAY a. All permanent full-time, part-time and seasonal employees who have completed three (3) months consecutive employment are eligible for bereavement leave benefits. i. All Term, Short Term, and Casual Employees will be eligible for bereavement leave that is consistent with the Canada Labour Code. b. In the event of the death of an immediate family member, as outlined in definition section, an employee is entitled to five (5) working days leave with pay. c. In the event of the death of an extended family member, as outlined in the definition section above, an employee is entitled to one (1) working days leave with pay. d. In the event of the death of a person, who is not included in the definitions of immediate or extended family, the employee may request to use vacation, lieu or emergency leave credits to attend the funeral service. e. Additional unpaid time may be requested where travel outside the immediate area is required to attend the funeral. Employees may use vacation, lieu or emergency leave credits to cover this additional time, if they choose. 1

The bereavement leave period may be deferred, in the event that services are deferred for the deceased, for example, a memorial service, internment service, a feast or other traditional service set at a future date. i. Deferring bereavement leave does not allow employees to exceed maximum bereavement leave allotted for the immediate or extended family member. g. Bereavement leave pay shall be equal to the regular hourly rate of the employee. h. Bereavement leave pay will not be considered hours worked for purposes of calculating overtime. i. In the event that bereavement leave pay is granted, the employee is expected to attend the funeral/service of the relative for which the bereavement leave was requested. j. Mohawks of the Bay of Quinte reserves the right to inquire as to the name, and nature of the relationship with the deceased, and the name of the funeral home responsible for handling the arrangements. Proof of relationship and attendance may be requested. k. The employee must inform their Manager/Supervisor immediately of their request for bereavement leave. Immediately upon their return to work, the employee must submit a leave request form for their absence. Requests for leave in addition to the bereavement leave allotted, are at the discretion of and must be approved by the immediate Manager/Supervisor prior to taking additional leave time. Employee may use vacation, lieu or emergency leave credits for this additional leave period. l. In the event that an employee is on vacation during the death of an immediate family member, they may make a request to have their vacation time credited back to utilize their bereavement leave benefit. 4.0 BEREAVEMENT LEAVE WITHOUT PAY a. If an employee does not qualify for paid bereavement leave or has no remaining leave credits, approved time off without pay may be granted by their Manager/Supervisor. b. Time off without pay may be granted to attend a funeral in the event of the death of a close friend or community member. c. Full days off required for bereavement leave without pay shall be counted as an absence without pay. 5.0 PROCEDURES a. The Employee: i. When making a request for bereavement leave, must do so through their Manager/Supervisor using the approved employee leave process. The employee must identify the relationship with the deceased individual. 2

When making a request for deferred bereavement leave to attend an internment or memorial service in the future, must follow the approved employee leave process at that time and must provide as much notice to the Manager/Supervisor as possible. a. This leave period will not exceed the maximum leave period allowed as stated above in Section 3.f.i. b. The Manager/Supervisor: i. Will provide a response to the employee as soon as possible once the leave request is made. If the Manager/Supervisor denies the request, the basis for this decision must be provided to the employee in writing. 6.0 DISCIPLINARY ACTIONS a. In the event that bereavement leave is sought and the employee did not utilize this leave for the purposes of attending the funeral and/or other services in relation to the death, this may be subject to discipline measures as stated in the MBQ Personnel Policy. 7.0 APPEAL PROCESS a. In the event that an employee wishes to appeal the decision of their immediate Manager/Supervisor, the employee must submit their appeal in writing to their immediate Manager/Supervisor, the Director (in the absence of a Director, to the Senior Director of Operations), and the Human Resources Department. b. The Human Resources Officer will ensure that the appeal is processed in compliance with MBQ Personnel Policy: Section 9: Grievance Procedures. 3
