1 TERMS OF REFERENCE INTERNATIONAL INDIVIDUAL CONSULTANT (TEAM LEADER) DEVELOPMENT OF KENYA UNITED NATIONS DEVELOPMENT ASSISTANCE FRAMEORK (UNDAF) 08-0.Background Development context The 07 Economic Survey indicates that Kenya s Gross Domestic Product (GDP) is estimated to have expanded by 5.8 per cent in 06 compared to a revised growth of 5.7 per cent in 05. Accommodation and food services recorded improved growth of. per cent in the year under review compared to a contraction of. per cent in 05. The other sectors that registered significant improved performance in economic activities were in the information and communication; real estate; and transport and storage. Persistent drought hampered growth in the fourth quarter of 06 impacting negatively on agriculture and electricity supply. On the other hand, growth in construction; mining and quarrying; and financial and insurance activities decelerated in 06. From the demand side, growth was buoyed by consumption in both the public and private sector. Annual average inflation eased to 6. per cent in 06 compared to an average of 6.6 percent in 05. This was mainly due to decline in prices of transportation; housing and utilities; and communication. The Shilling strengthened against the Pound Sterling, South African Rand, Ugandan Shilling, Tanzanian Shilling and the Rwandan Franc but weakened against the US Dollar, Euro, and the Yen in 06. The capping of interest rates to a maximum of.0 per cent above the Central Bank Rate (CBR) resulted in a significant decline in interest rates during the month of September to.8 per cent compared to 6.75 in a similar month in 05.Domestic credit slowed from a growth of 0.8 per cent in 05 to 6. per cent in 06 mainly because a decline in credit to the private sector. The current account deficit narrowed to KSh 70.8 billion in 06 from a deficit of KSh. billion in 05. The fiscal deficit in 06/7 as a percentage of GDP is expected to rise to 9.9 per cent compared to 8.6 per cent in 05/6. Kenya continues with implementation of its transformative agenda as outlined in the country's long term development blueprint under the Kenya Vision 00. The overarching goal of the Vision is to create a globally competitive and prosperous country with a high quality of life by 00. It aims to transform Kenya into a newly industrialized, middle income country providing a high quality of life to all its citizens in a clean and secure environment. Simultaneously, the Vision aimed to achieve the MDGs for Kenyans by 05 and now the SDGs. The Vision is anchored on three key pillars: economic; social; and political, implemented through a series of successive five-year medium term plans (MTPs). The theme of MTP is "transforming Kenya: pathway to devolution, socio-economic development, equity and national unity". The Government of Kenya is in the process of developing its Third Medium Term Plan III which will be informed by findings, lessons, conclusions and key recommendations of final review of MTP II and the manifesto of newly elected government after the August 07 elections. The third MTP will as outlined in the initial concept note, endeavour to move the economy towards a high growth trajectory to achieve 0 percent economic growth rate target by the end of the Plan period.

2 It will prioritize policies, programmes and projects which generate broad based inclusive economic growth, as well as faster job creation, reduction of poverty and inequality, consider climate change impacts, and meeting the 7 Sustainable Development Goals (SDGs) and the goals of African Union Agenda 06. United Nations Development Framework (UNDAF) in Kenya The United Nations Development Assistance Framework (UNDAF 0-08) is the fourth-generation Programme of UN support to Kenya. The UNDAF was developed per the principles of UN Delivering as One (DaO), aimed at ensuring Government ownership, demonstrated through UNDAF s full alignment to Government priorities as defined in the Vision 00 and Medium-Term Plan 0-07 and planning cycles, as well as internal coherence among UN agencies and programmes operating in Kenya. The UNDAF contributes to the overall goal of Kenya s Vision 00 of: Creating a globally competitive and prosperous nation with a high quality of life by 00, that aims to transform Kenya into a newly industrializing, middle-income country for all citizens in a clean and secure environment. The UNDAF reflects the efforts of all UN agencies and key partners working in Kenya. The design of the UNDAF was informed by several strategic discussions both within the UN and with stakeholders, to determine how the UN System is best suited to support the national development goals. Accordingly, the Government of Kenya and the UN System are committed to working together in the spirit of partnership to implement the UNDAF, as a contribution to the achievement of national development goals and aspirations. Shaped by the five UNDG programming principles (a Human Rights-based approach, Gender equality, Environmental sustainability, Results-based management, and Capacity development) the UNDAF has a broad-based Results Framework, developed in collaboration with Government, Civil Society, donors and other partners. The UNDAF has four Strategic Results Areas: Transformational Governance encompassing Policy and Institutional Frameworks; Democratic Participation and Human Rights; Devolution and Accountability; and Evidencebased Decision-making, Human Capital Development comprised of Education and Learning; Health, including ater, Sanitation and Hygiene (ASH), Environmental Preservation, Food Availability and Nutrition; Multi-sectoral HIV and AIDS Response; and Social Protection; Inclusive and Sustainable Economic Growth, with Improving the Business Environment; Strengthening Productive Sectors and Trade; and Promoting Job Creation, Skills Development and Improved orking Conditions, and Environmental Sustainability, Land Management and Human Security including Policy and Legal Framework Development; and Peace, Community Security and Resilience. The UNDAF Results Areas are aligned with the three Pillars (Political, Social and Economic) of the Government s Vision 00 transformational agenda. The UN Country Team (UNCT), under the leadership of the UN Resident Coordinator, is responsible for implementation of the UNDAF Under the DaO One Leader approach the Resident Coordinator and the UNCT are responsible for oversight of the Strategic Results Groups, the Operations Management Team and the Country Communications Group. The National Steering Committee (NSC) oversees the Programme implementation and reporting and the One Budgetary Framework. The current UNDAF comes to an end in 08 June, the process of developing the next UNDAF 08-0, has commenced and will be largely informed by the proposed evaluation.

Kenya United Nations Development Assistance Framework (UNDAF) 08-0 As indicated above the current UNDAF for Kenya comes to an end in June The process of developing the next UNDAF has commenced, a road map alienating the framework within which he UNDAF will be developed has been developed in consultation with the UN Country Team (UNCT) and Government of Kenya (GOK) counterparts through the UNDAF National Steering Committee Secretariat. A copy of the UNDAF road map is attached as Annex to this terms of Reference. The next UNDAF (08-0) will be informed by key lessons and recommendations from the UNDAF MTR undertaken jointly by the Government of Kenya (GOK) and the UN Country Team (UNCT) and the UNDAF final evaluation to be undertaken in June 07. The final evaluation will not only focus on results but as a learning tool focusing on operations effectiveness and efficiency on issues around DaO, management and coordination, communications, business operations, strategic partnerships, financing among other- for attainment of agenda 00 while leaving no one behind. Key findings from the UNDAF Mid Term Review noted that the UNDAF is relevant and well aligned to the national priorities and needs, and has put in place strategies to respond to new emerging priorities such as Middle Income Country (MIC) status and SDGs. Though the UNDAF remains aligned on emerging issues such as SDGs and MIC status, deliberate and strategic efforts for programming and delivery of targeted initiatives aimed at addressing key specific issues such as the demographic dividend, issues of inequality, funding priorities among others must be put in place. In addition, supporting the process of devolution especially strengthening capacity a of devolved county governments to propel development and streamline quality service delivery will remain a key priority. Addressing Humanitarian challenges will also be a key agenda in the next UNDAF given the current scenario of drought emergencies and support required. To improve programme delivery and efficiency, the UNDAF MTR noted that significant progress has been made by the UN Operations Management Team (OMT) in working towards the Business Operations Strategy (BOS). Though Initial results include: a needs assessment for BOS which has already indicated a Cost Benefit Analysis (CBA) net saving of USD 606,008 for travel, USD,009,6 for conferences and USD, for communications in the next years there is need to fully implement and harmonise BOS within the UNDAF Framework. The MTR highlights the criticality of reinforcing strategic planning and delivery effectiveness through the Business Operations Strategy (BOS), which ensure that programmatic interventions are supported by high quality, efficient and expeditious integrated operational arrangements. The MTR also noted that though the UN in Kenya has worked with the host GOK for ownership and leadership of the program both at national and county level the coordination structures for implementing DaO also need further strengthening for sustainability. There is also need to reinforce communication as one to better communicate results and ownership of the programme among all UN agencies and GOK. The communication strategy that was developed to support the current UNDAF has not been effectively implemented. These are among the key areas of focus that the new UNDAF 08- will strengthen. The new UNDAF for Kenya 08-0 will be aligned to Kenya s Vision 00 and national priorities as outlined the third Medium Term Plan (MTP III), in accordance with the Sustainable Development Goals (SDGs). To effectively align the new UNDAF to MTP III, the UN is strategically and actively engaged with the process of developing MTP III. In 06, GOK launched the SDGs roadmap for the next years. In the new UNDAF, the UN guided by MAPS (MAPS - Mainstreaming, Acceleration and Policy Support) will strategically position itself to support the localization and implementation of the SDGs in Kenya as outlined in the current road map and in the next road map. Specific focus areas will include: - Comprehensive UNCT roadmap and costing to facilitate UNCT support to the implementation of the SDGs in Kenya and substantive and regular reporting on the SDGs, with focus on key results achieved at the national and county levels as well as defining solutions to off-track goals through SDGs Acceleration Framework.

4 To effectively align to the 00 Agenda for Sustainable Development, the UN in Kenya will undertake a foresight visioning exercise. Priorities of the next UNDAF will also be informed by global and regional priorities such as Africa Agenda 06, Paris Agreement, Sendai Framework among others. In the current UNDAF, Disaster Risk Management and resilience building have been woven into long term development. The commitment is to break down the barriers between emergency response as experienced in the current drought situations and longer term development including disaster preparedness. The UNCT will also continue investing in innovative are based programmes and cross border programmes to reduce vulnerability and increase resilience of communities through building their capacity building and promotion of sustainable livelihood projects and conflict management strategies. On peace building and conflict resolution, efforts toward mainstreaming UNSCR 5 into national development, diplomacy, gender, conflict prevention, conflict resolution, peace, security and reconciliation strategies and ensure implementation of existing commitments by government to promote gender equality and women s participation and leadership in public affairs at all levels will continue. Addressing emerging issues such as Violent extremism which has become an additional layer of Kenya s conflict dynamics will call for innovation and programming to contribute to long term sustainability of youth empowerment initiatives. Consultancy to develop UNDAF Objectives of the consultancy The UN Country team in Kenya hope to recruit a team of two consultants, a senior international consultant who will be the team leader and a national consultant to support, provide technical guidance and facilitate the process of developing the UNDAF as outlined in the roadmap for developing the UNDAF. Specific objectives of the assignment include:. To undertake desk review and Compilation of the Evidence Based Common Country Assessment (CCA). (See Annex on the UNDAF road map outlining details of the CCA). To facilitate strategic planning and prioritization process of developing the UNDAF which includes actual development of the UNDAF theory of change, results framework, finance and budgetary framework and writing the narrative document.. Specific Tasks Specific tasks to be undertaken by the consultancy team include:. Desk review and compilation of Common country assessment: (The scope of the CCA is outlined in the detailed UNDAF Road Map). ork closely with the Resident Coordinators office and UN agencies to consolidate and compile desk review data for the CCA. Prior to compilation of the data by the consultancy team, all UN agencies are expected to submit to the Resident Coordinators office (RCO) data and information relevant or specific to their mandates. The concept note of the CCA outlining information needs and responsibilities of each agency has been shared with all the UN agencies. RCO will follow-up with the agencies and provide the raw data to the consultancy team. The data will include reports, figures/relevant statistical information, research and policy papers among others on key thematic areas. All agencies must ensure quality control of the information provided -must be sound in terms of validity and reliability. Desk/secondary review of relevant reports including data collected by GOK as part of the situational analysis to undertake MTP III (See details on the UNDAF road map).

5 The consultancy team will review the data/information provided by the UN agencies through the RCO and other relevant data available nationally from GOK office among other reliable resources. The consultancy team will be expected to use other sources of data other that what is provided for. The local consultant will review hard copy reports that may not be available virtually given that the team leader will work virtually. Analysis of the data and information from the desk review as guided by the CCA concept note (attached Road map). The analysis plan for the CCA is also provided in the concept note. Based on the desk review and analysis, the consultancy team will compile a CCA report outlining background context, root cause analysis of underlying causes challenges and opportunities among other areas as outlined in the CCA concept note. The report will be brief but specific enough indicating status and gaps where possible. The report should also outline areas of focus in future programming. A detailed outline of the CCA report guided by the scope of the CAA as outlined in the UNDAF Road Map will be discussed and finalized in consultation with the RCO and the UNDAF steering committee before commencement of the CCA exercise Under the guidance of the team leader, the consultants will work closely to undertake the CCA. This aspect of the assignment will be undertaken virtually. The team leader who is an international consultant will work from home office while the local consultant will where necessary visit the RCO office. The team leader will bear the overall responsibility of the final CCA report. The final CCA report should be finalized by end of September (see Annex on the detailed work breakdown structure).. Strategic planning and prioritization Strategic planning and prioritization is the most critical process of developing the UNDAF. Specific tasks of the consultancy team include: ork closely with RCO to facilitate consultations and engagement with stakeholders including the Government of Kenya, the UN Country Team (UNCT) and UN agencies/technical working groups on priorities for next UNDAF. The consultants will play a technical facilitation role leading to drafting of the UNDAF theory of change and results framework Promptly document outcomes of the consultations and engagement sessions outlining issues discussed, key outcomes in-terms of strategic priorities and next steps From the outcomes of the various consultative process and the common country assessment- work closely with the UN monitoring and Evaluation Technical orking Group (UNMETG) and the programme management team (PMT) to facilitate and provide technical guidance to the UN in developing a theory of change for the next UNDAF. The theory of change will be informed by county context data, priorities as outlined in Kenya s vision 00 and the MTP III. From the theory of change work closely with the UN monitoring and Evaluation Technical orking Group (UNMETG) and the programme management team (PMT) to facilitate and provide technical and strategic guidance to development of the UNDAF Results framework outlining Strategic Result Areas, key outcomes, key outputs, broad activities, indicators, targets and means of verification. The format for the Results framework will be provided by the RCO. ork closely with the UN Monitoring and Evaluation Technical working group to develop a costed monitoring and evaluation plan for the UNDAF ork closely with the RCO, operations management team (OMT)and programme management team (PMT) to develop the financial strategy for the UNDAF- outlining budgets, source of funds including UN agency and GOK contributions. 5

6 In consultation with RCO and UNCT/PMT/UNMETG draft the narrative section of the UNDAF In consultation with RCO facilitate stakeholder validation processes of the new UNDAF The consultants will work as a team to ensure that the process is well facilitated and documented. The team leader will take overall responsibility of the expected deliverables.. Deliverables and timelines The team leader will have 65 working days while the local consultant will have 50 working days. The consultancy days will be spread over a period of months commencing Mid-August 07- June 08. The team leader will work in-county for a period of approximately 0 days while 5 days will be home-based, working virtually with the local consultant. The assignment will be undertaken in phases as outlined in the detailed work break down structure presented in Annex, and table below. The day to day task Manger who will work closely with the team is the Monitoring and evaluation specialist at the RCO office. The team will work with the all the UNDAF technical working groups, Strategic Result Area groups and the UNCT as required.. Qualifications of the Team Leader The consultancy team will be composed of one consultant who will be the team leader, and a national consultant. Qualifications of the team leader are outlined below. Post-graduate degree in development studies/international development, international relations, political science, governance and public policy, social sciences, or any other related field Minimum 5 years experience working in the field of development in developing countries (orking in the UN and Delivering as One is an added advantage). Documented international experience in developing, managing and working with UNDAF including substantive knowledge of development issues, especially related to Governance and Equitable Growth/Poverty Reduction Substantive knowledge of Gender and Human Rights issues addressed by the UNDAF; including strong skills and experience in applying with human-rights based and gender mainstreaming approaches. Results based management, developing result frameworks, monitoring and evaluation plans and formulation of programme budgets is a key requirement Demonstrated capacity in strategic thinking, problem solving, high level facilitation of visioning exercises and policy advice Strong inter-personal, teamwork and organizational skills demonstrated by working with multi-disciplinary teams, broad stakeholder including Government Excellent presentation and drafting skills, especially writing programme documents, drafting strategic plans among others (Sample documents done from previous evaluations is a mandatory requirement) Fluency in written and spoken English is essential 7

8 Evaluation Criteria for Team Leader The following criteria will be used to select consultants suitable for the assignment: Criteria eight Max.
