1 TERMS OF REFERENCE TO SOURCE A SERVICE PROVIDER TO UNDERTAKE A RESEARCH STUDY TO PROBE THE GREEN SKILLS THAT CAN BE PRIORITIZED IN THE MINING AND MINERALS SECTOR 1. BACKGROUND The National Skills Development Strategy III requires a new approach and set of skills to identify, foster and develop strategic opportunities, partnerships and ensure specialised technical support for new initiatives that focus on quality, throughput and scale. To address this requirement; the MQA has adopted a strategic approach that seeks to put research at the centre of planning and inform decision making. This being achieved through the following: Monitor external trends in education and training, nationally and internationally, and promote a learning and development culture in order to support continuous learning and improvement in the MMS Develop a robust and reliable sector Labour Market Intelligence (LMI) framework and institutional capacity in order to make informed planning decisions Identify and leverage Research and Skills Planning partnerships. In the context of this imperative, MQA is mandated to commission research that will look at, among others, the Green Skills that can be prioritized in the Mining and Mineral Sector. 2. OBJECTIVE The Mining Qualification Authority (MQA) wishes to appoint a service provider to undertake a research study that will probe the Green Skills that can be prioritized in the Mining and Minerals Sector. This study is prompted by the concept of Green Economy which has emerged from the field of environmental economics which in turn has become increasingly influential in governments policy and decision-making over the last few years. The core assumption of the green economy is that economic growth and development, especially in the mining sector cannot be separated from environmental progress as depicted among others, by sustainable development and supply of green skills into the sector. The study aims at understanding the current and potential contribution of Green Skills to the MMS in effecting substantive and transformative change towards the goal of sustainable development. The research should be able to provide knowledge that will assist the MQA, the MMS and labour and other stakeholders to forecast essential, scarce, critical, top up and emerging skills in ensuring a sustainable supply of green skills to the entire MMS.

SCOPE OF WORK In order for the study to achieve the above, the scope of work includes an attempt to find out the following: Main Focus: Investigate the status of the essential green skills in the entire mining and minerals sector and across sub-sectoral value chains. Sub-sections: 1. Investigate the essential green skills that are important for the environmental considerations such as Air/Water Pollution and Mining Waste/Biodiversity (where relevant) in the Core Mining and Beneficiation (where relevant) of the mining and minerals sector. 2. Investigate the green skills that are considered scarce in the as Air/Water Pollution and Mining Waste/Biodiversity (where relevant) in the Core Mining and Beneficiation (where relevant) of the mining and minerals sector that can help in mitigating the effects of Core Mining and Beneficiation (where relevant). 3. Find out the factors that affect both green skills supply pipelines and demand in each subsector and how. 4. Investigate if the current green skills that aim to address Air/Water Pollution and Mining Waste/Biodiversity (where relevant) in the Core Mining and Beneficiation (where relevant) of the mining and minerals sector integral to the new QCTO qualifications. 5. Stipulate the implications of the green skills in the mining and minerals sector when it comes to career pathing. 6. Stipulate practical recommendations that can the study make for the development and implementation of essential green skills in the Core Mining and Beneficiation (where relevant) of the mining and minerals sector. 4. DELIVERABLES The Service Provider shall undertake the research probing the green skills that can be prioritized in the MMS. The research study will focus on the following priority areas: Provide an in-depth report that explains the concept of green skills as it relates to Air/Water Pollution and Mining Waste/Biodiversity (where relevant) in the MMS and those green skills that can be prioritized to support sustainability in the sector. Provide in-depth ethnographic case studies in order to understand the extent of Air/Water Pollution and Mining Waste/Biodiversity (where relevant) and the supply and demand narrative of green skills in each sub-sector of the MMS. 3 Provide composite and consolidated findings which will clearly stipulate and identify the gaps in and the status of green skills in the MMS and also the practical recommendations related to skills development for each role player in the sector in addressing these gaps. Consolidated report of all the above-mentioned sections. Number Deliverable The Service provider will be required to undertake a literature review focusing on: (a) Understanding of Environmental Skills Analysis in South Africa. (b) 8 in-depth ethnographic case studies represented by each subsector (Gold Mining, Diamond Mining, CLAS, Platinum, Jewellery Manufacturing and Diamond Processing, Services Incidental to Mining and Other Mining) example/s on green skills and 1 benchmarking this with relevant international case studies. (c) Literature from relevant sources such as, but not limited to, reports from DMR, DEA, NUM/MDA, Chamber of Mines, MQA etc. and other relevant literature in the context of Green Economy. (d) Comparative study of literature of other related research in the field of green or environmental skills development. 2 Undertake primary research employing an in-depth case study approach on: (a) To produce an in-depth ethnographic case study for each of the 8 sub-sectors (each sub-sector represented by a minimum of 2 companies). (b) Administer in-depth interviews of a minimum of 10 participants per case study to determine current, essential and scarcity of green skills in the sector. The participants must be at a level of seniority and relevant to the area of investigation. (c) Practical Recommendations related to Skills Development of green skills to the MQA, the sector and other stakeholders on the development and implementation of essential green skills in the sector. 4 3 Present and submit milestones reports (according to the SLA) to the MQA and other relevant forums/committees: Preliminary Findings First Draft Reports per the sub-sectors Final Draft Reports per the sub-sectors 4 Present and Submit consolidated Final Report to the SRPC and the Board of the MQA. 5. TIME SCHEDULE The successful service provider will be expected to commence with the work by 01 April 2017 with the project closing on 31 March PROJECT MANAGEMENT The service provider appointed shall be given instructions by, or shall report to the appointed project manager. 7. PROJECT PROPOSAL The bidder wishing to submit proposals are required to include documents of statements on the following: a. A short profile of the bidder ; b. List of suitable human resource expertise to undertake the research of this nature c. Details of administration and financial controls, monitoring and evaluation in place; d. Auditing controls in place; e. Infrastructural capacity for the project ( Provide a list); f. Number and equity profile of the project team and their experience; g. Project plan showing how the institution will manage the project; h. Details of the cost / fee breakdown for the services to be rendered; i. One (1) set of original bidding documents accompanied by four (4) copies; j. Original valid tax clearance certificate (Mandatory). 8. PROJECT OUTLINE The Bidder is to submit a comprehensive project outline with deliverables and milestone considerations and approval by the MQA. Page 4 of 10

PROJECT PLAN Based on the information provided in this document, the bidder is to submit a project plan with timelines which the prospective service provider deems suitable for the delivery of the proposed project. The MQA will consider and approve of the project plan before commencement of the project. 10. PAYMENT The amount quoted must be denominated in South African Rand value, and should include VAT. Payment conditions will be stipulated in the Service Level Agreement (SLA).The amount quoted should include all the expenses related to this project. No additional fees will be entertained thereafter. 11. EVALUATION CRITERIA a. Proposals for the appointment of the bidder will be evaluated on functionality, price and BBBEE status in accordance with the Supply Chain Management Procurement policies (Preferential Point System). b. The following criteria will be used in particular as the criteria for appointment, apart from those laid down in the Preferential Procurement Regulations, 2001 pertaining to the Preferential Procurement Policy Framework Act 5 of Bids will be evaluated individually on score sheets by a representative evaluation panel according to the evaluation criteria indicated below. c. These functionality criteria will be broken down into a rating of poor, fair, satisfactory, very good and excellent. The proposals will be evaluated on a five point scale as follows; 1 = Poor, does not meet criteria 2 = Fair, less than acceptable. Not sufficient for performance requirements 3 = Satisfactory, adequate for the performance requirements 4 = Very Good, above the average compliance to the requirement 5 = Excellent, exceptional mastery of the requirement Page 5 of 10

Including plan to identify and mitigate risks. The minimum threshold is 60 points d. Proposals will be evaluated in two phases. In the first phase, the bid documents will be evaluated individually on separate score sheets on functionality, by a representative evaluation panel according to the evaluation criteria indicated in these Terms of Reference. All bidders who will score less than 60 out of hundred (100) points for functionality will not be considered further, and will be regarded as submitting a non-responsive proposal. Short-listed bidders will be required to do a presentation in person to the department. e. During the second phase of the bid the potential service provider will be evaluated using the 90/10 preference points system in accordance with the PPPFA guidelines. 8 f. During the second phase the 10 points principle for B-BBEE Status will be applied in terms of the Preferential Procurement Policy Framework and price of 90 points. Bids will be evaluated on whereby below: points 10 equals to B-BBEE Status level of contribution(bee) Preferential Points as allocated g. Bidders must submit original and valid B-BBEE Status Level Verification Certificate or certified copies thereof, issued by accredited Verification Agencies by SANAS or Registered Auditor approved by Independent Regulatory Board of Auditors (IRBA), together with their bids, to substantiate their B- BBEE claims. The Exempted Micro Enterprise must submit a letter from the Accounting Officer who is appointed in terms of Close Corporation Act. j. Bidders who do not submit B-BBEE Status Level Verification Certificate or are non-compliant contributors to be B-BBEE do not qualify for preference points for B-BBEE. k. The Mining Qualifications Authority (MQA) is an equal opportunity, affirmative action employer. This does not preclude the formation of consortiums or the inclusion of proposals on how this project can be used to further the aims of transformation. l. The MQA may undertake due diligence to qualifying bidders of functionality. m. The Mining Qualifications Authority reserves the right not award the bid, to bidders. 12. Awarding of this contract will be subject to the service provider s acceptance of the Supply Chain Management s general conditions of contract. b. The appointed service provider will enter into a service level agreement with the MQA, which will include: i. Period of agreement; ii. Project objectives and scope; iii. Method of communication; iv. Disputes; v. Termination of contract and other specific matters that will be agreed upon to form part of the service level agreement; c. The MQA reserves the right to terminate the contract in the event that there is clear evidence of non-performance; d. The MQA reserves a right to appoint one bidder or more than one ; Page 9 of 10

10 e. The basis of engaging bidders will be on an assignment basis. f. In the event where there are more than one bidder accredited on the bid, and they have the necessary skills that are required to render a specific service, the MQA will issue out the Terms of Reference/Specifications to call for bids and award the work accordingly. g. The MQA reserves the right to interview bidder(s) that are short listed for a specific assignments (meaning that bidders will be requested to do a presentation for a specific project / assignment). h. The MQA may at its sole discretion, award an assignment or any part thereof to more than one bidder (s). i. Payments will only be made for acceptable work completed and delivered. j. Any deviation from the project plan should be put in writing and signed by the project manager. k. Any suggestions during the progress meetings, once accepted by both parties, shall form part of the contract. 14.
