1 THE CORPORATION OF THE TOWN OF IROQUOIS FALLS BY-LAW NO. 3191/13 "Being a By-Law to establish a policy for the hiring of employees. " WHEREAS AND WHEREAS The Ontario Municipal Act S.O. 2001, c. 25, as amended provides that a municipality shall adopt and maintain policies with respect to its hiring of employees; and Council for the Corporation of the Town of Iroquois Falls deems it expedient and necessary to adopt such a policy. NOW THEREFORE, THE CORPORATION OF THE TOWN OF IROQUOIS FALLS ENACTS AS FOLLOWS: 1. That Schedule "A", Town of Iroquois Falls Hiring Policy, attached hereto, forms part of this By-Law. 2. This By-Law shall come into force and effect on the date of its final passing. 3. That Resolution No and are repealed. 2 Purpose TOWN OF IROQUOIS FALLS HIRING POLICY To ensure a consistent approach to the recruitment and selection of qualified applicants and to ensure that the Municipality hires the best applicants without bias based on qualifications, skills, training, and ability to perform the work. Scope This policy applies to all union and non-union employees, including but not limited to, full-time, part-time, contract, casual, seasonal, temporary employees, and students. Responsibilities This policy applies to all persons who have responsibility for recruiting and selecting personnel to fill new or existing job vacancies. The Clerk-Administrator or designate is responsible for the implementation and on-going administration of this policy. Hiring of Relatives Definition of Relative: spouse or same sex partner, common-law partner, parent, mother and father in-law, common-law mother and father in-law, same sex partner mother and father in-law, step-parent, foster parent, child, step-child, foster child, grandparent, step-grandparent, grandchild or step-grandchild, a relative of the employee who is dependent on the employee for care or assistance. Relatives of employees presently in the employ or members of Councilor Boards of the Municipality of the Town of Iroquois Falls shall receive the same consideration as any other applicant. However there may be situations where it may not be in the best interest of the Municipality andlor the employee to employ a relative in the same department, particularly if there is a reporting relationship. Relatives are expected to declare a conflict of interest, withdraw from the process and shall not make hiring decisions about one another. Procedure The Town of Iroquois Falls will follow all the provisions of the Ontario Human Rights Code, Employment Standards Act and any other relevant legislation when recruiting applicants for employment. Unsolicited resumes andlor applications shall not be accepted by the Municipality. The Municipality is an equal opportunity employer and does not discriminate in the hiring process on the basis of race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, gender, sexual orientation, age, marital status, family status or disability. All non-union positions may be posted internally, externally or both. Union positions shall be posted in accordance with the Collective Agreement. The job qualifications for both internal and external job postings shall be specific to the requirements of the position.

3 Advertising Advertising shall be utilized in the most cost effective manner suited to the position. Advertising may include one or more of the following methods: Internal posting throughout the Municipalities offices andlor work locations as required by the Collective Agreement On the municipal or other websites In a newspaper having general circulation Any other manner as determined by administration It may be deemed necessary to use recruitment agencies or executive search organizations to assist in the search for qualified candidates. If recruitment agencies or executive search offices are to be used, Council approval is required prior to such agency being engaged to assist in a recruitment assignment. Advertisements for employment opportunities with the Municipality should indicate that the Municipality is an equal opportunity employer and will include the following phrase: "We thank all applicants for applying, however, only those selected for an interview will be contacted." Interview Panel The interview panel for unionized positions and non-union non-managerial positions may consist of the appropriate supervisor, a maximum of one council member, the appropriate directorlmanager andlor Clerk Administrator. At the discretion of the panel members, additional resource persons and/or staff members may be included in the interview panel. The interview panel for management positions may consist of a maximum of one member of Council and the Clerk Administrator. At the discretion of the Clerk Administrator, additional resource persons and/or staff members may be included in the interview panel. The interview panel for the Clerk Administrator position may consist of three (3) members of Council and at least one senior management member or an appropriate external resource person. At the discretion of Council, addijional resource persons may be included in the interview panel. Selection Process The Municipality of the Town of Iroquois Falls is committed to recruiting and selecting individuals who are the most suitable to perform the requirements of each position available. Applications from qualified candidates will be reviewed by the interview panel that will short-list the candidates to determine who is most suitable for interviews based on education, experience, and other related qualifications. Short-listed candidates (internal or external) may be required to complete employment tests deemed necessary to detenmine the skill, knowledge or ability to perfonm the job. Depending upon the position being recruited, further testing of the short listed candidates may be required. Based on the short-listing and employment tests, if applicable, candidates may be offered a formal interview.

4 Only candidates who have received formal interviews or completed employment tests will receive a letter acknowledging their participation and identifying that a successful candidate was selected. Reference checks of the short-listed candidates shall be made after receiving written consent from the candidate, failing such consent, the candidate shall not offered employment by the Corporation. Returning or internal candidates with satisfactory job performance appraisals may be hired without being subject to the entire hiring process. Offer of Employment A successful applicant will receive a written offer of employment, if required by the position. An employment agreement will be required for all positions not covered by a collective agreement. Successful candidates shall provide a criminal reference check prior to commencing employment. Upon acceptance of a job offer, candidates are required to submit certified or original copies of all degrees, diplomas and other relevant documents which they claim to hold. These copies will be maintained in the employee's personnel file. An offer of employment made by the municipality may be subject to a satisfactory medical clearance. New employees in positions requiring driver's licences shall provide a copy of their driver's license and driver's abstract and shall be obliged to hold a valid driver's license of the appropriate class as a condition of employment. Any candidate who misrepresents or falsifies information during the recruitment or selection process shall be eliminated from the selection process and, if employed, may be discharged for cause. Should the successful candidate decline the job offer, the interview committee shall determine the next most suitable candidate, or may initiate the recruitment process again. Students Only students attending a secondary or post-secondary educational institution on a full-time basis will be considered for hiring by the Municipality. The Municipality will require that these students provide proof of attendance at an educational institution. Managers shall provide a list of summer student requirements during the budget process each year. Students may be hired by the manager/department head of the appropriate department or the Clerk-Administrator. A Background and Criminal Reference Check shall apply to all hiring. Eligibility for Employment In compliance with federal legislation, new employees, if requested, and as a condition of employment, shall present documentation establishing their identity and their eligibility to work in Canada. A valid Social Insurance Number, landed immigration papers, employment visa, or temporary work permit shall be sufficient for this purpose.

5 Probation All employees shall be on probation in accordance with the appropriate employment andlor collective agreement. Absences with leave of more than five (5) days during the probationary period may extend the probation. The probation period may be extended in writing at the discretion of the Clerk Administrator and in accordance with the appropriate employment andlor collective agreement. During the probationary period, an employee will be subject to all probationary terms under the appropriate agreement. Either the employee or the employer may end the employment relationship any time during the probationary period. The municipality is not obligated to provide any notice or pay in lieu of notice if an employee's employment is terminated during the probationary period. Orientation Newly hired employees shall receive orientation from the appropriate Supervisor within their first month of employment. Orientation of new employees is an important element of the hiring process and ensures that a strong and mutually satisfying working relationship will be established and maintained. FORMS Collective Agreement The Municipal Employment Application Form is available at the reception area of the Municipal Administration Office and on the Municipal website.
