1 Policy: 4206 Title: Leave of Absence Adopted: 5/19/08 Revised: Peters Township School District I. POLICY It is the policy of the District to grant employees various leaves of absence as outlined below. However, the employee must request the leave of absence, in writing, utilizing the Leave of Absence Request form, for the various leaves required. Requests must be made at least one month in advance except in cases of emergencies or other approved circumstances. II. SABBATICAL LEAVES Any professional employee will be granted sabbatical leave in accordance with applicable provisions of the School Code. Application for such leave shall be in writing and shall state specifically the reasons for requesting same, the use intended to be made of leave time, and the intention to return at the expiration of the leave. Should circumstances change during the period of leave, the employee shall furnish to the School Board a written statement of the nature of the change. At the conclusion of the leave, the returning employee shall submit a written report, indicating the manner in which the purpose of the leave was accomplished. 1. For purposes of this Policy, school term shall have the same meaning as provided under Section 102(3) of the Pennsylvania School Code 24 P.S. Section 102(3). School term shall be defined as follows: School term shall mean the period of time elapsing between the opening of the public schools in the Fall of one year and the closing of the public schools in the Spring of the following year. 2. Sabbatical leaves of absence requested for restoration of health shall be accompanied by the medical certification of employee s physician(s) verifying the need for leave for the purpose and duration for which requested. At the discretion of the Superintendent, the medical certification and examination policy described herein may be invoked. 26

Sabbatical leaves of absence requested for study shall be accompanied by a description of an intended study program acceptable to the Superintendent at one or more approved institutions, of higher education, evidencing proposed acquisition of not less than nine (9) graduate credits in one (1) semester, a total of eighteen (18) graduate credits in two (2) semesters, or a number of quarter hours yielding these equivalents. The program of study must be toward advanced standing in an area in which the employee holds certification or in an area approved by the superintendent. The obligation of the School District for payment of half salary, maintenance of benefits, and preservation of rights under the School Code shall be conditioned on fulfillment of this intention. 4. Sabbatical leaves of absence requested for a combination of two or more of the foregoing purposes shall be supported by such accompanying documentation and evidence as the nature of the requested combination suggests, proportionately allocated and distributed over one or two school semesters. 5. Notwithstanding the above, sabbatical leaves of absence will not be granted if the period of leave requested is divided into two or more segments with one or more intervening periods of time on duty, except as may be required by law. III. MILITARY LEAVES To be eligible for a military leave, an employee must be regularly employed by the District for any period, and must be inducted into military service or naval service, or have volunteered for military service in the armed forces of the United States of America or the Pennsylvania National Guard in time of war or during a state of national emergency. Any employee of the District entering military service will be granted a leave of absence for the duration of the tour of duty up to five (5) years. Military leaves will be administered in accordance with The Uniformed Services Employment and Reemployment Rights Act policy contained in the employee manual. IV. LEAVE WITHOUT PAY 1. Employees may be granted leaves of absence without pay on the recommendation of the Superintendent. Such leaves may be for reasons similar to those applicable to sabbatical leaves. Applications shall be in writing, and must state the reasons for requesting leave and use intended to 27
3 be made of leave time, and the intention to return to the district at the expiration of leave. Should circumstances change during the period of leave, the employee shall furnish to the School Board a written statement of the nature of the change. At the conclusion of the leave, the returning employee maybe asked to submit a written report indicating the manner in which the purpose of the leave was accomplished. 2. Notwithstanding the above, leaves of absence without pay will not be granted if the period of leave requested is divided into two or more segments with one or more intervening periods of time on duty, except as may be required by law. 28

6 PROFESSIONAL REQUEST FOR PERSONAL/EMERGENCY LEAVE DATE OF REQUEST: NAME: BUILDING: DATE OF INTENDED LEAVE: ½ day AM ½ day PM Full day REASON FOR INTENDED LEAVE: SUBSTITUTE REQUIRED: YES NO BUDGET CODE: Signature The use of three non cumulative personal/emergency leave days shall be granted upon request with pay per regular full time employee during each year of the contract. Such days may be used in full or half day increments after providing the Superintendent with at least three (3) days notice prior to the date of such leave. Personal leave days shall be used for urgent personal business which cannot be attended to outside normal school hours for reasons which include but are not limited to the following: 1. Medical problems of employee or family 2. Religious observance (The two per building restriction shall be waived) 3. Legal transactions 4. Family matters 5. Educational business The employee requesting such leave shall provide to the Superintendent the number of the category of reason for which the leave is to be used. No more than two (2) employees in any one school building with less than thirty (30) professional staff members, nor more than three (3) employees in any building with thirty (30) or more professional staff members may qualify for such personal leave on the same day. In addition, not more than eleven (11) employees in the District during the fall semester and not more than ten (10) employees in the District during the spring semester may qualify for such personal leave on the same day. In no case shall a personal leave day be granted on the day before or the day after a holiday. During the last two (2) weeks of school, personal leave requests shall contain a more specific reason and will only be granted in extraordinary circumstances. Emergency leave days are to be used for uncontrollable or unforeseeable situations which include, but are not limited to the following: 1. Surgery, serious illness or the delivery of a child of an immediate family member 2. Emergencies involving an employee s residence or property (i.e., water main break, gas leak, fire, flood, hurricane, tornado, automobile accident, serious home vandalism) There shall be no advance notice requirements for emergency leave. (Submit two (2) copies to the Superintendent of Schools not less than three (3) days in advance of the date of intended personal leave.) Administrator Superintendent SO 23
