3 BILL C-45 On June 12, 2003, the Minister of Justice and Attorney General of Canada, introduced Bill C-45, an Act to amend the Criminal Code that imposes criminal liability on corporations and organizations, that fail to take reasonable measures to protect employee and public safety.

4 BILL C-45 CONTINUED In layman s terms If it can not be proven that a staff member had been trained on the piece of equipment (or task) they were injured on, their supervisor can be held criminally responsible and be fined or go to jail.

5 DUTIES OF EMPLOYERS An employer shall ensure that, where prescribed, they provide equipment, materials and protective devices information, instruction and training is provided only a competent person is appointed as a supervisor workers are trained about any potential hazards in the workplace they cooperate with the Joint Health & Safety Committee the written Occupational Health & Safety Policy is prepared and reviewed annually training programs and procedures are developed they take every precaution reasonable to ensure the safety of workers O.H.S.A. Section 25 and 26 (marked in the OH&S Act hanging on the Health and Safety Board) The General Manager is accountable, on behalf of the Board of Directors, for the health and safety of the employees of the U.T.R.C.A.

6 NEW LEGISLATION On July 1, 2014 new legislation came into effect: Supervisor Awareness Training Worker Awareness Training

8 JOINT HEALTH & SAFETY COMMITTEE The JH&SC has the following functions: 1. Identify sources of danger 2. Make written recommendations for improvements to the employer 3. Obtain information from the employer regarding actual or potential hazards 4. To inspect the workplace at least once a month 5. To assist in resolving matters when a worker refuses work on the grounds that it endangers health and safety 6. To investigate accidents (there is a separate team for this)

10 MINISTRY OF LABOUR The Ministry of Labour has inspectors who: have strong powers to inspect workplaces investigate incidents, complaints and work refusals by issuing orders, can insist unsafe situations be corrected for serious violations, ask for the employer to be taken to court and, if found guilty, fined. The Ministry sets workplace health and safety standards in Ontario. It enforces them and it makes sure people know about them.

11 MINISTRY OF LABOUR CONT The Ministry of Labour employs policy advisors, communications staff, lawyers and specialists in a wide variety of labour-related fields. They're in the business of health and safety, employment standards, labour relations, pay equity and other work subjects. The Ministry also has a large network of offices all over Ontario where local staff work directly with employers and employees to inspect workplaces and enforce standards, resolve disputes or investigate serious incidents of injury or fatalities to workers.

12 INTERNAL RESPONSIBILITY SYSTEM The legal duties and responsibilities of employers, supervisors and workers overlap and complement each other. Together, they create what's known as the internal responsibility system or IRS. Simply put, the IRS means everyone in the workplace has a role to play and a duty to actively ensure workers are safe. Every worker who sees a health and safety problem such as a hazard in the workplace has a duty to report the situation to management. Once a hazard has been identified, the employer and supervisor have a duty to look at the problem and eliminate any hazard that could injure workers
