1 Personnel Manual Recommended Changes/Updates/Clarifications Policy 303 Holiday Pay If a recognized holiday falls on a Friday, Saturday or Sunday, the Department heads will identify the designated day off for their individual team therefore allowing the office to remain open for four days each week. However, with the rotating schedule of the Police department this has become an issue and is not clearly addressed. Recommended language becomes: If a recognized holiday falls on a scheduled off day the Department heads will identify a designated day off for the individual or individuals that have that holiday as a regularly scheduled off day. The paid holiday day off must be taken within the same pay period. Policy 312 Overtime Paragraph 1 reads: Overtime is defined as hours actually worked on the job in excess of 40 hours during a seven (7) consecutive day work week. Hourly, non-exempt, employees shall receive overtime pay at one and onehalf (1 ½) times their regular rate of pay for hours actually worked in excess of 40 hours in one work week. Salaried (exempt) employees are not eligible for overtime pay pursuant to the Fair Labor Standards Act FLSA). Even so, exempt employees who perform as Crew Leaders working side by side with hourly employees shall receive overtime payment at straight time for hours worked over eighty (80) in a two (2) week payroll period. The Chief of Police, when acting in the capacity of a regular shift officer and when called to assist another VOP police officer, shall receive overtime payment at straight time for hours worked over eighty-five and one half (85.5) in a two (2) week payroll period. However, with the 12 hour shifts of the police department and the union contract this needs some clarification. Overtime is defined as hours actually worked on the job in excess of 40 during a seven (7) consecutive day work week, for 40 hour/week employees. Hourly non-exempt, non-union, employees shall receive overtime pay at one and one-half times their regular rate of pay for hours actually worked in excess of 40 hours in one work week. Police employees, non-exempt, non-union, shall receive overtime at the rate of one and one-half the regular rate of pay for all hours worked in excess of eighty-five and one half (85.5) in a two-week (2) pay period.

2 Salaried, exempt, employees are not eligible for overtime pay pursuant to the Fair Labor Standards Act (FLSA). However, Council has agreed (1/8/2006) that said exempt employees who perform as Crew Leaders working side by side with hourly employees shall receive overtime payment at straight time for hours worked over eighty (80) for 8 and 10 hour shift employees in a two (2) week pay period. Council went on to state that the Chief of Police, when acting in the capacity of a regular shift officer and when called to assist another VOP police officer, shall receive overtime payment at straight time for hours worked over eighty-five and one half (85.5) in a two week payroll period for a 40 hour work week. Under the 84 hour bi-weekly pay period, the Chief will receive straight time overtime pay at 89.5 hours. Union employees should see their current contract for details on overtime policies. 3 Village of Pinckney Personnel Committee Meeting Thursday, November 5, AM Attendees: Lavey, Menosky & Salowitz Group readdressed unanswered question regarding OT policy for exempt Police personnel. The recommendation is that the policy should be reflective of the policy as it previously addressed the 80 hour pay period. With an 80 hour, exempt employees were required to work in the capacity of a shift officer or when called to assist another VOP police officer they received OT straight pay at 85.5 hours or 5.5 hours beyond their regular schedule. The recommended policy, based on an 84 hour pay period would be that the exempt employee working in the capacity of a shift officer or when called to assist another VOP police officer they receive OT straight pay at 89.5 hours or 5.5 hours beyond their regular schedule. Policy 313 Time off Awards (TOA) Committee reviewed the expanded policy statement as presented by Lavey and are comfortable sending it to Council for review and acceptance. Lavey shared an article about 12-hour shifts with the committee that Chief Newton forwarded to her. She still has concerns with the 12-hour shifts and also fears that the midnight staff has no option to get off overnights but too leave. Discussion ensued. More research needs to be done. Salowitz presented the Blue Cross recommendation for The recommended plan is a 3% rate increase to the village and maintains the best individual and family deductibles allowed by the new Affordable Care Act. It also leaves financial room within the state cap to continue to allow for the village to contribute to the individuals H.S.A. accounts as outlined in 2011 for the 2012 calendar year. Group agreed that it is exceptional and out of the ordinary that the employer still pays 100% of the insurance monthly premiums. Salowitz indicated that by law we are now required to report that benefit on annual w2s. Reminder that Council will request to go into Closed Session to prepare for MAP contract negotiations which begins on November 18 th. Salowitz to ask Attorney to remind staff and Council not to discuss negotiations with union officers outside of negotiations table.

She will present to Council at next meeting. Group decided that recommendations for policy changes were minor and could be presented in consent agenda.
