1 1 CHARTER TOWNSHIP OF CALEDONIA PLANNING COMMISSION Adam Paarlberg, Chairman Minutes of a meeting held on A regular meeting of the Charter Township of Caledonia Planning Commission held at 7:00 p.m., on Monday, at the Township Office, 8196 Broadmoor Ave. SE, Caledonia, Michigan. 1. CALL TO ORDER / ROLL CALL A Paarlberg called the meeting to order at 7:00 p.m. with a quorum present. Members Present: A. Paarlberg, D. Cutler,C. VanLaan, D. Curtis, T. Bradshaw, J. Masefield, S. Bosscher Members Absent: None Staff Present: Lynee Wells, Township Planner, Bethny Briggs, Planning Assistant Others Present: Residents of the Township 2. CONSIDERATION OF THE MEETING AGENDA A Paarlberg made a motion to approve the agenda, D Curtis supported.. VOICE VOTE: All ayes. Agenda approved. 3. PUBLIC COMMENTS (BRIEF UP TO 2 MINUTES) A Paarlberg opened the floor to public comment at 7:01, closed it at the same time finding no comment. 4. CONSIDERATION OF MEETING MINUTES A. Minutes of the October 01, 2018 meeting. T Bradshaw recommended amending minutes on page 5 to crushing concrete and made a motion to approve the minutes of October 01, 2018 as amended. Motion was supported by C VanLaan. VOICE VOTE: All ayes. Minutes of the October 01, 2018 meeting were approved as amended. 5. INQUIRY OF CONFLICT OF INTEREST None declared.

2 2 6. UNFINISHED BUSINESS None 7. NEW BUSINESS A. Public Hearing- Petition to Amend the Zoning Map from RR and R-1 to HC and I-1. Parcel numbers: , , , , , , A Paarlberg calls Don Degroot from Excel Engineering to the Podium: D Degroot: We would like to rezone the North side of 68 th Street, West of M37. The requested rezoning is in compliance with the Master Plan. Currently zoned RR & R1. Requesting to rezone 10 acres to Highway Commercial and approximately 39 acres to Light Industrial. Request comes with Conditional Rezoning requests. Asking because of location being rezoned to LI, has no frontage on Broadmoor. We are looking for two exceptions for 2 items in overlay district. We would like signage to be allowed which would meet I-1 zoning ordinance. These would be part of Industrial Zoning that would be in Overlay Zoning. Utilities are ready, and development is ready. This is the first step in rezoning the property. Commissioners questions J Masefield: Lynee, what is the difference on signage from overlay to I1 L Wells: I-1 60 square feet per sign total of 120 square feet, height 12 feet. Also, Signage for Overlay District allows ground signs, only Industrial that fronts 68 th would be able to have that Overlay ground sign and height is 8 feet and square feet is 32 and 1 sheet of plywood We just modified the Master Plan for our Overlay ordinance specifies uses. We don t have Light Industrial uses in that. Having the opportunity to do conditional rezoning gives them the ability to have those uses. We don t want to allow Industrial Use throughout our entire Overlay either. A Paarlberg: Lot numbers do not correspond to parcel numbers D Degroot: Existing lots, old plot A Paarlberg: Lynee- anything from existing parcel owner? L Wells-no we have not heard anything Commissioners questions D Curtis- are you claiming access to Industrial off 68 th St. I m more app to wave it if there is not M7 access vs 68 th St access. D Degroot- we wouldn t contemplate having connections between, access would be off 68 th St. L Wells-We could make adjustments at site plan review in the future.

3 3 Industrial sign could not go on M37- those properties are zoned Highway Commercial. T Bradshaw- Is the rezoning to make that portion of that property to Highway Commercial? The line following the fixed drain is the boundary of I-1 and HC. Is that ok to use that line instead of the property line. L Wells: They will use description to describe it. It was used in our notification. A Paarlberg:- Anyone else? L Wells- The ordinance is in the packet from the Township Attorney. A PAARLBERG ENTERTAINS A MOTION: T Bradshaw made a motion to approve the rezoning request in accordance of the draft from the Township Attorney. D Curtis supported the motion. Role call- All Ayes Motion Approved L Wells-Don take out to be eliminated under overlay. Don-yes B. Public Hearing to-recommend to the Township Board, a Zoning Ordinance test amendment concerning Mass Grading: L Wells: We want to allow the applicant to do grading of their site because we deal with seasonality. This way, they can get a head start on their site project. This is the opportunity to do a mass grading site plan. We added the performance guarantee in an amount determined by the township engineer. Text amendment so it has to be recommended by the Planning Commission and then goes to the Township Board for approval. Performance guarantee makes sure the site will be restored. Ord now states if application is in, you cannot move dirt. This gives them one step to move forward. D Curtis- if no app in, they can move dirt? L Wells- yes A PAARLBERG ENTERTAINS A MOTION: C Vanlaan makes motion to approve the recommendation of mass grading zoning ordinance text amendment. S Bosscher supported the motion. T Bradshaw: Note for letter C on page 2 add without a MDEQ permit. L Wells-included as recommendation to the Township Board Voice Vote: All Ayes- motion carried C. Public Hearing to recommend to the Township Board, a Zoning Ordinance text amendment concerning pools.

4 4 L Wells: We currently have two ordinances in the township, one in zoning and one in general law. We realized that the State construction code/building code allows for mechanical covers on pools to be sufficient. Ours is more restrictive than the States. Applicants and property owners for esthetic reasons and if the state allows, would like the mechanical covers and are wondering why are we more restrictive. We want to adhere to what the state provides. C Vanlaan-Who checks those for functionality? L Wells-Great question- no one enforces but we don t shake the fence either. T Bradshaw- people take the gates off or latches off. Ladders should be removed and are not, not a fool proof system. If anything, these covers are more efficient. L Wells- maybe insurance companies are checking them J Masefield -we would be approving the pool and the fence L Wells: Recommending approval of text amendment to say fencing is not required. T Bradshaw: Correction: swimming pools page 2- swimming pools not holes A Paarlberg asks if there is anything else? D Curtis makes a motion to recommend to the Township Board, a Zoning Ordinance text amendment for pool covers and fences. J Masefield supported the motion. Role call vote: J Masefield-yes; T Bradshaw yes; S Bosscher- yes; A Paarlberg-yes; D Curtis- yes; C Vanlaan-yes; D Cutler- yes. Motion carried D. Petition to Extend an Approved Site Plan at 9240 Cherry Valley, Caledonia, MI Parcel number: L Wells: Applicant had a year to get started and he has not. Requesting an extension. He got conditional rezoning due to small site and setbacks. The size of property did not meet minimum of overlay. Express car care center. He wanted to reface building. He has spent a lot of time and energy. He sent in for 1-year extension. Our ordinance allows for 2 1-year extensions. Typically, we if our ordinance has not changed, we allow the extension. As long as our Master Plan and zoning ordinance hasn t changed, we would recommend the extension. None of them have changed. L Wells- no changes and we would get site plan and make sure all drawing match what we approved last year. D Curtis: is he coming back before us L Wells: we already approved all of it D Curtis: the big thing was the color

5 5 L Wells: He backed off on some of that and he added glass doors. L Wells: We have approval on file A Paarlberg: Things haven t changed, he s still working, we don t need to go back although we could. C Vanlaan: Did we leave it up to you Lynee to decide how much yellow L Wells: I will go back and look at minutes L Wells: I will make sure he doesn t not put that much yellow J Masefield: Normal path to follow would be to direct that condition to Lynee D Curtis made the motion to except to extend the approved site plan for 1 year. C Vanlaan supported the motion. All ayes Petition is Approved Discussion Items: A. Accessory Buildings: L Wells: We looked through other townships and got feedback on what s working and what they would recommend They do it their own unique way Gains TWP said they would put a limit on total sq. footage Gains has max, they do SLU if you want something larger C Vanlaan: We have to make sure their barns are not larger than their homes D Curtis: I have a problem then because I have a small house. C Vanlaan: Should we do acreage of land and sq. ft of home? J Masefield: Curious on Byron-they put a lot of thought; do you know if they do take any sq. ft of home. He said if the house is smaller, they are still allowed to go that large no matter how small your house is. C Vanlaan: What would it look like if we did a 1.5 or 2 percent D Curtis: 1900 sq. ft on 2 acres J Masefield: Has to be easy for people to understand T Bradshaw: Right to farm, what is the difference between pole barns and agricultural barns? How do you define it?

6 6 L Wells: We ask owner to provide signed affidavit that they are a farm use and the burden is on them. Harvesting wood could be protected in right to farm. A Paarlberg: I d like to spend more time with this. A Paarlberg: My point is at some point we have to come together. Should we take it home and go through it or walk through it tonight. J Masefield: Home owners associations can be more restrictive A Paarlberg: I m in favor of Byron Centers sizes or bigger D Curtis: What we have now is too small L Wells-We should come up with a solution. Fixed numbers and come up with a new calibration. A Paarlberg: If we come to agreement, does it go to Public Hearing? L Wells-Yes We will revisit A Paarlberg opens the floor to Public Comment at 8:29 pm and closes it at the same time due to no comment. L Wells: We will be here on the 19 th A Paarlberg: Keep accessory buildings on the agenda until we figure it out A Paarlberg ENTERTAINS A MOTION: ADJOURNMENT J Masefield made a motion to adjourn, S Bosscher supported the motion. VOICE VOTE- all ayes-meeting adjourned at 8:31pm
