19 EIA Quality Developer EIA Report prepared by competent experts. EIA Report must be accompanied by a statement outlining the relevant expertise or qualifications of such experts. Competent Authority Competent Authority has, or has access to, sufficient expertise to examine the EIA Report.
20 Monitoring Competent Authority must. Consider whether.to require monitoring Secure monitoring measures (via S.75 / condition) Consider provision on remedial action Monitoring should. Be proportionate Not duplicate
21 Penalties Any person or bodies corporate who, for the purpose of procuring a particular decision on an application knowingly or recklessly makes a statement or uses a document which is false or misleading or with intent to deceive is liable for a fine.
22 Multi-stage consents Permission granted subject to further approval before development can commence Can include deemed permissions under S.57 of the Planning Act (e.g. energy consents with deemed planning) Can include SPZs, EZs, ROMPs (Planning system) New express provision on handling when LSE are not all fully identifiable when the principle permission is granted.
23 Transitional arrangements Different provisions across EIA regimes Planning 2011 Regs apply if ES submitted or scoping opinion / direction requested before 16 th May Multi-stage consents Judgement on LSE / requirement for supplementary information based on criteria at time ES submitted Screening Screening criteria at point of request will continue to apply
