1 B/17/38 NSS Board Meeting Friday, 7 April 2017 Occupational Health, Safety, Wellbeing Policy Occupational Health and Safety Advisory Committee Board Membership Purpose The purpose of this report is to seek the views of the NSS Board on membership of the Occupational Health and Safety Advisory Committee. Recommendation The Board are asked to recommend a member of the NSS Board to become a member of the Occupational Health and Safety Advisory Committee, in accordance with agreed policy; and agree if this person should become the joint chair or not. Timing There are no timing issues with this report. Background A paper setting out the governance arrangements for Occupational Health and Safety was presented to the Audit and Risk Committee on 29 March A copy of this paper is appended to this report along with the current Occupational Health, Safety and Wellbeing Policy. This policy came into effect in 2016 and put in place revised systems and processes for Health and Safety. The policy also included detailed description of the roles and responsibilities of individuals and groups across the organisation. This includes the role and responsibilities of the NSS Board, which are:- NSS Board Board members individually and collectively have responsibility for providing occupation health and safety leadership across NSS and to this end shall ensure: Occupational health and safety issues are taken into account and reinforced in all Board decisions and in all matters submitted to the Board A nominated Board member shall be an active member of NSS Occupational Health and Safety Advisory Committee and shall attend all Committee Meetings Occupational health and safety management systems are in place, adequately resourced and remain effective Occupational health and safety performance is monitored and reviewed at regular intervals Staff at all levels are actively encouraged to become involved in all aspects of NSS occupational health and safety arrangements and health promotion initiatives 1 Page 1 of 16

2 Key Considerations The Board should note that a member of the NSS Board has not been nominated to be a member of the Occupational Health and Safety Advisory Committee (OHSAC) in accordance with the agreed policy. This committee is currently Co-Chaired by the Director of HR and Andrew Lamb, UNITE Staff Safety Advisor for SNBTS. The Employee Director, Ian Cant is the NSS Board Health and Safety Champion an arrangement which has been in place since he was appointed. The Employee Director attends meetings of the Occupational Health and Safety Advisory Committee when his diary commitments allow, he receives all papers which go to the Committee and meets with the Director of HR on a monthly basis to discuss issues around people management and the workforce. This includes issues from the monthly People Report and issues on health and safety. The Board may wish to officially nominate the Employee Director as the Board representative on the Occupational Health and Safety Advisory Committee or alternatively select another member of the Board. The Board may also wish to review the current chairing arrangements of OHSAC which reports into the Staff Governance Committee. It could be considered as more appropriate for this committee to be co-chaired by a Non Executive Director and member of the Board (and the Trade Unions) as opposed to the Director of HR who also has line manager responsibility and therefore could be considered to have a conflict of interest. The benefit of a Non Executive Director co-chairing OHSAC would be to bring additional challenge and scrutiny to what is a very important issue keeping our employees safe and well at work. 3 AR/17/04 NSS Audit and Risk Committee Meeting 29 March 2017 NSS Occupational Health and Safety Governance Purpose The purpose of this paper is to provide the NSS Audit and Risk Committee with assurance in relation to the governance for occupational health and safety in NSS. Recommendation The Audit and Risk Committee are asked to note the current management arrangements. Timing N/A. Backgound Review It is important that the governance of health and safety matters is clearly defined. This is addressed in the revised Health, Safety and Wellbeing Policy 2015 which was developed in partnership with senior management and the Trade Unions in NSS. The policy was subject to extensive consultation in the organisation and was approved by the EMT and the NSS Board. This can be found at Appendix 1. Defined specific roles have been identified, including those which require specialist training under health and safety legislation. A brief summary of those key roles and responsibilities is identified below. Chief Executive Has ultimate responsibility and accountability for the occupational health and safety of all NSS employees, although overall management of occupational health and safety is delegated to Strategic/Support Business Unit Directors and Senior Managers. NSS Board Lead for Occupational Health and Safety Director of Human Resources and Workforce Development As the Occupational Health and Safety Lead, advise the NSS Board on all matters concerned with Occupational Health, Safety and Wellbeing. Provide effective and dynamic leadership of Occupational Health and Safety services for NSS. Lead and direct the design and implementation of a Health and Wellbeing Strategy. Strategic/Support Business Unit Directors Responsible and accountable for the Occupational Health and Safety of all their SBU staff and anyone else who may be affected by the work activities of that SBU. Healthy Working Lives Support SBUs to deliver effective Occupational Health and Safety management through a combination of expert guidance, audit and practical support and advice. Deliver a culture of continuous improvement through provision of good practice guidance and innovation. Responsible with SBUs for overall delivery. 1 Page 3 of 16

4 Occupational Health and Safety Advisory Committee (OHSAC) Chaired in Partnership, OHSAC is the overall governance, performance management, monitoring and improvement committee for NSS Occupational Health and Safety. OHSAC is responsible for endorsing and authorising NSS Occupational Health and Safety Policy across the organisation. Building User Groups Chaired by an appointed senior manager from one of the SBUs, Building User Groups are responsible for the governance over all agreed common areas for the particular building where they are based. Provide a monitoring, advice and support service to local managers and staff to manage and control all health and safety risks associated with the local work environment, building fabric and site premises. Support Facilities Management in resolving site/building related health and safety issues within agreed timescales. In premises where Building User Groups are not in place, these responsibilities fall to the appropriate Health and Safety Committee for the site. Facilities Management Responsible for ensuring buildings and associated car parks, mechanical and electrical systems and equipment, access and egress systems etc are in working order and comply with all appropriate legislation as part of business as usual. Accountable to Building User Groups and Health and Safety Committees with regards to any remedial work to address any health and safety issues associated with the building fabric or work environment. Considerations The governance arrangements in the Health, Safety and Wellbeing Policy have been in place for over a year now. During the early part of implementation it is fair to say that the arrangements took time to bed in and for people and groups to fully understand roles and responsibilities. However, these arrangements are now working well and there is clear understanding of where responsibilities lie. The Building User Groups have been particularly effective in carrying out their roles. An example of this would be the Gyle Building User Group which took action around areas within the car park which presented some serious health and safety issues. The Occupational Health and Safety Advisory Committee (OHSAC) provides an effective governance route for policy and process and also provides advice to the organisation on a range of issues. Finally, there is a close and strong and joined up working relationship between HR and Facilities which is proving effective when dealing with a range of health and safety issues. 8 1 Organisational Framework NSS recognises that a successful health and safety culture will only be achieved through effective communication, consultation, education and training and by actively encouraging the co-operation and participation of all employees and Trade Union Representatives. To achieve this NSS has developed a Health and Safety Organisational Framework (see Appendix 1) and has clearly established the roles and responsibilities of staff at all levels across the organisation (see Section 3). Failure to adhere to the aforementioned obligations and the specific duties, roles and responsibilities outlined in this Policy will be investigated and depending on the outcome of this investigation may be subject to the NSS Disciplinary Policy. 2 Occupational Health and Safety Arrangements NSS occupational health and safety policies and procedures (based on the list in Appendix 2), are subject to ongoing development as part of a planned programme developed by the NSS Occupational Health and Safety and Health Promotion Working Groups and endorsed by NSS Occupational Health and Safety Advisory Committee (OHSAC). This programme is specifically designed to: meet the requirements of Staff and Clinical Governance; meet the requirements of the Clinical Negligence and Other Risks Scheme (CNORIS); meet the requirements of the Safe, Effective, Quality Occupational Health Service (SEQOHS) achieve standards which reflect best practice and go beyond basic statutory requirements; contribute to standards and best practice across the NHS in Scotland as defined in the Partnership Information Network (PIN) Guidelines. The arrangements also include a comprehensive Health and Safety Performance Management Framework has been established to systematically audit and effectively monitor and review NSS Health and Safety arrangements and performance. It supports the achievement of Corporate and Strategic Business Unit (SBU) health and safety targets, links directly with the Chief Executive s annual programme of Quarterly Reviews with SBUs and includes the following for all NSS premises and SBUs: Health and Safety Audit OHS Minimum Dataset Workplace Inspection Programme Health Promotion Programme The Corporate responsibilities required under all current Occupational Health & Safety legislation; Each member of staff has a legal obligation to take reasonable care for the safety of themselves and of other persons who may be affected by their acts or omissions at work and to co-operate with NSS, its Management Team and staff at all levels in the achievement of a safe working environment without risks to health. 4 Page 8 of 16

9 3 Roles and Responsibilities These are the definitions and descriptions of key roles and responsibilities of NSS management, staff and others which relate specifically to the implementation and application of this procedure. NSS Board Board members individually and collectively have responsibility for providing occupational health and safety leadership across NSS and to this end shall ensure: occupational health and safety issues are taken into account and reinforced in all Board decisions and in all matters submitted to the Board; a nominated Board member shall be an active member of NSS Occupational Health and Safety Advisory Committee and shall attend all Committee Meetings; occupational health and safety management systems are in place, adequately resourced and remain effective; occupational health and safety performance is monitored and reviewed at regular intervals; staff at all levels are actively encouraged to become involved in all aspects of NSS occupational health and safety arrangements and health promotion initiatives. Chief Executive As the most senior employee in NSS, the Chief Executive has ultimate responsibility and accountability for the occupational health and safety of all NSS employees. However overall management of occupational health and safety at work is delegated by the Chief Executive to Strategic / Support Business Unit (SBU) Directors and Senior Managers who will be responsible for ensuring the occupational health and safety of staff, visitors, donors and contractors within their area of control. NSS Board Lead for Occupational Health and Safety The Occupational Health and Safety Lead will advise the NSS Board on all issues to do with Occupational Health and Safety and to provide effective and dynamic leadership of Occupational Health and Safety services for NSS. Lead and direct the design and implementation of a Health & Wellbeing Strategy, aligned with national frameworks and that will enable the development and growth of improved policies/processes and practices to positively impact on the health and wellbeing of all staff. Take responsibility for the safe operation of NSS according to best consolidated Occupational Health, Health and Safety and Environmental policies in compliance with Health and Safety at Work and Infection Prevention and Control and set high standards and ensure that any non-compliances are highlighted at Board level. Occupational Health and Safety Advisory Committee (OHSAC) Chaired in Partnership, OHSAC provides the overall governance, performance management, monitoring and improvement committee for NSS Occupational Health and Safety. OHSAC is responsible for endorsing and authorising NSS Occupational Health and Safety Policy across the organisation. OHSAC ensures that NSS is on track overall against agreed policy and action plans and takes action to remedy any issues. The management Chair of OHSAC should be the Director with overall Board responsibility for Occupational Health and Safety in NSS. Specific duties required under this process are: Endorsement by the Joint Chair on all Occupational Health and Safety (OH&S) Procedures and related documentation developed by the Safety Working Group and Healthy Working Lives to support the Occupational Health and Safety Performance Management System Monitor and review the NSS Occupational Health and Safety Corporate Risk Register and enforce any corrective action when and where necessary Monitor and review progress of all SBU Risk Profiles and OH&S Action Plans 5 Page 9 of 16

10 Communicate information discussed at OHSAC meetings to the staff they represent, including posting a copy of the minutes where they are accessible to all staff concerned Safety Working Group (SWG) Develop, update and review, in Partnership, NSS Occupational Health and Safety Policies and Procedures in line with all European and UK Health and Safety Legislation and current best practice to assist the Organisation in meeting its statutory obligations. Communicate information discussed at SWG/ Workplace Health Promotion meetings to the staff they represent, including posting a copy of the minutes where they are accessible to all staff concerned Workplace Health Promotion Group (WHPG) Lead by the NSS Workplace Health Promotion Adviser and including Trade Union and SBU representation from across all levels of the organisation. The WHPG supports the NSS Board, Chief Executive, Staff Governance Committee and Occupational Health and Safety Advisory Committee. This Group assists NSS in: promoting good health at work encouraging and supporting employees to live healthier lives developing a health promoting culture and environment contributing to standards and best practice across the NHS in Scotland achieving Scotland s Healthy Working Lives Awards The Health Promotion Working Group are responsible for the implementation of all activities detailed in the NSS HWL Project Plan and associated Health Promotion Action Plans. This will involve the development of health promotion interventions, which will include: health issues for staff based on the work environment and work activities; targeting specific groups of employees who may be at risk from particular health hazards. SBU Director SBU Directors are responsible and accountable for the Occupational Health and Safety of all their SBU staff in every site and anyone else who may be affected by the work activities of that SBU. SBU Directors responsibility covers all areas of activity, except those designated as common and under leadership of Building User Group. SBU Directors responsibilities under this policy are to: Provide visible and active leadership for occupational health and safety by chairing the SBU Occupational Health and Safety Committee and where this is not achievable, nominate one of the Senior Manager Team to do this on their behalf; Ensure the NSS Occupational Health and Safety Performance Management System is embedded into the business undertakings for which they have Director responsibility; Ensure that the Occupational Health and Safety Organisational Structure and appropriate Management Arrangements are in place, to ensure all aspects of occupational health and safety are suitably managed in line with this process Senior Management Team (SMT) SBU SMT members are responsible and accountable for the occupational health and safety of all line managers and staff and anyone else who may be affected by the work activities associated with their areas of responsibility Specific duties required under this process are to: Ensure that the Director is aware of any Occupational Health and Safety issues Ensure that a clear link exists between the SMT and the SBU Occupational Health and Safety Committee by having occupational health and safety as a routine Page agenda 10 of item 16on the 6

11 SMT meetings, with the Chair of the Occupational Health and Safety Committee providing an update on the latest issues Ensure the progress on corrective actions to address any non conformances identified is effectively and efficiently monitored Ensure SBU Line Managers and Supervisors are provided with adequate time and resources to effectively manage occupational health and safety as an integral part of the operational requirements, necessary to the business undertakings for which they have line management responsibility. Ensure SBU Line Managers and Supervisors and NSS Nominated Persons/Assessors and Trainers/Staff are provided with adequate occupational health and safety information, instruction, and training on their roles and responsibilities, including effectively communicating this process. Ensure SBU Line Managers, Supervisors and NSS Nominated Persons/Assessors and Trainers/Staff effectively and efficiently carry out their occupational health and safety roles and responsibilities SBU Line Managers / Supervisors Responsible for the day to day implementation of NSS occupational health and safety policies, procedures and safe systems of work. Specific duties required under are to: Ensure staff are provided with adequate time and resources to undertake their occupational health and safety roles and responsibilities effectively and efficiently; Ensure staff are provided with adequate information, instruction, training and supervision on their occupational health and safety roles and responsibilities, including effectively communicating this process; Ensure the effective implementation and enforcement of safe systems of work and corrective action as necessary, and that staff carry out their occupational health and safety roles and responsibilities; Ensure that appropriate risk assessments are undertaken, in line with the NSS Risk Assessment Procedure, for the work activities which they have line management responsibility; Ensure that all accident/incidents are reported and investigated, in line with the NSS Accident/Incident and Investigation Procedure, for the work activities which they have line management responsibility. Provide relevant information to the Occupational Health and Safety Committee Chair to assist the Occupational Health and Safety Performance Management Process, such as training needs of individuals within their area of control. SBU OH&S Committee Chair Director or appointed member of the SMT responsible for leading the SBU OH&S Committee. Specific duties are to: Chair the SBU Occupational Health and Safety Committee meetings ensuring there is appropriate representation from across all areas of that SBU. Minutes of these OH&S meetings are communicated effectively to all committee members, SMT and staff; Take the lead on all occupational health and safety matters within the SBU including supporting any Healthy Working Lives campaigns or initiatives locally on behalf of the wider NSS; Undertake an annual review and update of the SBU Risk Profile document and record any corrective action to address gaps or non conformances in the OH&S Action Plan; Submit updates on the progress of the action plan to OHSAC in line with the quarterly reporting timescales; Ensure there is an adequate number of trained NSS Nominated persons / assessors / Trainers and other relevant occupational health and safety personnel for the work activities carried out and subsequent level of risk associated, including, o General Task Risk Assessor Page 11 of 16 7

12 o COSHH Risk Assessor o Manual Handling Risk Assessor and Trainer o DSE Risk Assessor o Accident/Incident Investigator Appoint members of the committee to represent the SBU on the Building User Group (BUG) for the particular building in which they are based, to ensure there is a clear link between the SBU committee and relevant Building Users Groups (BUGs). This helps ensure that shared building related H&S issues are addressed appropriately and that necessary feedback on corrective actions is communicated effectively to the SBU staff concerned. SBU OH&S Committee Operates in partnership, members appointed to provide appropriate balanced representation across the various SBU work areas and who have completed as a minimum the NSS training course for OH&S Committee members, which are Line Manager and Risk Assessment Specific duties for OH&S Committee Reps are to: Provide support to SBU managers and staff to effectively and efficiently manage occupational health and safety within their areas of responsibility and accountability; Discuss any issues raised by the particular work stream representatives and ensure these matters are adequately addressed by the appropriate management responsible; Provide feedback to the OH&S Committee and NSS H&S Advisors on any actions delegated by the Committee Chair or that are necessary to close off any outstanding accidents/incidents on the Accident/Incident database; Communicate information discussed at committee meetings to the staff they represent, including posting the minutes of meetings on the occupational health and safety notice board; Monitor and review their own SBU OH&S performance and support the Committee Chair to drive occupational health and safety locally; Assist with annual audit/inspections and undertake regular local workplace inspections in their own work areas to help identify any issues at an early stage such as slip and trip hazards and help avoid potential accidents and work related injuries. Healthy Working Lives Responsible and accountable for supporting SBUs to deliver effective Occupational Health and Safety management through combination of expert guidance, audit and practical support and advice. Deliver a culture of continuous improvement through provision of good practice guidance and innovation. Responsible with SBUs for overall delivery.. Specific duties under this procedure are: Provide NSS management and occupational health and safety contacts with any updates to Health and Safety and Occupational Health Legislation; Monitor, review and report all SBU Occupational Health and Safety Risk profiles and Action Plans to OHSAC Carry out annual occupational health and safety audits and inspections on NSS sites which undertake the higher risk activities of the business; Record and monitor the Organisation s Accident/Incident reports and provide, where necessary, recommendations to Committee Chairs and Line managers on any corrective actions required to close them off; Lead on the Development and Review of all NSS Occupational Health and Health and Safety Policies and Procedures for sign off by the Safety Working Group Prepare end of quarter and end of year Occupational Health and Safety reports for OHSAC Provide occupational health and safety update reports to the SBU SMTs in line with the quarterly reporting timescales Develop and deliver internal occupational health and safety training packages, as approved by OHSAC, to train NSS staff on various elements of occupational health and safety such as Risk assessment, COSHH assessments, Manual Handling risk assessments, Manual Handling Trainers etc Page 12 of 16 8

13 Source suitable accredited assessor and trainer courses for senior executives, manual Handling Trainers, Display Screen Equipment Assessors etc Maintain the Healthy Working Lives occupational health and safety information website on HR Connect, Attend SBU Occupational Health and Safety Committee meetings Deliver an annual programme of work that is designed to support workplace wellbeing in NSS, to support the attainment required by NHS Scotland of the HWL Award Deliver an annual programme of work that is designed to support the continued improvement of an occupational health and safety culture in NSS, including the provision of e-learning training packages, campaigns and health fairs in line with European Union, Health and Safety Executive (HSE) and National Health Service (NHS) initiatives. Communicate information discussed at SWG/WHP meetings to the staff they represent, including posting a copy of the minutes where they are accessible to all staff concerned. Staff Side Safety Reps Appointed competent members of staff who have completed a Trade Union recognised training course on health and safety and who provide health and safety advice and support to staff at a local level. Specific duties are to: Attend SBU Occupational Health and Safety Committee meetings to provide practical support and guidance to the Committee Chair, Committee reps and staff on a daily basis; Assist SBU Committee Chair with annual self inspections and support Committee Reps to undertake regular local workplace inspections in their own work areas, to identify any issues at an early stage such as slip and trip hazards and help avoid potential accidents and work related injuries BUG Chair This Committee will be chaired by a senior manager from within one of the SBUs within the building. This group will be responsible for the following, over agreed common areas:- Providing a monitoring, advice and support service to local managers and staff to manage and control all health and safety risks associated with the local work environment, building fabric and site premises. Support Facilities Management in resolving site/building related Health and Safety issues within an agreed timescale. Building User Groups (BUG) / SBU Health and Safety Committees This group will operate in Partnership. Members will be appointed to represent each SBU and NHS organisation who are based within that particular building. The purpose of the group will be to ensure any shared building related issues raised, including those that could affect peoples OH&S and wellbeing are discussed and adequately addressed within a reasonable timeframe; Specific duties of the BUG group under this procedure are to: Ensure there is appropriate representation from across all SBUs and other Tenants who share that particular building or premises and that subsequent minutes of these meetings are effectively communicated to all stakeholders; Monitor and review progress on any outstanding Facilities Management works planned to address shared building issues to ensure appropriate course of action is carried out within agreed timescales; Submit updates on the progress of these works to OHSAC in line with quarterly reporting timescales; Ensure clear lines of communication exist between the BUG and respective SBU committees in order that relevant key information is shared as and when required; Ensure all shared site/building related OH&S issues raised are appropriately discussed and investigated where necessary, and are suitably addressed within an agreed acceptable period; Page 13 of 16 9

14 Ensure adequate First Aid arrangements are in place for the respective site/building based on the local first aid provision risk assessment, including sign off for any refresher training required; Provide feedback to staff from work stream they represent on progress of outstanding works being carried out to address any shared building OH&S issues; Communicate information discussed at committee meetings to the staff they represent, including posting a copy of the minutes where they are accessible to all staff concerned. Facilities Management Responsible for ensuring buildings and associated car parks, mechanical and electrical systems and equipment, access and egress systems etc are in working order and comply with all appropriate legislation as part of Business as Usual. Accountable to the Building User Groups and Health and Safety Committees for implementing changes to both structure and process as required to address Health and Safety issues in common areas. Facilities Management need to be integral to the decision making process but should deliver promptly to the requirement of the SBU Director responsible and Building User Group and Health and Safety Committee. Specific duties under this procedure for facilities management are to: Ensure that a safe means of access and egress into all NSS sites and buildings is provided and maintained; Undertake regular inspections in all NSS sites/buildings to ensure faults or damage is detected at an early stage and helps ensure that the building fabric, floor surfaces and all fixtures and fittings associated with NSS premises are maintained in a safe condition; Ensure that where car parking facilities are provided, there are appropriate systems in place for the safe movement of vehicles, bicycles and pedestrians including segregation where possible and appropriate signage and crossing points where necessary; Ensure that a safe working environment is maintained in all NSS buildings with respect to ventilation, air quality and temperature; Ensure that all toilets, rest facilities and changing rooms are maintained in a safe condition; Ensure hygiene in all areas where food and drink are consumed is suitably maintained to a high standard; Ensure that suitable contracts are in place to maintain essential services such as water, electricity and gas; Ensure that adequate general, special and recycling waste management facilities are in place on all NSS sites; Ensure suitable and effective gritting contracts are in place for all NSS sites during the winter months; Ensure suitable and effective reporting mechanisms are in place to allow staff to report site or building related faults or damage and also to feedback to management/staff on progress of such works. Employees All staff must comply with this procedure and follow the safe systems of work developed from risk assessments and co-operate with management to assist NSS in delivering the Occupational Health, Safety, Wellbeing and Fire Strategy and meet with its statutory occupational health and safety obligations. They should also report any accidents / incidents to their line manager.
