3 Are you compliant against the Standards for Registered Training Organisations (RTOs) 2015 If you are an RTO under the jurisdiction of ASQA then the overall approach to auditing has changed for you in recent years. This change is driven by some concerning factors and practices across the sector including increased complexity and new risks, changing profile and behaviour of providers in some areas and risks to public confidence in the VET sector (Adapted from ASQA training provider briefing slides 2017). ASQA has brought the audit process into line with its larger risk -based approach. The regulator is primarily concerned with risk that relates directly to training and assessment practices and how they are administered, managed and improved. ASQA s Regulatory Risk Framework (Version 1.0 April 2016)0F1 states that: The primary risk for ASQA to manage is an RTO certifying that a person has competencies that do not reflect his/her skills, knowledge and attitudes. The potential damage flows not just to the individual, but to employers, and the wider community. Risk based regulation may mean that you face less audits. However, being proactive with compliance and encouraging a positive attitude to compliance management in your RTO is the best way to ensure that you maintain a healthy provider profile and more importantly that you provide quality training and assessment. Of course, in addition to the shift towards risk based auditing. The regulator is now using an audit model that is structured around the key phases of the student s engagement with your RTO: Marketing and recruitment, Enrolment, Support and progression, Training and assessment and; Completion. 1 Page 3

4 The Self-Assessment Tool This tool contains information about the Standards for Registered Training Organisations (RTOs) 2015 and lists a range of evidence that an RTO could collect to demonstrate compliance with the Standards. The Tool is aligned with the five key phases of the Student Journey (Marketing and Recruitment, Enrolment, Support and Progression, Training and Assessment, Completion). However, it also references additional Standards and Clauses that refer to compliance and governance that are essential aspects of operating a compliant and successful RTO business. We have listed some suggested evidence at each stage of the student journey, however, this list is not exhaustive. RTOs vary in size and scope and therefore the evidence requirements will vary from RTO to RTO. The evidence list is provided as a suggestion to assist you to consider the range of evidence that may be required for your RTO. Instructions for Using the Tool 1. Read the Standards related to each phase of the Student Journey 2. Review the list of suggested evidence for each Standard 3. Consider whether your current policies and practices will enable you to gather sufficient evidence 4. Interview staff, students and other stakeholders as required for each Standard/phase of the Student Journey, collect evidence to support any claims made by the interviewees and document the information you gather. 5. Identify gaps in your existing policies, practices and systems in the space provided 6. Plan how you will address each of the identified gaps. 5 Marketing and recruitment RTOs are responsible for providing accurate and accessible information to prospective and current students about RTO services and performance (Standard 4/clause 4.1) To be compliant with Clause 4.1 the RTO must meet the following requirements: 4.1 Information, whether disseminated directly by the RTO or on its behalf, is both accurate and factual, and: a) accurately represents the services it provides and the training products on its scope of registration; b) includes its RTO Code; c) refers to another person or organisation in its marketing material only if the consent of that person or organisation has been obtained; d) uses the NRT Logo only in accordance with the conditions of use specified in Schedule 4; e) makes clear where a third party is recruiting prospective learners for the RTO on its behalf; f) distinguishes where it is delivering training and assessment on behalf of another RTO or where training and assessment is being delivered on its behalf by a third party; g) distinguishes between nationally recognised training and assessment leading to the issuance of AQF certification documentation from any other training or assessment delivered by the RTO; h) includes the code and title of any training product, as published on the National Register, referred to in that information; i) only advertises or markets a non-current training product while it remains on the RTO s scope of registration; j) only advertises or markets that a training product it delivers will enable learners to obtain a licensed or regulated outcome where this has been confirmed by the industry regulator in the jurisdiction in which it is being advertised; k) includes details about any VET FEE-HELP, government funded subsidy or other financial support arrangements associated with the RTO s provision of training and assessment; and l) does not guarantee that: i) a learner will successfully complete a training product on its scope of ii) registration; or a training product can be completed in a manner which does not meet the requirements of Clause 1.1 and 1.2; or iii) a learner will obtain a particular employment outcome where this is outside the control of the RTO.
