1 REQUEST FOR COMPETITIVE SEALED PROPOSALS BADGER HIGH RESOLUTION WATER METERS AND ENCODERS The West Wise Special Utility District (WWSUD) is requesting the submission of competitive sealed proposals, which may lead to the possible award of a contract to high resolution Badger encoder water meters. Equipment resulting from selection of a provider and award of a purchase agreement under this RFP are expected to be funded in part or in full by funds from the Texas Water Development Board (TWDB). This Request for Proposals is issued in accordance with Section 2155 of the Texas Government Code (Purchasing) and Title 40 Code of Federal Regulations, Part 33 - PARTICIPATION BY DISADVANTAGED BUSINESS ENTERPRISES IN UNITED STATES ENVIRONMENTAL PROTECTION AGENCY PROGRAMS. West Wise Rural Water Supply Corporation was formed to provide water supply to the members of the corporation. The called Membership Meeting of the Shareholders of West Wise Rural Water Supply Corporation was held on October 23, 2001 to consider and vote on whether West Wise Rural Water Supply Corporation should be converted to a Special Utility District. It was ordered by the Board of Directors of West Wise Rural Water Supply Corporation that it convert to a Special Utility District. The 1 P age: West Wise SUD Badger High Resolution Water Meter RFP

2 Order was filed with the Texas Natural Resource Conservation Commission (now the Texas Commission on Environmental Quality), passed and approved November 8, Time & Place for Submission of Proposals Submit one competitive sealed proposal no later than 2:00 p.m. CST, Monday, August 27, 2018 as follows: Submittal Deadline Please submit seven (7) hard copies and one electronic (flash drive) of the pricing and proposal statements to the attention of Mr. James Ward, West Wise Special Utility District, 3412 FM 2952, Bridgeport, TX The submittal deadline for the Request for Proposals is 2:00 p.m. CST, Monday August 27, Any proposal received after this time and date will be rejected and will not be considered by the WWSUD. Vendors accept all risks of late delivery of mailed proposals regardless of fault. 1.3 Evaluation Criteria Overall cost of products proposed The ability to of vendor to perform the goods or services and the availability of adequate personnel to assist Owner in system integration in a timely manner Extent of experience with Texas Water Development Board and projects located in this general region. Past performance of goods or services for governmental entities as reflected by past clients with respect to such factors as control of costs, quality of work, ability to meet deadlines and address problems, with consistently high quality Product support The proposals received will be evaluated and ranked according to the following criteria: Criteria Overall Cost Local Installation Experience Product Support Total Criteria Weighting 70 points 20 points 10 points 100 points 1.4 Proposal Modification, Clarification and Selection WWSUD will not reimburse Vendors for any costs involved in the preparation and submission of responses to this RFP. Furthermore, this RFP does not obligate WWSUD to accept or contract for any expressed or implied goods or services. WWSUD reserves the right to request any Vendor to clarify its proposal or to supply any additional material deemed necessary to assist in the evaluation of the Vendor, and to modify or alter any or all the requirements herein. 1.5 Notification of Withdrawal Proposals may be modified or withdrawn prior to the date and time specified for quotation submission by an authorized representative of the Vendor, or by formal written notice. 2 P age: West Wise SUD Badger High Resolution Water Meter RFP

SECTION 2 GENERAL TERMS AND CONDITIONS 2.1 Insurance Requirements Vendor will provide WWSUD certificates of coverage with corresponding limits of liability for the following: A. Comprehensive General Liability Insurance - coverage with minimum aggregate of $2,000,000. B. Worker s Compensation Insurance coverage with a limit of $1,000,000 per occurrence. C. Comprehensive Automobile Liability Insurance combined single limit of $1,000,000 (can be waived if contract does not involve use of motor vehicles). D. Professional Liability Insurance (Errors and Omissions Liability) coverage with a limit of $1,000,000 each claim, and $1,000,000 aggregate. E. Technology Errors and Omissions Insurance includes data breach and loss of personally identifiable information with coverage limits of $1,000,000 each claim and $2,000,000 aggregate. 2.2 Proposal Expiration Proposals must state the period for which they are valid and may be accepted by the WWSUD. A proposal offering less than ninety (90) calendar days for acceptance from the date proposals are due may be considered non-responsive and may be rejected. 2.3 Rights to Pertinent Materials All proposals, responses, inquiries, and correspondence relating to the RFP and all reports, charts, displays, schedules, exhibits, and other documentation produced by the Vendor that are submitted as part of the proposal shall become the property of WWSUD. Should the Vendor submit proprietary information in their proposal, the Vendor should clearly mark these sections. 2.4 Right of WWSUD Reject Proposals WWSUD retains the right to reject any or all proposals, or any part of proposals, to waive minor defects or technicalities or to solicit new proposals on the same project or a project which may include portions of the originally proposed project as WWSUD may deem necessary in its interest. 2.5 Performance WWSUD reserves the right to provide the Vendor, at any point in the process, with a 30 day notice to perform as contracted or terminate the contract. 3 P age: West Wise SUD Badger High Resolution Water Meter RFP

4 SECTION 3 - SCOPE OF SUPPLY 3.1 Objectives The work to be accomplished under this section of the Specifications consists of the furnishing of all material necessary for the supply of High Resolution Water Meters and accessories per the Specifications. Materials A. Badger High Resolution Encoder Register (HR-E) Model 25 size 5/8 x 3/4 disc meters, with bronze bottom, lead-free, Orion CD Integral pit transmitters with Data Profile, with twist tight connectors. Encoder type: straight reading, permanently sealed, magnetic drive B. 5/8 x 3/4 Badger, HR-E LCD Encoders, Orion CE Integral pit, transmitters with Data Profile. With twist tight connectors only. C. 2 Badger, E Series, Ultrasonic meter, Stainless Steel Housing, HR-E LCD Encoder, Orion CE pit transmitters with Data Profile, with twist tight connectors D. Panasonic Toughpad FZ-G1 preloaded w/ BEACON Advanced Metering Analytics (AMA) mobile solution including ORION Mobile Read and the ORION Endpoint Utility software a. Operating System: Windows 10, Professional 64 b. Memory: 8 GB c. CPU: Intel Core i5 d. Disk Space: 256 GB SSD e. 5 SECTION 4 INSTRUCTIONS FOR PROPOSAL Your response should include each section below. Failure to address a significant portion of the items may classify the response as non-responsive and may preclude it from further consideration. 4.1 Transmittal Letter The transmittal letters will indicate the intention to comply with the RFP requirements with or without modifications. The letter will: Identify the person responsible for this response. Include title, address, phone, fax and address. Explicitly state that the Vendor has reviewed the contents of this RFP. State the period of time for which the proposal is valid Acknowledge completion of the Pricing Schedule. Signed by a person authorized to contractually obligate the Vendor organization 4.2 Pricing Schedule - Attachment A 4.3 Approach to Owner Assistance/Product Support Describe how vendor typically assists Owners in metering system integration. Provide examples with references of successful meter replacement/upgrade programs similar to this work. Limited to 3 pages. 4.4 TWDB Experience Describe your firms experience with Texas Water Development Board on meter replacement/upgrade programs similar to this work. Limited to 3 pages. SECTION 5 FUNDING TERMS AND CONDITIONS 5.1 Special TWDB and EPA Requirements relating to DWSRF funding programs: This contract is contingent upon release of funds from the Texas Water Development Board (TWDB). Any contracts awarded under the Request for Proposals (RFP) are expected to be funded in part by a loan from the TWDB. Neither the Environmental Protection Agency nor the State of Texas nor any of its departments, agencies, or employees are or will be a party to this RFP, or any resulting contract. This contract is subject to the Environmental Protection Agency s (EPA) fair share policy, which includes EPA approved fair share goals for Minority Business Enterprise (MBE) and Women Business Enterprise (WBE) firms in the Construction, Supplies, Equipment, and Services procurement categories. EPA s policy requires that applicants, prime consultants, prime contractors and purchase order vendors, make a good faith effort to award a fair share of contracts, subcontracts, and procurements to Minority Business Enterprise and Women-Owned Business Enterprise firms. Although EPA s policy does not mandate that the fair share goals be achieved, it does require applicants and prime contractors to demonstrate use of six affirmative steps.
