3 ELECTRICAL GROUP TRAINING LTD 1. SCOPE AND PARTIES This Collective Agreement ( Agreement ) is between: Electrical Group Training Ltd (ABN ) of Units 18-20, 199 Balcatta Road, Balcatta WA ("EGT ) and All employees of Electrical Group Training Ltd. ( Employees ) 2. OPERATION This Agreement shall come into operation in accordance with s.347(1)(b) of the Act and shall remain in force for a period of five (5) years. This Agreement may be terminated after its nominal expiry date by either: the Company, giving employees at least 90 days notice of its intention to terminate; or approval of the Company and employees (employees would be required to undertake a majority ballot to approve the termination); or in accordance with s.397a of the Workplace Relations Act DEFINITIONS 3.1 Act means the Workplace Relations Act EGT means the Electrical Group Training Ltd (ABN ). 3.3 Apprentice employees mean employees engaged in an approved apprenticeship or traineeship. 3.4 "Host Employer" means the Company that, pursuant to an arrangement with EGT, provides apprentice employees in training with on-the-job training relevant to their particular training arrangement. 3.5 Apprentice means apprentice or trainee, likewise Apprenticeship means apprenticeship or traineeship 3.6 "Agreement" means this Employee Collective Agreement. 4. CONTRACT OF SERVICE Basis of Employment 4.1 Apprentice employees are engaged as a full time, part time or school based apprentice, in accordance with their training contract, and except for periods of authorised leave they are required to attend for work at any location directed by EGT and to attend training relevant to their employment as directed by EGT or pursuant to their training arrangements. 4.2 All other employees may be engaged on a full time, part time, casual or fixed term basis. 4 Probationary Period (New Employees) 4.3 All new employees will initially be employed on a probationary period of three (3) months to enable the employee and EGT to determine suitability for employment. 4.4 During the probationary period employment may be terminated by either party giving the other party no less than one (1) week's written notice. 4.5 During the term of or at the end of the probationary period EGT may: a) confirm ongoing employment; b) extend the probationary period for up to a further three (3) months to enable EGT to further assess work performance or suitability for ongoing employment; or c) terminate employment. 4.6 If EGT decides to extend the probationary period, EGT may reassign an employee to different duties for which they are or appear to be better suited. 4.7 In assessing whether an employee is likely to be a satisfactory permanent appointment, EGT may take into account such matters as it sees fit, irrespective of whether or not any such matter amounts to misconduct. 4.8 Any time spent as a probationary employee will form part of an apprentice employee s training term. Duties and Responsibilities 4.9 All apprentice employees agree to diligently perform all the duties and responsibilities for the trade in which they are indentured and apply themselves diligently to their training as an apprentice, working as reasonably directed by EGT and the Host Employer Employees must observe all safety requirements applicable to their workplace and comply with any lawful and reasonable directions given to them by EGT and the Host Employer (as applicable) Employees will not divulge any information regarding the affairs of EGT or the Host Employer (as applicable) without the express written authority of EGT and the Host Employer. Further, as the Host Employer is entitled to know and benefit from the results of the employees work, it may take out any Letters of Patent relating to the work employees perform Employees will behave ethically and honestly in all dealings with EGT and the Host Employer (as applicable) Except with EGT s prior written consent, employees will not work for any other employer or conduct any other business while they are employed by EGT. Term of Apprenticeship 4.14 The term of an apprentice employee s apprenticeship will be the period stated in their training contract Ongoing employment is dependent upon EGT being able to place an apprentice employee with the Host Employer. Termination of Employment 4.16 An apprentice s employment may be suspended, cancelled or the period varied in accordance with this Agreement and/or the relevant state training legislation as amended from time to time. 5 Overpayment Reimbursement 4.17 An employee(s) agrees to reimburse EGT for any overpayment of wages made to the employee in error by EGT Upon written notification of an overpayment to the employee(s), an employee(s) authorises EGT to deduct from any wages or any other entitlements payable, or owing to the employee(s) on termination, any overpayments made in error to the employee by EGT. Return of Property etc 4.19 Upon the termination of an employee s employment the employee must immediately return to EGT and/or the Host Employer (as applicable) any property of EGT and/or the Host Employer in their possession or control including any Confidential Information, keys, uniforms and tools provided by EGT or the Host Employer. Notification of Absences 4.20 It is a condition of employment that employees notify EGT and their Host Employer Supervisor (as applicable) no later than one (1) hour prior to the time they are required to commence ordinary working hours of: a) their inability to attend work for any reason; b) the reason for their inability to attend for work; and c) the estimated duration of their absence If an employee fails to notify EGT and their Host Employer (as applicable) within seventy two (72) hours of their failure to attend for work, EGT will consider their actions as abandoning their trade and/or their employment and their employment will be immediately terminated. 5. HOURS OF DUTY Ordinary Hours 5.1 The maximum ordinary hours are 38 hours per week, averaged over a defined work cycle of 12 months and are to be worked in accordance with this clause. 5.2 Ordinary day work hours (i.e. not including shift work) will be worked between 0600 hours and 1800 hours, or some other spread of hours as mutually agreed between EGT and the Employee or the group of affected employees. 5.3 Unless otherwise agreed between EGT and the Employee, ordinary working hours will not exceed twelve hours on any given day. 5.4 Ordinary working hours will be structured to meet the needs of EGT and the Host Employer (as applicable). 5.5 EGT and the Host Employer (as applicable) reserve the right to vary starting and finishing times and rosters on either a temporary or continuing basis. 5.6 Employees will be given 7 days notice of any change to working hours, except where otherwise agreed or in an emergency. Meal Break 5.7 Employees will be entitled to a meal break of between thirty (30) minutes and one (1) hour where they are required to work more than six (6) hours on any one shift. 6 5.8 Meal breaks will be taken at a time agreed between EGT or the Host Employer (as applicable) and the Employee in order to meet the operational requirements of EGT and the Host Employer (as applicable). Shift Work 5.9 Shift for the purposes of this clause, means a rostered shift which has the majority of working hours falling outside of the ordinary day work hours From time to time, an apprentice employee may be required to work shift work as directed by EGT subject to EGT giving the employee at least twenty four (24) hours notice of the requirement to work shift work, except where otherwise agreed or in an emergency Where an apprentice employee is required to work a shift, they will be paid a shift penalty calculated on their base rate of pay for all ordinary hours worked on that shift in accordance with this clause If an apprentice employee is required to work on a rostered afternoon or night shift the apprentice employee will be paid their ordinary rate of pay plus 15% for all hours worked If an apprentice employee is required to work on a rostered shift, when the major portion of such shift falls on a Saturday, Sunday or Public Holiday, the apprentice employee will be paid your ordinary time rate of pay plus-for hours worked on a: a) Saturday, 50%; b) Sunday, 100%; or c) Holidays, 150% If an apprentice employee works overtime in addition to the ordinary hours for that shift, the apprentice employee shall be paid at overtime rates prescribed by this agreement but no shift penalty will apply to those overtime hours Where an apprentice employee is engaged as a day worker and is transferred to shift work for a period of less than 5 consecutive nights, those hours worked will count towards the apprentice employee s ordinary hours for that week but the employee will be paid at overtime rates for those hours EGT may consult the apprentice employee if it is considers it necessary to vary work hours, shifts and roster arrangements. Overtime 5.17 From time to time EGT may require employees to work reasonable additional hours in addition to their maximum ordinary hours of work All work performed by apprentice employees outside of the ordinary hours of work or outside of ordinary rostered shift hours will be deemed overtime and paid as follows: a) all overtime worked on Monday to Friday inclusive will be paid at time and one half for the first two hours and double time thereafter; b) all overtime worked on Saturday will be paid at time and half for the first two hours and double time thereafter; c) all overtime worked on a Sunday will be paid at double time rates; and d) all time worked on a public holidays will be paid at double time and one half rates provided that the maximum payment for hours worked on a public holiday shall not exceed double time and one half rates (inclusive of ordinary time rates already paid for the day). 7 5.19 Overtime is calculated on a daily basis Under no circumstances will employees be entitled to overtime under this clause and shift and weekend penalties at the same time. In other words employees will only be entitled to one or the other Employees will not be required to work for more than four (4) hours overtime continuously without a thirty (30) minute break Employees agree to work reasonable additional hours as required by EGT and continual refusal or failure to work reasonable additional hours may result in disciplinary action being initiated against an employee. Callouts 5.23 Where an apprentice employee is recalled to work after leaving work for that day they will be provided with a minimum of three (3) hours work (including travel to and from the workplace) each time they are recalled or the employee will be paid a minimum of three (3) hours at overtime rates for each time they are recalled If the apprentice employee: a) works more than three (3) hours on call out prior to midnight on any given night; or b) works day shift and you finish work after midnight on any given night, the apprentice employee will be entitled to and must take a ten (10) hour continuous break in the event the (10) hour break was not taken prior to the callout Where the recall period overlaps the commencement of ordinary working time, payment for the recall period will be at overtime rates and all subsequent work during ordinary hours shall be paid at ordinary rates. Distant Work 5.26 For the purposes of this clause distant projects are projects where apprentice employees cannot return home to their normal place of residence each night If an apprentice employee is required by EGT to work on distant projects, they will be provided with meals and accommodation by the Host Employer at no charge. Minimum Break 5.28 EGT has a policy that all employees must have a minimum break of ten (10) hours between ending one shift and commencing their next shift of work As apprentice employees work at the Host Employer s workplace, they must comply with EGT s policy and ensure that they have a ten (10) hour break between shifts Failure to comply with this requirement may result in disciplinary action being taken against the employee. Rostered Days Off (RDO) 5.31 EGT and the Host Employer (as applicable) may decide, due to operational requirements, to implement a rostered day off working cycle Generally, a rostered day off working cycle will be structured in the following way: a) the apprentice employee will be required to work 8 hours per shift; EGT collective agreement Version 7 Page 7/17

8 b) the apprentice employee will only be paid for 7.6 hours per shift; and c) the apprentice employee will be provided with thirteen (13) paid rostered days off per annum If an apprentice employee is provided with a rostered day off, they will be paid their ordinary rate of pay for that day Rostered Days off shall be taken as soon as practicable after they have accrued, generally in the same month of accrual An apprentice employee may request and EGT may agree to the cashing out of RDO s Where there is a down turn in work in the industry or with an employee s host employer, EGT may direct an apprentice employee to take their RDO s. 6. REMUNERATION Wages 6.1 At the commencement of your employment you will be paid a weekly wage or annual salary in accordance with Schedule Two. Where a certified site or enterprise agreement provides terms and conditions of employment which are more favourable than this Agreement, the more favourable agreement will be observed for those apprentice employees covered by this Agreement who are actually assigned to work on that site for the period of their assignment to that site. In the event that Schedule Two does not provide for a rate of pay which would otherwise apply to an employee, the applicable Australian Fair Pay and Classification Scale or the Federal Minimum Wage shall be taken to be the basic periodic hourly rate of pay for the purposes of this Agreement. 6.2 EGT may, from time to time, at EGT s sole discretion increase an employee s weekly wage or annual salary. Generally, an apprentice employee s weekly wage will be increased each year to take account of the fact that the employee has progressed to the next year of his/her apprenticeship. 6.3 Except as is otherwise set out in this Agreement, an employee is not entitled to any additional payments, including payments for allowances, loadings or penalties. Allowances 6.4 The allowances (other than excess fares allowance excess travel time allowance) that are payable to apprentice employees are set out under Schedule 2 together with the terms and conditions upon which these allowances will be paid. Payment of Salary/Wages 6.5 Wages or salary will be paid weekly in arrears by electronic funds transfer into a bank, building society or credit union account nominated by the employee. 6.6 EGT may change the frequency or method of payment by giving employees two weeks written notice of the change. 6.7 Employees will be provided with details of wages paid including gross and net wages and details of any deductions. 7. SUPERANNUATION 7.1 EGT will make superannuation contributions on an employee s behalf in accordance with the Superannuation Guarantee (Administration) Act 1992 on the employee s ordinary time earnings. 9 7.2 On commencement employees must nominate, in writing, the fund they wish their superannuation contributions be deposited into. If an employee fails to notify EGT, within one month of the commencement of their employment, their contributions will be deposited into the Westscheme Superannuation fund. 7.3 At the time the parties entered into this Agreement, the current rate of contribution was 9%. 8. ANNUAL LEAVE Entitlement to annual leave 8.1 Full time employees are entitled to twenty (20) days paid annual leave per year in accordance with the Workplace Relations Act 1996 Part time employees are entitled to leave on a pro rata basis. 8.2 Annual leave entitlements accumulate from year to year and will be paid out on termination on a pro rata basis. Taking annual leave 8.3 Accrued annual leave must be taken at a mutually convenient time as agreed between EGT, the Host Employer (as applicable) and the Employee. 8.4 An EGT Leave Application Form must be completed and approved at least one (1) month prior to the commencement of leave. 8.5 Annual leave may be taken, with the agreement of EGT, in periods of one (1) working day or less. 8.6 EGT may direct employees to take accrued annual leave during periods of downturn or lower than usual activity. 8.7 Employees may be required to take accrued annual leave during EGT s or a Host Employer s (as applicable) Christmas shutdown period in accordance with the Workplace Relations Act The Host Employer will notify the employee of the intended dates of the Christmas shutdown period. 8.8 EGT may direct an employee to take an amount of excessive accrued annual leave in accordance with section 236(6) of the Workplace Relations Act Payment for annual leave 8.9 Payment for annual leave taken will be made in accordance with the normal pay period Employees are not entitled to annual leave loading under this Agreement as wage rates have been calculated to include a portion in lieu of annual leave loading Where an employee has insufficient leave, EGT may approve leave in advance of its accrual. Cashing out of annual leave 8.12 EGT and an Employee may agree for the Employee to cash out an amount of accrued annual leave subject to the following conditions: a) Annual leave cannot be cashed out in advance of it being credited to you. b) The employee must notify EGT, in writing, of their request to cash out accrued annual leave. c) EGT may, at its sole discretion, decide whether to allow an employee to cash out an amount of accrued annual leave. 10 8.13 Cashed out accrued annual leave will be paid at the ordinary rate of pay at the time when the election to cash out is made Employees cannot cash out more than two weeks accrued annual leave in each 12 month period. 9. LONG SERVICE LEAVE 9.1 Employees will be entitled to long service leave in accordance with all applicable legislation dealing with long service leave entitlements. 10. PERSONAL LEAVE 10.1 Employees are entitled to personal leave in accordance with the Workplace Relations Act Personal leave includes paid and unpaid personal leave. Paid personal leave 10.3 Full time employees are entitled to ten (10) days paid personal leave per year. Part time employees are entitled to a pro rata amount of paid personal leave 10.4 Paid personal leave may be taken as paid sick leave or paid carer s leave Paid personal leave accumulates from year to year Paid personal leave will be paid at the amount the employee would have reasonably expected to be paid had you worked during that period To be entitled to paid personal leave the employee must advise EGT as soon as reasonably practical of their inability to attend work. Whenever possible the employee should advise the Company at least 2 hours prior to the rostered commencement of their shift and indicate the expected duration of their absence. Paid sick leave 10.8 Personal leave may be taken as paid sick leave when an employee is not able to work due to personal illness or injury For all absences due to illness or injury, an employee must provide a medical certificate, or such evidence as EGT requires to establish their right to paid personal leave indicating that they were unfit for work during the period because of personal illness or injury to EGT Employees are not entitled to paid sick leave if they have an approved workers compensation claim. Paid carer s leave Employees are entitled to take a maximum of ten (10) days paid personal leave as paid carer s leave each year Carer s leave may be taken when an employee is required to provide care or support to a member of their immediate family or household because: a) that person is ill or injured; or b) of an unexpected emergency affecting that person An employee must, if requested, provide EGT with a medical certificate or evidence to the satisfaction of EGT that any absence on paid carer s leave was because the employee was EGT collective agreement Version 7 Page 10/17

11 required to provide care or support to an immediate family or household member or due to an unexpected emergency affecting that person. Unpaid carer s leave Employees are entitled to a period of up to two (2) days of unpaid leave as unpaid carer's per occasion Unpaid carer s leave may only be taken after an employee has exhausted their entitlement to paid carer s leave Unpaid carer s leave is to be taken as a single unbroken period of up to two (2) days, unless otherwise agreed between the employee and EGT To be entitled to unpaid carer's leave the employee must advise the General Manager or his/her delegate as soon as reasonably practical of their inability to attend work in order to provide care and support. Whenever possible they should advise the General Manager or his/her delegate prior to the commencement of their shift and indicate the expected duration of their absence and the reason To be entitled to unpaid carer s leave, for all absences greater than 1 day, an employee must provide EGT in the case of illness or injury of a member of your immediate family or household with: a) a medical certificate indicating that a member of their immediate family or household has, had or will have a personal illness or injury during a period of the leave: or b) a statutory declaration which includes a statement that the employee requires/required leave to provide care or support to a member of your immediate family or household because of personal illness or injury. c) the requirement to produce a medical certificate may be waived by the General Manager or his/ her delegate at their discretion; and To be entitled to unpaid carer s leave for all absences greater that one (1) day, the employee must provide EGT, in the case of an unexpected emergency with a statutory declaration which includes a statement that they require/required leave to provide care or support to a member of their immediate family or household because of an unexpected emergency affecting that person EGT may require the employee to provide proof to satisfy a reasonable person of the relationship between the employee and the person they are taking carer's leave to provide care and support to Untaken carer's leave does not accumulate from year to year. 11. PARENTAL LEAVE 11.1 Employees are entitled to parental leave in accordance with the Workplace Relations Act 1996 as in force from time to time The employee must have worked one (1) year s continuous service with EGT before becoming eligible for parental leave. 12. PUBLIC HOLIDAYS 12.1 For the purposes of this clause, public holidays mean the ten (10) public holidays that apply to the location in which an employee is working If a public holiday falls on a day that an employee would ordinarily be rostered to work, they are entitled to that day off without any loss of pay. Payment will be made for the number of hours they would normally have worked had it not been a public holiday. EGT collective agreement Version 7 Page 11/17

12 12.3 Employees and EGT agree that due to the operational requirements of the Host Employer, an employee may be required to work on a public holiday If requested to work on a public holiday the employee must attend for work unless they have reasonable grounds for refusing the request. Any request to refuse to work a public holiday must be made in advance and will be considered to be in accordance with the Workplace Relations Act If a public holiday falls on a day on which the employee is not normally rostered to work, you will not be entitled to any payment for that public holiday Employees are not entitled to any additional payments for time worked on a public holiday except as provided for in this Agreement. 13. COMPASSIONATE LEAVE 13.1 Employees are entitled to compassionate leave when a member of their immediate family or household dies or contracts or develops a personal injury or illness that poses a serious threat to their life Employees are entitled to two (2) days paid compassionate leave per occasion Unless otherwise agreed between an employee, EGT and their Host Employer (as applicable), compassionate leave can be taken as a single unbroken absence of two (2) days or two separate periods of one (1) day each In order to be entitled to compassionate leave an employee must provide EGT and their Host Employer (as applicable) with evidence to satisfy a reasonable person of the illness, injury or death and proof of their relationship with that person Employees must notify EGT and their Host Employer (as applicable) as soon as possible of their intention to take compassionate leave. Whenever possible the employee should advise them prior to the commencement of their shift and indicate the expected duration of their absence and the reason for that absence Compassionate leave will be paid at the amount the employee would have reasonably expected to be paid had they worked during that period. 14. MEDICAL ASSESSMENTS Drugs and Alcohol 14.1 EGT has a duty of care to provide a safe work environment. Being under the influence of, or consuming, intoxicating liquor or illicit drugs on the job is prohibited and any breach will lead to disciplinary action being taken against the employee concerned In accordance with EGT's Drugs & Alcohol Policy, as in force from time to time, if EGT or the Host Employer suspect that an employee is under the influence of any drugs or alcohol or doubts an employee s general fitness for work, EGT reserves the right to request a drug & alcohol, and/or medical assessment from the employee, throughout their apprenticeship or traineeship to ensure they can meet the performance requirements of their position Testing programs, including random testing will be carried out. Many host employers include a condition that employees are drug and alcohol free and testing systems are in place. Acceptance of employment shall be deemed acceptance of this condition The possession of illicit substances on the job will be considered to be serious misconduct and will result in instant dismissal. 13 Hearing tests 14.5 As an element of its duty of care to employees, a hearing test will be conducted at the commencement and completion of an apprentice employee s employment with EGT at EGT s cost. The purpose of these tests is to monitor potential deterioration of hearing during the course of employment with EGT and diminish risk factors in employment that may lead to hearing loss. 15. DEVELOPMENT REVIEW 15.1 In accordance with the relevant state training legislation as amended from time to time and the WA Department of Training s Apprenticeship and Traineeship Policy and Delivery Guidelines, EGT will review each apprentice employee s performance and their apprenticeship regularly and employees may be required to participate in their review by meeting with EGT, and in consultation with the Host Employer any improvement areas will be identified For employees under 18 years of age, their parent or guardian may be consulted as part of these reviews As a result of the development review, corrective action may be documented and further training needs addressed. 16. RESOLUTION OF DISPUTES 16.1 The following provisions shall apply to any matter that may be in dispute between the parties to this Agreement: Step 1 - Raise the matter with an EGT Field Officer, 16.2 When a problem, concern or grievance arises, the employee concerned should raise the matter with their assigned EGT Field Officer, or another EGT Field Officer If the matter concerns the employee s Host Employer, the matter should still be raised with an EGT Field Officer who will liaise with the Host Employer. Step 2 - Involve EGT Management 16.4 If a matter cannot be resolved at Step 1 it will be referred to the EGT General Manager or delegate, who will attempt to resolve the matter At all times normal work will continue whilst a question or dispute is being resolved in accordance with this clause Reasonable time limits shall be allowed for each stage of the procedure At all stages of the disputes resolution process, the employee is entitled to be represented by a representative of their choosing Nothing in this Agreement authorises the arbitration of a dispute in relation to this Agreement, including the application of this Agreement. 17. EMPLOYEE ASSISTANCE PROGRAM 17.1 Employees with problems of a personal nature, which may for example relate to work, family, health, legal, alcohol, drugs or finances may access the EGT Employee Assistance Program on a confidential basis EGT will provide details of the Employee Assistance Program and how to access it. Employees who are unsure how to access the Employee Assistance Program can obtain contact information from their Field Officer or the General Manager. EGT collective agreement Version 7 Page 13/17

14 18. ANTI-DISCRIMINATION 18.1 Employees and EGT agree that it is their intention to respect and value the diversity of the work force by helping to prevent and eliminate discrimination at their enterprise on the basis of race, colour, sex, sexual preference, age, physical or mental disability, marital status, family responsibilities, pregnancy, religion, political opinion, national extraction or social origin Whilst EGT has a responsibility to ensure that the principles of equal opportunity are practised, employees remain responsible for their own behaviour. Every EGT employee has a responsibility to treat all other people with whom they interact within the workplace with fairness, equality and respect so that the total working environment is free from discrimination and harassment Harassment and discriminatory behaviour will not be tolerated by EGT or any Host Employer and any reports of such behaviour will be investigated and, if justified, the offending employee will be disciplined or may have their employment terminated. 17 SCHEDULE THREE ALLOWANCES AND DISCRETIONARY ALLOWANCES 1 The wage rates in this Agreement are compensation for and thus already inclusive of the following allowances: 1.1 construction work allowances; 1.2 tool allowances; or 1.3 Special Allowance 1.4 Safety Net Allowance 1.5 Leave Loading 2 When an apprentice employee works for a Host Employer that has an agreement to pay a higher pay rate on a project, EGT, at its sole discretion, may pay you an additional allowance on top of the wage rates in this Agreement. These conditions may include: 2.1 site allowance; 2.2 travel allowance; 2.3 location allowance; 2.4 special allowance; 2.5 frame allowance; or 2.6 productivity allowance. 3 When an apprentice employee works in certain conditions EGT may, at its sole discretion, pay you an additional allowance on top of the wage rates in this Agreement. These conditions may include: 3.1 location allowance; 3.2 safety footwear allowance; 3.3 height and dirt work; 3.4 confined space; 3.5 diesel engine ships; 3.6 hot and cold work; 3.7 percussion tools; 3.8 chemical artificial manure and cement works; 3.9 abattoirs; 3.10 phosphate ships; or 3.11 gold mine work. 4 All travel allowance payments/reimbursements will be paid in accordance with EGT s Travel Allowance /Reimbursement Policy as in force from to time. 5 For the purposes of this Agreement, Construction work is defined as work on site or in connection with the: 5.1 construction of a large industrial undertaking; 5.2 construction of a large civil engineering project; or 5.3 construction or erection of multi-storey buildings.
