1 Recruitment Exercise Directorate Officer / Chief Personal Data Officer / Legal Counsel / Personal Data Assistant The Privacy Commissioner for Personal Data, Hong Kong (the PCPD) is an independent statutory authority established to enforce and promote compliance with the Personal Data (Privacy) Ordinance (the Ordinance). The PCPD invites high calibre candidates who share the mission to join and meet the new challenges in protecting and respecting personal data privacy right. (A) Directorate Officer The successful candidate will play a key role in overseeing the performance of functional divisions 1, maximizing utilization of resources to achieve efficiency and cost-effectiveness; adhering to the principles of transparency and accountability; making continuous efforts to streamline work procedures, applying a selective in order to be effective approach in prioritising work, with an emphasis on assignments that will deliver the expected result, as well as building and maintaining a loyal and professional team. Requirements a) (i) A good Bachelor s Degree from a Hong Kong university or (ii) a postgraduate degree from a Hong Kong university, or equivalent, where the qualifications considered in totality are comparable to the requirement in (a)(i); 1 There are six divisions of the PCPD, namely, Legal Division, Policy and Research Division, Compliance Division, Complaints Division, Communications and Education Division, and Corporate Support and Enquiries Division. 1

2 and Culture or Chinese Language and Literature of the HKALE, or c) At least 18 years demonstrable track record in senior management or professional position in a comparable set-up; d) A strong analytical ability to make independent judgment; e) Proven leadership qualities; f) Sensitivity and alertness to wider social, economic and political issues in making decisions; g) Excellent presentational skills in both written and spoken English and Chinese, with the proficiency in Putonghua; and h) A legal professional qualification would be an advantage, preferably with a broadly based practising experience, including that of advising on the exercise of statutory powers in the conduct of investigations and / or prosecution by a regulatory authority. The directorate officer will assist the Privacy Commissioner in the discharge of his statutory duties and responsibilities, including the strategic planning and formulation of operational polices. He or she shall oversee investigations of complaints, supervise compliance with the Ordinance, co-ordinate and manage the provision of advice and support on legal matters, appear in tribunals and courts, conduct public consultations, give talks and lectures, plan and manage the day-to-day operation and resources of the office, liaise and co-operate with persons / organisations performing similar functions in places outside Hong Kong, and promote awareness and understanding of the law and practice of the personal data protection. The successful candidate will receive a monthly salary ranging from around $138,000 to $180,000, depending on qualifications and experience. He or she will be appointed on contract terms with a gratuity on satisfactory completion of the contract which, when added to the employer s contribution to a Mandatory Provident Fund scheme, is up to 15% of the total basic salary for the contract period. Salary point increment, if any, shall be determined by the Privacy Commissioner upon renewal of contract. Requirements a) (i) A good Bachelor s Degree from a Hong Kong university or (ii) a postgraduate degree from a Hong Kong university, or equivalent, where the qualifications considered in totality are comparable to the requirement in (a) (i); and Culture or Chinese Language and Literature of the HKALE, or c) Substantive work experience of 12 or more years in senior management or profession position in a comparable set-up; d) Substantial research, analytical and problem-solving skills and experience; e) Exemplary skills in communication, written and oral, English and Chinese (Putonghua included); and f) Positive, energetic team leader and self-starter with good judgment, strong analytical and inter-personal skills. The Chief Personal Data Officer will lead and supervise one of the multidisciplinary professional teams to handle complaints, compliance checks / investigations and audits to enforce compliance with the provisions of the Ordinance; provide policy advice and undertake research projects, surveys and 3

4 public consultation exercises on major / topical privacy matters; formulate and improve on the policies and procedures of investigation and compliance work to achieve enhanced efficiency and productivity; develop codes of practices, guidelines / guidance notes to promote compliance by data users with the requirements under the Ordinance; provide corporate support and manage dayto-day operation; and coordinate, or represent PCPD at conferences, meetings, working groups and discussions on personal data privacy matters. The successful candidate will receive a monthly salary at $107,870. He or she will be appointed on contract terms with a gratuity on satisfactory completion of contract which, when added to the employer s contribution to a Mandatory Provident Fund scheme, is up to 15% of the total basic salary for the contract period. Requirements a) A good Bachelor s Degree in law from a Hong Kong university or and Culture or Chinese Language and Literature of the HKALE, or 4

5 c) Solicitor or barrister admitted to practise in Hong Kong; d) Minimum 8 years post-qualification experience, preferably with a broadly based practising experience, including that of advising on the exercise of statutory powers in the conduct of investigations and / or prosecution by a regulatory authority; e) Substantial research, analytical and problem-solving skills and experience; f) Previous work experience in similar set-up and proficiency in advocacy will be an advantage; g) Exemplary skills in consultation and communication, written and oral, English and Chinese (Putonghua included); and h) Positive, energetic and self-starter with good judgment, strong analytical and inter-personal skills. The Legal Counsel will handle legal proceedings and Administrative Appeals Board cases; advise on all legal matters relating to the handling of enquires, complaints, compliance checks, investigations, inspections and data matching requests and policy and research work; prepare submissions to public consultations which may have concerns on personal data privacy; undertake legal researches and provide legal support for projects undertaken by the PCPD; and gives talks and lectures, assist in the preparation of guidance materials, guidelines and codes of practice. The successful candidate will receive a monthly salary at $85,970. He or she will be appointed on contract terms with a gratuity on satisfactory completion of contract which, when added to the employer s contribution to a Mandatory Provident Fund scheme, is up to 15% of the total basic salary for the contract period. 6 (D) Personal Data Assistant a) A good Bachelor s Degree from a Hong Kong university, or and Culture or Chinese Language and Literature of the HKALE, or c) Being creative, resourceful, positive and energetic in adding value and meeting changing needs; d) Good analytical and communication skills with mature personality; ability to work independently and under pressure; e) Good exposure to translation, research, training, publication, and media; f) Proficiency in operating Microsoft applications and Chinese word processing; and g) Previous work experience in a similar set-up would be an advantage. The Personal Data Assistant will be responsible for handling enquiries and complaints made by members of the public, conducting research, compiling statistics / reports, assisting in preparing publications, educational and promotional materials, and carrying out general administration work. The successful candidate will receive a monthly salary at $19,395. He or she will be appointed on contract terms.
