TBG will achieve an IIF culture through the disciplined application of our Health, Safety and Environment Management System (HSE MS) which focuses on Leadership Accountability and Management System Processes. PURPOSE To outline and formalise the WHSE expectations at all levels of the Group. To provide the foundation for the Group s efforts to create an IIF culture. SCOPE This policy applies to all premises and facilities owned, occupied or managed by TBG, and to all sites where work is being conducted by TBG workers, whatever their location. DEFINITIONS Refer to WHSE Guide 1 Definitions Guidelines. ACTIONS Achieving an Incident and Injury Free (IIF) workplace will be accomplished by: Demonstrating a commitment to HSE excellence by holding managers at all levels accountable for WHSE performance. Assigning appropriate HSE duties to all workers. Providing suitable and sufficient resources to implement and maintain IIF workplaces. Setting measurable targets to achieve IIF operations and rewarding superior performance in the management of WHSE. Ensuring risks are eliminated as far as reasonably practicable or controlled at the purchasing, design, planning and implementation phases. Ensuring that no hazardous operational activities are undertaken unless a risk assessment of the work is completed and the responsible person is satisfied that all foreseeable hazards associated with the work are eliminated as far as reasonably practicable, or controlled using the hierarchy of risk controls. 2 Ensuring full compliance with legal requirements. Providing workers and visitors with information, instruction, training and supervision, relevant to their existing knowledge and skills and identified needs. Ensuring that corrective action/s is/are taken for all reported hazards. Working to limit our environmental impacts from our operations by conserving company and natural resources, reducing waste, and preventing pollution. Establishing effective emergency management procedures for any probable emergency that may impact on the health and safety of workers and/or the public, and/or is likely to adversely impact the environment. Implementing an effective Injury Management and Rehabilitation program. Investigating incidents to identify and correct root causes of incidents to reduce the likelihood of recurrence. STOP WORK AUTHORITY All TBG workers have the right to stop a task if they believe an unsafe condition exists or that an unsafe act is being performed. The attached Guide to Stop Work must be communicated to all TBG workers (refer attachment 4). RESPONSIBILITIES Refer attachment 2 HSE Responsibilities. REQUIREMENT OF OPERATING DIVISIONS Operational Divisions are to base their WHSE business systems (policies and procedures) on this Policy, attached WHSE Management Standards (attachment 1). DISTRIBUTION This policy shall be communicated to all TBG workers and be available to the public. POLICY STATEMENT The attached signed WHSE policy statement is to be included on the Group s web site, and is to be subject to review every 2 years. 5 Attachment 1 to WHSE POL 1 Work Health, Safety & Environment Policy Introduction These standards detail the performance requirements for the WHSE management systems that support the implementation of TBG s Work Health, Safety and Environment (WHSE) policies. These standards are consistent with AS/NZS4801; OHSA18001; ISO14001 and ISO9001 and adopt the Plan-Do-Check-Act (PDCA) methodology (see Appendix 1.0). Scope These Standards apply to all premises and facilities owned, occupied or managed by TBG, and to all sites where work is being conducted by TBG workers, whatever their location. Responsibility Divisions are required to put in place supporting management systems, including business procedures, which reflect the requirements of Group-wide policies and these management standards. Unless otherwise stated, managers responsible for TBG controlled activities are accountable for the implementation of the requirements contained within this document. STANDARD 1 Leadership and Accountability INTENT Managers understand their responsibilities and demonstrate leadership and commitment to an Incident and Injury Free (IIF) work environment. Performance Requirements 1.1 Managers define and document the scope of the WHSE arrangements for operations under their control. 1.2 Managers demonstrate visible leadership and proactive commitment to WHSE excellence through personal example, by: promoting WHSE initiatives through workforce engagement; providing resources and support necessary for effective WHSE management; conducting site inspections and site WHSE performance reviews; taking a lead role in incident investigations; participating in risk review processes; and reviewing implementation of, and compliance with, TBG WHSE policies and procedures. 1.3 Managers manage WHSE behaviours and expectations by: communicating position description requirements, including relevant WHSE responsibilities, to workers; defining WHSE responsibilities for contractors and communicating to relevant personnel; recognising, reinforcing and rewarding WHSE initiatives, desired behaviours and outcomes; recognising and correcting undesired WHSE behaviours and outcomes; educating workers about their authority and obligation to stop work where the potential for an unacceptable WHSE impact exists; implementing a process for the controlled restart of work, where work has been stopped using Stop Work Authority. 6 Attachment 1 to WHSE POL 1 Work Health, Safety & Environment Policy STANDARD 2 Compliance with Legal and other Requirements INTENT Arrangements are in placed to assure compliance through periodic evaluations. Performance Requirements 2.1 Compliance with WHSE laws and other requirements, including license conditions, permit obligations, consents, joint venture commitments, contracts, agreements, policies, standards and guidelines is achieved by: identifying applicable WHSE legislation, license conditions, permit obligations, consents, joint venture commitments, contracts, agreements, policies, standards and guidelines; and implementing procedures and processes necessary to comply with applicable WHSE legislation, license conditions, permit obligations, consents, joint venture commitments, contracts, agreements, policies, standards and guidelines. 2.2 Continued compliance with WHSE laws and other requirements, is effectively managed by: communicating applicable WHSE legal and other WHSE requirements to affected personnel; implementing auditable procedures and processes for demonstrating compliance; implementing arrangements to periodically assess compliance with WHSE legal and other WHSE requirements; and documenting any changes resulting from the periodic assessments and communicating changes to affected personnel. 2.3 Currency of compliance information is maintained by: summarising identified applicable WHSE legal and other WHSE requirements in a Compliance Register, which includes the following: - Role(s) responsible for specific compliance requirements. - A listing of any applicable regulations required to operate. - A listing of all permits / licenses required to operate. revising the Compliance Register to include findings from compliance reviews, or whenever there are changes to applicable laws, license conditions, permit obligations, consents, joint venture commitments, contracts, agreements, policies, standards and guidelines. Recording and maintaining the currency of workers (employees and contractors) licensing, permits and other related information, such as necessary business insurances, registrations, etc., in Salvus. STANDARD 3 WHSE Hazards and Risk INTENT WHSE hazards are identified and associated risks assessed and managed. Performance Requirements 3.1 WHSE risk management processes are applied to all activities that TBG controls or can influence. 3.2 WHSE hazards and associated risks associated with work activities are identified and assessed. 3.3 Where hazards are unable to be eliminated, risks are controlled / managed in accordance with legislative requirements and TBG policies. 3.4 Hierarchy of controls is used in the development and application of controls. 7 Attachment 1 to WHSE POL 1 Work Health, Safety & Environment Policy 3.5 Personnel who undertake hazard identification and risk assessments are competent and experienced or supervised. 3.6 WHSE risks are evaluated and controls approved by the appropriate level of management, consistent with the significance of the risk. 3.7 Changes are communicated to and understood by all those who may be affected, including external stakeholders. 3.8 The effectiveness of controls is evaluated, at a frequency based on the level of risk, to evaluate the actual impact against the intended impact and to identify the reasons for any deviation. 3.9 WHSE risks are recorded and maintained in Salvus. The risks are reviewed and updated at least annually or more often if the nature of the risk requires. STANDARD 4 Planning, Goals and Targets INTENT WHSE goals and targets are established to drive continual improvement in performance. Performance Requirements 4.1 WHSE goals and targets are established annually and are based on identified significant WHSE issues, risks and opportunities. 4.2 Plans and programs to achieve WHSE goals and targets are in place and include designated responsibilities, resources and time frames. 4.3 WHSE goals and targets are documented and communicated to all stakeholders. 4.4 Processes are in place to monitor and report on progress towards achieving established WHSE goals and targets. 4.5 WHSE performance information is used to refine plans, goals and targets to improve risk management and WHSE performance. STANDARD 5 Awareness, Competence and Behaviour INTENT Workers and visitors are aware of relevant WHSE requirements, hazards, risks and controls, are competent to conduct their activities and behave in a responsible manner. Performance Requirements 5.1 WHSE awareness and competence for all workers and visitors is developed by providing: workers and visitors with information and training on hazards, risks, controls and expected behaviours relevant and appropriate to workplace activities; supervisors and managers with training in WHSE leadership and management. 5.2 WHSE inductions are managed by: developing induction programs for workers and visitors appropriate to identified hazards and risks; conducting WHSE inductions for all new workers and visitors that is appropriate and commensurate with workplace hazards and risk/s; maintaining records of induction and competency assessments; reviewing induction programs, processes and content for relevance, appropriateness, accuracy and currency; conducting refresher inductions at a frequency based on local WHSE risks. 8 Attachment 1 to WHSE POL 1 Work Health, Safety & Environment Policy 5.3 WHSE competency is managed by: identifying role-specific WHSE competencies and training requirements; including assessment of WHSE competencies in the recruitment process; documenting the outcome of WHSE competency analysis in training and development plans; training and / or assessing workers against defined competencies; maintaining WHSE competency and training records for workers and visitors; implementing a process for managing contractor competencies where contractor activity may result in the realisation of a material risk. STANDARD 6 Communication and Consultation INTENT Arrangements are in place for effective, transparent and open communication and consultation with workers on the management of WHSE. Performance Requirements 6.1 There is a process to encourage the participation of workers in activities which promote improvements in WHSE performance, including their appropriate involvement in: Hazard identification, risk analysis and determination of controls. Incident investigation. The development and review of WHSE policy and objectives. 6.2 Arrangements are in place to inform workers about participation arrangements, including: Who their representative/s is/are on WHSE matters. The time and resources available to participate in WHSE activities. The arrangements in place to access information that is relevant to current or planned WHSE improvement activities. The mechanisms available to identify and remove obstacles or barriers to participation in WHSE arrangements. 6.3 There are processes in place for communicating about the management of WHSE, including, but not limited to: Internal communications to raise awareness about performance measures and changes or improvements. Pre-start/tool box meetings, or briefings, for sharing experiences, lessons learned or raising awareness about WHSE risks. Other arrangements for sharing knowledge and lessons learned, such as relevant incidents, hazardous conditions, legislative changes, suggested practices, etc. 6.4 There are arrangements in place for encouraging and receiving suggestions, including a process for documenting, evaluating, implementing (as appropriate) and archiving improvement ideas. 6.5 There is a process for receiving, documenting and responding to communications, including complaints, from all stakeholders. 9 Attachment 1 to WHSE POL 1 Work Health, Safety & Environment Policy STANDARD 7 Supply of Plant, Machinery and Equipment INTENT Arrangements are in place to ensure the effective management of the WHSE risks and opportunities associated with the procurement and disposal, or sale and distribution of plant, machinery and equipment. Performance Requirements 7.1 All plant, machinery or equipment is assessed prior to purchase or sale to ensure that the design and construction complies with current legislation, relevant industry codes and standards. 7.2 Operating procedures and maintenance requirements for plant, machines and equipment are documented and made available to anyone who needs to refer to them. 7.3 Equipment which has been modified or adapted for a different use from that which was originally intended is subjected to documented inspection and testing by appropriate technical personnel, and certified for the purpose prior to use or sale. 7.4 Design data, operating limits and identified risks, are documented, understood and is made available for all plant, machines and equipment. STANDARD 8 Operation and Maintenance of Plant, Machinery and Equipment INTENT Plant and equipment is operated, maintained, inspected and tested using systems and procedures that effectively manage WHSE risks. Performance Requirements 8.1 Procedures and practices are in place to induct, train and assess operators of plant, equipment and machinery in their proper operation. 8.2 Managers and supervisors ensure that operators of plant, equipment and machinery under their control are competent in their operation and know the rules which govern the use of the plant/equipment. 8.3 Maintenance, inspection, testing, calibration and certification of plant and equipment is conducted at frequencies based on risk associated with the plant/equipment, legal and manufacturers requirements. Records of these activities are retained. STANDARD 9 Documentation and Document Control INTENT An effective WHSE document control system is in place and records are properly managed. Performance Requirements 9.1 WHSE documents are controlled, available, understandable and current. 9.2 WHSE records are accurate, legible, identifiable, securely stored and readily retrievable. 9.3 WHSE records are maintained relative to their source and in accordance with policy and any applicable data and/or privacy protection legislation. Performance Requirements 10.1 There is a process to identify and evaluate risks associated with the planned procurement of materials, equipment, services and labour There is a process for evaluating a supplier s ability to provide material, equipment and/or services which meet defined specifications or design criteria Contracts include relevant WHSE obligations and requirements for disclosure of information on WHSE performance, including previous incidents There is a process to ensure that all materials, equipment, services and labour procured or supplied meet required specifications There is a process to effectively deal with non-conforming materials, equipment, services and labour procured or supplied. STANDARD 11 Incidents and Emergencies INTENT Response to WHSE incidents and emergencies is appropriate and are reported, investigated and analysed in a timely manner. Corrective and preventive actions are taken and lessons shared. Performance Requirements 11.1 Suitable and sufficient resources are in place to ensure an appropriate response and the timely reporting and investigation of WHSE incidents and emergencies Documented plans that define accountabilities, resources and responses, including the mitigation of WHSE impacts, for foreseeable emergency scenarios are developed, communicated to affected stakeholders, implemented, regularly tested and maintained at least annually Information and training on how to appropriately respond to incidents and / or emergencies is provided to workers, applicable to their level of involvement Workers receive instruction on incident and emergency reporting requirements in accordance with corporate policy requirements Reporting of near miss incidents is promoted as a required WHSE behaviour Sufficient numbers of workers are trained in the use of Salvus to enable the timely capturing of incident data Corrective and preventive actions arising from investigations and emergency response activities are implemented, communicated to affected stakeholders and their effectiveness evaluated Information gathered from incident and emergency investigations is analysed to monitor trends, identify lessons and the results communicated to affected stakeholders. 11 Attachment 1 to WHSE POL 1 Work Health, Safety & Environment Policy STANDARD 12 Management of Change INTENT Manage the WHSE risks associated with any change to business processes. Performance Requirements 12.1 There is a process to identify and manage changes to any business processes that may impact on WHSE performance, including changes that are: Planned or unplanned. Sudden or gradual. Temporary or permanent The management of change process includes a contingency to cover emergency situations where the full management of the change process cannot practically be applied Workers are trained to identify what constitutes a change and how to initiate the management of change process All proposals for change are evaluated and include: An appropriate level of technical expertise. The involvement of the workforce impacted by the proposed change. An approval of the change by the appropriate level of management, consistent with the level of the risk/s, at least the same level of authority as those who control the existing process or item being changed Risk management decisions are documented and the implementation of resulting actions tracked Proposed changes are communicated to and understood by all those who may be affected, including external stakeholders A formal review is conducted following a change to evaluate the actual impact against the intended impacts and to identify the reasons for any deviation. STANDARD 13 Monitoring, Audit and Review INTENT WHSE performance is measured and monitored to identify trends, measure progress, assess compliance and drive continual improvement. Performance Requirements 13.1 WHSE performance is regularly measured, monitored and analysed, with results reported to appropriate stakeholders WHSE inspection and audit of activities and processes is conducted at frequencies appropriate to the level of WHSE risk and the results reported to stakeholders as appropriate An annual self-assessment is conducted by each business unit to evaluate compliance with WHSE requirements, including these Standards, (unless a Corporate audit is conducted within the same reporting year) Corporate audits are conducted no less than every two years at all business units to establish the extent of conformance with corporate requirements, including these Standards Non-compliances and improvement opportunities identified during WHSE inspections, selfassessments and audits are reported, improvement plans prepared and executed. The effectiveness of corrective and preventive actions is assessed and results reported to appropriate stakeholders An annual management review is conducted to determine the continuing suitability, adequacy and effectiveness of WHSE management systems. 14 Attachment 2 to WHSE POL 1 Work Health, Safety & Environment Policy BOARD MEMBERS RESPONSIBILITIES Board members will undertake a positive approach to due diligence in overseeing that the Group complies with WHSE legislation, has available and uses appropriate resources and processes to eliminate or minimise WHSE risks. Board members are required to: o Undertake, where required, WHSE training targeted towards effective safety governance. o Obtain advice on major changes in WHSE legislation and developments in case law. o Obtain information on WHSE initiatives and incidents occurring in relevant/similar industry/ies relevant to the Group s operations. o Review managements reports that identify the WHSE hazards and risks associated with the Group s activities and the controls put into place to eliminate or manage identified risks. o Review and approve the Group s WHSE strategic and management plans. o Integrate WHSE considerations in the business planning and budgeting processes. o Review management reports on hazards and incidents to determine if responsiveness was timely and that appropriate controls have been implemented. o Review management reports on hazards and incidents to determine whether the Group is dealing with high consequence/low probability events appropriately. o Direct management to establish an audit regime that examines the WHSE system and its implementation and which is conducted by competent persons on a regular basis. o Review management responses to WHSE system audit reports to ensure that appropriate actions are being taken. o Review the Group s WHSE performance against the WHSE management plan and WHSE strategic plan. o Review and assess the achievements of the previous elements. 15 Attachment 2 to WHSE POL 1 Work Health, Safety & Environment Policy MANAGING DIRECTOR RESPONSIBILITIES The Managing Director will exercise a positive approach to due diligence in ensuring that the Group complies with WHSE legislation, including taking reasonable steps to ensure that the Group has available and uses appropriate resources and processes to eliminate or minimise risks to health and safety. The MD is required to: o Undertake, where required, WHSE training targeted towards effective safety governance. o Obtain advice on major changes in WHSE legislation and developments in case law. o Obtain information on WHSE initiatives and incidents occurring in relevant/similar industry/ies relevant to the Group s operations. o Review reports from General Managers that identify the WHSE hazards and risks associated with their Division s activities and the controls put into place to eliminate or manage identified risks. o Review the results of WHSE audits, hazard and incident reports. o Undertake workplace observations and consultation with site workers regarding operations and the hazards associated with those operations. o Develop, in consultation with the Group Manager WHSE, a WHSE strategic plan for the Group. o Develop annually, in consultation with the Group Manager WHSE, a WHSE management plan for the Group that outlines the Group-wide WHSE goals, objectives, targets and WHSE activities, which is consistent with the WHSE strategic plan. o Review and approve Division annual WHSE management plans. o Incorporate WHSE considerations in business planning and budgeting processes and ensure they are included in the business planning and budgeting processes throughout the Group. o Review and approve investments made in safety infrastructure, processes and systems to determine whether they are appropriate and adequate in relation to the WHSE hazards and risks associated with the Group s business activities. o Ensure that WHSE responsibilities and accountabilities of managers, supervisors and workers are defined, documented, kept up-to-date and applied across the Group. o Ensure that specific and measurable WHSE activities, goals and targets are included in the performance plans and appraisal processes. o Verify that WHSE training is available for managers and workers throughout the Group. o Ensure that a reporting system for recording and investigating WHSE hazards and associated risks and WHSE incidents is in place. o Review hazard, risk and incident reports to determine if responsiveness was timely and whether appropriate controls have been implemented. o Review hazard, risk and incident reports to determine whether the Group is dealing with high consequence/low probability events appropriately. o Review whether WHSE performance reports are balanced i.e. that reports contain information regarding both lead and lag indicators. Due Diligence Responsibilities GMs are required to: o Undertake, where required, WHSE training targeted towards effective safety governance. o Obtain advice on major changes in WHSE legislation and developments in case law. o Obtain information on WHSE initiatives and incidents occurring in relevant/similar industry/ies relevant to their Division s operations. o Review reports from Business Unit Managers that identify the WHSE hazards and risks associated with their Unit s activities and the controls put into place to eliminate or manage identified risks. o Review reports from Business Unit Managers regarding their Business Unit s WHSE performance. o Review the results of WHSE audits, hazard and incident reports. o Undertake workplace observations and consultation with site workers regarding operations and the hazards associated with those operations. o Develop annually, in consultation with Group WHSE, a WHSE management plan for the Division, which outlines the Division s WHSE goals, objectives, targets and WHSE activities consistent with the Group WHSE management plan. o Review and approve annual WHSE management plans of Business Units. o Incorporate WHSE considerations in the Division s business planning and budgeting processes and ensuring that it is included in the business planning and budgeting processes throughout the Division s Business Units. o Review and approve investments made in safety infrastructure, processes and systems by Business Units, to determine whether they are appropriate and adequate in relation to the WHSE hazards and risks associated with the Business Unit s business activities. o Ensure that WHSE responsibilities and accountabilities of managers, supervisors and workers are communicated across the Division. o Ensure that managers and workers throughout the Division are provided training in their WHSE responsibilities. o Ensure that specific and measurable WHSE goals, targets and activities are included in the performance plans and appraisal processes. o Verify that all WHSE incidents are being reported, recorded and investigated in accordance with Group requirements. o Review hazard, risk and incident reports to determine if responsiveness was timely and whether appropriate controls have been implemented. 23 Attachment 2 to WHSE POL 1 Work Health, Safety & Environment Policy Supervisors Responsibilities Supervisors are responsible for the communication and implementation of the organisation s WHSE policies and procedures to the area (s) and activities under their control. Supervisors are required to: o Undertake regular workplace observations and consultation with workers regarding work activities and the hazards associated with those activities. o Make sure risk management activities are regularly undertaken in the workplace e.g. workplace inspections, pre-start inspections, pre-start meetings, etc. o Review and analyse their workplaces s core activities to identify the hazards and risks associated with those activities. o Review the findings of WHSE inspections, audits, hazard and incident reports. o Make sure employees follow safe work procedures. o Respond to hazard reports from workers and/or others and implement appropriate corrective action. o Report to management any WHSE issues that cannot be solved at the supervisory level. o Undertake regular workplace inspections and see that corrective action is taken promptly. o Participate in incident/accident investigations and see that corrective action is taken promptly. o Monitor the activities of contractors in the workplace to make sure they are working safely. o Help identify WHSE training needs of employees and see that they attend the training which is provided. o Participate in WHSE consultation through workers meetings, contacts with WHSE Representatives and WHSE Committee members and contacts with individual workers. o Circulate relevant WHSE information to workers. o Participate in emergency procedure trials and help evaluate the success of the trial. o Support workers who are involved in a return to work program. o Report to management any matters which affect the health and safety of the work environment or the effective operation of the WHSE system. o Participate in reviews of WHSE policies, procedures and programs. o Participate, where required, in the development of the Business Unit s annual WHSE management plan. o Participate in any training programme put in place to acquire and keep up-to-date knowledge of WHSE matters. 24 Attachment 2 to WHSE POL 1 Work Health, Safety & Environment Policy Workers Major responsibility for implementing an effective WHSE management system and maintaining the health and safety of the work environment lies with people in management and supervisory positions. But workers also have WHSE responsibilities. Their involvement in the management of WHSE is vital if the system is to work effectively for everyone s benefit. Workers responsibilities include: o Working in a safe manner without risk to themselves, others or the environment. o Complying with the WHSE management plan, and following any issued SOPs, SWIMS, JSAs, and SWMSs. o Compliance with and adherence to all workplace rules. o Correctly using, maintaining and caring for all Personal Protective Equipment (PPE) provided. o Reporting of all WHSE hazards to the Supervisor. o Reporting of any faulty tools, plant or equipment to the Supervisor. o Reporting of all incidents to the Supervisor. o Reporting of all injuries and illnesses to the supervisor, designated First Aid Officer and/or other designated person. o Participate in WHSE training initiatives. o Active participation in agreed WHSE consultation mechanisms and activities, including provision of suggestions on how WHSE issues can be addressed or WHSE methods may be improved. o Cooperate with managers and supervisors so they can meet their WHSE responsibilities. o Seeking of assistance if unsure of WHSE rules or work methods. o Not to wilfully interfere with or misuse anything provided in the interest of health and safety or wilfully put anyone at risk o Compliance with all emergency and evacuation procedures, including any associated training. When you perceive an unsafe condition, immediately initiate a stop work intervention with the person(s) at risk. 2. Coordinate the stop work action through the supervisor (if available) unless the affected person(s) are at immediate risk of injury or harm. 3. Adopt a positive attitude, clarify your intent to stop work and explain your reasoning. 4. Notify affected personnel and supervision and make the area as safe as possible. 5. Discuss with the affected parties and gain agreement on the stop work issue. 6. If agreed that the task or operation is okay to proceed, the affected persons should thank the initiator for their concern and proceed with the work. 7. If agreed that the stop work issue is valid, then every attempt should be made to resolve the issue. 8. If the stop work issue cannot be resolved immediately, or there is a delay in rectifying the situation, the task shall be suspended and affected personnel relocated to work in other areas within their skill and competency until an appropriate resolution is achieved. 9. Stop work action should be reported in Salvus as a Near Miss to ensure lessons are captured. 10. Provide positive feedback to the affected personnel regarding resolution of the stop work issue. 11. Stop Work Authority shall not circumvent, override or replace the legislative obligations under HSE legislation, company policy or site procedures for resolving safety related issues. 12. Under no circumstances shall retribution be directed at any person(s) who exercise Stop Work Authority in good faith.
