1 PROPOSER: MBCR (Evaluator #3) DATE: 8/17/13 OVERALL RATING: NARRATIVE SUMMARY: The proposer has demonstrated an approach that is considered to have met the stated criteria of the RFP and its Affirmative Action Plan generally meets the requirements of FTA Circular In addition, the proposer states that it is strongly committed to expanding workforce diversity and inclusion. Objective: The following are the objectives for the Equal Employment Opportunity and other Civil Rights Programs s evaluation factor: 1) To identify a Proposer with an Affirmative Action Plan in compliance with federal law, including the Federal Transit Administration's (FTA) Circular ; and 2) To identify a Proposer that has submitted a workforce management plan that is inclusive of opportunities for minorities and women. Evaluation Criteria: The Proposer has submitted an Affirmative Action Plan that complies with FTA's Circular and is committed to establishing a workforce that is inclusive of minorities and women and creating employment practices that are inclusive of minorities and women. 2 Instructions: Evaluators must rate each requirement outlined in the table below as one of the following: (i) Exceptional; (ii) Good; (iii) ; (iv) Potential to Become ; or (v) Unacceptable. Please note the following explanations when rating each requirement: 1) A rating of Exceptional is appropriate when the Proposer has demonstrated an approach that is considered to significantly exceed stated criteria in a way that is beneficial to the MBTA. This rating indicates a consistently outstanding level of quality, with very little or no risk that this Proposer would fail to meet the requirements of the solicitation. There are no weaknesses. 2) A rating of Good is appropriate when the Proposer has demonstrated an approach that is considered to exceed stated criteria. This rating indicates a generally better than acceptable quality, with little risk that this Proposer would fail to meet the requirements of the solicitation. Weaknesses, if any, are very minor. Correction of the weaknesses would not be necessary before the Proposal would be considered further. 3) A rating of is appropriate if the Proposer has demonstrated an approach that is considered to meet the stated criteria. This rating indicates an acceptable level of quality. The Proposal demonstrates a reasonable probability of success. Weaknesses exist but can be readily corrected through requests for Clarification or Communications. 4) A rating of Potential to Become is appropriate if the Proposer has demonstrated an approach that fails to meet stated criteria as there are weaknesses, but they are susceptible to correction through Discussions. The response is considered marginal in terms of the basic content and/or amount of information provided for evaluation, but overall the Proposer is capable of providing an acceptable or better Proposal. 5) A rating of Unacceptable is appropriate if the Proposer has demonstrated an approach that indicates significant weaknesses and/or unacceptable quality. The Proposal fails to meet the stated criteria and/or lacks essential information and is conflicting and/or unproductive. There is no reasonable likelihood of success; weaknesses are so major and/or extensive that a major revision to the Proposal would be necessary. MBTA 2 Proposal Evaluation Worksheet

3 Ratings for each requirement must be recorded in the associated Rating column, and a detailed explanation of why a particular rating was given to a requirement must be recorded in the associated Comments/Justification for Rating column. Appendix B Section B12.2(A) A current copy of the Proposer's Affirmative Action Plan for each Proposer Equity Member, a copy of its Civil Rights Investigation processes and procedures and a description of Equal Employment Opportunity (EEOyAffirmative Action Plan (AAP)/Civil Rights Training Programs, if applicable. The Proposer should include a narrative of its prior year's analysis of its recruitment/outreach and employment practice. Rating Comments/Justification for Rating The proposer demonstrated an approach that is considered to meet the stated criteria. Summaries of the proposers AAP for each Equity member were provided. These summaries provide each firms commitment to the basic principles found in an AAP. MBCR provided an AAP that met the basic program requirements found in circular The seven major components being: Statement of Policy, Dissemination, Designation of Personal Responsibility, Utilization Analysis, Goals and timetables, Assessments of Employment Practices to identify causes of Underutilization, and Monitoring and Reporting. Detail concerning the CRI process and procedure was minimal (11-6), but Proposer offered to assume a leadership role in complaint handling process and proposed the creation of an internal Title VI program. EEO/ADHP training opportunities were plainly stated and met the requirements. MBCR also committed to having management complete initial and refresher training on Civil Rights, Diversity, Inclusion and Harassment Prevention by commencement of new contract. 5 No. Appendix B Section Rating Comments/Justification for Rating B12.2(B) B 12.2(C) A draft Affirmative Action Plan for the Proposer itself in the performance of the Contract. The Proposer shall: (i) identify those portions of the information that it provided in response to Section B12.2(A) through B12.2(B) of Appendix B that it considers to be innovative, best practice, beneficial to MBTA Customers and/or cost efficient, and (ii) submit information supporting or otherwise validating its position that said portions are innovative, best practice, beneficial to MBTA Customers and/or cost efficient. Weaknesses include: lack of detail in clarifying how often and in what format reports would be provided to the MBTA. The Proposer has demonstrated an approach that is considered to meet the stated criteria. AH 7 requirements of Circular were included. Weakness include: lack of statistical breakdown of work force by department and title; an explanation of what labor market was used for utilization analysis and a list of all the Job Groups and the Job Titles represented in each Job Group. The Proposer has demonstrated an approach that is considered to meet the stated criteria. The expansion of the Proposer's mentoring program to all levels of the organization, its commitment to provided management with refresher training by the commencement of the contract; and its collaborative efforts on outreach with leading diversity organizations meet this requirement. ^0M^ Qc^/ MBTA Proposal Evaluation Worksheet
