PURPOSE OF THE STUDY The Joint Programme (JP), jointly implemented by the United Nations Development Programme (UNDP) and the United Nations Entity for Gender Equality and the Empowerment of Women and Girls (UN Women), will support the Government of Myanmar (GoM), the Rakhine State Government (RSG) and the people living in Rakhine State to address some of the key causes related to the underdevelopment of the State, the perceived marginalization and exclusion felt by the people from the country s and state s developments, and the intercommunal tension and conflict experienced during the last years. The situation of economic precariousness and exclusion is compounded for women living in Rakhine State, and must be addressed with a special emphasis, recognizing that women s empowerment is not only a development and human rights imperative on its own, but also a pathway to realize peace, stability and resilient communities. Against this backdrop, UNDP and UN Women are conducting a review to inform the design, implementation and management of the Joint Programme between UNDP and UN Women with preliminary analysis and recommendations regarding conflict sensitivity and gender equality considerations in Rakhine State. B. BACKGROUND AND CONTEXT Rakhine context

2 Rakhine State has received significant attention by national and international actors due to the ongoing challenges the State faces, mainly related to the socioeconomic situation of the population, weak economic infrastructure and production, its vulnerability to natural disasters and climate change, and, periodically (in 2012, 2016 and 2017) ethnic tensions and violence. Although support to Rakhine State currently tends to be largely framed as part of a humanitarian response, it needs to be emphasized that the present crisis occurs against the background of chronic poverty, longstanding and structural inequalities, including on the basis of gender, ethnicity and religion and protracted ethno-political conflict. Restrictive socio-cultural norms, gender based discrimination and violence, the gendered division of labor, women s limited access to decision making, and women s lack of ownership and control over resources render women further vulnerable in the face of poverty, inequality and human and natural disasters. Therefore, a humanitarian response needs to be combined with a developmental approach that addresses the key issues of poverty, vulnerability, exclusion, and statesociety and inter-communal conflict. Joint UNDP and UN Women programme Inclusive development and empowerment of women in Rakhine state, Myanmar The joint programme will support the Government of Myanmar, the Rakhine State Government and people living in Rakhine State, by a) facilitating and institutionalizing democratic processes for local development processes, including local development planning; b) strengthening individual and institutional knowledge and skills around community social cohesion and building awareness on rule of law principles by rights holders and duty bearers; c) addressing the immediate needs of vulnerable communities by improving their livelihoods; and d) improving women s leadership and socio-economic capacities. The overall aim of the project is to lay the foundations for improved participatory governance, equitable and responsive service delivery, and creating immediate improvements to people s socioeconomic well-being. Key cross-cutting themes such as human rights, gender equality, conflict sensitivity, disaster risk reduction and capacity-development have been integrated into project activities. The Project also anticipates the establishment of a Rule of Law Centre in line with Rakhine Commission recommendations. The project is a one year initiative (1 April 2018 to 31 March 2019) and will be catalytic in initiating a substantive engagement in Rakhine State that will be sustained for coming years upon mobilization of additional resources. Within this context, UNDP is seeking a team of individual consultants to conduct an independent review on conflict sensitivity and gender equality to inform Programming in Rakhine State, for a period of 25 days commencing on the 19 th March 2018 per requirements set forth in this Terms of Reference (TOR). C. OBJECTIVES AND CRITERIA The purpose of the review is to inform the design, implementation and management of the Joint Programme between UNDP and UN Women with preliminary analysis and recommendations regarding conflict sensitivity and gender equality considerations in Rakhine State. It will provide a starting point to assist UNDP and UN Women to operate in a conflict-sensitive and gender-responsive manner in Rakhine. In achieving this, the objectives of the review are to: i. Generate a deeper understanding of peace, conflict and gender dynamics in Rakhine and how these interact with the components and implementation approaches of the Joint Programme; 2

Identify risks and recommend concrete measures so that the Joint Programme not only avoids contributing to tensions, exclusion or violence, but also seeks opportunities to reinforce peace outcomes and social/community cohesion; iii. Identify risks and recommend concrete measures so that the Joint Programme not only avoids contributing to the disempowerment and exclusion of women (or otherwise discrimination and violence against women), but also deepens local capacities, coping mechanisms and overall opportunities to address these challenges through prevention, social mobilisation, awareness raising and other elemengs of gender-responsive and transformative programming; iv. Inform the direction of any future UNDP and UN Women strategies, programmes and approaches in Rakhine. Therefore, the final review report should: Provide a full analysis of the possible impact of Joint Programme interventions on conflict and gender dynamics in Rakhine State, including: o analyzing the interaction between Joint Programme component outputs/activities and Rakhine conflict and gender dynamics; o identifying potential conflict/gender risks and recommending appropriate mitigation measures for each Joint Programme component, as well as appropriate adjustments that maximise opportunities to positively affect peace and gender dynamics; o advising on Joint Programme entry-points, criteria for selecting intervention locations and appropriate delivery options and implementation modalities in relation to conflict/gender dynamics in the Rakhine context; o mapping relevant stakeholders for each Joint Programme component in relation to conflict and gender considerations; o identifying criteria for assessing stakeholder capacities to operate in a conflict sensitive and gender responsive manner; Support Joint Programme monitoring, evaluation and learning related to the project s impact on conflict and gender dynamics, including: o reviewing the logical framework and M&E activities of the Joint Programme to ensure due attention is given to monitoring for conflict sensitivity and gender equality effectiveness; o recommending criteria and a framework for designing a conflict sensitive and gender responsive evaluation of the Joint Programme in the future; o recommending any further programme tools or methods, such as: project specific conflict sensitivity checklists; monitoring effectiveness for conflict sensitivity and gender responsiveness through intervention/context interaction indicators; indicators measuring unintended impacts; development of reflective learning and best practice documentation for conflict sensitivity and gender responsiveness methods; etc. Provide specific advice to inform the development of a Rakhine-appropriate Joint Programme outreach and communications strategy that ensures maximum inclusiveness across different communities, genders and relevant stakeholder groups. D. SCOPE The review will be carried out by a four-person team (International Consultant for Conflict Sensitivity, National Consultant for Conflict Sensitivity, International Programme Specialist for Gender Analysis, 3

4 National Programme Analyst for Gender Analysis) with the support of UNDP and UN Women management and programme teams. The review team will rely on the following sources of information to develop its analysis and findings: Relevant literature relating to conflict sensitivity and gender equality in Rakhine (including comparison of existing conflict and gender analyses of Rakhine State) and global best practice; Interviews with a wide range of stakeholders and partners (e.g. UN/UNDP/UN Women staff; INGO staff; government; civil society and community-based organisations; women organisations and networks; youth organisations and networks; academic, policy and research organisations; the private sector; professional and business associations; community centres and other local institutions; etc.) in Sittwe, Yangon and Nay Pyi Taw; Feedback from facilitating a 1-day consultation workshop with development and humanitarian partners on conflict sensitivity and gender equality practice in Rakhine; and Relevant secondary sources of data relating to conflict sensitivity and gender equality in Rakhine. The review team will jointly undertake the following tasks: Consult with management at the outset of the assignment and periodically throughout to clarify objectives, scope and requirements for conducting the study; Produce and submit an Inception Report outlining the study methodology, research matrix, work plan and draft outline for the study report; Conduct a desk review of relevant literature relating to conflict sensitivity and gender equality in Rakhine, as well as global best practice; Develop the study s interview questionnaires, data collection plan and facilitation plan for the 1-day consultation workshop based on the agreed study methodology; Conduct interviews with relevant stakeholders and collect relevant data at the Sittwe, Yangon and Nay Pyi Taw levels; Facilitate a 1-day consultation workshop with development and humanitarian partners on conflict sensitivity and gender equality practice in Rakhine (with the support of the Rakhine Coordination Group); Provide a Presentation of Initial Findings after the conclusion of in-country field mission; Produce and submit the Draft Study Report based on the analysis and findings of the study; Consult with management and adjust the draft report based on feedback from; Submit Final Report to management. The review will follow international guidelines on conflict sensitivity and gender mainstreaming from the Conflict Sensitivity Consortium and the United Nations Development Group, as well as be guided by Do No Harm principles. E. EXPERTISE REQUIRED The review team will be comprised of four (4) persons. UN Women will provide International programme specialist and national programme analysist for Gender analysis. UNDP will contract consultants with the skills, knowledge and expertise detailed below: 1. International Conflict Sensitivity Consultant Master s degree in law, political science, development studies, conflict security and development or a Bachelor s degree a minimum of 10 years experience in development studies, political science or related field 4

5 Experience of design and implementation of projects in conflict affected areas. Proven expertise and experience in conducting evaluations and Project/program studys in the field of conflict sensitivity and conflict analysis Robust experience with data collection methodologies, including prior experience with focus and analysis groups, key informant interviews, surveys, etc. Prior knowledge and experience of working in the country and Rakhine State, including comprehensive understanding of the UN s projects and approaches in Myanmar, is strongly desirable Technical knowledge and experience in UNDP thematic areas, specifically in governance, local development, rule of law/access to justice, and cross cutting issues such as social cohesion, gender, sustaining peace/conflict prevention, rights-based approaches to programming and capacity development is an asset Strong analytical and interpersonal skills Ability to work in a multicultural environment Strong English language skills (both written and spoken) 2. National Conflict Sensitivity Consultant Master s degree in law, political science, development studies or a Bachelor s degree in these (or related) fields with additional 5 years experience Knowledge and demonstrable experience in the field of rule of law and access to justice, conflict s analysis and prevention, is highly desirable Proven expertise and experience in conducting evaluations and Project/program study is highly desirable, especially in conflict-affected contexts Fluency in spoken and written Myanmar language Excellent command of the English language (written and spoken) is required Strong analytical skills Myanmar national F. DELIVERABLES The review team will be expected to produce the following deliverables: Deliverables 1. Inception Report: Prior to embarking on the review, the team will prepare an inception report that details the study methodology, research matrix, work plan and draft outline for the study report 2. 1-Day Consultation Workshop: Design and facilitate workshop with development and humanitarian partners on conflict sensitivity and gender equality practice in Rakhine 3. Presentation of Initial Findings: The team will present the initial findings and recommendations of the report to UNDP and UN Women (including additional stakeholders / partners as appropriate) 4. Draft Report: The team will be required to submit a draft report for management review, quality assurance and substantive feedback / clarifications Due Dates 26/3/ /3/2018 9/4/ /4/2018 5

6 5. Final Report: The team will revise and submit a final report that addresses management feedback 19/4/2018 G. MANAGEMENT AND IMPLEMENTATION ARRANGEMENTS The International Conflict Sensitivity Consultant will lead the conflict sensitivity analysis, and will act as the team leader of the review team. He/she will coordinate the work of the 4 team members and will ensure timely submission of deliverables. That National Conflict Sensitivity Consultant will provide inputs and insights during the review, supports drafting on the mission schedule, facilitates and translates in meetings, translates documents in Myanmar to English and provides inputs in inception, draft and final report. The International Programme Specialist for Gender Analysis will lead the gender analysis, and ensures timely submission of inputs in the review deliverables. The review team will report to the UNDP Programme Manager in Sittwe on a weekly basis as work against deliverables progresses, and will coordinate with UNDP programme leads in UNDP Yangon office on Local Governance and Rule of law, and UN Women in Yangon. They will be accountable to UNDP and UN Women on the timeliness and quality of the deliverables The review team will be required to review documents and consult with UNDP senior management and UN Women senior management and programme leads to better understand the proposed intervention in Rakhine State, including its design process, implementation aspects and expected results The review team will be required to conduct interviews with UNDP staff, INGO staff, government officials, local stakeholders and other parties relevant to this study, as identified by UNDP UNDP and UN Women will facilitate government (and other counterpart) cooperation for this assignment UNDP and UN Women will assist in the facilitation of introduction letters and/or requests for meetings upon request with stakeholders and beneficiaries UNDP consultants are responsible for providing their own laptop computers and mobile phones for use during this assignment UNDP and UN Women will provide the following support as appropriate: Substantive inputs to and quality control of deliverables Administrative and logistical support with travel and transport arrangements, visas, and processes necessary for successful completion of the assignment Arrange the consultants in-country work-related travel Provide office/work space to the review team while in Myanmar H. DUTY STATION FOR UNDP CONSULTANTS a) This consultancy will be home-based with mission travel to some of the locations in Myanmar as deemed appropriate for the purpose of this evaluation: Yangon, Nay Pyi Taw, Rakhine b) The consultants may be required to travel to other locations in Myanmar for the purposes of this evaluation. This will be determined by the Programme Manager I. TIMEFRAME FOR UNDP CONSULTANTS a) The contract will come into effect on 19 th March till 19 th April

7 b) The consultants will work for a period of 25 work days within the dates indicated as per the tentative schedule below: a. Home-based work: 3 days i. Preparation for mission, review of background documents, inception report, including data collection methodology b. Mission to Myanmar: 17 days i. Field visits, interviews, etc. ii. Presentation of initial findings and recommendations to UNDP and selected audiences c. Home-based work: 5 days i. Finalization of report ii. Submission of final report: 19 th April 2018 J. COST FOR UNDP CONSULTANTS Interested persons are requested to submit their financial proposals as a lump sum amount noting the following conditions: 1) The lump sum amount must be all-inclusive and further broken down by category as detailed below a. All costs (professional fees, travel costs, living allowances, communications, consumables, etc.) required to perform the demands of the TOR must be incorporated in the financial proposal 2) The contract price is fixed regardless of changes in the cost components 3) The consultant will be entitled to a full fare economy class return ticket in order to travel to/from Myanmar to fulfill the requirements of this terms of reference The consultants will be paid according to the completion of deliverables as detailed below: Deliverables/ Outputs Target Due Dates Percentage of Contract 1 Upon arrival in Myanmar, submission of inception report and preliminary meetings held with UNDP and partner institutions 26 March % - To cover flight costs and initial costs of living in Myanmar 2 Presentation of initial findings and draft report 13 April 2018 to UNDP 30% 3 Submission of Final review Report 19 April % Total 100% K. RECOMMENDED PRESENTATION OF OFFER: Interested persons are requested to submit the following documents: 1) Letter of Confirmation of Interest and Availability using the template provided by UNDP 2) Personal CV indicating all past experience as well as the contact details ( and telephone number) of the candidate and at least three (3) professional references 3) Financial Proposal that indicates the all-inclusive fixed total contract price, supported by a breakdown of costs, as per template provided by UNDP 7

CRITERIA FOR SELECTION OF THE BEST OFFER The following criteria shall serve as basis for evaluating offers: Combined Scoring Method - where the qualifications and experience will be weighted a maximum of 70% and combined with the price offer which will be weighted a maximum of 30% Qualifications and experience will be scored as per the following breakdown: o Educational background and years of relevant experience - 10 points o Relevant experience and expertise in designing and implementing conflict sensitive projects and conducting conflict analysis - 50 points o o Prior experience of working in Rakhine and/or transitional contexts - 20 points Proven expertise and experience in conflict prevention, local development, rule of law programming and social cohesion- 20 points M. EVALUATION ETHICS This review will be conducted in accordance with the principles outlined in the United Nations Evaluation Group Ethical Guidelines for Evaluation (2008) and the UNEG Code of Conduct for Evaluation in the UN System. See attached annexes for reference. 8
