3 Attorneys in our Corporate Diversity Counseling practice bring to bear over 100 years of collective experience advising CEOs and senior executives of Fortune 500 companies, government agency heads, and other large organizations in connection with targeted strategies for minimizing legal liability and enhancing diversity programs, performance, and profile. On a daily basis, we counsel clients on developing and implementing effective diversity strategies that, in return, protect the organization s reputation and expand business opportunities by strengthening relationships with stockholders, customers, employees, regulators, and the general public. The Jackson Lewis Corporate Diversity Counseling practice-composed of prominent attorneys with extensive employment law and government relations experience-is frequently called upon to advise major companies and government agencies in connection with complex issues involving diversity enhancement, affirmative action, equal employment opportunity, government audits, benchmarking, and best practices. Our work includes: Comprehensive diversity compliance reviews; Internal legal vulnerability assessments; Resolution of complex discrimination-related disputes; Diversity enhancement programs and comprehensive action plans; Diversity crisis prevention and mitigation; Crisis management with regard to high-profile allegations of race, gender, age and other discrimination, harassment, and retaliation; Response to government EEO audits and investigations; Internal and external diversity communications strategies; Diversity-related government relations; and Community outreach and philanthropic efforts. Diversity Assessments and Action Plans Early identification and resolution of diversity issues can often mitigate-or avoid altogether-serious consequences down the road. Jackson Lewis Corporate Diversity Counseling practice has extensive experience assisting clients with the following: Legal vulnerability assessments or diversity checkups that examine internal complaint processes, employment discrimination/retaliation/harassment/ Jackson Lewis P.C.
4 hostile work environment claims, human resource policies and practices, and workforce demographic trends; Comprehensive diversity reviews that evaluate diversity in corporate governance and senior management, the company s workforce, and in supplier and business partner relationships; and Analysis of government and community relations, strategic communications, minority outreach, corporate image, targeted philanthropy, and related relationship building. With this information, our lawyers assist senior management in developing and implementing practical strategies-sensitive to the company s corporate culturefor achieving their legitimate business and marketing objectives. We benchmark our clients against best-inclass performance, and then tailor diversity action plans to address each client s specific needs. Crisis Prevention High-profile race and sex discrimination allegations can produce significant financial consequences as well as long-term damage to a company s brand and reputation, and even its market share. The Jackson Lewis Corporate Diversity Counseling practice advises clients regarding proactive crisis prevention strategies and long-term solutions to avoid financial, business, and management disruptions. Crisis Mitigation and Management For major corporations and key government agencies facing charges of discrimination in employment or other aspects of their business, we investigate complaints, claims, allegations, and/or attacks from individuals or interest groups. We then assist in developing resolution strategies that often include litigation and/or settlement alternatives. We also help create action plans to address legitimate concerns and issues, and collaborate with corporate and agency public relations advisers in crafting and delivering key messages to targeted constituencies during difficult situations. Community Outreach Maintaining a positive diversity image both enhances internal diversity initiatives and enables a company to work cooperatively with opinion leaders, concerned public officials, and most importantly diverse customers, business partners and stockholders. We assist clients in developing and enhancing relationships with key organizations and leaders, which in turn produces an emphatic message about a company s commitment to diversity and inclusion in its organization. This strategy encourages collaboration rather than confrontation, and communication rather than confusion. Government Relations Practice Along with members of Jackson Lewis Government Relations practice, our Corporate Diversity Counseling attorneys possess extensive Washington practice expertise and superior knowledge of the public policy issues that affect our clients on a daily basis. Jackson
5 Lewis attorneys have filed amicus curiae briefs on many occasions to the U.S. Supreme Court and to other Federal and state courts; filed comments during rule-making to the U.S. Department of Labor, the U.S. Department of Health and Human Services, the Office of Management and Budget, the U.S. General Services Administration, the Equal Employment Opportunity Commission, and the National Labor Relations Board; and testified on numerous occasions before U.S. Senate and U.S. House of Representatives committees and subcommittees. Through the firm s Corporate Diversity Counseling practice, we not only advocate for our private sector clients in the government arena, but we also advise senior governmental officials regarding diversity enhancement programs, crisis resolution strategies, comprehensive action plan recommendations, and other issues affecting government entities and their constituents to ensure fair and equitable workplaces. Counseling on Affirmative Action Plans and OFCCP Audit Defense The breadth of services offered by our Corporate Diversity Counseling practice is enhanced by the firm s Affirmative Action and OFCCP Diversity Planning Group, which provides specialized assistance in developing and implementing affirmative action plans ( AAPs ) for federal contractors. We also defend clients in connection with audits by the Office of Federal Contract Compliance Programs ( OFCCP ) and in related litigation brought on the OFCCP s behalf by the Solicitor s office of the U.S. Department of Labor. To identify and resolve potential adverse impact and compensation disparity discrimination liability, we perform highly-specialized vulnerability audits. Preventing and Defending Systemic Discrimination Class Action Claims Unlike most firms, Jackson Lewis offers a variety of preventive tools for spotting and resolving indicators of systemic discrimination prior to litigation. Attorneys in our Corporate Diversity Counseling practice work with our Affirmative Action Group to perform classbased liability vulnerability audits that evaluate employers personnel processes and practices. Through this internal network of experts, Jackson Lewis also has the resources to manage and analyze large volumes of data and model estimated damages in class and collective action litigation. Not only does Jackson Lewis have the expertise to help employers avoid systemic discrimination litigation, but we also have the experience and knowledge necessary to aggressively defend class action discrimination claims. Our class action litigators have successfully opposed class certification, negotiated favorable settlements, and even convinced class counsel to withdraw claims in a multitude of cases, often working with labor economists and statisticians to defeat plaintiffs commonality arguments and disprove their allegations.
