3 Duty Holders Employers (Act 2005 and GA 2007) in relation to an employee means the person with whom the employee has entered into or for whom the employee works under(or, where the employment has ceased, entered into or worked under) a contract of employment, includes a person (other than an employee of that person) under whose control and direction an employee works,.. Lift Installers (Directive 95/16/EC) Means the natural or legal person who takes responsibility for the design, manufacture, installation, and placing on the market of the lift and who affixes the CE marking and draws up the EC declaration of conformity Persons (Act 2005) 3

4 Definitions Place of Work Includes any, or any part of any, place (whether or not within or forming part of a building or structure), land or other location at, in upon or near which, work is carried on whether occasionally or otherwise.. Undertaking Means a person being an individual, a body corporate or an unincorporated body of persons engaged in the production, supply or distribution of goods or the provision of a service (whether carried on by him or her for profit or not) 4

5 Definitions Work Equipment Means any machinery, appliance, apparatus, tool or installation for use at work Lifting Equipment Means work equipment for lifting, lowering loads or pile driving, and includes anything used for anchoring, fixing or supporting such equipment. Load includes a person Thorough Examination( Schedule 1 Part E) Includes testing if competent person considers it to be necessary for the for the purpose of the examination, or testing is required pursuant to Regulation 52 and Schedule 1 5

6 Definitions Competent Person Having regard to the task he or she is required to perform and taking account of the size or hazards (or both of them) of the undertaking or establishment in which he or she undertakes work, the person possesses sufficient training, experience and knowledge appropriate to the nature of the work to be undertaken 6

The means of access to or egress from that place of work.. Including a person who has control of a place of work or part of place of work trade, undertaking or business Where a person has, by virtue of any contract, tenancy, licence or other interest, an obligation to any extent to maintain or repair a place of work or access thereto or egress therefrom.. The person is deemed, for the purposes of this section, to be a person to whom this section applies to the extent of his or her obligation 7

8 Obligations (Act 2005) Section 15 (Continued) A person to whom this section applies shall ensure, so far as is reasonably practicable, that the place of work, the means of access thereto, or egress therefrom.. Are safe and without risk to health Section 12 Every employer shall manage and conduct his or her undertaking in such a way as to ensure, so far as is reasonably practicable, that in the course of work being carried on, individuals at the place of work (not being his or her employees) are not exposed to risks to their safety, health or welfare 8

11 Obligations (GA 2007) Regulation 52 (Examination and Testing of Lifting Equipment) Fixed Equipment for lifting loads tested and thoroughly examined by a competent person Frequency every 6 months ( Schedule 1 Part B) Regulation 53 (Reports by Competent Person) Prepare a report (Schedule 1 Part E) If repairs required to make safe then notify owner and H.S.A., and competent person advices cessation of lift. 11

12 Obligations (Lift Installers) After 30 th June 1999 S.I. 246 /1998 European Communities (Lifts Regulations) Lift Installations put into service must comply with the essential health and safety requirements of lifts directive 95/16/EC Annex 1 e.g. Interlocking device to prevent car from moving until landing doors shut and locked Device for freefall prevention and uncontrolled upward movement etc. Harmonized Standards 12

14 Irish Lift & Escalator Association 2 Years in existence 10 Members & Representing about 95% of industry Improvement of standards in maintenance & safety within the industry 33,000 lifts. 16,700 TEs undertaken, at best only 27%* inspection rate. (*2 TEs required on a lift annually) Mission statement: Our association is dedicated to the enhancement of safety in use in Ireland, of all domestic and commercial lifts, escalators, travelators and chair lifts through design, installation and maintenance best practice. Our aim is to achieve this advancement in full co-operation with our customers and with the Irish and European standards and regulatory bodies support.

16 New Lifts Installed Must be CE marked & Inspected before going into use Must comply with the following minimum standards. Lifts Directive 95/16EC, EN81-1/2+A3, EN81-70, EN81-28, EN others Must comply with Part M : 2010 of the Building Regulations. (Building Control (Amendment) Regulations 2014 & BCar Certs at various stages of a project. Important documents to have at handover A Safety file consisting of Lift Layout drawings, BS8486 Test Cert, Operating Instructions, Maintenance Instructions. EC Declaration of Conformity Cert for the lift by the Installer (under Annex XIII) or by Certified Notified Body plus Type Test Examination Certs for the main components. Details of the Warranty and Warranty Maintenance (if included) Set of keys for the lift. Contact Name of Service Provider & Contact number In Case Emergency

19 Thorough Examinations (summary) The Safety Health and Welfare at work Act (General Application Regulations : 2010) places a Legal requirement on Employers/Owners/Property Managers/FMs who have control of lifts to ensure that a Report of Thorough Examination is conducted on lifts (by a Competent Person*) at 6 monthly intervals. Key Requirements Report should identify any defects which may be a danger to persons. Indicate repair/action required to remedy the defect. Timescale for the repair/action to be carried out. Should be kept and available for inspection or in Maintenance Log Card Should be sent to lift service provider, especially where action required. Repair /action should be undertaken within timescale indicated. 20 New Standards New Lifts Directive 2014/33/EU Awaiting ratification and will repeal Lifts Directive 95/16/EC (To be implemented in ROI by 20th April 2016 to avoid breach of EU Laws) Lift standards for New Lifts. EN81-1/2+A3 for new lifts to be replaced by EN81-20 & EN81-50 (Expected from June 2016) Existing Lifts EN81-80 Rules for the Improvement of Safety on Existing lifts. Comprehensive 74 item check list/risk Assessment for older lifts which Includes accessibility Will assist Owners/Persons in Control, to manage risk on their lifts
