1 Monterey County ASSISTANT AGRICULTURAL COMMISSIONER 12C01 DEFINITION Under administrative direction, assists the County Agricultural Commissioner in planning, administering and coordinating the activities of the Agricultural Commissioner s Office to enforce the provisions of the California Food and Agricultural Code, Code of Regulations, Business and Professional Code, National Organics Program, and County Ordinances; acts for the Agricultural Commissioner in his/her absence; and performs related duties as required. DISTINGUISHING CHARACTERISTICS The Assistant Agricultural Commissioner classification is found only in the Office of the Agricultural Commissioner, a regulatory and enforcement entity, with the authority to issue administrative fines and penalties, and responsible for programs to monitor compliance issues within the industries of the County, and to ensure the health, safety and welfare of consumers and workers. This is a single, at-will, assistant department head position, which reports to the Agricultural Commissioner. The incumbent in this class is responsible for assisting the Agricultural Commissioner in the planning, coordination, management and administration of all phases of departmental operations. This position requires the ability to expediently respond to continual changes in laws, regulations, procedures, and issues receiving political and public scrutiny as related to the Agricultural Commissioner s Office. This position is distinguished from the next higher class of Agricultural Commissioner in that the latter is a department head with full responsibility for the administration and management of the department. This class is further distinguished from the next lower class of Chief Deputy Agricultural Commissioner in that the latter is responsible for planning, implementing, coordinating and directing the inspection and enforcement programs of one or more major divisions of the Agricultural Commissioner s Office. EXAMPLES OF DUTIES 1. Consults with and assists the Agricultural Commissioner in the planning, coordination, management and administration of all phases of departmental operations, which includes formulating/interpreting/recommending policies and programs, collecting data, and preparing comprehensive oral, written and statistical reports on department activities 2. Supervises and participates in analytical studies, organizational and administrative problems, recommends solutions and improvements in departmental methods and procedures 3. Assists in the formulation, implementation and enforcement of department policies, procedures and new programs 4. Acts in the absence of the Agricultural Commissioner with decision-making authority on the full range of departmental issues 5. Confers with and directs management and supervisory staff in the efficient use of department personnel and equipment, and in the effective operation of department programs 6. Reviews, analyzes, evaluates and interprets proposed and new statutes and regulations affecting departmental operations; recommends and initiates new and/or revised operational procedures and ordinances required by law 7. Directs and assists in the preparation and administration of the annual department budget including revenue projection, review and analysis of budget requests, development of justification for budget

2 proposals and monitoring of budget performance; prepares board messages and reports relating to department operations 8. Directs the personnel actions of the department; coordinates and assists in the recruitment and selection process of department personnel; assists in the preparation and resolution of disciplinary issues, and supervises subordinate management and supervisory personnel 9. Directs subordinate staff in the serving of notices of violation of the California Food and Agricultural Code, Business and Professions Code, State Regulations or County Ordinances, and abatement notices; directs the documentation of factual case information for required legal actions 10. Represents the Agricultural Commissioner at a variety of meetings/functions/civic affairs and special assignments; makes public presentations explaining and interpreting the Agricultural Commissioner Office functions and programs 11. Works with other County departments on issues that affect agriculture but are not within the scope of the programs of the Agricultural Commissioner such as land use and planning QUALIFICATIONS A combination of experience, education, and/or training which substantially demonstrates the following knowledge, skills and abilities: Knowledge and Skills: Thorough knowledge of: 1. Federal, state and county laws, regulations, policies and agreements pertaining to agricultural and sealer programs, regulation and enforcement 2. California Agricultural Commissioners and Sealers Association policies and agreements 3. The principles and practices of management techniques, supervisory/personnel administration and training 4. The principles and practices of organizational theory, budget/fiscal preparation and administration, and public administration 5. The principles of English grammar, spelling and punctuation Working Knowledge of: 1. The structure and functions of County government 2. The principles of office procedures and methods, such as recordkeeping and accounting procedures 3. Community agricultural needs, public and private community agricultural related resources Some Knowledge of: 1. Governmental accounting procedures 2. Current data processing techniques and capabilities 3. Issues related to land use planning, water resources and the environment 2

3 Skill and Ability to: 1. Plan, direct and evaluate the work of subordinate staff engaged in agricultural and weights and measures inspection and enforcement programs 2. Understand, interpret, explain and apply laws, rules, policies and regulations as they relate to the function of the Agricultural Commissioner s Office program areas; assist in formulating and administering plans of enforcement 3. Analyze and evaluate complex policy and program proposals and projects, select alternatives, project consequences of proposed actions, and implement recommendations and take action in support of broad organizational objectives 4. Effectively plan, direct and administer program operations so as to accomplish broad policies, goals and objectives 5. Collect, interpret and evaluate narrative and statistical data pertaining to policy, administrative, fiscal and management matters 6. Communicate effectively, both orally and in writing, including skills to prepare and present ideas, facts, recommendations, financial and statistical reports in an understandable and persuasive manner; gain cooperation from diverse interest groups through discussion and persuasion 7. Establish and maintain cooperative and effective relationships with all levels of county employees, public officials, public and private agencies, community groups, members of the general public and of the international community, and the news media 8. Train and supervise subordinate staff 9. Apply basic data processing/computer skills and techniques REQUIRED CONDITIONS OF EMPLOYMENT As a condition of employment, the incumbent will be required to: 1. Possess a valid County Agricultural Commissioner License issued by the California Department of Food and Agriculture 2. Possess a valid California Sealer License issued by the California Department of Food and Agriculture 3. Possess a valid California Class C Driver's License 4. Possess and maintain a good driving record and good driving habits 5. Travel and work throughout Monterey County 6. Adhere to related Federal, State, and local safety laws, regulations, and ordinances as applicable 7. Wear and use proper and appropriate safety clothing and equipment 8. Work overtime, weekends and holidays, as assignments require 9. Work with potentially hostile public, growers, etc. 10. Work under such adverse conditions as inclement weather, heat, dust, chemicals and noise 11. May come in contact with a variety of toxic elements or irritants (with protective equipment) 3

4 EXAMPLES OF EXPERIENCE/EDUCATION The knowledge, skills and abilities listed above may be acquired through various types of experiences, education or training, typically: Experience: Option I Two (2) years experience performing the duties of a Deputy Agricultural Commissioner or Sealer with at least one of the following responsibilities: 1. Directing a major branch office of a County Agricultural Commissioner s department 2. Directing one or more of the following County-wide programs such as: Pesticide Regulation Pest Prevention and Plant Regulation Commodity Regulation Integrated Pest Management Weights & Measures Inspection OR OPTION II Two years of experience in a supervisory or management position within Division of Plant Health and Pest Prevention or the Division of Measurement Standards of the California Department of Food and Agriculture, or within the California Department of Pesticide Regulation AND (For both options) Education: College level courses, seminars, or training in business or public administration, management, or related topics OR PHYSICAL AND SENSORY REQUIREMENTS The physical and sensory abilities required for this classification include: 1. Operate a motor vehicle 2. Sit for long periods of time 3. Stand/walk for long periods of time 4. Verbally communicate and to hear cell phones in field or noisy environments 5. Smell and detect the presence of chemicals and/or pesticides in open and closed environments. Detect odors and aromas for potential hazards 6. Distinguish and identify sounds and voices in a noisy environment, able to recognize potential danger 7. Read maps, fine print, gauges, meters and other calibrated or precision measuring instrument, data on computer screen, and to visually detect differences between agricultural pests, crops, plant material, etc. 4

5 8. Differentiate between colors while conducting tests 9. Project a voice that can be heard over loud noises 10.
