Grier, III, the duly appointed Legal Representative for Future Asbestos Claimants (the FCR ), through counsel, submits this Eleventh Interim Application (the Application ) for allowance of compensation and reimbursement of expenses for Hamilton, Rabinovitz & Associates, Inc. ( HRA ), asbestos-related bodily injury consultant to the FCR, for the period November 1, 2015 through February 29, 2016 (the Interim Period ) pursuant to Sections 328, 330, and 331 of the Bankruptcy Code, subject to the procedures set forth in the Bankruptcy Code, Rule 2016 of the Federal Rules of Bankruptcy Procedure, and the Court s Administrative Order entered July 15, 2010 (the Fee Procedure Order ). On June 1, 2015, the Court entered a further Order approving certain additional fee procedures requested by the fee examiner appointed in this case (the Garlock Procedures ) (Docket No. 4634). By this Application, the FCR hereby moves this Court for an order awarding HRA reasonable compensation for the Interim Period for professional services rendered to the FCR in 1 The Debtors include Garlock Sealing Technologies, Garrison Litigation Management Group, Ltd. and The Anchor Packing Company.
3 Document Page 3 of 30 the amount of $45, and reimbursement for actual and necessary expenses incurred in the amount of $0.00 for a total of $45, In support of this Application, the FCR represents as follows: JURISDICTION 1. The Court has jurisdiction over this Application pursuant to 28 U.S.C. 157 and This is a core proceeding within the meaning of 28 U.S.C. 157(b)(2). BACKGROUND 2. On June 5, 2010 (the Petition Date ), the Debtors filed their voluntary petitions for relief under chapter 11 of the Bankruptcy Code. These cases have been consolidated for administrative purposes. 3. On September 16, 2010, the Court entered an Order appointing the FCR. (D.E. 512). That Order authorizes the FCR to employ professionals, consistent with Section 1103 of the Bankruptcy Code, subject to approval of the Court. 4. On December 9, 2010, the Court entered an order approving HRA as the asbestosrelated bodily injury consultant to the FCR. (D.E. 850). 5. Pursuant to the Fee Procedure Order, professionals may request monthly compensation and reimbursement. Such requests are to be served on certain identified interested parties for review. If no objection to a professional s request is received within ten (10) days of such request, the Debtors are authorized to pay 90% of the fees and 100% of the expenses requested. The Fee Procedure Order also requires each retained professional to file, approximately every four months, an application for interim Court approval and allowance, pursuant to Section 331 of the Bankruptcy Code, of 100% of the compensation and reimbursement expenses for the prior four months. 2
4 Document Page 4 of 30 COMPENSATION RECEIVED DURING INTERIM PERIOD 6. All services for which HRA seeks compensation were performed consonant with HRA s role as asbestos-related bodily injury consultant to the FCR. Attached hereto as Exhibits A1-A3 are detailed descriptions of the services performed and expenses incurred by Applicant during the Interim Period. In summary, HRA professionals expended 67.3 hours in rendering services to the FCR during the Interim Period resulting in fees of $45, The majority of HRA s time during the Interim Period was devoted to reviewing and analyzing various models of and proposals for claims resolution procedures and providing advice to the FCR as to the same. To the extent that charges for services rendered or expense incurred relate to the Interim Period but were not processed prior to the preparation of, or otherwise included in, this Application, HRA reserves the right to request additional compensation for such services and reimbursement of such expenses in future applications. 8. A summary of HRA s professionals and paraprofessionals who have rendered services during the Interim Period totaling $45, is attached hereto as Exhibit C. 10. Attached hereto as Exhibit D is a summary of the FCR s interim fee applications for HRA that have been filed in these cases to date. DISBURSEMENTS 11. The FCR requests that HRA be reimbursed for its actual and necessary expenses incurred during the Interim Period totaling $0.00. On Exhibit E, HRA has itemized its costs and expenses that were billed during the Interim Period. NOTICE 12. Notice of this Application has been given to the Bankruptcy Administrator, counsel for the Debtors, and those parties listed on the Master Service List in this case. WHEREFORE, the FCR respectfully requests that the Court enter an Order: 1) Allowing interim compensation for HRA in the amount of $45, as reasonable, actual and necessary for professional services rendered by HRA during the Interim Period and interim reimbursement of expenses incurred during the Interim Period of $0.00as reasonable, actual, and necessary; 2) Authorizing and directing the Debtors to pay HRA the amount of $45,220.00, which is equal to the sum of 100% of HRA s allowed interim compensation and 100% of HRA s allowed expense reimbursement for the Interim Period; and 4
