1 Colleague HR Policies: Statutory & Mandatory Training Policy Date Approved: 5 December 2017 In a nutshell We recognise our responsibilities that all of our colleagues are adequately and properly trained so that we can ensure they are all able to do their jobs well and to the required standard. This policy outlines the key points on statutory and mandatory training and to set out the responsibilities of all parties. It provides clear guidance and advice to colleagues and line managers to ensure that everyone is supported in their learning and development to achieve both personal and organisation objectives. Who this policy is for All colleagues across all NHS Kernow sites Temporary staff contracted through agencies and/or by third-party contractors who are required to have had some or all of their mandatory training needs met by their employer before starting work with us. 4 1. Our Statutory and Mandatory Training Policy In Detail What is Statutory and Mandatory training? The UK Core Skills Training Framework (CSTF) sets out 10 statutory and mandatory training topics for all staff working in health and social care settings. The CSTF includes nationally agreed learning outcomes and training delivery standards. Mandatory training is therefore a requirement that has been determined by us, that all colleagues must complete. This training ensures that colleagues are able to undertake their duties safely and efficiently; it minimises risk and ensures that external standards are met. Mandatory training requirements are not the same for each colleague and may relate to a specific team or professional group, and will be proportionate to roles and responsibilities. Your mandatory training will be assigned to your profile in the Electronic Staff Record (ESR) to ensure you complete the appropriate modules. The statutory and mandatory training for all staff will cover the following topics (please see appendix 1 for more information): Data Security Equality, Diversity and Human Rights Fire Safety Health, Safety and Welfare Infection Prevention and Control Moving and Handling Safeguarding Adults Safeguarding Children and Young People (please refer to the relevant policy for indication on the training level requirements specific to your role) Managing Conflict of Interest Training (relevant to senior colleagues and decision makers, banded 8c and above) Statutory training is a requirement that we are legally required to provide where a statutory body or law requires us to provide training on the basis of legislation. Individual statutory and mandatory training requirements are publicised on IRIS, the Staff Zone and on ESR. What is the process? As part of the induction process you are required to complete your statutory and mandatory training requirements using ESR within one month of commencing your role. Some elements of our statutory and mandatory training are only available by attending a workshop and you are required to attend the first available session after starting work Statutory & Mandatory Training Policy Page 4 of 9

5 with us, or on the expiry of your current training if this is sooner. The requirement to complete the appropriate statutory and mandatory training also applies if you have moved into a different role for whatever reason. It is your accountability to ensure that you have completed the statutory and mandatory training that is necessary and your line manager is responsible for ensuring that you are compliant. If you have joined from another part of the NHS, we will on receipt of evidence of previous completion of your statutory and mandatory training (copy of ESR record or from your previous L&D department) update your new learning record. There will be no requirement to complete it again unless any of your competencies are out of date. If your ESR record needs to be updated, please get in contact with a member of the HR team. Your line manager is responsible for checking your mandatory and statutory training compliance levels during your annual appraisal, and any actions required and by when will be noted on your appraisal form. Statutory and mandatory training requirements must be met before any decisions relating to funding for any other development opportunities, including but not limited to externally verified courses or qualifications, are considered. Who is responsible for the process? You are responsible for following the guidance contained within this policy and for understanding and monitoring your own compliance with required mandatory and statutory training. You must make sure that you prioritise your completion of training to make sure that it does not become out of date or overdue. It is your responsibility to liaise with your line manager to agree time to complete your training if required and to raise any questions that you have regarding its completion with your line manager or a member of the HR team. If you are unable to attend a pre-booked workshop or training event then you must advise your line manager. Once you have received the relevant training it is your responsibility to make sure that you apply it correctly in the course of your duties. Line managers are responsible for ensuring that all of their colleagues are aware of the mandatory and statutory training requirements and that it is completed within the required timescales. Line managers are also responsible for making sure that their colleagues receive adequate support to enable them to complete their training on time and within working hours, including attendance at mandatory and statutory training events. It is the responsibility of the line manager to identify any specific mandatory training requirements that need to be met (for example, Basic Life Support training for nurses) and for ensuring that these are completed. Line managers will also review compliance Statutory & Mandatory Training Policy Page 5 of 9

6 levels on at least a monthly basis and take the appropriate action with their colleagues to reach the required compliance level. Before any period of study leave or external development (that is not considered to be statutory and/or mandatory) is authorised, line managers will make sure that the colleague s statutory and mandatory training is up to date. They will also make sure that essential training requirements are discussed and documented at the annual appraisal and set actions as appropriate. Line managers will also make sure that the colleague receives reimbursement for any travelling expenses rightfully incurred to attend training events in accordance with our expenses policy. They will also make the HR team aware of any training undertaken independently so it can be recorded on ESR. To support the delivery and compliance of statutory and mandatory training, the HR team will manage the provision and coordination of workshop sessions and will liaise with subject matter experts regarding appropriate content in ESR and classroom training. Upon completion and once notified by the provider, HR will update statutory and mandatory ESR records and will maintain, in conjunction with the colleague and line manager, accurate records to enable reporting and monitoring mechanisms to line managers, Workforce Committee and statutory bodies. It is very important that we ensure that all of our colleagues are adequately trained to ensure that we fulfil our statutory obligations to provide the best service possible to all of our stakeholders including patients, service providers and each other. We also have to make sure that all of our colleagues wellbeing is protected and statutory and mandatory training goes a long way in making this happen. In cases where there is continued evidence of non-compliance to statutory and mandatory training, we may choose to manage the issue as a disciplinary matter. How do I access training? All colleagues can access mandatory and statutory training via their ESR account. Mandatory Training Guidance is available to download from the documents library in IRIS, with instructions on how to complete your training in ESR. Please see Appendix 1 for an up-to-date list of our statutory and mandatory training requirements that apply to all colleagues. Workshop-based mandatory training courses will be advertised using the weekly staff bulletin. You can also access mandatory training courses at Royal Cornwall Hospitals Trust (RCHT) and booking should be made through the HR team. Statutory & Mandatory Training Policy Page 6 of 9

7 There are selected workshops on which your attendance is mandatory but in order to reduce cost and increase compliance, all colleagues are expected to complete their statutory and mandatory training on ESR as a preference to attending a workshop. We will be phasing out workshops where there is a solution available on ESR. Who can help with queries? If you are a colleague you should seek advice from your line manager in the first instance. If you require further guidance the HR team can provide advice and support to you and your line manager for any of our colleague policies. 2. Governance Monitoring and Review Arrangements We monitor compliance and effectiveness of this policy through submission of regular reports to the Workforce Committee. The HR team ensure any subsequent recommendations are undertaken and incorporated into this policy if appropriate. How is this policy cross-referenced to our other Colleague HR Policies? We have written this policy to make it easy to understand, but at times you may need further information. You may need to refer to the Expenses Policy, Disciplinary Policy, or Safeguarding Children Training Policy for further guidance.
