Introducton 1.1 There s a requrement for Neghbourhood Development Plans to nclude a statement explanng how the proposed Neghbourhood Development Plan s n accordance wth the Neghbourhood Plannng (General) Regulatons 2012 and, n partcular, how t meets the requrements of paragraph 8 of Schedule 4B to the Town and Country Plannng Act 1990 whch relates to meetng basc condtons. Meetng legal requrements 2.1 Ths Submsson Plan s beng submtted by a qualfyng body, namely Longhope Parsh Councl. 2.2 The Neghbourhood Plan sets out polces n relaton to the development and use of land. The Plan proposal relates to plannng matters (the use and development of land) and has been prepared n accordance wth the statutory requrements and processes set out n the Town and Country Plannng Act 1990 (as amended by the Localsm Act 2011) and the Neghbourhood Plannng Regulatons The Neghbourhood Plan document clearly dstngushes between plannng polces relatng to land use and projects whch, n parallel, wll help to acheve the Plan s objectves. 2

3 2.3 The Longhope Neghbourhood Plan document states the perod for whch t s to have effect. That perod s from the Plan beng made up to 2026 (the same perod as the Forest of Dean Dstrct Councl Local Plan). 2.4 Longhope Neghbourhood Plan does not deal wth county matters (mneral extracton and waste development), natonally sgnfcant nfrastructure or any other matters set out n Secton 61K of the Town and Country Plannng Act The Longhope Neghbourhood Plan does not relate to more than one neghbourhood area. The Neghbourhood Plan proposal relates to the Longhope Parsh Neghbourhood Area and to no other area. The Neghbourhood Area s dentfable on a map on page 3 of the Longhope Neghbourhood Plan document and s dentcal to the area desgnated by Forest of Dean Dstrct Councl (FoDDC). There are no other neghbourhood plans relatng to that Neghbourhood Area. 2.6 The Longhope Neghbourhood Plan has followed regulatons relatng to nvolvement of stakeholders and statutory consultaton perods. The Plan has been produced wth extensve nput from the local communty and other stakeholders, as descrbed n the accompanyng Consultaton Statement. The Neghbourhood Area was desgnated by Forest of Dean Dstrct Councl followng the requred process and consultaton perod. Consultaton on the Pre-Submsson Draft of the Neghbourhood Plan has been conducted as requred by the Plannng Regulatons 2011 n terms of tmescales and n terms of recordng and consderaton of ssues and suggestons made, meetng the requrements of paragraph 8 of Schedule 4B of the Town and Country Plannng Act Meetng the requrements of paragraph 8 of Schedule 4B of the Town and Country Plannng Act 3.1 A number of basc condtons must be met by Neghbourhood Development Plans and the followng sectons hghlght how the Longhope Neghbourhood Plan meets requrements n relaton to: havng regard to natonal polces and prncples of sustanable development; beng n general conformty wth Forest of Dean Dstrct Councl s Local Plan adopted polces; and s compatble wth EU oblgatons. 3.2 Have approprate regard to the Natonal Plannng Polcy Framework (NPPF) and related gudance and achevement of sustanable development. 3.3 Polces n the Longhope Neghbourhood Plan relate to balancng economc, socal and envronmental ssues, resultng n sustanable development. It addresses ths by encouragng job creaton, makng net gans for nature, enablng good desgn, mprovng lvng, workng, travel and lesure condtons and wdenng the choce of homes. For Longhope Parsh to reman a vbrant workng communty where people at all stages of ther lves enjoy lvng and workng. It wll be a thrvng communty that contrbutes to, and benefts from, ts outstandng rural settng. 3

Stakeholders have approached the exercse creatvely n order to enhance the parsh and ts surroundngs. 3.5 The Longhope Neghbourhood Plan wll be montored by the lead councllor of Longhope Parsh Councl and the plannng commttee of the Parsh Councl by: n Ensurng that the polces of the NDP are appled to all plannng applcatons; n Reportng to the full Parsh Councl the outcomes of ths montorng process after each meetng of the plannng commttee. And revewed n the lght of: n The outcomes of the montorng and evaluaton process; n Revsons to local and natonal plannng gudance. 3.6 The requrement of the basc condtons s that the Longhope Neghbourhood Plan s n general conformty wth strategc polces n the current adopted Core Strategy (2012). 3.7 The Forest of Dean Dstrct Councl s emergng Allocatons Plan and current proposed modfcatons (September 2016) allocates stes across the dstrct based on the housng Objectvely Assessed Needs and n lne wth the Core Strategy s settlement herarchy. The Allocatons Plan also provdes a range of other

5 allocatons ncludng an updated defned settlement boundary. The Longhope NDP operates wthn ths context and whlst t can be expected that unallocated housng stes wll come forward (n housng number terms often called wndfall stes) no addtonal housng allocatons are proposed n the NDP and t can be expected that the quantum of housng development wthn the NDP area wll be n lne wth that expected n the Allocatons Plan. CSP The Longhope Neghbourhood Plan s objectves and polces emphasse makng the parsh a vbrant workng communty where people at all stages of ther lves enjoy lvng and workng. 3.9 Longhope les wthn the admnstratve area of Forest of Dean Dstrct Councl (FoDDC). Relevant polces n the case of FoDDC are those whch apply to the Forest of Dean Dstrct Local Plan and, n keepng wth good practce, the Longhope Neghbourhood Plan has used nformaton from the Local Plan evdence base prepared by Forest of Dean Dstrct Councl. The steerng group has also engaged n constructve dscusson wth Forest of Dean Dstrct Councl at key stages durng the process The Longhope Neghbourhood Plan s approach, vson and objectves recognse ts poston as n the Forest of Dean Dstrct adopted Local Plan as a servce vllage Core Strategy Adopted Verson Feb para. 7.73: Settlement Polces: servce vllages are lkely to see relatvely lttle change over the Plan perod. Some are capable of accommodatng modest housng and employment developments, and all are potental locatons for small groups of affordable dwellngs (subject always to the avalablty of sutable stes) The settlement boundares wll be revewed as part of the Allocatons Plan Document, but new major housng allocatons are unlkely to be made CSP.16 states that except for possble affordable housng as an excepton, and exstng commtments, new housng and employment opportuntes are lkely to be small n scale (e.g. sngle plots, or pars, small workshops or change of use of exstng buldngs plus reuse of agrcultural buldngs) The Longhope Neghbourhood Plan demonstrates t s n conformty wth the Local Plan by drectly referencng the Local Plan or deferrng to t n ts polces In keepng wth the purpose of Neghbourhood Development Plans, polces n the Longhope Neghbourhood Plan add detal and consderatons whch are specfc to the parsh area. Ths approach can be seen n polces H1a: Meetng Local Needs and H1b: Affordable Housng regardng needs to be met, housng mx and local connectons for affordable housng, extendng the general affordable housng polcy n the Local Plan. The desgn polces n the Longhope Neghbourhood Plan also reference specfc vews and key features to be consdered for new developments. 5

Compatblty wth EU oblgatons 4.1 Human Rghts The Longhope Neghbourhood Plan s fully compatble wth the European Conventon on Human Rghts. It has been prepared wth full regard to natonal statutory regulaton and polcy gudance, whch are both compatble wth the Conventon. The Plan has been produced n full consultaton wth the local communty. It does not contan polces or proposals that would nfrnge the human rghts of resdents or other stakeholders over and above the exstng strategc polces at natonal and dstrct levels. 4.2 Strategc Envronmental Assessment (SEA) and Habtats Regulatons Assessment (HRA) Forest of Dean Dstrct Councl was commssoned to screen the Longhope Neghbourhood Plan to determne whether a full SEA was requred. An HRA screenng was also undertaken to assess the mpacts on the Natura 2000 network of nternatonally mportant nature conservaton stes. It s requred by the European Habtats Drectve, transposed nto UK legslaton through the Conservaton of Habtats and Speces Regulatons 2010 (and prevous smlar legslaton). The Habtats Drectve apples the precautonary prncple to desgnated stes: plans can only be permtted f t has been shown that they wll not adversely affect the desgnated stes, or else can go ahead only under lmted and strngent requrements regardng fndngs of no alternatves, mperatve reasons of overrdng publc nterest and provson of compensatory measures. The full screenng statements can be found n the Appendces 8 and 9 of the Longhope Neghbourhood Plan Evdence Base documents. 4.3 The Forest of Dean Dstrct Councl statement concluded that t s consdered that the Longhope Neghbourhood Development Plan s a plan to whch the Envronmental Assessment of Plans and Programmes Regulatons 2004 apples. 4.4 Followng the assessment set the Forest of Dean Dstrct Councl has concluded that the Longhope Neghbourhood Development Plan wll not result n sgnfcant envronmental effects. Therefore, an Envronmental Assessment s currently not requred for the Longhope Neghbourhood Development Plan. 4.5 The Local Plannng Authorty (FoDDC) confrmed that the Longhope Neghbourhood Plan wll not trgger the need for a full SEA or HRA.
