6 1. Introduction Boggabri Coal Mine is located 15km north-east of the township of Boggabri in north-western New South Wales. The open cut coal mine has been operating since Truck and shovel operations produce a crushed and screened run-of-mine (ROM) coal product. Coal is transported on a sealed private haul road to a rail loading facility, to be dispatched via the Port of Newcastle for overseas consumption. The mine is managed by Boggabri Coal Pty Limited (BCPL), who engages contractors to undertake construction, mining, coal crushing and transportation activities. All contractors working at the Boggabri Coal Mine are required to operate in compliance with this Environment Management Strategy. In 2009, BCPL lodged a major project application (the project) under the now-repealed Part 3A of the Environmental Planning and Assessment Act, 1979 (EP&A Act). In the project application, Boggabri Coal sought to extend its mining operations for a further 21 years, and increase its production rate to 7 Mtpa of ROM coal from a total resource of 145 Mt. The project includes operation of existing ancillary equipment; construction of a new coal handling and preparation plant; a 17 km rail spur line; bridges over the Namoi River and Kamilaroi Highway; a rail load-out facility located at the mine; upgrade of the overburden and coal extraction haulage fleet (with an option for a drag-line); upgrade of electricity transmission lines; and other ancillary infrastructure. The project application was determined by the NSW Planning Assessment Commission (PAC), under delegation by the Minister for Planning and Infrastructure. Project Approval 09_0182 (the Project Approval) was received in July Schedule 5, Condition 1 of the Project Approval requires the preparation of an Environment Management Strategy (EM Strategy). This plan has been prepared in fulfilment of this approval requirement. 7 1.2 Aims of this Environment Management Strategy The aims of the Environment Management Strategy are to: outline the strategic framework for environment management at the Boggabri Coal Mine provide an outline of all relevant statutory leases, licences and approvals that apply to the Boggabri Coal Mine detail the key plans, procedures and other documents that will be implemented to ensure compliance with all relevant leases, licences and approvals describe the key processes that will be implemented to: communicate with community and government stakeholders manage community complaints resolve disputes respond to non-compliance incidents and emergencies outline the site s monitoring, reporting and auditing requirements outline relevant roles, responsibilities and accountabilities relevant to environment management for all BCPL employees and contractors 1.3 Elements covered by the Environment Management Strategy This Strategy applies to all employees and contractors at the Boggabri Coal Mine and covers all areas within the Project Boundary as defined in the Project Approval. A figure showing the extent of the Project Boundary is provided in Appendix A. BCPL Page 2

8 2. Planning 2.1 Leases, licences and approvals Leases, licences and approvals relevant to environment management at Boggabri Coal Mine are listed below in Table 2.1. 9 2.2 Idemitsu Australia resources group environment policy BCPL s parent company Idemitsu Australia resources group (IARG) has developed an environment policy that has been adopted at the Boggabri Coal Mine. The Environment Management Strategy has been developed in accordance with the IARG Environment Policy. A copy of the policy is provided in Appendix C. 2.3 Environment management framework BCPL are working towards developing an Environmental Management System that is generally in accordance with the International Standards Organisation (ISO) framework. ISO14001 framework as it applies to the Boggabri Coal Mine is summarised in Figure 2.1. Figure 2.1 ISO Environmental Management Framework 2.4 Annual risk review The BCPL Environment Superintendent will undertake an annual review of all environment risks associated with activities at Boggabri Coal Mine. This review will be the key process for identifying risks and planning for effective management strategies. The environment risk review will broadly aim to identify hazards associated with project activities and any potential impacts on the environment, community or BCPL s social licence to operate. Once all hazards and impacts are identified, the level of risk will be assessed, and controls will be nominated. Management of impacts will be prioritised according to the level of risk each hazard presents. All identified hazards, risks and controls will be documented in the BCPL environment risk register. All controls listed in the BCPL risk register will be used to inform development of annual budgets, and the setting of objectives and targets. BCPL Page 4

10 2.5 Objectives and targets Objectives and targets for environment management will be reviewed annually by the Environment Superintendent, including: risks identified in the annual review of the BCPL risk register (as described in Section 2.4) corporate business objectives proposed mining activities, as documented in the BCPL Mining Operations Plan (MOP) legal and other requirements, including obligations from BCPL s mining leases, Project Approval, EPL and other relevant licences and approvals as detailed in the BCPL compliance register roles and responsibilities for BCPL employees and contractors trends identified in monitoring results actions arising from internal and external audits community and other stakeholder sentiments trends in environment incidents any outstanding objectives, targets or corrective actions from the previous year All BCPL environment objectives and targets will be specific, measureable, achievable, realistic and timely (SMART). Implementation 3.1 Roles and responsibilities The management of activities with potential to impact the environment and the community will be the responsibility of all BCPL employees and contractors. All employees and contractors are responsible to comply with all documents referred to in this environment management strategy. Key management personnel and their relevant roles and responsibilities with regard to environment management and community relations are outlined in Table 3.1. 12 Role All BCPL employees and contractors Responsibility providing relevant environment data to assist BCPL with environment reporting ensuring the BCEP CEMP and subordinate documents are developed and implemented to facilitate compliance with the documents referred to in this environment management strategy undertaking activities, as required, in accordance with the documents referred to in this environment management strategy and under instruction from their supervisor informing the Boggabri Coal Environment Superintendent of any environment and/or community issues as they arise 3.2 Compliance management Compliance with all approvals listed in Section 2 is the responsibility of all BCPL employees and contractors at the Boggabri Coal Mine. To ensure all environment management obligations are met and compliant, the BCPL Environment Superintendent will develop and maintain the BCPL compliance register, which will detail the conditions relevant leases, licences and approvals held by BCPL and outline specific actions and completion dates for each action. The register will be used by the BCPL Environment Superintendent as a planning tool to ensure legal obligations are met. The register will be reviewed annually or more frequently if changes to any licences, permits or approvals are received. 3.3 Environment management plans and procedures Environment and community issues and impacts will be managed through the implementation of specific management plans and procedures developed to facilitate compliance with BCPL s relevant environment leases, licences and approvals (as listed in Section 2.1). A figure illustrating the organisational structure of these environment management documents is provided in Appendix B. 3.4 Permitting Potential environment and community impacts from any new work (see definition below) at the Boggabri Coal Mine are managed through an on-site permitting process. All employees and contractors proposing to undertake new work will be required to complete a BCPL New work permit. The permit will contain a checklist to ensure: the proposed works are allowed under BCPL s mining leases, licences, permits and approvals all environment constraints associated with the work have been identified and plotted on a plan appropriate management strategies will be implemented to minimise impacts on the environment and the community all personnel undertaking the task have been trained and are competent to undertake the proposed work All permits will be reviewed and approved by the BCPL Environment Superintendent (or delegate). 13 Note: New work is defined as any work that is different from normal day-to-day activities. This includes any non-routine activities proposed to be undertaken in an area outside previously approved areas. 3.5 Internal communication BCPL intranet Relevant environment documentation, including all management plans and strategies, will be made available on the BCPL intranet. For contractors without intranet access, their BCPL representative is responsible to provide them with the required documents. Documentation available via the Environment page on the BCPL intranet includes: this environment management strategy the BCPL environment induction all relevant BCPL mining leases, permits, licences and approvals the BCPL Environmental Assessment (Hansen Bailey, 2010) and supporting documents links to relevant legislation, codes and standards all management plans and procedures (Appendix B) blank environment work permit forms incident reporting forms community complaint reporting forms information notices checklists and factsheets environmental constraints maps statutory report the BCPL training register the BCPL organisation management structure chart the BCPL environment management process (as shown in Appendix B) The Environment page of the BCPL intranet will be developed progressively and maintained by the BCPL Environment Superintendent Toolbox talks Toolbox talks will be provided to BCPL employees and contractors as a means of promoting awareness by communicating environment issues and management requirements, and presented periodically or as required by the Environment Superintendent (or delegate) and will typically cover: BCPL Page 8

14 details of any environment risks, issues or incidents environment performance statistics or monitoring trends notification of non-routine environment work activities feedback from community and government stakeholders training in specific environment management tasks 3.6 External communication If BCPL employees or contractors require consultation with external stakeholders such as regulatory authorities, community members or Aboriginal groups, a defined process must be followed. This will consist of the employee or contractor liaising with the BCPL Environment Superintendent, after which the BCPL Environment Superintendent will contact the relevant stakeholder(s) on behalf of BCPL or the contractor. The only exception to this process will be if the BCPL Environment Superintendent determines that an alternative process is appropriate. 3.7 Training BCPL will ensure all personnel at Boggabri Coal Mine are appropriately trained and have an appropriate level of experience to undertake their work in a way that minimises impacts on the environment and the community. All BCPL employees and contractors will receive general environment awareness training as a component of their site induction. Training will be provided in accordance with the BCPL training procedure. The requirement for individuals to receive additional environment training for specific tasks will be identified in the BCPL Training needs analysis. Records of training and competencies for BCPL employees and contractors will be maintained in the BCPL training register, which will be made available to all personnel on the BCPL intranet Visitors induction All visitors to the Boggabri Coal Mine (personnel not undertaking work) will undergo a visitor s induction, which will outline the key environment and health and safety requirements for visitors while they are on site. Contractors and subcontractors will be responsible for the actions and conduct of their visitors and will ensure that all environment requirements of the site are obeyed. All visitors will be accompanied on site at all times. Under no circumstances will a visitor undertake any physical work on site. Records of visitor inductions will be maintained by BCPL and relevant contractors and subcontractors Site induction All personnel (including employees, contractors and subcontractors) mobilised during the construction and operational phases of the Project will undertake a site-orientated induction program prior to commencing works. The induction will describe environmental aspects and impacts applicable to the Boggabri Coal Mine, including relevant legislation and associated legal responsibilities. BCPL Page 9

15 3.7.3 Task specific training BCPL employees and contractors undertaking specific tasks requiring skills in air quality and greenhouse gas management may be required to undergo task specific training. Specific requirements for BCPL employees and contractors (e.g. use of air quality monitoring equipment) will be identified during BCPL s annual training needs analysis, and/or as required as changes to activities or personnel occur. The training needs analysis identifies the minimum required competencies, qualifications and skills commensurate with the individual s role responsibilities. Records of personnel training attendance, competencies, qualifications and skills will be maintained by BCPL and contractors. 3.8 Incidents Environment incidents will be reported and responded to in accordance with the BCPL incident response procedure. All environment incidents will be reported to the BCPL Environment Superintendent using the BCPL incident report form. Following an incident, the BCPL Environment Superintendent is responsible for assigning any corrective or preventative actions to BCPL employees or contractors. Incidents will be reviewed by the BCPL management team during weekly meetings and periodically by the Environment Superintendent. Incidents will also be used to guide the setting of annual objectives and targets, as described in Section Emergencies Environment emergencies are defined as environment incidents, which have the potential to cause material harm to the environment, including: large spills of hydrocarbons, dangerous goods, sewage, coal or regulated waste dam wall failure bushfire flooding All BCPL employees and contractors will receive emergency preparedness and response training during their site induction. This includes awareness of environment incidents. BCPL will also maintain a dedicated emergency response team which will undergo regular targeted training and operational drills. The BCPL emergency response procedure determines the method of response to environmental emergences Notification to regulatory authorities In accordance with the Project Approval and the EPL, BCPL will provide verbal and written notification to the relevant regulatory authority of any incident and/or environmental emergency that has caused, or threatens to cause, material harm to the environment. All BCPL employees and contractors at the Boggabri Coal Mine will be required to notify the BCPL Environment Superintendent immediately after becoming aware of an environment incident. The BCPL Environment Superintendent is responsible to then notify the relevant BCPL Page 10

16 regulatory authority. Contractors will not liaise directly with regulatory authorities under any circumstances unless prior approval has been granted by BCPL. The following notification process will apply: for an incident related to environmental conditions in the EPL, notification will be made to the EPA via the environmental incident hotline ( ) for an incident related to environmental conditions in the Project Approval, notification will be made to the Director-General (or delegate) verbal notification will be provided to the relevant regulatory authority as soon as possible after the incident written notification will be provided within 7 days of the date of the incident 3.11 Community complaints BCPL will maintain a 24 hour community complaints hotline (1800 Boggabri), which will be advertised via the following media: quarterly in the Namoi Valley Independent (local Gunnedah newspaper) quarterly in the Independent (local Narrabri newspaper) on the company website: ( in the White Pages: ( Community complaints will be recorded in accordance with the BCPL community complaint management procedure. Community complaints will be reported to the BCPL Environment Superintendent using the BCPL community complaint report form. All consultation with community members will be undertaken by the BCPL Environment Superintendent, or the BCPL General Manager Operations (as required). Any actions arising from community consultation will be the responsibility of the Environment Superintendent Dispute resolution Any disputes between community members and BCPL employees and contractors will be referred to the BCPL Environment Superintendent. The BCPL Environment Superintendent will continue discussions with the community member and attempt to resolve the dispute. If required and where relevant, negotiations will be initiated in accordance with the relevant dispute resolution processes outlined in the Project Approval. If the matter cannot be resolved between BCPL and the landholder, the matter will be referred to the Director-General of NSW Department of Planning and Infrastructure for resolution. BCPL Page 11

17 3.13 Document control All environment documents will be standardised and controlled in accordance with the BCPL document control procedure, implemented to: promote ease of recognition and access prevent duplication ensure that only the current version of a document is available prevent the unintended use of obsolete documents ensure documents are reviewed and approved as required ensure relevant documents developed externally to BCPL are readily identifiable and their distribution is controlled The BCPL Environment Superintendent will ensure all environment documents are developed and maintained appropriately Records management BCPL will establish and maintain records as necessary to demonstrate compliance with the requirements of all relevant leases, licences and approvals. The process for the identification, storage, protection, retrieval, retention and disposal of all BCPL environment related records will be outlined in the BCPL records management procedure. The BCPL Environment Superintendent will ensure all environmental records are managed in accordance with this procedure.. BCPL Page 12

18 4. Measurement and evaluation 4.1 Monitoring system effectiveness Monitoring of the effectiveness of this EM Strategy and all subordinate documents and processes will be undertaken by the BCPL Environment Superintendent to: confirm the adequacy and effectiveness of all BCPL environment management documents confirm that all environment requirements have been adequately communicated to all employees and contractors identify improvement opportunities share good practice and lessons learnt with BCPL employees and contractors ensure ongoing compliance with BCPL s leases, licences and approvals 4.2 Environment monitoring BCPL will monitor the environment impacts of activities at the Boggabri Coal Mine in accordance with the requirements of operation s leases, licences and approvals (as listed in Table 2.1). Monitoring will be undertaken to ensure the project is operating in compliance with all legislative requirements. The specific monitoring requirements for each environmental aspect (e.g. noise, air quality, surface water, groundwater, etc.) will be detailed in the relevant management plan (and subordinate procedure) as listed in Appendix B. The BCPL Environment Superintendent will coordinate all environment monitoring at the Boggabri Coal Mine. Monitoring results will be communicated to BCPL employees and contractors as required to promote awareness and encourage improvements in environment management performance. Environment monitoring results and trends will also be reported in the site s annual environment management report, as described below in Section Environment inspections Environment inspections will be undertaken by the BCPL Environment Superintendent (or delegate) within the Project Boundary, at a frequency deemed suitable by the Environment Superintendent. The objectives of inspections are to: identify general housekeeping issues identify any potential non-compliances or environment incidents not previously identified and/or reported maintain a visual presence around the site to promote awareness of environment issues among BCPL employees and contractors ensure personnel are aware of any physical changes to operations or processes at the site BCPL Page 13

19 All environment inspections will be undertaken using the BCPL environment inspection checklist. Copies of all completed checklists will be forwarded to and/or stored by the BCPL Environment Superintendent. The BCPL Environment Superintendent (or delegate) will inform relevant personnel of their duty to undertake any required corrective or preventative actions arising from environment inspections. 20 5. Review and improvement 5.1 Reporting The BCPL Environment Superintendent will be responsible for completion of all environment reporting, as required by BCPL s leases, licences and approvals. Details of all reporting to regulatory authorities are provided in the following sections and summarised in Table Annual environment management report The Annual Environment Management Report (AEMR) summarises the environment performance of the site over the previous calendar year. In accordance with BCPL s mining leases (CL368, A355, and A339) and Schedule 5, condition 4 of the Project Approval, the BCPL AEMR will include the following information: a description of the activities (including rehabilitation) undertaken in the past calendar year, and the activities proposed to be undertaken over the current calendar year a comprehensive review of the monitoring results and complaint records over the past year, including a comparison of these results against the: assessment criteria (refer to Section 4) monitoring results of previous years predictions in the EA identification of any non-compliance over the last year, and a description of actions taken to ensure compliance identification of any trends in the monitoring data over the life of the project identification of any discrepancies between the predicted and actual impacts of the project, and analysis of the potential cause of any significant discrepancies a description of what measures will be implemented over the next year to improve environment management performance Real-time monitoring reports In accordance with Schedule 5, Condition 13 of the Project Approval, BCPL is required to publish validated real-time air quality and noise monitoring data on the Boggabri Coal Mine website ( The published monitoring data will: be presented in a clearly understandable form include identification of mine operational responses to monitoring data and weather forecasts include provision for on-line input/response by members of the community and real-time engagement with regionally bases regulatory compliance staff BCPL Page 15

21 5.1.3 Annual return At the end of each reporting period an Annual return form must be completed and returned in hardcopy format to the EPA. The Annual return summarises BCPL s compliance with the requirements of the EPL and includes: a statement of compliance with monitoring requirements a summary of monitoring and community complaints during the reporting period NPI reporting The National Pollutant Inventory (NPI) report is an estimate of emissions of NPI listed substances across all activities at the Boggabri Coal Mine. Emissions are estimated in accordance with the NPI Guide (SEWPAC, 2012) and relevant emissions estimation technique (EET) manuals (e.g. EET manual for mining, EET manual for explosive detonation and firing ranges, etc.). The report is submitted online by 30 September each year. BCPL employees and contractors will be required to capture and provide to the BCPL Environment Superintendent, the following NPI input data every financial year (1 July 30 June) (if applicable): a register of all vehicles/equipment and machinery operated on site fuel use by vehicle and machine kilometres travelled per vehicle disturbed areas (in hectares) explosives type and quantity blast design details (i.e. diameter of blast holes drilled, number of blast holes drilled) quantities of spills of hazardous materials discharges of hazardous materials to water and to land quantities of materials handled by type methods of materials handling (e.g. crushing, hauling, conveying, loading/unloading in excavators) transfers of waste to final destination (if required) Further details regarding NPI data and reporting requirements can be found at NGER reporting Under the National Greenhouse and Energy Reporting Act, 2007 (NGER Act), a registered corporation that meets a corporate reporting threshold, or whose corporate group has operational control over a facility that meets a facility reporting threshold, must apply to register and report energy consumption, energy production and greenhouse gas emissions and other information as specified. 24 5.2 Auditing Environment audits at the Boggabri Coal Mine will assess the performance of BCPL s environment management process, including plans and strategies, identify non-compliances and opportunities for improvement. The schedule for BCPL s internal and external environment audits is provided below in Table 5.2. Annually BCPL management team 5.3 Continuous improvement BCPL will continually improve the EM Strategy and subordinate plans through the use of the Environment Policy, objectives and targets, audit results, analysis of data, corrective and preventative actions and management review. 5.4 Corrective and preventative actions Non-compliances and corrective actions Non-compliances will be detected through verification processes such as monitoring, inspections and audits, as follows: When a non-conformance issue is detected, corrective actions will be identified, communicated and agreed with BCPL and implemented. Relevant contractors will be notified immediately of any non-compliant activities that present a risk of causing material environmental harm. Corrective actions will include a review of any relevant plans and procedures following identification of any non-conformance. BCPL Page 19

25 Where the non-conformance issue is associated with an inspection, audit or monitoring event, the actions will be linked to the record of that event. Non-compliance reports will be reviewed on a regular basis to ensure actions are progressed appropriately Preventive actions Preventive actions will be managed as follows: A preventive action may be identified without an environment incident or nonconformance occurring. Corrective actions will be identified and agreed with BCPL before being implemented. Preventative actions may include physical works or changes to plans or procedures, training or other requirements. 5.5 Document review Review of this document and subordinate documents will be undertaken annually by the Environment Superintendent in accordance with the Boggabri Coal document control procedure and records management. Review may also be triggered by: changes to construction methodologies, mining operations, equipment or design a hazard, near miss, or incident outcomes of an internal or external audit changes to legislation modifications to the Project Approval, mining leases, EPL or other relevant approvals changes to the organisational management structure at the Boggabri Coal Mine BCPL Page 20
