1 Strengthening Infrastructure Capacity and Innovation for Inclusive Growth TERMS OF REFERENCE FOR CONSULTANTS (Phase 1) I. OBJECTIVE AND PURPOSE OF ASSIGNMENT 1. The technical assistance (TA) will supplement capacity in the Department of Finance (DOF), National Economic and Development Authority (NEDA) as well as in the Department of Public Works and Highways (DPWH) and the Department of Transport (DOTr) and support the required system enhancements to assist the Government in the acceleration of infrastructure investments. 2. Phase 1 of the TA will: undertake project screening and prioritization activities; identifying key specialist support to augment capacity in DPWH and DOTr; instigate the development of management systems and structures to deliver projects, including preparation of detailed terms of reference (TOR) for the implementation of the project management and monitoring system that will form Phase 2 of the TA. The TA will thus ensure smooth and timely start-up of the proposed Project to meet the accelerated delivery of the large project investment portfolio as well as ensure continued support to the government in the management and oversight of the Build Build Build program. 3. Phase 1 of the TA will establish implementation teams and project management units within DPWH and DOTr that will be utilized by the proposed Project. The specialized expertise provided by the TA will directly supplement skills and innovations urgently required by DPWH and DOTr to undertake pre-investment activities to be financed under the proposed Project. 4. Phase 1 of the TA will also undertake an assessment of the current project management systems within DOF, NEDA, DOTr and DPWH and define a relevant project management and monitoring system that will be supported under Phase 2 of the TA. Phase 1 of the TA will also prepare detailed TORs for the Phase 2 consultants based on the findings of the needs defined for the project management and monitoring system. 5. Under the TA, consultants will be recruited as individuals and/or firms to assist the executing agencies. The TA will assess capacity building needs of the implementing agencies and propose a capacity development program to be implemented under the proposed Project. All consultants will be selected and engaged by the Asian Development Bank (ADB) in accordance with the ADB s Guidelines on the Use of Consultants (2013 as amended from time to time). II. CONSULTANT S TERMS OF REFERENCE INTERNATIONAL PROJECT MANAGEMENT AND MONITORING SPECIALIST (5 person-months, individual) Objective and Purpose of the Assignment 6. The key objective of the consultant s assignment is to assist NEDA, DPWH, and DOTr in enhancing their institutional capacity to accelerate infrastructure investment through development of management systems and structures to prepare and deliver projects. In addition, the consultant will assist in identifying the needs of DPWH and DOTr for specialist support to screen and prioritize investment projects under the Infrastructure Preparation and Innovation Facility (IPIF). The specialists will also be responsible for the development of detailed TORs for Phase 2 of the TA, and support for implementation of the project management and monitoring system. The

2 2 Project Management and Monitoring Specialist will be responsible for overall coordination of inputs under Phase 1 of the TA. 7. The scope of work of the Project Management and Monitoring Specialist will include but will not be limited to assist NEDA and the executing agency and/or implementing agencies in: assessing the requirements, and recommending systems and structures for management and monitoring of preparation of infrastructure projects; ensuring smooth startup of the proposed IPIF, which supports the accelerated delivery of priority infrastructure projects; assessing capacity constraints in DPWH and DOTr and developing comprehensive capacity development plan; screening and prioritizing investment projects including identifying the needs for key experts to be funded under IPIF to augment the capacity of DPWH and DOTr; Prepare the scope and documentation of the project monitoring and management system; and (vi) Prepare detailed TORs for Phase 2 of the TA, the support of the implementing of the project management and monitoring system. 1. Project Management Activities (vi) (vii) (viii) (ix) (x) (xi) coordinate with the executing agency, for smooth and timely implementation of the TA; coordinate and supervise the input of all experts under Phase 1 of the TA; identify the needs for required specialist inputs and prepare TORs for the specialists/experts under Phase 1 of the TA to support IPIF; identify early needs for specialist input required for Phase 2 of the TA and prepare draft TORs; assist the implementing agency in the selection and recruitment of consultants for Phase 1 and early recruitment for Phase 2 of the TA; discuss with government officials the priorities for public infrastructure investment and propose criteria for project prioritization under IPIF; together with other experts, screen the long list of investment projects and propose priority list of projects for inclusion in the IPIF; in collaboration with other experts assess capacity within DPWH and DOTr for planning and preparation of the prioritized projects; assist and advise DPWH and DOTr in establishment of project management units and resourcing of the project implementation teams; assess the capacity building needs of the executing agency and prepare a capacity building program to be implemented under Phase 2 of the TA; and assist the executing agency in the preparation of periodic progress implementation reports in accordance with ADB requirements.

Project Monitoring and Management System (vi) (vii) (viii) (ix) assess preparedness of NEDA, DPWH, and DOTr to develop and implement a comprehensive project management and monitoring system (such as a Project Monitoring Information System [PIMS]) including an interagency network system; in collaboration with NEDA, DPWH, and DOTr officials, determine the requirements and parameters of each agency for a PIMS to monitor and manage project planning, preparation and implementation activities; review the approval requirements of NEDA, DPWH, and DOTr for every step of the project planning and preparation process and recommend ways to streamline and enhance the internal procedures for approval within the legal system of the Government of the Philippines; based on the requirements of NEDA, DPWH, and DOTr for project management and monitoring, determine the key parameters for a proposed PIMS; define the detailed indicators for the PIMS in key areas such as project planning activities, project cost projections and estimates, procurement and selection of consultants, contract management, resource management, social safeguard monitoring, and environmental monitoring; determine the need to expand the system to other agencies and units which are responsible for part of the planning and preparation process, such as the Bureau of Design and Bureau of Construction of DPWH, Department of Environment and Natural Resources, and others to facilitate and enhance the efficiency of the Government in planning and implementation of infrastructure investment projects; identify and recommend possible off-the-shell or custom designed software packages for PIMS; assess the equipment and IT status and need for deployment of PIMS in targeted agencies and offices; and prepare detailed TOR for development and implementation of a comprehensive PIMS to be deployed in NEDA, DPWH, and DOTr under Phase 2 of the TA. Reporting 8. The Project Management and Monitoring Specialist will be responsible for preparation of an inception report within 30 days of mobilization outlining the work plan and schedule for the assignment and identifying possible areas of difficulties; periodic (monthly and quarterly) progress reports outlining accomplishments during the period and projected activities for the following period; and a final report outlining the outcome of the project and making recommendation for further action under the ensuing TA loan. 9. The International Project Management and Monitoring Specialist should have a degree in engineering, management, or a related field and at least 15 years international work experience in project implementation, management, and administration. Experience in the Philippines would

4 4 be preferential. Good knowledge and understanding of project implementation and administration of ADB financed projects will be considered a major asset. NATIONAL PROJECT MANAGEMENT AND MONITORING SPECIALISTS (6 person months; 2 individuals) Objective and purpose of the assignment 10. The key objective of the consultant s assignment is to assist NEDA, DPWH and DOTr in enhancing their institutional capacity to accelerate infrastructure investment through development of management systems and structures to prepare and deliver projects. In addition, the consultant will identify areas where DPWH and DOTr need specialist support to screen and prioritize investment projects. 11. The National Project Management and Monitoring Specialists will assist the international Project Management and Monitoring Specialist in: assessing the management and monitoring systems and structures in place at DPWH and DOTr; and ii) identifying capacity constraints in DPWH and DOTr. One expert will be deployed in DOTr and the other at DPWH. Both will report directly and work closely with the international Project Management and Monitoring Specialist. 12. The national Project Management and Monitoring Specialists will specifically assist the executing agency and/or implementing agencies with the following tasks under guidance of the international Project Management and Monitoring Specialist: assess project preparation, monitoring and approval systems within DPWH and DOTr; prepare detailed TOR for development and implementation of program/project management system to be deployed in DPWH and DOTr; assist and advise DPWH and DOTr in establishment of project management units and resourcing of the project implementation teams; assess the capacity building needs of DPWH and DOTr and prepare a capacity building program to be implemented under IPIF; assess capacity within DPWH and DOTr as it relates to prioritized projects and ensure the required specialist skills are included in the TORs for IPIF; and (vi) ensure that preparation of TORs, cost estimates, environmental and social safeguards, gender, and climate change assessments are carried out in conformity with relevant norms and regulations; 13. The National Experts should have an advanced degree in relevant discipline from a recognized university with 15 years of relevant work experience and experience working with international consultants and good knowledge of the DPWH and DOTR project cycle.

5 5 INTERNATIONAL SENIOR EXPERTS (15 person-months, individual) 14. The International Senior Experts will be responsible for supporting the screen and selection of projects for the proposed Project within their field of expertise. The consultants will provide support and advice in technical areas of project selection and screening, project management, and specialist advise (such as road and bridge engineering, flood protection works, river basin management, tunneling, transport, climate change, financial management, gender, and resettlement). The areas of expertise include: Road Engineer/Planner Bridge Engineer/Planner Flood Protect/Planner River Basin Management Specialist Airport Engineer/Planner Railway Engineer/Planner Tunneling Specialist Financial Management Specialist Environment Specialist Social Safeguard /Resettlement Specialist Gender specialist Climate change specialist assist with the preparation of TORs, cost estimates, and preparation of request for propositions for the IPIF consultants for preparation of feasibility studies, and detailed design, and assistance in recruitment of construction supervision consultants; review and advise the implementing agencies on technical matters related to the output of the IPIF consultants; and review and advise the implementing agencies regarding the output of the IPIF consultants regarding environmental and social safeguard studies, gender, and climate change for IPIF projects. 15. The International Senior Experts should have an advanced degree in relevant disciplines and at least 15 years of experience in planning, designing, and implementing of international projects. NATIONAL EXPERTS (32 person-months, individual) 16. The National Experts will assist the International Experts in their own field of expertise and will provide advice to the international team regarding local conditions and government regulations. The consultants will provide support and advice in technical areas of project selection and screening, project management, and specialist advise (such as road and bridge engineering,

6 6 flood protection works, river basin management, tunneling, transport, climate change, financial management, gender, and resettlement). 17. The TA consultants will specifically assist the executing agencies with the following tasks: assist with the preparation of TORs, cost estimates, and preparation of request for propositions for the IPIF consultants for preparation of feasibility studies, detailed design, and assistance in selection of construction supervision consultants for IPIF projects; review and advise the implementing agencies on technical matters related to the output of the IPIF consultants; review and advise the implementing agencies regarding the output of the IPIF consultants regarding environmental and social safeguard studies, gender, and climate change for IPIF projects. assist in the implementation of the capacity building program to be implemented under the proposed Project; provide assistance and guidance in overall implementation of the TA Project; and 18. The National Experts should have an advanced degree in relevant discipline from a recognized university with 15 years of relevant work experience and experience working with international consultants preferably in donor funded projects and government institutes. NATIONAL COMMUNICATION CONSULTANT (3 person months, individual) 19. In coordination with designated ADB and government staff, the consultant is expected to support the further development of a more substantive project Stakeholder Communication Strategy (SCS), and its early-stage implementation. The consultant will work in close coordination with the project s three main communication focal points in the steering committee, DPWH, and DOTr to develop and put in place a system to help ensure: timely response to stakeholder inquiries; regular information sharing with stakeholders; two-way information flow between key stakeholders; and coordinated public dissemination of project progress and achievements. The consultant will provide on-the-job training and transfer of knowledge to steering committee, DPWH and DOTr staff to ensure sustainability in the implementation of the SCS. The consultant will undertake, but not be limited to, the key activities outlined below. Deliverables revised Stakeholder Communication Strategy; project webpage; work flowchart and timeline for inter-departmental communications coordination; and communications capacity assessment and staff capacity building plan.

7 7 Specific Responsibilities (vi) Support communication strategy development and implementation: support the further development and early-stage implementation of the SCS; Information dissemination: ensure systems are developed to ensure the regular and proactive sharing of information with key stakeholders, consistent with the SCS; Communications coordination: Support the development of systems (and work flow chart and timelines) to ensure regular, coordinated information sharing between the steering committee, DPWH and DOTr. Support the coordination of communication activities between DPWH, DOTr, and their respective information management units, to ensure these units involvement, as appropriate, in SCS implementation, including information dissemination (public relations, website, social media), public engagement, online inquires and complaints, etc.; Project webpage: Support the conceptualization and development of a TA Project webpage, which will be established under the leadership of the steering committee s communication focal point, to ensure disclosure of TA project implementation status, and to proactively share project information and progress with interested stakeholders; Capacity building: Provide on-the-job training and transfer of knowledge to steering committee, DPWH and DOTr staff to ensure sustainability in the implementation of the SCS; and Capacity assessment and planning: Conduct a capacity assessment examining to what extent the communication focal points and other staff in the steering committee, DPWH, and DOTr are equipped to anticipate, plan for, and manage public concerns about projects being prepared from the outset; to mitigate future project risk; and build public support and buy-in for the projects, consistent with the SCS. Develop a capacity building plan for continued training and development of key staff to ensure successful SCS implementation. s 20. A degree in Communication or related field, or equivalent experience is preferred with at least 10 years experience working in communications/public relations. Experience with international donor-funded development projects is a plus. Experience in designing and implementing communication activities to support stakeholder engagement, and experience in communication activity planning, design and implementation would be an advantage. The consultant should be fluent in English and Tagalog writing and verbal skills. He or she should have strong interpersonal skills and proven ability to work in a collaborative, multi-stakeholder team environment.
